HomeMy WebLinkAboutpitkin.boa.01.04 RESOLUTION OF THE PITKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING SETBACK VARIANCES FOR GERALD HOSIER Resolution No. 01-04 WHEREAS, Gerald Hosier, owner of 2020 Red Mountain Road, is requesting approval for a Collector Street setback variance and a front yard setback variance for the construction of a second story addition to an existing three-caz gazage; and WHEREAS, pursuant to Section 3-30-20 A and C of the Pitkin County Land Use Code, 50 feet is required from the Red Mountain Road right-of-way, and a 100 foot front yard setback is required pursuant to Figure 3-1; and WHEREAS, this pazcel contains 31.7 acres and is located in the AFR-10 zone district; and, WHEREAS, the subject property is described as in Exhibit A; and, WHEREAS, the Boazd of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hazdship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE 1T RESOLVED by the Boazd of Adjustment, that a Collector Street and Front Yazd setback variances be granted for the construction of a second story addition to an existing three-caz garage as presented on Exhibits B and C due to topographical hazdships. WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. The Resolution was adopted by vote of the Boazd of Adjustment of the County of Pitkin, State of Colorado. Ol-2 Lewis, Tom: Lot 1-A, Block 3, Revised Red Mountain Subdivision, aka 1121 Red Mountain Road. The applicant is requesting a Collector Street setback variance where 50 feet is required from the Red Mountain Road right-of--way, and front and side yazd setback variances where 30 feet and 15 feet respectively aze required for this 37,480 squaze foot parcel in the R-30 zone district. Krabacher excused himself due to a conflict. The applicant agreed to proceed with the three remaining Boazd members. Schaffner gave a brief summary of the application. She stated that the applicant was originally denied 1041 Hazazd Review due to steep slopes, but was then approved through the takings procedure of the Land Use Code. Schaffner stated that the applicant is submitting two proposed driveway plans; only one complies with the existing BOCC approval. She noted that if the BOA approved the alternate driveway plan, the applicant would then seek the approval of the BOCC. Vaziances aze necessary on either driveway plan to change the grade more than 30 inches in height within a setback. Janver Derrington, the applicant's architect, pointed out that the Fire Marshal had concerns with the steepness of the existing driveway (which was approved by the BOCC) and asked if a new driveway could be designed. Herb Klein, the applicant's representative, stated that the property is heavily impacted by the Collector Street Setback because Red Mountain Road is on both sides of it. He stated that they must change the grade by more than 30 inches in height because there is no other way to get in to the property without doing this. He explained both plans. Klein stated that they would like approval for the existing alignment and also for the alternate alignment, which would be conditioned upon the BOCC granting an amendment to the 00006 • MINUTES • of the Pitkin County Board of Adjustment Thursday, March 6, 2001 existing 1041 approval. Klein stated that the fire marshal has stated he would approve either alignment but has noted a strong preference for the alternate alignment. Klein stated that there is cleazly a topographic hardship. It was also represented the if the new alignment were approved, the existing alignment would be regraded and revegetated. Schaffner noted that she had spoken with the Fire Marshal, Ed van Walraven and that he prefers the new alignment. Neighbor, Bill Hodges spoke about the history of the property and stated that he and his sister currently own land across the street from the applicant. He stated that there has been some question about why the use of the existing driveway can't continue, and that although he doesn't have serious personal objections to the alternate driveway, but that his sister, Marilyn Wilmerding, does. Hodges stated that he wasn't sure that there has been a valid hazdship shown in order to justify a vaziance for the alternate driveway. Head asked if the applicant had demonstrated access before the BOCC. Klein responded that there is an easement that has been granted to the County and public for purposes of road access. He stated that this easement appeazs in a deed and a plat map and has been accepted and signed off on by the County. Head asked Hodges to suggest an alternative. Hodges responded that they have no objection to the alternative that Schaffner pointed out on the map, but that he isn't satisfied that the County has ever truly signed-off on the easement. Rifkin asked Hodges what impact this request has on his property. Hodges responded that there probably isn't any impact on his property. Marilyn Wilmerding, who arrived to the meeting late, noted strong dissatisfaction with anyone being able to do anything on her property. She added that if she didn't own the property she wouldn't Gaze what they did with it. Olsen asked Wilmerding if there would be anything that they would find less offensive. Wilmerding responded that all of it was offensive. There was discussion regarding access. Schaffner stated that it is her understanding that the County doesn't have a concern with a new access point through the easement. Rifkin stated that in his opinion the BOA could only vote on the vaziance request before them and whether or not a hardship has been demonstrated, not determine if the applicant had legal access. Motiou: Olsen moved to approve both driveway access designs based on the drawings before them and based on topographic hazdships in both designs. Rifkin seconded the motion. Members Rifkin, Head and Olsen voted unanimously in favor of the mnri~n ~Q~~Q~ • MINUTES • of the Pitkin County Board of Adjustment Thursday, March 6, 2001 Ol-3 Andersen, Chris: 0800 Brush Creek Road Requesting a 70 foot Arterial Highway setback variance where 200 feet is required from the Brush Creek Road right-of--way, for the construction of a driveway that exceeds 30 inches in height within the setback of this 35+ acre parcel in the AFR-10 zone district. Schaffner gave a brief summary of the application as outlined above and explained the location of the property. She stated that the county engineer has requested that this driveway be increased from a 12 foot width as indicated on the plan, to a 14 foot width. The proposed alignment will not change if this increase is made. Rifkin asked if adjacent neighbors had filed any objections. Schaffner responded there had been none. Doug Pratt, the applicant's representative, stated that they are requesting a variance to the 30 inch rule so that they can minimize the length of the driveway that would be visible from Brush Creek Road. Pratt noted the piece of the property that exceeds 30% on the map. He stated that they are trying to avoid a switchback through the property's meadow. Rifkin asked what the hardship was. Pratt responded that the hardship is environmental sensitivity so that they don't have to produce a bigger scar on the land. He stated that a switchback could produce safety issues for emergency vehicles. Schaffner stated that a longer road that requires switchbacks takes up too much of the meadow and this was a concern during the scenic review. Motion: Head moved to approve based on topographical hardships. Rifkin seconded the motion. Members Head, Rifkin, Krabacher and Olsen voted unanimously in favor of the motion. -4 Hosier, Gerald: 2020 Red Mountain Requesting a Collector Street setback variance where 50 feet is required from the Red Mountain Road right-of--way, and a front Yazd setback vaziance where 100 feet is required, to construct a second story addition to an existing three-car gazage on this 31.7 acre parcel in the AFR-10 zone district. Schaffner gave a brief summary of the application noting the location of the property. She stated that the application was originally before the BOA in April of 2000. Schaffner stated that the plan has been redesigned and noted the different roofline. She stated that the new vaziance is necessary because the increase in the height of the roof increases the encroachment into the setback. Glenn Horn, the applicant's representative, stated that the BOA found the hazdship to be topographical at the original meeting. Horn pointed out that everything is similaz to the original application accept the roofline. He stated that they need 20.82 feet from the roofline to the road on the backside. In the southeast corner they need 23.04 feet. Due to the shape of the property, the west property line is the front yard. He noted the front yazd setback and stated the retaining wall is already in place there. Schaffner stated that there were no objection filed by adjacent neighbors. Motion: Head moved to approve 01-4 based on the unusual shape of the property and the road pattern, which creates the hazdship. Rifkin seconded the motion. Members Head, Rifkin, Olsen and Krabacher voted unanimously in favor of the motion. 01-5 AKA Requesting a Major Road setback vaziance where 100 feet is required from the East Highway 82 right-of--way for the construction of a new duplex. Schaffner gave a brief summary of the application noting the location of the property on the map provided. She stated that the request is for a Major Road Setback variance and that no yard setbacks aze being violated. She noted a letter from Richazd Haberman who is with the azchitectural review committee for the Mountain Valley Homeowner's Assocation. Stan Mathis, the applicant's architect, stated that they want to use the development right for a duplex on this lot of up to 4,950 square feet. They would like to use the existing access cut from the Highway, because the reaz of the property, adjacent to Lupine Drive, is too steep for access. He stated that they are looking for a vaziance of 58 feet into the setback. Head asked what the hazdship was. Mathis responded that the hardship was steep slopes. Julie Wyckoff, an adjacent neighbor, noted considerable objections to the request, including that the slopes don't appear to be as steep as the applicant purports them to be, and that the project will completely block out the sunset and Aspen Mountain views from her property. Additionally she had objections to the proposed density of the project. Wyckoff noted view obstructions to other neighboring parcels. She stated that parking would be a problem, and that guests are already having to park on her property. Wyckoff asked if Schaffner had contacted CDOT regarding this application. Schaffner responded that she had but that CDOT had not responded. Wyckoff noted all the accidents that have occurred along this portion of East Highway 82. WHO ELSE WAS THERE? The single-family house on the subject site received 1041 Hazard Review approval approximately 11 years ago. Attachment 1 is a vicinity map depicting the location of the subject site. On February 21, 2000 the applicant submitted a land use application seeking the following land use approvals: * Employee Dwelling Unit (Section 3-150-120); * Scenic Overlay (Section 3-60-040); * Residential Development with more than 15,000 square feet of Residential Floor Area (Section 3-200-090); * Transfer of Development Rights Receiver Site (Section 3- 310); * Land Use Code Amendment (Section 3-220); and * Rezoning. The preceding approvals were granted by the Board of County Commissioners pursuant to Resolution 151-2000 (see Attachment 14). EXISTING CONDITIONS & PROJECT DESCRIPTION On April 4, 2000 the Board of Adjustment approved Resolution 00-9 granting a front yard setback variance of 15 feet and Collector Street setback variances of 24 and 26 feet (see Attachment 15). The applicant has changes the roof plan for the proposed dwelling unit. The change to the roof plan necessitates another variance application. The Hunter Creek trail crosses the lower portion of the site. The site is currently improved with a single family residence located on the south side of Red Mountain Road. Attachment 2, the site plan, shows there is an existing detached garage located above the house within the switchback of upper Red Mountain Road. Section 3-50-020 of the Pitkin County Land Use Code establishes road setbacks that supersede County yard setbacks. According to the Code, "collector streets" require 50 foot road setbacks. This provision was added to the Code in 1994 upon adoption of the current Code. The Hosier detached garage which was constructed in 1989 does not meet the setback requirements from "collector streets." The garage is located 30 feet south of Red Mountain Road on the north and 35 feet from Red Mountain Road on the south. Consequently, the garage is non-conforming. According to Bud Eylar, County Engineer, the section of Red Mountain Road (Upper Red Mountain Road) accessing the subject site does not serve a collector function. Rather, this section of Red Mountain Road serves a driveway function. The applicant requests a road setback variance to alleviate the existing non-conformity. Attachments 3-9 (11" x 17") depict the proposed second story addition to the detached garage. Attachment 3 depicts a staircase to be located on the west side of the garage. The staircase is located within the 100 foot front yard setback. The addition will contain an employee dwelling unit (EDU). The addition will have a pitched roof as compared to the existing garage which has a flat roof. The proposed 1,500 +/- addition will include a two bedroom unit. Attachments 7, 8 and 9 depict the south, west and east elevations. Attachment 2 shows the west side of the detached garage is located approximately 106 feet from the west property line. Attachment 2 also shows there is an existing non-conforming retaining wall located just to the west of the garage. The applicant will seek a front yard setback variance to provide for the construction of the employee dwelling unit. The southwest end of the retaining wall is located 74 feet from the west property line. Attachments 3 and 4 show the applicant intends to construct a staircase parallel to the existing non-conforming retaining wall. Attachment 2 shows it is not possible to construct the staircase on the west side of the garage due to steep topography. 2 o®~U~~ n Joanna Schaffner February 12, 2001 Page 3 The applicant requests a front yard setback variance to alleviate the existing non-conformity. LAND USE APPROVALS Section 7-10-030 established standards for a variance to be granted. This section demonstrates the subject site qualifies for front yard and road setback variances due to hardships. Road Setback Variance Attachment 10 is a copy of the Hosier property survey. The survey shows the Hosier property has a unusual shape. Red Mountain Road forms a switchback traversing the west side of the property. The existing garage is within the switchback of the Road (see Attachment 10). There are only approximately 90 feet between the two segments of Red Mountain Road (measured at the east end of the garage). It is impossible to build an employee unit on top of the existing garage and comply with the 50 foot road setback. The unusual shape of the lot and the unusual road pattern creates a hardship. Front Yard Setback Variance As previously indicated, Attachment 10 shows that the subject site has an unusual shape. The west property line is the front yard. The area surrounding the existing garage was graded for vehicular access when the garage was constructed. Attachments 3 and 4 show the area to the southwest of the existing retaining wall is an ideal place for the staircase which will access the employee unit because it is flat. However, the unusual shape of the lot places this area in the front yard setback which is a hardship. The southwest end of the retaining wall is located 74 feet from the west property line. The staircase can not be located on the south side of the garage because it would block cars from entering and can not be placed on the north or east side of the garage due to steep topography. SUMMARY This application has demonstrated compliance with the Land Use Code standards identified by the staff in the pre-application meeting.
