HomeMy WebLinkAboutpitkin.boa.01.10C~ RESOLUTION OF THE PITKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING A SETBACK VARIANCE FOR NANCY BELL COE Resolution No. 01-10 WHEREAS, Nancy Bell Coe, owner of 1261 Juniper Hill Road, is requesting a 10 foot west side yard setback variance for the construction of a detached garage; and, WHEREAS, a 20 foot side yard setback is required for this 2.09 acre pazcel in the AFR-10 zone district; and, WHEREAS, the subject property is described as Lot 3, Filing 2, Brush Creek Village Subdivision; and, WHEREAS, the Boazd of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised Statutes,1973,30-28-118(2)(C);and, WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfaze and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment, that a 10 foot side yard setback variance be granted for the construction of a detached gazage as presented on Exhibits A and B due to a topographical hazdship. WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. I{rabacher left the meeting. 01-10 Coe, Nancv Bell: Lot 3. Filing 2 Brush Creek Village AKA• 1261 Juniper Hill Dr Requesting a 10 foot side yazd setback variance where 20 feet is required to construct a garage on this 2.09 acre pazcel in the AFR-10 zone district. Cooper noted that he resides in Brush Creek Village, that he is on the Metro Board, as well as the land owners association. He offered to step down if the Board so desired. It was agreed that Cooper would remain. Schaffner presented a brief summary as outlined above. She noted the location of the property. Schaffner noted that the applicant is proposing a detached gazage, and stated that there is currently a 30 foot access easement that the neighbors are working towards vacating. Because the garage is located within the easement, the vacation must occur before a permit can be issued for the garage. Nancy Bell Coe introduced herself as the homeowner. Simon Elliott introduced himself as the applicant's representative and architect. Elliott presented a brief summary of the applicant's proposal. He stated that the reason for the proposal is to allow access to the area behind the residence for construction equipment and yazd maintenance, etc. He used photographs to point out the location of the proposed gazage as well as the mature vegetation in the area. He noted that if the gazage would be located outside of the setback and closer to the house, an egress window in the house would be blocked. Rifkin asked if any letters from adjacent neighbors had been submitted. Schaffner responded that she has not received any. Throm asked if the fug marshal has seen this access. Elliott responded that he has not. Throm asked if the utility company had been notified yet. Elliott responded that they have not because the garage does not encroach on their easement. Cooper stated that this would not affect anyone who lives in Bmsh Creek. Motion Rifkin moved to approve application 01-10, on the basis of a topographical hazdship as well as a hardship that presently exists if the variance isn't granted. This hardship is the window blockage that would occur and be in violation of the code. Throm seconded the motion. Members Rifkin, Throm, Cooper, Hunt and Olsen voted unanimously to approve application 01-10. 01-11 Johns Dan: Lot 1 Navlor Lot Split AICA• 26501 Highway 82 Snowmass OOOU05 • MINUTES • of the Pitkin County Board of Adjustment Tuesday, June 5, 2001 Pitkin County Courthouse Requesting a 5 foot, 130 foot, and a 67 foot Arterial Highway setback variance where 200 feet is required from the Highway 82 right-of--way for the construction of an addition to a single family residence, bam, and carport, respectively on this 36+ acre parcel in the AFR-10 zone district. Schaffner presented a brief summary of the application as outlined above. She noted the location of the property. Schaffner briefly discussed the history with the application stating that the applicant had originally been before the BOA, who approved a lazge berm in front of the residence as well as a detached garage. Schaffner stated that this is a Board approved subdivision. She stated that there is no building envelope, and pointed out the general area the applicant will be working in. Dan Johns introduced himself as the property owner. He presented a brief summary of the proposals stating that they have 36 acres. He noted the location of the river in relation to the residence. He discussed a previous property line adjustment and the setback lines. Johns stated that there was a mistake in the original survey. Cooper asked what the elevation is at the centerline of the road. Johns responded that the highway pavement is about 6 feet below the top of the bam ridge. Rifkin clarified that Johns also owned the property on the other side of the river and asked if there was another homeowner that would be impacted by this. Johns responded that there was not, because they are big pieces of property. There were no public comments. Johns continued with his presentation stating that they would like to build a storage bam. He noted the proposed location of the barn, which is in a group of cottonwood trees. He stated that the bam would be sheltered by the trees on either end and that they would add additional landscaping in the front for screening. He stated that they are requesting a 130 foot setback for the bam. Rifkin asked if there had been any objections from adjacent homeowners. Schaffner stated that she had not heazd from any. Riflcin asked if the BOA could request a landscape plan if the variance is granted. Schaffner responded that they could. Rifkin also stated that the color of the bam should be consistent with the color of the home. There was brief discussion on colors and screening that would be provided by a berm and trees. For the benefit of the BOA members, Johns pointed out the berm and [he existing and proposed trees on a map. Throm pointed out that he has known the owner for many yeazs. He stated that in his opinion it's better to see the barn from the highway than constrnction materials. There was brief discussion on the appeazance of the barn from the highway and the potential uses of the bam. Schaffner stated that pursuant to the definition in the land use code the structure is not considered a bam if it's being used for something other than agricultural purposes. Johns stated that they do not have horses, they need the barn for storage. Cooper asked if water and 240 electric aze proposed in the bam. Johns responded that they weren't. Olsen asked if they could locate the barn on the other side of the road. Johns responded that there really wasn't room. Johns responded that that was correct Motion• Rifkin moved that Case 01-11 be approved contingent upon the submission of landscape plans which reflects restoration of the cottonwoods to their current condition prior to construction and that there be landscaping of 8-12 Ft frees to shield the carport as well as 12-14 Ft trees for the barn. Olsen seconded the motion. Additional Discussion Schaffner asked if the BOA would like to table this until the applicant can come back with a landscape plan next month. Cooper asked if this would cause any undue hardship on the applicant. Johns responded that the only aspect he is anxious to proceed with is the addition to the house. He stated the barn probably would not be constmcted this year anyway. There was discussion among the BOA on how best to proceed with the approval. The BOA agreed that they should vote on the house, and defer the approval for the bam until the landscape plans are submitted. Amended Motion Rifkin amended his motion to approve the additon to the house based on the applicant's inability to build on the additional acreage without a vaziance. Cooper seconded the motion. Members Rifkin, Cooper, Olsen, Throm and Hunt voted unanimously in favor of the motion. Schaffner clarified that there was a motion to table the rest of the motion. Final Motion Rifkin moved to table the application for the carport and bam until the next meeting when a suitable landscape plan could be submitted. Cooper seconded the motion. Members Rifkin, Cooper, Olsen, Throm and Hunt voted unanimously in favor of the motion. All members agreed to meet again on July 1 Ith at 5:15. O1-12 Larson, Karl: Lot 4 Block 1 Filin 2 Brush Creek Village Requestmg front and side yard setback variances where 30 feet and 20 feet, respectively, are required, to constmct a driveway greater than 30 inches in height on this 2.142 acre pazcel in the AFR-10 zone district. For the record, Cooper reiterated that he lives in Brush Creek and would be willing to step down if the members thought it necessary. The members did not request that Cooper step down. For the record, Throm noted that he has been acquainted with the owners for a number of yeazs and offered to step down. The members did not request that Throm step down. Schaflher presented a brief summary of the application as outlined above. She noted the location of the property, noting that it is very visible from the intersection of Highway 82 and Brush Creek Road. Bruce Barth noted that they have gone through ridgeline review as well. Throm asked if that review was approved to which Barth responded yes. Schaffner noted that some revisions had been made as a result of speaking with Lance Clazke, the Assistant Planning Dtrector. She noted that although a Ridgeline review was required on this lot, per an intergovernmental agreement between Pitkin County and Brush Creek Village, the Planning Department had 30 days in which to review the application. The planner was unaware of the restricted timeframe and scheduled the application two or three months out. It was presented to the Hearing Officer anyway, at which point Planning's input was offered, but no longer required because of the missed deadline. The applicant did take staff's comments into consideration and made some changes. Cooper discussed the difficulty of the property due to where it is located. Rifkin asked if there had been any objections from adjacent neighbors. Schaffner noted that she received a phone call from neighbors asking what was going on, and she thought they might show up today, but they haven't. There was no other public comment. Motion: Cooper moved to approve Case 01-12 per the plans submitted due to a topographical hardship in that there is no other way to access the property. Rifkin seconded the motion. The Pitkin County Board of Adjustment Re Variance request for 1261 Juniper Hill Road The purpose of this submittal is to request aside-yard setback variance for 1261 Juniper Hill Road. The owner of 1261 Juniper Hill Road requested the design of a garage for the property not only to have the convenience of such a structure but also to bring the amenities of this property in line with the other homes in the area. The structure as located (see sheet A-1) is in the most desirable location on the property. The location of the garage requires a 10'-0" variance to the 20'-0" side- yard setback. The following hardships justify the request for a variance • If the structure is located in compliance with the setback it would block the only egress window from one of the bedrooms in the house, violating life safety codes. • The requested location of the structure allows for vehicular access to the North yard/garden. Vehicular access is required for the North yard/garden for construction machinery, machinery for the maintenance of the garden and utility company equipment. Use of the proposed access as opposed to the current utility easement will preserve mature vegetation on the adjacent slope. Destroying the vegetation on this slope will make the shale rich soil in this area even less stable. • The only other location for the garage would be in the North yard/garden. This, however, would also require a variance for the driveway access to the garage. Locating the garage in the North yard/garden is the least desirable location for both the owner and the surrounding community. In the North yard/garden the garage would block views for the owner, and would be far more visible and prominent from Juniper Hill Road. The location of the garage as proposed tucks the garage into an existing curve in the slope, allows for egress from the house, does not block access or views, and exposes the short side of the structure to the surrounding area therefore lessening it's visual impact.
