The existing residence was built before the setback line was established and any addition fo this building would be difficult to build due to the fact that the existing house is not parallel to the setback line. 2. If the addition was built behind the setback line there would be an undue damage to the riparian habitat. 3. I feel that it is prudent to build the addition as far above the mean high water mark as is reasonable. 4. As the property falls away from the back of the existing house and the proposed addition, it would be an economic hardship to construct the addition on the slope rather than on the relatively level land to the front of the property. C1erL::, Doc ~.Oq RESOLUTION OF THE PITRIN COIINTY~ COLORADO BOARD OF ADJIISTMENT GRANTING SETBACK RELIEF FOR JACK AND ANNERE DEPAGTER RESOLUTION NO. 93-06 WHEREAS, Jack and Anneke DePagter, owners of 0217 Harbour Lane, are requesting approval for a 12 foot front yard setback variance on the north side of the house for construction of an addition to an existing single-family residence; and WHEREAS, a 30 foot front yard setback variance is required in the R-15 zone district; and WHEREAS, the subject property is within the unincorporated area of Pitkin County, Colorado, (as described in Exhibit "A", attached); and, WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 16-1.3, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Board of Adjustment makes the following findings: 1. Case 93-05. Robert F. Leonard. Lots 10. 11 & 12. Block 5. Kistler Subdivision This case was tabled at the meeting on April 6, 1993. Schaffner stated that the outstanding planning issues have not yet been resolved, and requested that the case be tabled to the June 1, 1993 meeting. Gull moved to table this application to the June 1, 1993 meeting. Dyer seconded the motion, and all were in favor. Case 93-07. Willoughby Ponds Trust. Lots 5 and 7. Willouahbv Ponds Subdivision Schaffner stated that the applicant requested that this case be tabled to the June 1, 1993 meeting because the public notice sign was not posted. Nasser Sadeghi, a neighbor, was present, and stated that he would like to see specific plans for the gate before the June 1, 1993 meeting. Schaffner stated that several neighbors stated their opposition to the gate at the County Planning and Zoning Commission meeting. Dyer moved to table this application to the June 1, 1993 meeting subject to the receipt of plans concerning the proposed ranch gate by May l0, 1993. Cooper seconded the motion, and all were in favor. 1 000':,2 Case 93-06, Jack & Anneke DePaater, 0217 Harbour Lane This application was tabled at the April 6, 1993 meeting. Jack and Yasmin Simmons were present, representing Jack and Anneke DePagter, to request a 17 foot front yard setback variance on the south side of the house and a 12 foot front yard setback variance on the north side of the house, where a 30 foot front yard setback is required in the R-15 zone district, for construction of an addition to an existing single-family residence. Simmons stated that they met with with the representatives of the Villas of Aspen after the last meeting to discuss their concerns. He noted that the Villas representatives were concerned about development on the south side of the property, but that no development is planned for that side of the property at this time. No objections were received by the Zoning Office from any of the neighbors. Neiley stated that the property is impacted by topographical hardships which justify granting a variance. Gull moved to grant a 12 foot front yard setback variance on the east side of the lot for an addition on the north side of the house due to topographical hardships. Dyer seconded the motion, and all were in favor. Case 93-08, Pam & Tom Tweed, 2122 Lower River Road Pam and Tom Tweed were present to request a 31 foot front yard setback variance, an 8 foot east side yard setback variance, and a 5 foot west side yard setback variance, where 100 feet, 30 feet and 30 feet, respectively, are required in the AF-1 zone district, for construction of two additions to an existing residence. Tom Tweed stated that the house was built 30 years ago and that the lot is nonconforming. The major encroachment of the addition will be on the on east side. He noted that the lot is less than 1 acre in a minimum l0 acre zone district, and that the surrounding lots are all much larger. There was no public comment. Neiley noted that the R-30 zone district would be the closest conforming zone district with a required 30 foot front yard setback and 15 foot side yard setbacks. 2 000023 Neiley moved to grant a 31 foot front yard setback variance, an 8 foot east side yard setback variance, and a 5 foot west side yard setback variance, on the basis of the narrow size of the lot and downzoning, based on the plans submitted. Robert Leonard and Harold Leonard were present to request a 189 square foot increase in floor area, where a maximuan of 2,500 square feet is allowed, for construction of a single-family residence. Francis Krizmanich, Zoning Administrator, stated that the Zoning staff discovered this afternoon that the three lots owned by Robert Leonard were split from other merged lots without subdivision exemption approval. Krizmanich noted that the issue needs to be discussed with the County Attorney, and that the applicant may need to go through the lot separation process. He requested that the application be tabled to the next meeting of the Board. Robert Leonard agreed, and requested that the Board table this case to the May 4, 1993 meeting. Gull moved to table the application to the meeting on May 4, 1993 at the request of the applicant. Dyer seconded the motion, and all were in favor. Case 93-06, Jack & Anneke DePaater. 0217 Harbour Lane Jack Simmons and Yasmin DePagter were present, representing Jack and Anneke DePagter, to request a 17 foot front yard setback variance on the south side of the house and a 12 foot front yard setback variance on the north side of the house, where a 30 foot front yard setback is required in the R-15 zone district, for construction of an addition to an existing single-family residence. DePagter stated that the house was built in 1962 within the 1 OQ~~~J setbacks. To construct an addition to the house without a setback variance, they would have to build on the bank of the river. They chose to construct the addition on the front side of the house because they did not want to encroach on the river, nor to destroy any of the trees by the river. Nancy Henricks, Vice President of the Board of Directors of the Villas of Aspen Homeowners' Association, and Tim Pettit, manager and unit owner at the Villas of Aspen, were present to represent the concerns of the Homeowners' Association. Schaffner clarified that the setback variance requests are both from the east {front) lot line. The original public notice that was sent to the adjacent owners stated the variance request incorrectly, and was replaced by a revised notice. Simmons noted that a building envelope was established through the 1041 Hazard Review process, and that the approved envelope has more FAR than is being proposed for this addition. Pettit stated that they are preparing a conceptual plan for the renovation of the Villas, and that they are considering subdividing their property that is adjacent to the DePagter's house to finance the improvements. He noted that the driveway the DePagters use is on property owned by the Villas (North Texas Mill site), and is part of the land they may try to subdivide. He stated his concern that the proximity of the DePagter's addition could impact the value of their property. He requested a tabling of the review of the application until they can meet with the DePagters. He also wanted to meet again with the Board of Directors of the Villas because they had the incorrect public notice when they originally discussed the DePagter's request with their Board. Simmons noted that the DePagter's property is in the County and that the North Texas Mill site owned by the Villas is in the City, and that the County setback requirements for their property are more restrictive than the setback requirements for the surrounding City properties. Neiley stated that the property displays topographic hardships, and that the Board makes decisions based on a hardship. The Board can consider the concerns of the Villas, but cannot consider how the variance would impact what the Villas might want to do with their property in the future. Dyer asked if the DePagter and the Villas have an access agreement for the driveway that the DePagters use. Simmons replied that they do not have a formal access agreement, but that the access appears on the deed. Dyer moved to table the application to the May 4, 1993 meeting at the request of the applicant. Wheeler seconded the motion, and all 2 ~~U~2s ~_ C~ were in favor.
