I have followed the appropriate procedures in examining my expansion plans by meeting with the adjacent property owners and working with them. The design which I am presenting to you took into account the impacts that this expansion would have on the adjacent property owners. I have enclosed for your review a letter of support from the adjacent property owners, supporting this application. If you examine the existing house and property, you would see what a unique situation we are in. The existing farmhouse on the property is almost one hundred years old. It was constructed prior to zoning, and at that time, setbacks were not an issue. Since its construction, there were further subdivisions of the property which create undue hardships when existing setbacks are applied. The zoning has been changed so that the lot is now non-conforming. In addition, it has been determined by my structural engineer that, without severe alterations resulting in a complete loss of the integrity of the building, it cannot support a second floor. My request is, therefore, for a sidevard setback .variation of twenty feet. The single-story addition which is proposed is consistent with the clustered nature of the Sopris Creek Cabin Subdivision, and also comes from the desire to save the mature fruit trees and garden close to the house, as well as preserving the integrity of a wonderful old building. The house currently encroaches into the setbacks because of current zoning. Therefore, I hope you agree that I am facing a tremendous hardship, and with the strong support of the neighborhood on my behalf, a variance is appropriate. After reviewing the Carter's plans we support thier decision to place this proposed addition as suggested by the site plan,as this placement seems to have the least impact on the rest of the neighborhood.. Minutes Pitkin County Board of Adjustment November 3, 1992 Members Present: Rick Neiley, Chairman Ted Guy John Wheeler Rod Dyer Michael Cooper Members Absent: Stan Mathis Evan Gull Staff: Joanna Schaffner, Zoning Enforcement Neiley opened the meeting at 5:15 p.m. and•.introduced the Board to those present. Case #,92-35, Justine Kirk, L14, B2, Pitkin Green Subdivision This case was tabled at the last meeting. Joanna Schaffner addressed the Board, stating that Justine Kirk has requested that this case be tabled to December 1, 1992. Guy moved to table Case #92-35 at the applicant's request. Wheeler seconded the motion, and all were in favor. Case #92-44, Richard Carter, 0373 Souris Creek Road Glenn Rappaport was present, representing Richard Carter, to request a 20 foot south side yard setback variance, where 30 feet is required in the AF-1 zone district, for construction of an addition to a single-family residence. Richard Carter was present. Rappaport stated that the subdivision is clustered, and that an addition in any direction would encroach into the setbacks. They worked with neighbors to determine the best site for the addition, and they have the approval of the neighbors and the Homeowner's Association. The addition was designed to try to preserve the large fruit trees between the house and the addition, and to mitigate the negative impacts of the addition. The addition will be less than 900 square feet. Neiley noted that the Sopris Creek Cabins Homeowner's Association sent a letter to the Board in support of the request, and he read into the record letters from neighbors Emma Walling, Tom & Linda Clark, and Howard Gunther, all of whom also support the Carter's request. There was no public comment. Wheeler stated that the footprint seems arbitrary, and that all of the density was being clustered in one area. Carter replied that 1 ~~~~~~i, ~ _. the Homeowners Association did not support an addition on the other side of the house, because it would be right next to the common area for the Sopris Creek Cabins. Neiley added that he would prefer to see development clustered in the area, especially since the neighbors and the Homeowners Association do not object to the addition as proposed. Guy moved to grant a 20 foot south side yard setback variance due to non-conforming lot size in accordance with the plans submitted. Dyer seconded the motion. All were in favor. Case #92-45. Deborah Strom. Lot 36, Crustal River Park Subdivision Jochem Wolf was present, representing Deborah Strom, to request a 69 foot front yard setback variance, a 20 foot rear yard setback variance, and a 20 foot north side yard setback variance, where 100 feet, 30 feet, and 30 feet, respectively, are required in the AF- 1 zone district, for construction of a single-family residence. Wolf stated that a drainage ditch runs through the property, so he is trying to build higher on the property. Wheeler asked what will happen to the drainage ditch. Wolf stated that Bishop Construction suggested putting in a culvert or re-routing the ditch. Schaffner stated that Bob McCormick, the present owner of the property, called to state his approval of the request. Guy asked how the location of the building envelope was determined. Wolf replied that he had defined the envelope's location, and Schaffner stated that the subdivision does not have platted building envelopes. Guy stated that he did not have a problem with the proposed setba.;iks, but that he did have a problem with building the house on a drainage course. Dyer agreed. Guy then pointed out another site that could be used and that would not cross the drainage ditch. He felt the 10 foot rear yard setback was fine, but was uncomfortable with the 10 foot side yard setback. Wolf stated that water is not flowing through ditch. He also noted that the south side of the property borders dedicated greenbelt and the north side borders a Holy Cross easement. The adjacent property on the north side consists of two lots that are being sold as one. Neiley stated that the lot is closest in size to conforming lots in the R-15 zone district, which has a 10 foot side yard setback requirement. Guy then agreed that a 10 foot side yard setback would be appropriate. There was no public comment. 2 ~oll`J^ 7 ;4 Dyer stated that drainage ditches have specific owners, who have rights and access to the ditch. Wolf noted that it is a runoff ditch, and not an irrigation ditch. Guy also noted that the ditch appears to be a natural topographic feature. Guy asked why the subdivision is exempt from the 1041 hazard review process. Schaffner stated that the subdivision was approved in the 1960s. The two original filings were not approved by the Board of County Commissioners (BOCC), but the BOCC did approve these previously created lots by approving a composite plat that was presented later. Neiley made a motion to grant a 69 foot front yard setback variance, a 20 foot rear yard setback variance, and a 20 foot north side yard setback variance, as a consequence of downzoning, subject to review by the County -staff as to the appropriateness of the location of the house with respect to the drainage course.
