DETERMINATION OF THE DIRECTOR OF THE PITKIN COUNTY,
COLORADO, COMMUNITY DEVELOPMENT DEPARTMENT APPROVING A
TEMPORARY COMMERCIAL USE PERMIT FOR CHERYL SOVICH TO
OPERATE A LANDSCAPING BUSINESS FROM THE ASPEN QUICK MART
FOR THE SUMMER OF 2008

RECITALS
1. Pursuant to Subsection 2-30-20 and 4-30-50 (i) of the Pitkin County Land
Use Code, the Community Development Director of Pitkin County,
Colorado ("Director") may approve a Temporary Commercial Use Permit
for commercial activities or special events.
2. Cheryl Sovich (hereafter, the "Applicant") has applied for approval of a
Temporary Commercial Use Permit to operate a wholesale landscape
business from the Aspen Quick Mart site at 31336 Highway 82 for the
summer of 2008.
3. The Director finds that, to the extent applicable, the application complies
with the standards in Subsection 4-30-50 (i) of the Land Use Code.
NOW, THEREFORE, BE IT DETERMINED BY THE COMMUNITY
DEVELOPMENT DIRECTOR OF PITKIN COUNTY THAT the Cheryl Sovich
Temporary Commercial Use Permit is approved, subject to Applicant's
compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in
connection with, the application.
2. There shall be no retail sales or signage associated with the use,
except to note that there are no retail sales on the premises.
3. The dates of operation are limited to from April 15, 2008, to October
15, 2008.
4. At the completion of operations the site shall be restored to its previous
condition.
5. Daily hours of operation are limited to from 7:00 am to 7:00 pm.
Monday through Saturday with watering on Sunday.
6. Employee commuting shall be consolidated to a maximum of four
vehicles to preserve parking for the Quick Mart.

REQUEST: The applicant is requesting approval of a Temporary Commercial Use Permit
in order to operate a wholesale landscaping business for the summer of 2008 from the
Aspen Quick Mart site on Highway 82. Temporary Commercial Uses of more than 72 hours
duration no longer require Board approval and may be approved administratively.
APPLICANT: Cheryl Sovich, Runaway Shovel, Inc. (hereafter, "Applicant").
LOCATION: Aspen Quick Mart, 31336 Highway 82, Don and Linda Crouch, Owners
BACKGROUND: Applicant desires to conduct her wholesale landscaping business with a
base of operations on vacant "yard" space at the Quick Mart. A permit for this operation has
been approved for the last four summers, and the Applicant is requesting that the same
level of activities be allowed again this summer. Ms. Sovich has operated a landscaping
business in the valley for 15 years. Finding an upvalley base of operations has been
problematic. Prior to 2004, Ms. Sovich was operating out of a residential property in Woody
Creek. Neighborhood concerns led to a County "Notice of Violation" and removal of
operations from that site. Ms. Sovich has been looking for a permanent site where zoning
would allow such use. Ms. Sovich has been unsuccessful in finding a suitable location to
date, which is why she is again seeking temporary use of the Quick Mart location for this
summer.
There were concerns expressed about last summer's operation as related to the business's
storage of vehicles. Vehicles are to be parked overnight in the paved area west of the
Quick Mart, not on the east side of the "Sovich area."
The proposed operation is located adjacent to the Quick Mart building on a vacant grassy
area. There is one temporary shade hoop house structure and a wire fence to enclose the
operations for security and protection of plants from the wildlife. There will be no retail
sales. The only signage into notify people that no retail sales take place on the premises.
Deliveries will off load from the Quick Mart paved areas. Business vehicles will park in the
Quick Mart parking areas.
REFERRAL COMMENTS: The application was referred to the Aspen Village
Homeowners Association. Referral comments indicate support for Ms. Sovich's operation,
but there are concerns with the parking and congestion in the area.
STAFF COMMENTS:

Pursuant to Subsection 4-30-50 (i) of the 2006 Land Use Code, Applicant must
demonstrate that adequate provisions have been made for all of the following:
1. Public Safety (if necessary);
2. Public Parking;
3. Site set-up, maintenance and clean-up;
4. Emergency services.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in tum, below.
Public Safety: No special arrangements are necessary.
Public Parkins: There will be no retail operations and no "public" accessing the site.
Business vehicles will use portions of the Quick Mart parking areas, not "grassy areas".
Site Set-Ua. Maintenance and Clean-Ua: Applicant would restore site after breakdown in
November.
Emerstencv Services: No special emergency services are necessitated.
Conformance with Buildins~ Code: A building permit would be required for the shade
hoop structure. This permit was previously obtained.
RECOMMENDATION: Staff recommends that the Director approve the Sovich
Temporary Commercial Use Permit application subject to Applicant's compliance with
each of the conditions in the attached Determination.

As you know this is my Soh year that I am applying for permission to operate my
wholesale landscape business from the Quick Mart location. For the Runaway
Shovel it is our 17`h season as a landscape company which includes weekly mowing
and general yard maintenance with a very strong emphasis on container planting and
perennial gardens. We use this as our staging area, I meet my crews and receive
deliveries of plant material which are unloaded into the shade hoop house and from
there we deliver to various accounts from Woody Creek to Aspen.
My crew consists of 4 teams of guys with generally 4 in a team which includes a
supervisor. Each supervisor drives a company vehicle which is taken home nightly
and 3 trailers stay on site at night and on the weekends. The trailers have led to
some discussion this year and instead of parking them along the fence we will revert
back to pazking 2 of them in the designated spots of the gas station and one as before
under the spruce tree. One I will not have parked on site and I will have my
supervisors pull the 3 out of the pazking spots by 7.30am and they will go to the
dump at that time. The majority of the crew arrives in the company trucks so at no
time do we have more than 2 extra cazs on site during the day.
We begin to receive deliveries in mid May which arrive from vazious suppliers,
possible 3 - 5 deliveries a week and this slows after August to perhaps 2 a week.
We try to expedite the process by having more hands available for the bigger
deliveries to reduce the inconvenience to the patrons of the store and the fruit stand
to a minimum. Unfortunately in order for us to be out of the pazking for the fruit
stand we generally receive our deliveries early so as to be gone before they open at

gam. This does add some level of chaos but I do try to be very aware of people
coming and going and I am always on site for these big deliveries. I find that people
are very willing to be accommodated and understand that it is part of what we have
to do to run the business. It is the van that Idrive - no trailer -that generally returns
during the day to re-fill with flowers and return to Aspen for deliveries or planting.
We shall have the exact same structure as previous yeazs, metal hoops with black
shade cloth. Last yeaz we had to cover the hoop house twice with white plastic for
the night due to the inclement weather that came through but we have to remove the
plastic the following day as the plants cannot survive in these enclosed conditions.
The fence posts aze still there from last there and shall just be wired with the gates
put in place. It takes us a day to get this all installed and ready to go. Again I have
no request for signage on site and hope that again Rosh from the fruit stand will be
there to direct any questions - as she has willingly done in the past!!!
We normally begin work at lam with a few guys watering the plants and some
loading and moving plant material. We work Monday through Saturday and on
Sundays watering the plant material. The crews aze done by 7.30pm and the plants
may need a further watering in the hotter weather. I am very awaze of keeping a
clean and tidy site and most plastics aze dumped daily. We shall hopefully run this
season from mid April to mid October.
The AQM location still proves to be an excellent staging azea for my business and as
the business has grown a little we do try to be conscience that many people aze
reliant on this azea as an entrance to their homes as well as a stopping point for
fruit/fuel or a paper. My customers aze very grateful for our fast turnazound which
we can achieve by being so close to town but not needing to send any extra delivery
vehicles into the congested city of Aspen.
I trust that we have answered all the questions and I have attended a meeting at
Aspen Village Homeowners where I believe we addressed the concerns of the
residents by moving our trailers off the site along the fence in the wild grass azea
and I shall do the best we canto have my crews out of the azea before the morning
rush from 7.30am which appeazs to be the craziest time for coffee drinkers!!!

Attachment A1. A Safety and Operations Plan is required for planned events/activities
because the emergency service infrastructure is funded by the Pitkin County taxpayers
to offset unplanned events that pose a threat to life and property. As a result, any
demand for services generated by a planned event/activity should be alleviated ahead

Permit that I receive shall be subject to the following terms and conditions, in addition to those
specified in the Administrative Determination/BOCC Resolution granting the permit:
A. The County may revoke a Temporary Commercial Use/Special Event Permit prior to or
during the event if the permittee violates any of the conditions of the permit.
B. The County may require the permittee to participate in a post-event debriefing with
referral agencies, affected citizens and other interested/involved parties to address
issues that arose during the event.
C. The County may require the permittee to post financial security to ensure compliance
with any of the conditions of the permit.
D. If a major incident or emergency occurs in the County during the event, the Sheriff
reserves the right to remove any and all emergency medical, fire and law resources
from the event.
E. The permittee shall adhere to all representations made in the application and in public
piretings.

Re: The Runaway Shovel and areas adjacent to Aspen Village
Dear Lance,
Please accept the following comments concerning the renewal application for the
Runaway Shovel use of the area adjacent to Aspen Village:
/ Aspen Village is 100 % behind Cheryl Sovich and the business she operates.
/ Our review of last year's use application showed that trailers and other vehicles
should be parked and staged on the west side of the Aspen Quick Mart parking
lot. During the Summer, 2007, all staging and parking of trailers and other
vehicles were parked on the east side of the Aspen Quick Mart on County
property. This property, although not pristine, was a grassy area. It is now
sunken and void of grass. It will be a huge mud hole when the snow melts.
/ We were told by Cheryl Sovich at the February 12, 2008 AVHOA meeting, that
Don Crouch, owner of the Aspen Quick Mart, requested that she not park in the
area designated by her application.
Please accept the following comments concerning Pitkin County property between the
AVFD and Aspen Village:
/ During the Spring, Summer and Fall, vehicles of all sizes and purpose park at the
Aspen Quick Mart, most especially during the rush hour, for reason from buying
morning coffee to staging horse back riding trips. Vehicles are parked all over
the place making it difficult as a pedestrian to walk to the bus, and for cars
leaving AV to avoid cars parked on Aspen Village Road. No parking signs have
been posted and as you can see from the 2 attached pictures, not taken seriously.
/ A discussion between the County and Aspen Village took place at the time when
Aspen Village evolved from a mobile home park to a subdivision, regarding the

County's commitment to take care of this area. Some bushes were planted, but
for the most part, this area looks like an industrial site. We sincerely request that
the County be accountable for this area. Not all AV residents use the stairs near
the fire station. Many, including kids, walk down the hill and through the maze
of trucks to get the bus stop. We feel that it is imperative for residents' safety
that a sidewalk is built from the bus stop up to the end of Pitco's part of Aspen
Village Road. Fencing in this area would also be helpful to discourage vehicles
from parking in the mud pits.
The next meeting of the Aspen Village Homeowners Association will be Apri18, 2008.
