November 12, 1990 Pitkin County Board of Adjustment 130 South Galena Street Aspen, Colorado 81611 Dear Board Members: AREA CODE 303 9259190 925-9577 This letter is being submitted on behalf of the Starwood Homeowners Association for a variance within the setback from the Association's privately owned road known as Kessler Drive, for the purpose of constructing an addition of approximately 1,000 square feet to the fire house and garage on Lot C-1. The addition will be utilized to store cinders and miscellaneous equipment. As appears from the Application submitted to the Aspen/Pitkin Planning Department dated October 10, 1990, the Association has requested approval for replatting Tract C-1, Tract C-2, and Kessler Drive to depict Kessler Drive's actual location as shown on the attached plat. It is assumed that Kessler Drive was constructed in its current location due to engineering and topographical considerations. The existing fire house and garage was constructed on Tract C- 1 in 1983. Cinders and miscellaneous equipment have been stored directly to the east of the fire house and garage, and the Association desires to construct the addition as a means of providing protection against snow and ice accumulation. The garage in its current location presents exceptional topographic conditions. Ms. Ellie Brickham is the Architectural Review Advisor to the Starwood Homeowners Association, P.O. Box 167, Aspen, Colorado 81612 (telephone number 925-7508), and a designated representative authorized to act on the Association's behalf. The address of the subject property is the Starwood Subdivision as shown on the original plat for Starwood I, recorded in the office of the Pitkin County Clerk and Recorder on the 7th day of December, 1962 in Plat Book 2 at Page 282. The following are attached in connection with this Application: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substan- tial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. County PO # 47999 OQUVL~ ,~ Minutes Members Present: Members Absent: Pitkin County Board of Adjustment January 8, 1991 Kandi Shaffran, Chairman Stan Mathis Rick Neiley John Ostwald Ted Guy Evan Gull Joanna Schaffner, of the Pitkin County Zoning Office, was present with staff recommendations and comments. Shaffran opened the meeting at 5:20 p.m. and introduced the Board to those present. Christensen informed the Board that cases 90- 53, Collier, and 90-55, Davis, received no objections and that' their approvals from last month have, therefore, become effective. Case ~90-48, John Walker, was tabled until the February 5, 1991 meeting. Case #90-47, Thomas Gardner, will be reheard at the February 5, 1991 meeting. Paul Taddune, Attorney, and Ellie Brickham, Starwood Architectural Review Advisor, were present to request a 90 foot front yard setback variance, where 100 feet-is required in the AF-1 zone district, for construction of a proposed addition to an existing firehouse and garage. Taddune explained the need for this addition. Taddune stated that adjacent land is owned by the Association, and therefore has no impact on any individual's private property. Shaffran asked if anyone from the public was present to comment on this case; there were no comments. After a brief discussion, Mathis moved,to grant a 98 foot front yard setback variance as .per the plans submitted, due to topographical hardship. Guy seconded the motion and all were in favor. Case #91-01 Lavery r'reaericx L6A- ISb xea tncn xu .7l1A1i1V1b1V11 Frederick Lavery was present to request a 55 foot front yard setback variance, where 30 feet is required, and a 45 foot collector street setback variance, where 50 feet is required per the Pitkin County Land Use Code, for construction of a proposed residential garage. 1 000021 Lavery explained that 1041 approval has been granted by the P&Z and that he was then informed that setback variances would be necessary for his proposed garage. The proposed garage is to be located underground between the house and Red Mountain Road. Schaffner was questioned over the determination of the front yard on this parcel. The current access located on the east side of the lot will be abandoned through an agreement between Lavery and the County. The new access will be taken from the road on the north side of the lot. Hence, the current side yard will become the future front yard and visa versa. Although this vacation has not yet occurred, Zoning Administrator, Krizmanich, approved of referencing the .future front yard as the front yard for the purposes of this variance request. There was no one from tl}e public present to comment on this case. Guy made a motion to grant a 26 foot front yard setback variance (side nearest Red Mountain Road), where 30 feet is required, and/or an 11 foot side yard setback variance, where 15 feet is required (depending on how the front yard is determined, to enable the garage to be 4 feet from the North property line), and a 46 foot collector street setback variance, where 50 feet is required, due to topographical hardship, as per the plans submitted on the First Plat Amendment and 1041 Review for Lots 5A, 6A, Block 3 (Revised) Red Mountain Subdivision). Neiley seconded the motion and all were in favor. Larry Yarber was present to request a 55 foot front yard setback variance and a 10 foot north side yard setback variance, where 100 feet aild 30 feet, respectively, are required in the AF-1 zone district, for construction of a single-family residence. Yarber stated that the rear of the lot is very steep. He continued that if the house was placed anywhere else (or if the• building envelope was changed), large trees on the property would have to be destroyed or moved. Yarber wants to retain the trees and vegetation. Redstone Ranch Acres Subdivision covenants, require a 10 foot side yard setback and a 25 foot front yard setback. Guy stated that he is in favor of this request because it does not encroach into the setbacks designed for the Subdivision. There was'no comment from. the public. Neiley moved to grant a 55 foot front yard setback variance and a 10 foot north side yard setback variance, as per the plans submitted, due to downzoning. No one protested on this issue. Nininger stated that the barn was built 'about a year ago and that a topographical map was not done prior to the excavation of this site. The height is being calculated based on the surveyors best guess of natural existing grade prior to excavation. Guy asked what the height limit was for a barn. Schaffner stated that it was 12 feet to the midpoint and 17 feet to the peak. Guy also wanted to .know how a barn was defined, and Schaffner read the definition of a barn 'from the Code. Guy mentioned that it was difficult to design a barn to comply with a 12 foot height limit. Shaffran agreed that a 12 foot height limit was not enough for expected barn uses, i.e., hay loft. Nininger mentioned that he could bring the barn into compliance if he removed the roof and made it flat. There was no one present from the public to comment.on this case. Guy made a motion to grant a 4 foot 6 inch height variance due to topographical hardship, as per the plans submitted. Shaffran seconded the motion and all were in favor. Tom Hansen was present to request an 85 foot front yard setback variance and a 16 foot east side yard setback variance, where 100 feet and 30 feet, respectively, are required in the AF-1 zone district, for construction of a second floor above a garage. Hansen received approval.for the same setback variances for the garage in case 90-09. The proposed second floor will rise 10 feet above the existing house. Schaffner stated that Hansen is increasing his encroachment into the setback, and therefore requires a second review for approval. Ostwald moved to grant all setbacks as requested on the plans submitted, due to downzoning. Mathis seconded the motion. Guy was concerned with the visual impact of such a large structure situated within the setback, so closely next to an existing large building (the Wildbock Inn) which is also located within the setback. Neiley agreed with Guy's concerns. 3 0000?3 Shaffran asked ,if any members of the public were present and Hansen's neighbor, David Swersky, was present but had no comment to Ostwald's motion. Swersky then left the meeting. Ostwald's motion was voted on with Ostwald being the only member in favor. It was decided that a site visit was needed to see what visual impact this addition would have. Hansen agreed to erect sticks indicating the proposed height. Shaffran moved to table Case 90-04 until Friday, January 11, at 8:00 a.m.; Guy seconded the motion and all were in favor. Attorney, Mickey Herron, was present representing the Liss', to request a 14 foot rear .yard setback variance, where 30 feet is required in the AF-1 zone district, to bring an existing single- family residence into conformity. Herron mentioned that the Liss' want to legitimize the house that was built within the required setbacks in 1979. Shaffran read County Attorney, Tim Whitsitt's letter supporting approval of the variance request. There was no one from the public present to comment. Guy moved to grant a 17 foot rear yard setback variance, for the existing structure, due to existing conditions. Mathis seconded the motion and all were in favor with Shaffran abstaining. Architect, Jack Miller, was present representing Eddie Cheever, to request a 45 foot front yard setback variance, where 100 feet is required in the AF-1 zone district, for an addition to a single-family residence. Cheever received approval for an addition to his home in Case 90- 36. Schaffner stated that the proposed changes to those plans result in an increase in the encroachment of the required setback, therefore, needs to be reviewed again •by the Board for approval. Miller explained what the proposed changes were. Ellie Brickham, member of the starwood Homeowner's Association, stated that there were no objections from the Association to this request. Guy made a motion to grant a 45 foot front yard setback variance for .the building, and an additional 2 feet of variance for the roof and overhangs for the entry and stair tower, as~shown on the plans submitted, due to downzoning. Shaffran opened the meeting at 5:20 p.m. and introduced the Board to those present. The meeting began with the Gardner case which was tabled from the November 6 meeting to provide for a site visit. (Ted Guy was not present to vote on the first case.) Thomas Gardner was present to request a 56 foot front yard setback variance where 100 feet is required, for construction of a detached garage. Gardner reviewed what was discussed in the November 6 meeting and at the site visit on November 14, 1990. Gardner submitted a new set of plans which show the change that he is requesting. The proposed garage will be placed further back into the hillside. Shaffran asked if there were any members of the public present to comment. There were none. After a brief discussion, Gardner stated he would place the garage 7 feet off of the right-of-way. Ostwald asked if Gardner could move the location of the garage back another 2 feet to allow for a parking apron (this would be 9 feet off the right-of- way with the right-of-way being 60 feet). Gardner had no problem with that request. After a brief discussion Gull made a motion to grant a 61 foot front yard setback variance for the construction of a detached garage, as per the plans submitted on December 4, due to topographical hardship. Mathis seconded the motion and all were in favor. 1 ~~~nO Case #90-53, Collier, Marguerite. 0122 Stewart Drive, Stanwood Marguerite Collier, Bill Lipsey, architect and Chuck Brandt, attorney, were present to request a 20.5 foot rear yard setback variance, where 50 feet is required for construction of a deck. Shaffran stated that there was a problem with notification on this case. The correct request was written on the sign but was incorrectly stated in notices sent the adjacent property owners and posted in the Aspen Times. Therefore, any decision on this case will be subject to no objections being made after renotification to the adjacent property owners and the Aspen Times, and prior to the January 8, 1991 meeting date. Brandt also submitted a copy of a letter of consent from Collier's neighbor, Kenneth Wang, and the minutes from the November 5, 1990 Stanwood Homeowners Association meeting, also approving this request. Also made a part of the file is a copy of the Minor Ridgeline Development Review from the Planning Office approving this request for a deck. Paul Taddune and Ellie Brickham, representing the Stanwood Homeowners Association, were present stating that there were no objections to this request. Mathis made a motion to grant a 20.5 foot rear yard setback variance for construction of a proposed deck, due to downzoning, as per the plans submitted, pending renotification of the neighbors and Aspen Times, and no objections from this renotification. Ostwald seconded the motion and all were in favor. Case #90-54 Stanwood Homeowners Assoc.. Kessler Drive. Stanwood Since no notification of this meeting was posted at this site, Shaffran moved to table this case to the January 8, 1991 meeting. Guy seconded the motion and all were in favor. Case #90-55 Davis Don 2800 McLain Flats Road Joe Lalande, representing Don Davis, was present to request a 15 foot west side yard setback variance, where 50 feet is required, for construction of a proposed workshop/storage shed. Lalande reviewed what Davis wanted to do and stated that the location on the plans is the only place to put the shed due to the topography. Gull mentioned that because of the 1041 building envelope, there are constraints as to where the shed can be placed. Shaffran asked if there was anyone from the public present to comment and there was no one.
