BRANDY Re: Variance Request - Marguerite Collier Dear Members: This letter will set forth the basis for the request for variance on behalf of our client, Marguerite Collier, Owner of Tract R-13, Starwood Three. BACKGROUND. Sepp Kessler acquired Tract R-13 in early 1965 and constructed the residence of the property shortly thereafter. At the time of construction of the residence, the yard set-back was 20 feet which was fully complied with as the house was placed 40 feet from the rear boundary line. Tract R-13 was sold to Donald Shea Green in 1975. In 1976, Mr. Green constructed the greenhouse addition which also complied with the 20 foot setback requirement. In 1977, Pitkin Courrty rezoned the Starwood area from AF-1 to RS-20 PUD. This rezoning also changed the yard provisions of the Land Use Code extending the set-back from 2U feet to 50 feet. Mrs. Collier acquired the property in 1982. She now proposes to remove the glass roof of the greenhouse and construct a deck in its place. NEED FOR VARIANCE. Because the replacement of the glass roof of the greenhouse with a deck is within the rear yard minimum setback, the construction of the deck cannot be accomplished without the granting of the requested variance. HARDSHIP (Basis for the Variance. The hardship is caused by the increase in setback requirements in 1977 as a result of the zoning change from AF-1 to RS-20 increasing the minimum yard requirements. Thus, the existing condition was not created by the applicant (or her predecessor in title) subsequent to the adoption of the new setback requirements in 1977. Because of the location of. the Collier residence, the impact on the neighborhood of replacing the greenhouse roof with a balcony will be virtually non- existent. A Starwood Homeowner's Association pasture tract is located on either side of the residence (east and west) and the property to the south of the modification to the residence is a large undeveloped parcel owned by the White Horse Springs Water and Sanitation District. It is my understanding that this parcel contains the springs and holding tanks supplying the domestic water for the White Horse Springs Subdivision. APPROVAL BY STARWOOD. The modifications to the residence shown on the accompanying floor plans and elevation drawings were approved by the Starwood Homeowners Architectural Committee on November 5, 1990. Houben, Senior Planner RE: Minor Ridgeline Development in Starwood/Collier Residence DATE: November 29, 1990 REQUEST: The applicant, Marguerite Collier, has applied for a building permit to construct a 650 square foot addition to a 3,000 square foot residence located on Lot R-13, Starwood 3 Subdivision. According to Ordinance 90-7, this property was mapped as a'scenic/ridgeline area. Section 3-1.13 (D)(1) permits the Planning Director to sign-off on development which is considered insignificant: (D) Planning Director Sign-Off (1) The applicant shall demonstrate that development within the mapped scenic overlay is insignificant and will not impact the visual quality of the ridgeline or overlay area. In this case the Planning Director may approve development with conditions upon a finding that: a. Development cannot be seen from the designated corridors as defined in Section (B)(1), or b. In the case of additions or remodels of existing homes, visible development is thirty percent (30%) or less, of the existing square footage of the structure, or c. For areas not mapped within the Scenic Overlay but included in Ridgeline map- ping, such development shall not break a ridgeline. The attached Addition plans illustrate the proposed addition. County PO # 47999 000022 Minutes Pitkin County Board of Adjustment December 4, 1990 Members Present: Kandi Shaffran, Chairman Stan Mathis Evan Gull John Ostwald Ted Guy Members Absent: Rick Neiley Joanna Schaffner, of the Pitkin County Zoning Office, was present with staff recommendations and comments. Shaffran opened the meeting at 5:20 p.m. and introduced the Board to those present. The meeting began with the Gardner case which was tabled from the November 6 meeting to provide for a site visit. (Ted Guy was not present to vote on the first case.) Case #90-47, Gardner, Thomas, Lot 16, Shield-O-Terrace Thomas Gardner was present to request a 56 foot front yard setback variance where 100 feet is required, for construction of a detached garage. Gardner reviewed what was discussed in the November 6 meeting and at the site visit on November 14, 1990. Gardner submitted a new set of plans which show the change that he is requesting. The proposed garage will be placed further back into the hillside. Shaffran asked if there were any members of the public present to comment. There were none. After a brief discussion, Gardner stated he would place the garage 7 feet off of the right-of-way. Ostwald asked if Gardner could move the location of the garage back another 2 feet to allow for a parking apron (this would be 9 feet off the right-of- way with the right-of-way being 60 feet). After a brief discussion Gull made a motion to grant a 61 foot front yard setback variance for the construction of a detached garage, as per the plans submitted on December 4, due to topographical hardship. Shaffran stated that there was a problem with notification on this case. The correct request was written on the sign but was incorrectly stated in notices sent the adjacent property owners and posted in the Aspen Times. Therefore; any decision on this case will be subject to no objections being made after renotification to the adjacent property owners and the Aspen Times, and prior to the January 8, 1991 meeting date. Brandt also submitted a copy of a letter of consent from Collier's neighbor, Kenneth Wang, and the minutes from the November 5, 1990 Stanwood Homeowners Association meeting, also approving this request. Also made a part of the file is a copy of the Minor Ridgeline Development Review from the Planning Office approving this request for a deck. Case #90-55, Davis, Don, 2800 McLain Flats Road Joe Lalande, representing Don Davis, was present to request a 15 foot west side yard setback variance, where 50 feet is required, for construction of a proposed workshop/storage shed. Lalande reviewed what Davis wanted to do and stated that the location on the plans is the only place to put the shed due to the topography. Gull mentioned that because of the 1041 building envelope, there are constraints as to where the shed can be placed.
