Dear Members,
We are submitting for your review and consideration this setback
variance request because of the non standard lot setback of approximately
31 0". The required setback, as we understand from the planning office,
is 100'. However, this building was built prior to the implementation of
this setback requirement.
The need for expansion of the subject residence is a growing family
and the inadequacy of the present residence to accomodate their needs.
Otherwise, all requirements of height and area are complied with.
We trust you will review this proposed addition favorably and grant
us the setback variance.

RESOLUTION OF THE PITKIN COUNTY, COLORADO
BOARD OF ADJUSTMENT
GRANTING 3ETBACR RELIEF FOR STEPHEN AND HEATHER ISBERZAN
RESOLUTION NO. 93-03
WHEREAS, Stephen and Heather Isberian, owners of Lot 21, Holland
Hills Subdivision, are requesting approval for a 36 foot front yard
setback variance for an addition to an existing single family
residence and a 70 foot front yard setback variance for
construction of a garage; and
WHEREAS, a 100 foot front yard setback is required in the AF-1 zone
district; and
WHEREAS, the subject property is within the unincorporated area of
Pitkin County, Colorado, (as described in Exhibit "A", attached);
and,
WHEREAS, the Board of Adjustment is vested with the power to grant
or deny such variances by virtue of Title II, Section 16-1.3,
Pitkin County Code (Land Use Code) and Colorado Revised Statutes,
1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment
makes the following findings:
1. Proper notice procedures, including the
notification of all adjoining property owners,
has been shown by the applicant.
2. The required hardship or practical difficulty
has been established.
3. Granting such relief will not cause substan-
tial detriment to the public welfare and will
not substantially impair the intent and
purpose of the Zoning Resolutions and the
zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment, that a
36 foot front yard setback variance be granted for an addition to
the existing residence and a 70 foot front yard setback variance ~
be granted for construction of a garage, due to downzoning, as per
the plans submitted (Exhibit "B"). r;

Guy opened the meeting at 5:20 p.m. and introduced the Board to
those present.
Case 93-01. Donniel Hecker. Lot 2. Block 3. Filina 2. Gatewav of
Snowmass Mesa Subdivision
Donniel Hecker was present to request a 92.5 foot front yard
setback variance and a 42.5 foot south side yard setback variance,
where 100 feet and 50 feet, respectively, are required in the RS-
30 zone district, for construction of a single family residence.
Hecker noted that the steep slopes and the lot's location below the
ridgeline create topographical hardships, and that only one
building site is available on the lot. He also noted that there
are many non-conforming lots in Gateway, and displayed pictures of
several. The structure he is proposing will not protrude out
farther than the structures on adjacent lots. Hecker stated that
the Gateway Homeowners Association gave him a verbal approval, and
that the Planning and Zoning Commission approved his Ridgeline
Review at their meeting this morning.
There was no public comment.
Wheeler asked about the design of the house. Hecker responded that
the house was designed to pass the ridgeline review. The house
will be kept low (23-24 foot maximum height) with a flat roof, and
natural colors will be used. Guy noted that the structure is on
a secondary ridge.
Guy stated that he had been to the site previously, and that the
footprint occurs naturally and that the house is in the only site
that can be reached with a vehicle. He noted that topographical
hardship and non-conforming lot size were obvious concerns with
this lot.

Wheeler moved to grant a 92.5 foot front yard setback variance and
a 42.5 foot south side yard setback variance, due to topographical
hardships, based on the plans submitted. Dyer seconded the motion,
and all were in favor.
Case 93-02, Gary Carlston, Homestead 6, Wildcat Ranch
Bruce Hazzard of Design Workshop, and John Wolfe and Tom Lyons, the
architects, were present, representing Gary Carlston, to request
a 7.6 foot height variance, where a maximum height of 20 feet is
permitted for an accessory building, for construction of a
caretaker dwelling unit above an agricultural accessory building.
Hazzard stated that each 500 acre parcel at Wildcat Ranch was given
multiple building envelopes during the 1041 Review process. Once
one 10 acre envelope is selected, the others are no longer
developable. The envelope that was chosen is at the widest point
of a narrow valley at the upper end of Wildcat Ranch and Wildcat
Reservoir. Hazzard explained that various physical constraints
affected their choice of a building envelope, and their choice of
the developable area within the envelope they chose. The County
Land Use Code requires that they maintain existing drainage ways
and patterns, in order to minimize sedimentation of the lake and
minimize disturbance to wildlife areas. Within the l0 acre
envelope that was chosen, the developable area is restricted by the
major drainage way that goes through the bottom of the valley,
which has been identified as a riparian and waterfowl habitat in
the Wildcat Ranch wildlife enhancement and managment plan (internal
restrictions). The requirement for a 20 foot setback from Wildcat
Creek also restricted the developable area. The envelope also
contains bands of trees that they would like to maintain, and much
of the remaining area of the envelope is on 20-25~ cross slopes.
Hazzard also stated that only two houses are currently within a
quarter of a mile of this structure, and the structure will not be
visible to them, or from any of the private roads in Wildcat Ranch.
The owner is currently requesting a new access on an old irrigation
ditch, which will keep vehicles out of the valley floor, thereby
creating less of a disturbance.
There was no public comment.
Guy noted that the height limit for accessory structures only
recently increased from 12 feet to 20 feet. He asked what hardship
required that this structure exceed the 20 foot limit.
Wolfe stated that the structure is very slender and only one room
wide so as to fit into the surrounding aspen trees, as well as to
respond to the physical characteristics of the aspens. He noted
that the structure would not create any negative impacts. The
caretaker unit is only 700 square feet, and they decided to
minimize the footprint and build a three story structure.

Hazzard noted that they considered locating the third floor over
the garage area, but they were concerned about fumes from the
garage, which will be used for equipment and materials storage.
Wheeler stated that he did not see the hardship involved, and noted
that design alone is not a hardship. Guy added that 25$ slopes are
not considered a topographical hardship in this county.
Wolfe stated that the Board should consider the context of the lot;
this structure is being built on a 500 acre lot, which creates
different relationships which would not be found elsewhere. He
added that the structure will not harm anyone.
Guy read from Section 16-1.3 of the County Land Use Code,
concerning the Powers and Duties of the Board of Adjustment:
"Where by reason of exceptional narrowness, shallowness or
shape of a specific piece of property at the time of enactment
of zoning regulation, or by reason of exceptional topographic
conditions or other extraordinary or exceptional physical
characteristics or condition of such piece of property not
created by the applicant subsequent to the adoption.,of these
regulations, the strict application of any zoning regulation
would result in peculiar and exceptional practical
difficulties to, or exceptional and undue hardship upon, the
owner of such property, then the Board shall have authority
upon an appeal relating to said property, to authorize a
variance from such strict application so as to relieve such
difficulties or hardship, provided such relief may be granted
without substantial detriment to the public good and without
substantially altering or impairing the intent and purpose of
the zoning district regulations and the policies and
regulations of this Code."
Hazzard asked the Board to consider that there are extraordinary
or exceptional physical constraints or conditions on the property
that relate to topography.
Guy noted that the structure causes no detriment to the public
good, but that being limited to only 3.5 acres of a to acre
building envelope for development is not a hardship that would
require exceeding the height limit by almost 30$.
Cooper disagreed, noting that the developable areas available to
the applicant were limited by the topography, and stated that he
felt the lot displays the "exceptional physical characteristics...
not created by the applicant" that are referred to in the Code.
Guy stated that there are ways to achieve the same feeling with the
structure without three stories. Wheeler agreed, noting that there
are also ways to site this particular structure in order to lower

its height.
At the applicant's request, Wheeler moved to table the application
to the March 2, 1993 meeting. Dyer seconded the motion, and all
were in favor.
Case 93-03_, Stephen and Heather Isberian. Lot 21. Holland Hills
Subdivision
Stephen and Heather Isberian and architect Varouj Hairabedian were
present to request a 36 foot front yard setback variance for an
addition to an existing house, and a 70 foot front yard setback
variance for a garage, where a 100 foot front yard setback is
required in the AF-1 zone district.
Hairabedian stated that the existing residence has become too small
for the family.
Isberian noted that they need the garage for storage space because
everything is now stored outside. He added that the owners in
Holland Hills approve of improvements, such as garages, which
improve the appearance of the subdivision.
Guy stated that AF-1 zone district requires a l0 acre lot, and that
the lot is closest in size to conforming lots in the R-30 zone
district (30,000 square foot lots), which requires a front yard
setback of 30 feet.
There was no public comment.
Cooper moved to grant a 36 foot front yard setback variance for an
addition to an existing house and a 70 foot front yard setback
variance for a garage, due to downzoning, as per the plans
submitted. Wheeler seconded the motion,•and all were in favor.
The January 5, 1993 minutes were approved as written.
The meeting was adjourned at 6:3o p.m.
