HomeMy WebLinkAboutpitkin.boa.01.24 RESOLUTION OF THE PITKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING A 10 FOOT REAR YARD SETBACK VARIANCE FOR JACQUES AND MICHELE STOERR Resolution No. Ol- 24 WHEREAS, Jacques and Michele Stoerr, owners of 0401 Light Hill Drive, are requesting a ten foot rear yard setback variance for the construction of asingle-family residence; and, WHEREAS, a thirty foot reaz yard setback is required for this .79 acre parcel in the R-30 zone district; and, WHEREAS, the subject property is described as Lot 4, Block 2, Filing 3 of the Gateway to Snowmass Subdivision; and, WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hazdship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfaze and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE TI' RESOLVED by the Boazd of Adjustment, that a 10 foot reaz yazd setback variance be granted for the construction of asingle-family residence as presented on Exhibits A and B, due to topographical hardships. WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. The Resolution was adopted by vote of the Board of Adjustment of the County of Pitkin, State of Colorado. MINUTES Of the Pitkin County Board of Adjustment Tuesday, November 6, 2001 Pitkin County Courthouse Members Present: Michael Cooper, Chair Bob Throm Deanna Olsen Members Absent: Jim Rifkin Jack Hunt Rick Head Staff Present: Joanna S. Schaffner, Zoning Officer and recorder Michael Cooper called the meeting to order at 5:31pm. All members of the public that were present were asked to sign in. I. NEW BUSINESS: Architect, Mark Mahoney was present representing Jacques and Michele Stoerr, who are seeking a 10 foot reaz yard setback variance where 30 feet is required on their .79 acre lot in an R-30 zone district. The Stoerr's own Lot 4, Block 2, of the Gateway of Snowmass Subdivision. Schaffner introduced the application, identified the lot on the plat and explained that the covenants require a 20 foot reaz yard setback. The architect designed the proposed residence to comply with a 20 foot setback, not realizing that 30 feet was required by zoning. Mr. Mahoney explained that there was a natural bench on the site. The house is proposed to be located on this bench. To move the house higher will increase engineering costs and result in a steeper driveway. The Homeowner's Association and immediately adjacent neighbors were supportive of the request as evidenced by letters to the file and their presence at the meeting. Present were Susan Harvey and Doug MacKenzie of Lot 5, John M. Bruegger of Lot 3 and Eric Carman of Lot 6. Ms Harvey and Mr. MacKenzie offered their support. Mr. Bruegger stated that he would look over the top of the house in its proposed location. If it were any higher on the site, it would block his view towazds Ruedi. Mr. Carman stated that all walked the site and agreed that the bench is the best place for the house. There were no questions by the Boazd. ~o~~~~J Throm moved to approve the variance request as submitted due to a topographic hardship. Olsen seconded the motion. Members Throm, Olsen, and Cooper voted unanimously in favor of the motion. Old Business: The Board requested that Board members call staff to affirm that they CAN make the meeting rather than if they cannot make a meeting. The Board reviewed and approved the minutes of the October meeting as prepazed. The Board was to elect a new Chair at this meeting, however, due to lack of attendance, the election was postponed until next month. Olsen stated that she did not care to be Chair, and Throm also did not wish for the position since he will be absent at the January, February, and March meetings. Throm offered his support for Rifkin, siting his experience and knowledge. Cooper asked if Rifkin was the next senior member? Staff did not know. Throm also suggested that the Board consider a co-Chair to act when the Chair is not present. Olsen and Cooper thought this was a good idea. The meeting was adjourned. The reason for the request is due to hardship caused by existing topography. Pitkin County Code Section 7-10-030 specifies that a vaziance may be granted where by reason of unusual topographic conditions, the application of the setback requirement would result in peculiar difficulties or undue hardship. The topography of the site is such that to build in the setback would require that the applicant invade a steeper slope area. This will result in additional design and implementation strategies for the foundation of the building. The slope invasion and related design and implementation issues are unnecessary and can be mitigated by allowing the building to be placed outside of the setback are only to the extent originally designed for the subdivision. As many of the homes are built according to the older setbacks, the variance would not create a result inconsistent with the neighborhood. In addition, the comprehensive plan encourages development in areas containing less severe slopes. If granted, the variance would not result in any substantial detriment to the public good. This is underscored by the vocal support of this application by all of the adjoining neighbors. Thank you for your consideration in this matter.
