My property is located in an area that is zoned AF-1, which means that the lets are to be 10 acres in size with 100' setback from the front property line and 30' on the sides. My lot is onl}- 1,3 of an acre, with the D. S R.C;.P7. Railroad to the one side and the roaring fork. river on tl-ie other with neighbors to the north crest and south east. Because of the river and it's ban}; I cannot build in that direction, cahich the enclosed photos trill show. The proposed garaye'oaorkshop that I wv-uld li}:e to build would be situated on the north west side of the property adjacent to the neighbor ~n that side, (vahich after looking at the last survey closely I noticed that the neighbor on that side has built to within 3 feet of the property line. I am not asking to be allowed to build that close to the line but that the board take tkia'_ fact into consideration vahen re~~ietving my need for a variance. I also understand that I should be allowed to build up to 1.3 of m~- etiisting square footage for an sddition, what I am curious about is that if I am going t:, incorpcrate the etisting corkshop area into the new structure if my necv construction would be the 1'3 area plus the square footage of the shoo that trill be rebuilt- \ot all of this footage is for the garage, part of the construction is for a bathroom and increasing the size of tt~ie etiisting office space. This construction till also straighten out some of the odd angles that +he house has currently. The ga:-age that i am proposing is mainly for use as a place that I can keep me work vehicles maintained and storC some of m~ equipment. Krizmanich, Pitkin County Zoning Administrator, and Joanna Schaffner, Zoning Technician, were present with staff recommendations and comments. Shaffran opened the meeting at 5:22 p.m. and introduced the Board to those present. Shaffran moved to take Case #90-09 off the table from the meeting held March 6, 1990. Shaffran stated that she visited the site and agreed that there is a topographic hardship. Hansen submitted revised plans where Plan "A" indicate an encroachment close to the river. Plan "B" is preferred by Hansen. No one from the pukilic was present to comment. Guy made a motion to grant the 85 foot front yard setback variance and a 16 foot east side yard setback variance as requested on Plan "B" submitted, due to topographic hardship and nonconforming lot size. Neiley seconded the motion with the condition that the use of the garage not be sanctioned because of the granting of the variance for a commercial enterprise. The Board agreed. It was passed 5-0. Case #90-14, Harper Bryan L40 B1 Mtn Valley Subdivision Bryan Harper was present to request a 55 foot rear yard setback variance where a 100 foot Highway 82 setback is required, per the Pitkin County Land Use Code, for the construction of a single- family residence, due to downzoning. The placement of a rhtaining wall was questioned. Krizmanich stated that excavating into the hillside is acceptable; however, if the wall is above grade, it becomes a structure and needs a permit. The Harper retaining wall is allowable as presented on the plans. 1 ~~~Q~~ Shaffran asked if there were any members of the public to respond to this case. There were none. Harper presented to the Board a letter from neighbors Richard and Ginny Haberman, which stated that they do not object to Harper's request. Neiley made a motion to grant the requested 55 foot rear yard setback variance as reflected on the plans submitted, due to downzoning. Shaffran seconded the motion and it was passed with a 4-1 vote, with Guy opposing. Case #90-15, Snowmass/Gateway, was tabled until later in the meeting as the representative had not yet arrived. Case #90-16. Ossario. Hillary, L14. S20. T10S. R84W, Hwv. 82 Tom Stevens and architect David Finholm represented the applicant who was requesting a 60 foot front yard setback variance where 100 feet is required along Highway 82, per the Pitkin County Land Use Code, for the construction of a single-family residence, because of topographic and geologic hardships. Stevens stated that there were possibly two other locations on the site that could be used to build, but they would require traversing 30% slopes to get to those sites. A model of the house was shown to the Board to grasp the nature of the steepness of the slope. Shaffran questioned the legality of the parcel as a building site; a letter was included in the file from Tom Smith, County Attorney, stating the legality of the lot. Also, the lot has undergone a 1041 review and has been approved by the Board of County Commissioners and the Pitkin Planning & Zoning Commission. The opinion of both of these Boards was that the location of the house, low on the site, would have less visual impact then if it were located higher on the site. The Board agrees. The building envelope that resulted from the review was shown on the plans submitted. It was noted that a landscaping plan was not included in the general submission and 1041 review. A discussion ensued as to where the boundary of the parcel should start and whether the boundary should be from the highway or the right-of-way. The setback variance was measured from the highway and not the right-of-way, which is how it should have been measured. Shaffran commented that the proposed house is just so huge and nothing had been done ,to mitigate the impact, but Neiley stated that it is not excessive for the size of the lot. Finholm stated that the house was designed in pieces so that it would not look so large and it would blend into the site. 2 00~(~?~• Marty Stouffer, a member of the Aspen Bike Lovers East was present with concerns of the Aspen East Scenic CorridorLand the homes being built within the corridor. ABLE is trying to get the Highway east of Aspen widened, and this would situate the highway closer to the house. Ostwald suggested an 80 foot front yard setback variance. Schaffner asked if the Board wanted to table this case until the Boards next meeting to discuss the case with County Attorney, Tom Smith. The Board decided it was not necessary since a motion can be made with conditions. Gull made a motion to approve an 80 foot front yard setback variance due to topographical hardships without any conditions. Ostwald seconded the motion. The vote was 3 to 2 with Guy and Shaffran opposing, therefore, it did not pass. Guy then made a motion to grant the 80 foot front yard setback variance, due to topographic hardships, subject to submission of a landscape plan by the applicant. A portion of the house will also be changed to accommodate the variance granted. It was decided by the Board that Tom Stevens will give a landscape plan to Krizmanich and the Board to review. The acceptance or denial of this plan will then be part of record. Gull seconded and the motion passed 4-1, with Shaffran opposing. u°° 7~-15 Snowmass Gatewa Ventures Lot 3 Block 3 Filin 3 Gatewa of Snowmass Ron Kahan was present to request a 70 foot front variance and a 10 foot rear yard setback variance whered100tfeet and 50 feet is required, respectively, in the RS-30 zone district, for the construction of a single-family residence, due to topographic hardships and nonconforming lot size. Kahan submitted a topographic plan of the area showing the grade of the land. Kahan stated that he removed the deck so that a rear yard setback' variance is not needed. Where the proposed house is situated will cause the least amount of scarring to the land. No one from the public was present to comment. Shaffran moved to grant a 70 foot front yard setback variance due to downzoning and topographical hardships. Guy seconded the motion and it was passed 5-0. Scott submitted photos of the trees and vegetation. Scott also stated that he is trying to place the location of the house as far from Booth Plumbing (a business in the Holland Hills area) as possible. Gull stated that the setbacks for a comparable zone district for this lot size should be 30 foot front, 20 foot side, 20 foot rear. Gull believes the extra 5 feet being requested should not make a difference to the location of the house. Scott reiterated that it was to save the trees which would have to be destroyed. The house has been staked out and if moved, the vegetation would be destroyed. The Board decided to table this until an on-site visit could be made which was set for Friday, April 6, at 8:00 a.m. A decision by the Board will be made at that time. Mariano "Buddy" Lucero then introduced himself and Krizmanich and Lucero explained the changes in the Planning and Zoning Department and the role Lucero would be playing. i Gull made a motion to approve the minutes of the March 6, 1990, meeting as submitted. Krizmanich, Pitkin County Zoning Administrator, and Joanna Schaffner, Zoning Technician, were present with staff recommendations and comments. The Board reconvened at 8:20 a.m. on Friday, April 6. John Ostwald was not present during this meeting, but did arrive later to review the site. Shaffran moved to take Case #90-17 off the table and it was seconded by Neiley. Allen Scott, the applicant, and Susan Furr, architect, were present representing the case. A discussion then ensued on where the house would be situated and where the stakes were located. It was noted that if the house were moved any further north to remain out of the setback, the vegetation and trees would be destroyed.. Furr submitted revised plans of the house. It was also noted that the rear of the house would be against BLM property and that no neighbor would be affected by this decision. With further discussion, a motion was made by Guy to grant the 15 foot rear yard setback variance, as submitted on the revised plans, due to downzoning and for keeping the trees and vegetation presently on the lot. Shaffran seconded and all were in favor. Ostwald called the Planning Office at 11:00 a.m., April 6, and told Cindy Christensen that he was also in favor of the 15 foot rear yard setback variance requested. Krizmanich, Pitkin County Zoning Administrator, and Joanna Schaffner, Zoning Technician, were present with staff recommendations and comments. Shaffran opened the meeting at 5:23 p.m. and introduced the Board to those present. Schaffner stated that Robert Dickerson (Case 90-05) and Donald Rutherford (Case 90-07) have been renotified as required and no objections from adjacent property owners have been received. Shaffran questioned whether Greg Mackey (Case 90-04) needed to be renotified and reposted as well. Schaffner stated that only renotification needed to be completed and this was done. Shaffran stated that the fence was already in existence, so if someone would have objected, they would have already done so. Case 90-08. Philosoohos/Koules. 0260 Wriahts Road. Red Mountain Tim Philosophos was present to request a 5 foot front yard setback variance where 30 feet is required in the R-30 zone district to allow for the construction of a single-family residence on an existing foundation. According to Philosophos, the house was designed for minimal visual impact and minimization of slope disturbance. Philosophos also wants to recontour the road to correct drainage problems. Shaffran wanted to know why building plans were not submitted. Philosophos stated that the Board of Adjustment application asked specifically for copies of the floor plan of the proposed structure, with all uses identified. He believed that if the building plans did not match the floor space, the setback variance requested, if granted, could become void at a later date. Krizmanich had no comment about the variance, but added that the applicant will need an encroachment permit for the second access. ~~~U~g Shaffran asked if there were any members of the public present who wanted to contribute comments. Neighbor Bob Leimacher stated that the line of trees and railroad ties along the road make it virtually impossible for the road to be plowed. It was Leimacher's opinion that this variance request is only for financial gain, not for any topographical hardship. Philosophos stated that he is willing to pave the entire road and intends on improving the character and safety of the road, but that the road itself is not affected by the proposed variance. Leimacher believed that a variance would affect the road. Guy believes that there is no benefit to the community because the house is already going to be extremely big. He does not see any hardship and would not vote in favor of the variance. Mathis agreed. Philosophos wishes to minimize disturbance on the hill. Gull stated that the applicant has not reduced the impact of the house on the hill as stated by Philosophos. Neiley disagreed and believes the proposed house is not offensive and has a good design. Mathis stated that because the building encroached into the setback before, does not mean it should be allowed to encroach again. After the Board reviewed all the material presented, Guy made a motion that the five foot front yard setback variance be denied due to lack of demonstrated hardship. Mathis seconded. The motion was passed 4-1 vote, with Neiley opposing. Case_#90-09, Hansen, Tom. 4074 Lower River Road. Woody Creek Tom Hansen was present to request a 90 foot front yard setback variance and a 17.5 foot east side yard setback variance, where 100 feet and 30 feet, respectively, are required in the AF-1 zone district, because of topographic difficulties and a nonconforming lot size. Hansen has resided at this address for approximately three years and wants to construct a workshop/garage area, add a bathroom and extend an existing office. He is self-employed and the garage would be used to do his own vehicle repair, storage of equipment and inventory. Hansen did not have topographical maps, but did show photographs of his property. Discussion was held on what should be specified as the front yard. Part of the building already encroaches into the railroad easement. Shaffran stated this is a nonconforming lot size and the appropriate zoning for a lot this size (1/3 acre) would require a 30 foot front yard setback. 2 ~~~~~~~ No one from the public was present to comment on this case. Other design alternatives for the garage setback were discussed. The previous owners had received two setback variances. Guy suggested to grant the side yard setback variance, but change the request from a 90 foot setback variance requested to an 80 foot or 85 foot setback variance. Shaffran still believes this is too much. Neiley stated that in the future the railroad easement may become a very hot issue. Mathis stated that he cannot support this variance request because it is for a business and may cause excessive noise and more traffic. Shaffran suggested that Hansen take all the comments made by the Board and redesign the addition so a minimum variance would be necessary. Shaffran moved to table this application until the April 3, 1990 meeting. Guy seconded the motion and it was passed 5-0. Cas_e__#90-05, Asoen Valley Hospital, 0200 Castle Creek Road Ed Stuessi, ASI Sign Systems, and Tom Lake, Aspen Valley Hospital, were present to request an 11 foot front yard setback variance where 30 feet is required and a request for sign permits for three signs, in the PUB Zone District. Stuessi submitted a rendering of the proposed signs for Aspen Valley Hospital, Castle Creek Terrace, and for Mountain oaks. The signs are all 36 X 38 which is approximately 9.7 square feet (within the 10-foot limit). The size of the lettering is also within code requirements. Signs for Aspen Valley Hospital and Castle Creek Terrace are to be internally illuminated for easy identification in the dark. The sign for Mountain Oaks was not to be internally illuminated. Krizmanich stated that internal lighting is prohibited by the Pitkin County Land Use Code. Krizmanich read from the code regarding internal lighting. John Keleher, a neighbor, wondered if the lights for Castle Creek could be on a timer to turn off at designated hours. Neiley believed that the signs should be illuminated because of their importance. Lake commented that the signs for the Hospital and Castle Creek Terrace should be lit to prevent confusion when going to the hospital. The Board agreed. A site map and photographs were submitted to the file indicating the locations of each of the signs. The Aspen Valley Hospital sign is the one that encroaches into the setback. 3 000(1? Neiley made a motion to approve the signs with only the Aspen Valley Hospital sign being internally illuminated and to grant the 11-foot front yard setback variance due to safety concerns so people may recognize the hospital sign immediately. Mathis seconded the motion and it was passed with a 5-0 vote. Lee Miller was present to request a 70 foot front yard setback variance where 100 feet is required in the AF-1 Zone District, for the construction of a single-family residence because of topographic hardship. Shaffran read a letter from the Brush Creek Landowners Associa- tion, which stated that the Board of Directors is supportive of this application, and have no objections to the requested setback variance. The neighbors also have no objection to this setback variance. There were no members of the public present to comment on the setback variance. Shaffran stated that she is familiar with this area and it is extremely steep. After a brief discussion, Guy made a motion to grant a 70 foot front yard setback variance where 100 feet is required due to topographic hardship. Shaffran seconded the motion and it was passed with a 5-0 vote. Case #90-12. Hoff, Dave & Ruth, Portions of Lot 19 & 20, Sec 9, T9S, Wood Creek Area Michael Manchester and Dave Hoff were present to request a 30 foot rear yard setback variance where 50 feet is required in the RS-20 zone district, for the construction of a single-family residence and to allow for the preservation of mature trees. Manchester presented a letter from Dale Dillingham, an adjacent property owner, in support of the setback variance request. Shaffran read the letter and it was submitted to the file. Mathis stated that he may have a conflict, but the Hoff's and Manchester felt there was no conflict. Photos of three large spruce trees were submitted which was the main reason for the setback variance request. The Hoffs want to keep the view and the trees, and preserve the vegetation already in existence. By locating the house where proposed, it would leave the trees as is and allow for the use of solar energy. Mickey Herron, attorney for the applicant, commented that the newly proposed Pitkin County Land Use Code as submitted and prepared by Glenn Horn, has changed the setback requirement for 4 00031 an RS-20 zone district, thereby making only a five foot variance request necessary. Neiley commented that he has a hard time seeing a hardship and further stated that he could accept a 30 foot setback variance based on this being a 7.68 acre lot located in a 20 acre zoning district. Manchester stated they could move the proposed location of the house, but the trees would be removed. The Board agreed that the trees should be preserved. Schaffner stated that the Board has used a topography hardship to preserve trees and vegetation before. Shaffran commented that the Board tries to help when a request would also benefit a neighbor. Neiley made a motion to grant a 30 foot rear yard setback vari- ance based upon extraordinary and exceptional physical charac- teristics on the site which were not created by the applicant. Mathis seconded the motion. The motion was passed 4-1 with Gull opposing. Case #90-13 Garza Santiago Lot 7 Ridge of Red Mtn ReDlat 2 Sherry Geller, architect for Santiago Garza, represented this case to request a 184.63 square foot variance from FAR and a 13 foot 5 inch rear yard setback variance (to permit a setback of 6 feet, 6 inches), where a maximum of 3150.03 square feet is allowed and 20 feet is required, respectively. Guy stated that he might have a conflict with this case, but Garza felt there was no conflict. Geller stated that this is a nonconforming lot (should be 30,000 square feet and it is 27,114 square feet; lot width should be 125 feet minimum and is only 88 feet). The existing house is presently nonconforming. (Because of errors in the notification, whatever action taken, renotification will have to be done.) Geller explained that remodeling is to be done because this house has five bedrooms, ten occupants, a one-car garage and no off- street parking. Geller presented a letter of support from neighbor, Jim Goodman, stating that the variances requested would benefit him. A second letter was read from John Moore, Ridge of Red Mountain Home- owners' Association. This letter also stated that these variances would be acceptable to them as long as the neighbor agrees. 5 OflOQ? Neiley stated that the need for the variance appeared more aesthetic than due to a hardship. Guy and Shaffran agreed with Neiley. Shaffran suggested splitting the variance requests and making a motion on the FAR portion. Shaffran made a motion to deny the FAR request variance due to demonstrated lack of hardship. Guy seconded and it was approved 5-0. A discussion resumed on the request for a variance 13 feet, 5 inches from the 20 feet that is required with the result of the building being 6 feet, 5 inches from the property line. Guy made a motion granting the 13 foot 5 inch rear yard setback variance due to topographical hardship and a nonconforming lot width. Mathis seconded the motion. It was approved 4-1 with Gull opposing. This is dependent on renotification of the proper variance request and a corrected letter from John Moore. Shaffran made a motion to accept the minutes of the February 6, 1990, meeting. Shaffran then read a letter from Bryan Harper requesting that the Board of Adjustment meet at least twice a month during the months of March and April to alleviate the backlog of building permits stopped by various requirements and allow the citizens to be able to start construction during the spring and summer months. This was discussed and it was decided that meetings will be kept at once a month. Schaffner stated that because of the time needed for notification and posting, it is virtually impossible to have two meetings per month. This will be discussed again in April.
