CODE TITLE 6, CHAPTER 6.28, "ONSITE WASTEWATER TREATMENT SYSTEMS"
RESOLUTION NO. ~ s~ -2008
RECITALS
A. WHEREAS, the Board of County Commissioners acting as the local Board of Health for
Pitkin County has the authority to adopt rules and regulations governing the design, construction,
installation, repair, modification, maintenance and use of onsite wastewater treatment systems, as
well as the authority to set fees for permits and related services from time to time; and
B. WHEREAS, the Board of County Commissioners, after Public Hearing, adopted new
rules and regulations governing the design, construction, installation, repair, modification,
maintenance and use of onsite wastewater treatment systems on January 23, 2008; and
C. WHEREAS, the new rules and regulations will become effective on March 8, 2008; and
D. WHEREAS, cerkain fees currently charged by the Department of Environmental Health &
Natural Resources do not reflect the cost of actually providing the Department's permit and
license-related services; and
E. WHEREAS, certain services specified under the newly-adopted rules and regulations
require establishment of new fees; and
F. WHEREAS, the Board of County Commissioners, acting as the local Board of Health for
Pitkin County, desires to set such fees.
~~NOW, THEREFOA~, BE IT RESOLVED by the Board of County Commissioners of Pitkin
County, Colorado that the fee schedule attached hereto as Exhibit A is hereby adopted, effective
on and as of March 8, 2008, and any and all prior Resolutions establishing fees for the specified
permits, licenses and services are hereby repealed.

* Examples of such services include: (i) a site visit requested by a prospective purchaser of a property (not pursuant
to a Land Use Referral) to assess the site's potential for locating an adequate OWTS, and (ii) a site visit requested by
a prospective purchaser of a properly to discuss the functioning of an existing OWTS (in the absence of OWTS Use
Permits and Licensed System Inspectors). Sec. 5(a) of the OWTS Regulation also requires that an applicant for an
OWTS Construction Permit be assessed an additional fee for staff time spent traveling to and from a properiy in the
event staff is called for a fmal inspection of an OWTS and the OWTS is not ready for a fmal inspection on the date
specified.
