Ol-7 WinWin LLC 1231 Ute Avenue Aspen Requesting 75 foot and 100 foot front yazd setback variances where 100 feet are required for this 10+ acre parcel in the AFR-10 zone district for the construction of a single family residence, and driveway related improvements that exceed 30 inches in height. Schaffner provided a brief summary of the application noting the location of the property. She introduced Herb Klein and Bill Campbell, the applicant's representatives. Referencing a map, Klein pointed out the proposals for the property. Rick Head asked if there were any objections from surrounding neighbors. Ted Gazdenscwartz, representing a neighbor that had just recently received the memo due to an addressing error, stated that they haven't had a chance to review the request or proposals. He stated that the neighbor questions the validity of a hazdship and isn't sure if they will have an objection. Michael Cooper noted that typically when there are objections from surrounding neighbors the BOA isn't likely to approve the request. Klein responded that there are currently many people working on the project and it would be agreeable to table the application until the neighbors have had a chance to review it. There was brief discussion regarding schedules. Motion: Head moved to [able Case #01-7 until Friday, May 4. Throm seconded the motion. Members Head, Throm, Olsen, and Cooper voted unanimously in favor of the motion. Members Head, Olsen, Throm voted in favor of the motion. Member Cooper abstained from voting. Schaffner, Zoning Officer and Acting Secretary Mr. Cooper called the meeting to order at 10: loam. He explained to those in attendance that when only three Boazd members aze present, a unanimous vote is necessary for approval. Should the applicant believe that the application is about to be denied by the Boazd, they may choose to table the application to the next meeting when more/other Board members will be present. Case #Ol-7, Win Win, LLC Newfound Lode aka 1231 Ute Avenue Aspen This case was tabled from the May 1, 2001 regulazly scheduled meeting bacause a neighbor did not receive notice until Apri128. It is uncleaz why the notice was postmarked in New Orleans, LA. The Boazd agreed to allow the neighbor's representative an opportunity to review the application and asked the applicant to return to them at this meeting. Schaffner briefly re-introduced the application to the Board. Attorney, Herb Klein and azchitect, Bill Campbell were present to represent the applicant. Attorney, John Kelley was present to represent neighbors, Rappaport (Lot _, Hoag Subdivision), Coleman (Lot 4, Hoag Subdivision), and I.G. Davis Jr. (Lot 2, Hoag Subdivision). There were no members of the public present. Kelley began by apologizing to the Board and the applicant's representatives for being out of town for Tuesday's meeting and for causing the Boazd to convene for this Special Meeting. He suggested that the Boazd recommend to the Boazd of County Commissioners (BOCC) that a seven day notice period does not allow sufficient time, especially in Aspen during low-season when many aze out of town. He expressed disappointment that neighbors (indeed the whole neighborhood) did not receive notice of the Takings meeting, and suggested that noticing be extended to every property owner within 300 of the subject site instead of just to adjacent property owners. This is what the City of Aspen requires for their Boazd of Adjustment public notice. Kelley stated that he will not object to the application because he believed that if the Board of Adjustment were to deny this application today the applicant would appeal to OOOOIr~ Minutes Pitkin County Board of Adjustment Special Meeting May 4, 2001 the Board of County Commissioners, whom he believed would approve the variance request since it was the BOCC that ultimately approved development on this pazcel though the Takings process. The Board agreed that this circulaz path to approval was not efficient. Klein reminded the Board that the State does not grant the BOCC the authority to grant zoning variances except on appeal. Therefore, the "circular process", although not efficient, is correct. Head moved to approve the application due to a topographic hardship. Olsen seconded the motion and it passed 3-0. Cooper moved to adjourn the meeting. Head seconded and all were in favor. Klein, Esq., on behalf of Win Win LLC, (the "Applicant") with respect to its property located at Newfoundland Lode Mining Claim M.S. 5190 (the "Property"). The Property has obtained 1041 Hazard review approval pursuant to BOCC Resolution #99-186, a copy of which is attached at Exhibit 1. The Property is in the AFR-10 zone district which requires a fifty foot front yard setback. The Applicant is submitting this application for a front yard setback variance from fifty (50) feet to twenty-five (25) feet for the residence and zero (-0-) feet for a parking area and fire department mandated turn-around area and for the ability to alter the grade within the set back by more than 30 inches. The Property is located adjacent to the boundary of the City of Aspen and is accessed from Ute Avenue. The entirety of the Property is a steeply sloping hillside with slopes in excess of 30%. A specific building envelope was approved by the BOCC that sits at the lowest portion of the Property within ten feet of its property line. The closest projection of the residence will be approximately 25 feet from the property line, however, the Property shazes a fire department mandated turn-around area with its neighbor and the support and retaining improvements for this turn-aoound straddles the common lot line of the Property and its neighbor, Lot 3, Hoag Subdivision. Due to the severely sloping topography of the site, the limited access way and the location of the building envelop imposed by the County's 1041 regulations, a hardship exists. The Property cannot be utilized for any reasonable use without the variances requested.
