RESOLUTION OF THE PITKIN COUNTY, COLORADO
BOARD OF ADJUSTMENT
GRANTING A SETBACK VARIANCE
FOR THE ASPEN/PITKIN COUNTY AIRPORT
Resolution No. 01-06
WHEREAS, Pitkin County, owner of the Aspen/Pitkin County Airport, is requesting a 125 foot
Arterial Highway setback variance for the construction of aircraft patio shelters; and,
WHEREAS, pursuant to Section 3-050-020 A and C of the Pitkin County Land Use Code, 200 feet
is required from the Highway 82 right-of-way; and
WHEREAS, the Boazd of Adjustment is vested with the power to grant or deny such variances by
virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised
Statutes, 1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following
findings:
1. Proper notice procedures, including the notification of all adjoining property owners, has been
shown by the applicant.
2. The required hazdship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment to the public welfaze and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Boazd of Adjustment, that a 125 foot Arterial
Highway setback variance be granted for the construction of aircraft patio shelters as depicted on
the plans on file in the Community Development Department file, due to topographic constraints
and FAA downzoning.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation.
The Resolution was adopted by vote of the Board of Adjustment of the County of Pitkin, State of
Colorado.

Old Business: Amending BOA case 99-32 (Blechman) ~`'
Schaffner gave a brief summary of the application, noting the location of the property on
Red Mountain. She stated that this application was previously before the BOA in 1999
for vaziances from the Collector Street setback, which is a 50-foot requirement from Red
Mountain Road. The applicant did receive approval to exceed 30 inches within the
setback. They have redesigned the retaining wall to make it less impactive and allow for
greater landscaping and the retention of native vegetation. Schaffner explained to the
members that they could require the applicant to make a complete application for public
heazing, or, if they believe the changes aze minor enough they could reflect their approval
through the minutes of this meeting. She added that in terms of wall design she felt this
to be a minor amendment. The conditions on the site are the same and the BOA had
previously found a topographic hazdship.
Michael Moore, the applicant's representative, referenced a map provided to point out the
retaining wall, regrading and the azeas that aze left undisturbed. He specifically noted the
changes in height stating that the wall needed to get higher and still grade back to the
property line. Moore stated that they have slightly changed the shape of the wall and
brought landscape elements azound to integrate the wall into the landform. He noted that
with this concept they aze retaining most of the existing vegetation versus cleaz-cutting
the lot. He reference the elevation that shows the wall is behind the residence as
therefore isn't visible from Hwy 82.
There was discussion on the overall height of the wall. Head suggested that it was the
decrease in disturbed vegetation that was more significant.
Motion: Bob Throm moved that the plan as submitted is acceptable, of less intrusion into
the natural site.

Rick Head asked if there were any objection neighbors. Schaffner responded that there
were not.
Motion Continued: Rick Head seconded the motion. Members Throm, Head, Cooper,
Krabacher, Olsen and Hunt voted unanimously to approve the motion.

Requesting a Major Road setback variance where 100 Feet is required from the East
Highway 82 right-of--way for the construction of a new duplex.
Schaffner pointed out that the applicant was not present for the meeting. She stated that
there were people from the public present to speak on the application. She suggested that
one option the BOA had was to hear the public, in case the applicant were just late,
instead of tabling until the next meeting.
Krabacher noted his disapproval that the applicant didn't show for tonight's meeting, and
noted his sympathy for the neighbors that did take the time to show up. All members
present appeared to be in agreement with this. There was discussion on how to
appropriately proceed. Krabacher suggested that they simply deny the application and
make the applicant come back at a later date. Schaffner pointed out that if they did that
the applicant would be unable to bring this application back for a yeaz.
Julie Wyckof, an adjacent neighbor, stated that she would just like to go on record and
stated that she opposed the application. She also added that there has been no
cornmunication between the applicant and the neighbors.
Richazd Haberman, azchitectural design committee, was also present for this meeting. He
noted that he would be in favor of the application being denied because the applicant
didn't show. He also asked if the applicant had had any contact with anyone. Schaffner
noted that Stan had called her to let her know she wouldn't be there.
Krabacher pointed out that they don't typically approve an application if there aze
opposing neighbors. He also noted that he realizes it's difficult for neighbors to keep
reappearing for the application.
There was further discussion regazding the appropriate process. The members agreed
that the application should be tabled.
Haberman stated that he had no problem being present for the next meeting and noted
that he hadn't seen any additional plans from Stan.
Motion: Krabacher moved to table Case 01-5 until next month. Michael Cooper
seconded the motion. Throm suggested that they note if the applicant doesn't show the
next time the application should be denied. Krabacher accepted the amendment.

Requesting a 12~ foot Arterial Highway setback vaziance where 200 feet is required from
the West Highway 82 right-of--way, for the construction of 18 patio aircraft shelters.
Cooper noted a possible conflict with the application in that he is a pilot, flight instructor
and owner of 1 /8 of an airplane. He stated that he is unlikely to be a beneficiary of the
patio hangers. Cooper stated that he would participate in the discussion but that he
wouldn't chair this portion of the meeting or vote. Cooper appointed Olsen as acting,
temporary chair.
Schaffner summarized the application and pointed out the location where the applicant
wishes to place the patio hangers, a portion of which is in the 200-foot setback from the
highway. Shaffner noted that the applicant has received approval from the BOCC to
place the shelters at a height that will be measured from the new grade.
Gary ?, the applicant's representative, stated that the height at the high end (down valley
end) of the property is proposed to be 18 feet from the new grade. Gary noted that
historically there has been a modification of standazds to allow aircraft to be pazked
closer than 400 feet to the runway centerline. With a change in policy the FAA has
rescinded that standazd to get everything behind the 400-foot line. He discussed vazious
options the applicant considered and stated that this was the least intrusive way of
covering the aircraft.
Regazding landscaping, Gary stated that they've minimized the structures down to the
thinnest dimension possible and angled them slightly towazds the highway. He stated
that they've modified the corner several times to provide screening. Shannon? discussed
the native shrubs and trees that they've chosen for screening.
Head asked why the applicant wasn't using evergreens, which could provide screening all
yeaz round. Shannon responded that they've chosen the vegetation that's native to that
azea, which is the really dry vegetation such as scrub oak, service berry and sage. She
added that the BOCC has asked the applicant to work with Jonathan Lowsky, county
wildlife biologist, to come up with a plan that maximized screening and is appropriate to
the Eco system.
Throm asked if the patio structures were for rent. Gary responded that technically they
were for rent. The County has made an arrangement with the local pilots association,
which is more like along-term lease. He stated that this isn't a revenue generator; the
County is simply trying to recover the cost of putting the structures in.

Requesting a 30-foot front yard setback where 30 feet is required for this .38 acre parcel
in the AFR-10 zone district, for the construction of asingle-family residence.
Schaffner summazized the application and noted the location of the site. She stated that
the applicant has received 1041 approval. The building envelope is situated on top of the
slope and to the front of the property. The applicant must cross the Rio Grande right-of-
way to access their property and is requesting a zero lot line for the proposed residence.
David?, the applicant's representative, stated that this is a topographic hazdship based on
the fact that the 1041 established a building envelope that is zero lot line in the front. The
applicant is subject to the county setback for front yazd, which will essentially cut the
building envelope in half. They aze asking for relief from the county setback.
There were no public comments.
Krabacher asked if the setback was a 20 or 30 foot requirement. Schaffner clarified that
it is a 30 requirement.
Throm asked how lazge the house is. David? responded that it's about 3800 Sq. Ft.,
conforming to all of the other pazcels on that stretch of the river. He stated that the
applicant is constrained by the 100-yeaz flood plane as well as a 50-foot setback that
controls where the septic system can be.
Krabacher asked if this was a vacant lot. David? responded that it was. He stated that the
lot was shaped funny and is angled towazds the middle of the river. He stated that the
septic system encroaches more on the building envelope because of this.
Motion: Olsen moved to approve based on hazdships relating to 1041 and railroad
setback requirements and general site conditions. Throm seconded the motion. Members
Olsen, Throm, Cooper, Head, Hunt and Krabacher voted unanimously in favor of the
motion.

Patio Shelters
Tamara - In accordance with the Pitkin County Board of Adjustment Requirement List, this letter
is provide to describe why a vaziance is requested to allow for the construction of Patio Shelter
Roof Structures within the 200 foot highway setback at the Pitkin County Airport. This
application is a follow-up to a variance application made last yeaz that relocated the pazked
aircraft to the same location (resolution 00-06) and I believe that the intent to submit this
application was discussed at that time.
Project Background/Description:
In 1998 the Federal Aviation Administration informed the Airport that it was their intent to
revoke a modification of standards that had historically allowed aircraft to be parked in areas
closer than 400 feet trom the runway centerline. This area within 400 feet of the runway center
line is referred to as the Runway Object Free Area (ROFA) and is kept cleaz of obstructions to
provide a clear safety area for arriving and departing aircraft. Also in conjunction with this
action the distance between the runway centerline and the taxiway center line was also to be
increased to meet FAA standazds. The result of these actions was to compress the available area
for aircrafr pazking between this ROFA line and the setback line for Highway 82.
To accommodate this action a project was undertaken in 2000 to relocate the general aviation
aircraft pazking ramp to the east so that all of the locally based private aircraft could be pazked in
areas meeting the FAA ROFA standard. This resulted in the easternmost row of aircraft and the
airport security/wildlife fence being located within the highway setback. In eazly 2000, land use
and vaziance applications were submitted and ultimately approved for these changes. The
relocation of the fence has been completed and the construction of the replacement aircraft ramp
will be completed in the Spring of 2001.
Historically over the years, there have been repeated requests by the local pilot community to
develop a program to provide hangazs for the locally based aircrafr. In addition to the
maintenance issues related to keeping aircrafr in an uncovered location, there are safety and
environmental issues related to the build-up of snow and ice on the aircraft during the winter
months and the need to de-ice those aircraft prior to flight. There were concerns about the visual
mass of a lazge number of enclosed hangar buildings so it was determined that the construction
of carport type patio shelters would be pursued as a alternate solution.

Design of the structures was begun in mid 2000. The design philosophy used was to minimize
the structure to the greatest extent possible and to step the structure down with the slope that
exists on the aircraft ramp. The roofs were also sloped down towazds the highway to reduce the
visual mass of the roof plane since a person's angle of view from the highway will be from below
the elevation of the structure. The design was submitted for special and scenic review and
approval was recommended by the Planning and Zoning Commission on February 20'" and
approved by the Board of County Commissioners on February 28'" of this yeaz. Per the direction
of the Community Development Department submission to the Boazd of Adjustment was not
made until the project had been reviewed by those entities.
The project proposes to construct roof structures, without sidewalls, over 53 of the 88 aircraft tie
down locations. This application requests a variance for the eighteen spaces located at the
eastern edge of the aircraft parking ramp. At the southern end of the row a maximum setback
variance of 62 feet is required. As you move to the north the required variance reduces to
approximately 40 feet.
Hardship:
The location of the airport between the hills to the west and highway 82 on the east results in
minimal flat topography available for aircraft operations and associated airport development.
FAA regulations with respect to minimum distances between runways and aircraft pazking and
between runways and structures further limits azeas for these functions. There are a total of 88
aircraft tie down locations currently approved for locally based aircraft at the airport. Although it
would be desirous to cover the majority of those spots, the 35 tie downs located closest to the
runway cannot be covered due to their proximity to the runway. Aircraft can be pazked so long
as they are no closer than 400 feet from the runway centerline but structures are covered by more
stringent regulations. The next double row of 35 aircraft located to the east of the first row are
proposed to be covered and do not require a variance since they aze beyond the 200' highway
setback. The remaining 18 aircraft in the eastern row all lie within the setback as noted above.
Due to the eastern row being a single row it provides some necessary flexibility in
accommodating aircraft of different size and type that cannot be accommodated in the double
row so covering those spots is extremely important. Although it might have been technically
possible to relocate those aircraft outside the setback by continuing the double row ftirther to the
north it was determined at the time that the aircraft pazking was approved that the location within
the setback would be of lesser impact than extending the pazking ramp another 600 to 800 feet to
the north. It also resulted in a more efficient use of the limited land azea since the double and
single row both utilize the same access lane.

Impacts:
Although the structures will be visible from Highway 82, various measures have been taken to
reduce the visual impact to persons traveling along that route. It is also noted that the roof
structures will provide a certain amount of organization to the aircraft that aze already approved
to be located within the setback. As noted above, the thickness of the roof structure has been
minimized to reduce the visual profile. The eave thickness will be approximately 14" and the
total structure depth will be approximately 22". The roofs aze sloped in the same direction as a
person's angle of view to also reduce the mass that is perceived. This slope also results in the
lowest eave heights being closest to the highway. The roofs are stepped down at regulaz
intervals to both keep the height down and to break up the line of the fascia. No lighting is
proposed to be installed anywhere on the underside of the roofs so these structures will be dark at
night. Finally, a landscaping plan has been developed to provide some level of screening
between the highway and the structure locations. A number of cottonwoods groupings aze
proposed to be planted adjacent to the highway right-of--way fence. With these located relatively
close to the highway, they will provide screening of both the structures and aircraft as one looks
up to the aircraft ramp. Behind the cottonwoods on the slope, groupings of sage, serviceberry or
similar native plantings will be used to draw your eye away from the structures and will provide
some screening of the aircraft.

901-2.1 SEED The species and application rates of grass, legume, and cover-crop seed
furnished shall be those stipulated herein. Seed shall conform to the requirements of Fed.
Spec. JJJ-S-181.
Seed shall be furnished sepazately or in mixtures in standard containers with the seed name,
lot number, net weight, percentages of purity and of germination and hard seed, and
percentage of maximum weed seed content cleazly mazked for each kind of seed. The
Contractor shall furnish the Engineer duplicate signed copies of a statement by the vendor
certifying that each lot of seed has been tested by a recognized laboratory for seed testing
within 6 months of date of delivery. This statement shall include: name and address of
laboratory, date of test, lot number for each kind of seed, and the results of tests as to
name, percentages of purity and of germination, and percentage of weed content for each
kind of seed furnished, and in case of a mixture, the proportions of each kind of seed.

A FENCE EXCEEDING SIX FEET IN HEIGHT, TEMPORARY PARKING FOR
CONSTRUCTION TRAILERS' AND THE COMPLETION OF EARTHMOVING FOR
THE APRON RELOCATION
Resolution No. 00-06
WHEREAS, Pitkin County, owner of the Aspen Pitkin County Airport located at 0233 Airport
Road off of Highway 82, is requesting approval of Arterial Highway Setback Variances for
relocation of a fence exceeding six ft in height, temporary parking for construction trailers and the
completion of earthmoving for the apron relocation; and
WHEREAS, 200 feet is the minimum allowed setback from the Highway 82 Right-of Way and 6
feet is the maximum allowed height for a fence within a setback; and `
WHEREAS, the Boazd of Adjustment is vested with the power to grant or deny such variances by
virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised
Statutes, 1973, 30-28-118(2) (C); and.
WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following
findings:
1. Proper notice procedures. including the notification of all adjoining property owners. has been
shown by the applicant.
2. The required hazdship or practical difficulty has been established.
3. Granting such relief will not cause substantial detriment tc the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE. BE IT RESOLVED by the Board of Adjustment that Arterial Highway
Setback Variances be granted for the relocation of a fence exceeding six feet in height, temporary
pazking for construction trailers and the completion of earthmoving for the apron relocation as
shown on the attached plans (Exhibits " A " & "B"), due to FAA down-zoning.
WARNING: Any violation of the terms of this resolution may result in rehearing and possible
revocation. y
The Resolution was adopted by vote of the Boazd of Adjustment of the County of Pitkin. State of
Colorado.

COLORADO, GRANTING SCENIC OVERLAY AND SPECIAL REVIEW TO THE PITKIN
COUNTY AIIiPORT FOR PATIO SHELTERS

RECITALS
l . The Board of County Commissioners of Pitkin County ("Applicant"), as owner of the Pitkin County
Airport, has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") for the
following approvals:
1) Scenic Overlay and Special Review approval for the construction of covered port strrctures
("patio shelters") over the privately owned aircraft parked on the north ramp area of the airport.
2) Approval to allow the temporary aircraft pazking area approved pursuant to Resolution No. 043
2000 to remain until the patio shelters are constructed This area will provide a location for the
temporary relocation of the aircrafr during the construction period.
3) Approval for the location of the 5,000 square foot T-Hanger to be eliminated without
eliminating the approval for the square footage.
2. The Planning and Zoning Commission ("Commission") at regularly scheduled meetings on
February 6, 2001 and February 20, 2001, reviewed the application, and a recommendation of approval was
forwarded to the BOCC with conditions.
3. The BOCC heard this application at a duly noticed public hearing on February 28, 2001, at which
time evidence and testimony were presented with respect to this application.
4. The BOCC finds that the Applicant's proposal complies with the Pitkin County Land Use Code and
the Airport Layout Plan Update, provided that conditions of this document are adhered to.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant approval to the Pitkin County Airport for Special Review and Scenic Overlay for
Patio Shelters, subject to the following conditions, which shall run with the land and be binding on all
successors in interest:
1. The Applicant shall comply with the provisions of Resolutions No. 99-79 and 043-2000 unless
otherwise replaced or amended by the conditions of this approval.
2. The Applicant shall receive Board of Adjustment approval for development in the 200' highway
setback.
3. The one (1) additional light to be installed on the south end of the middle patio shelter structure
shall comply with County lighting standards and be attached to a motion detector system. This light and
the 39 lighting fixtures, approved pursuant to Resolution No. 043-2000, shall be on a timer that will
completely deactivate between the hours of I ] :30 p.m. and 6:30 a.m.

4. The Applicant shall be allowed to maintain the right to construct a T-Hanger limited to a
maximum of 5,000 square feet and a maximum of 18 feet to the top of the roof in the future. The
ultimate location of the T-Hanger shall be determined through the Special Review and Scenic Overlay
Review process. The existing T-Hanger shall be removed, prior to final approval of 5,000 square foot T-
Hanger.
5. The temporary parking area north of the apron expansion area shall be maintained until
completion of the patio shelter construction. Within 30 days of construction completion, the temporary
parking area shall be removed and revegetated.
6. The patio shelters shall not exceed 18' feet in height as measured by the Land Use Code at the
time of installation. The patio shelters shall not extend beyond 814 feet in length. The patio shelters shall
incorporate earth tone, non-reflective colors. The patio shelter roofs shall be pitched toward State Highway
82.
7. The Applicant shall obtain all required Federal, State, and local permits before he commencement
of construction.
8. The Applicant shall comply with all codes and requirements of the Aspen Fire Protection District
and applicable NFPA Standards.
9. All material representations made in the application shall be considered conditions of approval,
unless amended herein.
10. The Applicant is not required to submit annual reports attesting to conformance with the conditions
of this approval, nor is the proposed use required to commence within 12 months of the date of this
approval, as would otherwise be required under the Special Review provisions in the Land Use Code.
1 1. Additional vegetation shall be incorporated on the landscaping plan reviewed and approved by the
BOCC on February 28, 2001 to provide maximum screening. Any modificatio~u to the plan shall be
reviewed by the Community Development Department.
12. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin
County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land
Use Code, § 4-140 and C.R.S., § 24-68-]O5. The statutory vested rights granted herein shall expire on
February 28, 2004.
