RESOLUTION OF THE PTTKIN COUNTY, COLORADO BOARD OF ADJUSTMENT GRANTING FRONT YARD, SIDE YARD AND COLLECTOR STREET SETBACK VARIANCES FOR TOM LEWIS Resolution No. Ol-2 WHEREAS, Tom Lewis, owner of 112] Red Mountain Rd, is requesting front yard, side yard and Collector Street setback variances, for the construction of a driveway that exceeds 30 inches in height within the setbacks; and, WHEREAS, a 30 foot front yard setback, a 15 foot side yazd setback and a 50 foot collector street setback are required for this .86 acre parcel in the R-30 zone district; and, WHEREAS, the subject property is described as Lot 1-A, Block 3, Red Mountain Subdivision; and, WHEREAS, the applicant proposes improvements to an existing driveway pursuant to Boardof County Commissioners (BOCC) resolution 1662000. The applicant is also requesting an alternate driveway alignment that has yet to be approved by the BOCC. If the alternate driveway is approved by the BOCC, the existing driveway will be regraded and revegetated. Both driveways exceed 30 inches in height within the required setbacks. WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by virtue of Title II, Section 7-10.30, Pitkin County Code (Land Use Code) and Colorado Revised Statutes, 1973, 30-28-118(2) (C); and, WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following findings: 1. Proper notice procedures, including the notification of all adjoining property owners, has been shownby the applicant. 2. The required hazdship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. NOW, THEREFORE, BE IT RESOLVED by the Boazd of Adjustment, that front yard, side yazd and collector street setback variances be granted for improvements to the existing driveway OR for the construction of the alternate driveway as presented on Exhibits A-C, due to a topographical hardship. WARNING: Any violation of the terms of this resolution may result in rehearing and possible revocation. The Resolution was adopted by vote of the Boazd of Adjustment of the County of Pitkin, State of Cdorado. Old Business: Amending BOA case 99-32 (Blechman) Lot 18, Block 1, Red Mountain Ranch, AKA 0196 Hunter Creek Road Schaffner gave a brief summary of the application, noting the location of the property on Red Mountain. She stated that this application was previously reviewed by the BOA in 1999 for a variance from the 50 foot Collector Street setback. The applicant received approval to exceed 30 inches within the setback for a retaining wall and driveway improvements. The applicant has redesigned the retaining wall to make it less impactive and allow for greater landscaping and the retention of more native vegetation. Schaffner explained to the members that they could require the applicant to make a complete application for public hearing to amend the previous approval, or, if they believe the changes aze minor enough, they could reflect their approval through the minutes of this meeting. She added that in terms of wall design, she felt this to be a minor amendment. The conditions on the site are the same and the BOA had previously found a topographic hardship. Michael Moore, the applicant's representative, referenced a map provided to point out the retaining wall, regrading and the areas that are left undisturbed. He specifically noted the changes in height stating that the wall needed to get higher. Moore stated that they have slightly changed the shape of the wall and brought landscape elements azound to integrate the wall into the landform. He noted that with this concept they aze retaining most of the existing vegetation. He referenced the elevation showing that the wall is behind the residence as that it isn't, therefore, visible from Highway 82. There was discussion on the overall height of the wall. Head suggested that the decrease in disturbed vegetation was more significant than the minor increase in height. Motion: Bob Throm moved that the plan as submitted is acceptable, because of less intrusion into the natural site. Hardship remains topographical. OOOU(?6 MINUTES • of the Pitkin County Board of Adjustment Tuesday, April 3, 2001 Rick Head asked if there were any objections from neighbors. Schaffner responded that there were not. Motion Continued: Rick Head seconded the motion. Members Throm, Head, Cooper, Krabacher, Olsen and Hunt voted unanimously to approve the motion. Ol-5 Boland, Marjorie: Lot 5 Block 1 Mountain Valley Subdivision AKA 42701 State Hwy 82 The applicant is requesting a Major Road setback variance where 100 feet is required from the East Highway 82 right-of--way for the construction of a new duplex. Schaffner pointed out that the applicant was not present for the meeting. She stated that there were people from the public present to speak on the application. She suggested that one option the BOA had was to hear the public, in case the applicant was just late, instead of tabling until the next meeting. Krabacher noted his disapproval that the applicant didn't show for tonight's meeting, and noted his sympathy for the neighbors that did take the time to show up. All members present appeared to be in agreement with this. There was discussion on how to appropriately proceed. Krabacher suggested that they simply deny the application and make the applicant come back at a later date. Schaffner pointed out that if they did that the applicant would be unable to bring this application back for a year. Julie Wyckof, an adjacent neighbor, stated that she would just like to go on record and stated that she opposed the application. She also added that there has been no communication between the applicant and the neighbors. Richard Haberman, from the Mountain Valley architectural design committee, was also present for this meeting. He noted that he would be in favor of the application being denied because the applicant didn't show. He also asked if the applicant had had any contact with anyone. Schaffner noted that Stan had called her to let her know he wouldn't be there. Krabacher pointed out that they don't typically approve an application if there are opposing neighbors. He also noted that he realizes it's difficult for neighbors to keep reappearing for the application. It was felt that applications shouldn't be repeatedly continued. There was further discussion regarding the appropriate process. The members agreed that the application should be tabled. Haberman stated that he had no problem being present for the next meeting and noted that he hadn't seen any additional plans from Stan. OOOU07 • MINUTES • of the Pitkin County Board of Adjustment Tuesday, April 3, 2001 Motion: Krabacher moved to table Case Ol-5 until next month. Michael Cooper seconded the motion. Throm suggested that they note if the applicant doesn't show the next time the application should be denied. Krabacher accepted the amendment. Members Krabacher, Cooper, Throm, Olsen, Head and Hunt voted unanimously in favor of the motion. Ol-6 Pitkin County Airport• Aspen/Pitkin County airport 0233 East Airport Road Aspen The applicant is requesting a 125 foot Arterial Highway setback variance where 200 feet is required from the West Highway 82 right-of--way, for the construction of 18 patio aircraft shelters. Cooper noted a possible conflict with the application in that he is a pilot, flight instructor and 1/8 owner of an airplane. He stated that he is unlikely to be a beneficiary of the patio hangers. Cooper stated that he would participate in the discussion but that he wouldn't Chair this portion of the meeting or vote. Cooper appointed Olsen as acting, temporary Chair. Schaffner summarized the application and pointed out the location where the applicant wishes to place the patio hangers, a portion of which is in the 200-foot setback from the highway. Shaffner noted that the applicant has received approval from the BOCC to place the shelters at a height that will be measured from the new grade. Typically, the height of structures is measured to the most restrictive grade. The grade on this site was significantly raised with the extension of the apron. Gary Ross, the applicant's representative, stated that the height at the high end (down valley end) of the property is proposed to be 18 feet from the new grade. Gary noted that historically there has been a modification of standazds to allow aircraft to be parked closer than 400 feet to the runway centerline. With a change in policy the FAA has rescinded that standard to get everything behind the 400-foot line. He discussed various options the applicant considered and stated that this was the least intrusive way of covering the aircraft. Regarding landscaping, Gary stated that they've minimized the structures down to the thinnest dimension possible and angled them slightly towards the highway. He stated that they've modified the corner several times to provide screening. Shannon Murphy discussed the native shrubs and trees that were approved by the BOCC for screening. Head asked why the applicant wasn't using evergreens, which could provide screening all year round. Shannon responded that they've chosen the vegetation that's native to that area, which is the really dry vegetation such as scrub oak, serviceberry and sage. She added that the BOCC has asked the applicant to work with Jonathan Lowsky, County wildlife biologist, to come up with a plan that maximized screening and is appropriate to the Eco system. 00000$ • MINUTES • of the Pitkin County Board of Adjustment Tuesday, Apri13, 2001 Throm asked if the patio structures were for rent. Gary responded that technically they were for rent. The County has made an arrangement with the local pilots association, which is more like along-term lease. He stated that this isn't a revenue generator; the County is simply trying to recover the cost of putting the structures in. There were no public comments. Motion: Throm moved to approve the application as submitted due to topographic constraints and FAA down zoning. Head seconded the motion. Members Throm, Olsen, Head, Hunt and Krabacher voted unanimously in favor of the motion. Cooper did not vote. 01-8 Swerskv, David: 4080 Lower River Road Snowmass The applicant is requesting a 30-foot front yard setback variance where 30 feet is required for this .38 acre parcel in the AFR-10 zone district, for the construction of asingle-family residence. Schaffner summarized the application and noted the location of the site. She stated that the applicant has received 1041 approval. The building envelope is situated on top of the slope and to the front of the property. The applicant must cross the Rio Grande right-of- way to access their property and is requesting a zero lot line for the proposed residence. David Swersky and his representative, David Panico, were present. Panico stated that this is a topographic hazdship based on the fact that the 1041 established a building envelope that has a zero lot line in the front. The applicant is subject to the County's 30 foot front yard setback requirement, which, if applied, will essentially cut the building envelope in half. There were no public comments Throm asked how lazge the proposed house will be. Swersky responded that it's about 3800 square feet, and that it is consistent with all of the other pazcels on that stretch of the river. He stated that the site is constrained by the 100-yeaz flood plane as well as a 50 foot setback that controls where the septic system can be. I{rabacher asked if this was a vacant lot. David Panico responded that it was. He stated that the lot had a funny shape and that it is angled towazds the middle of the river. He stated that the septic system encroaches more into the building envelope because of this. Motion: Olsen moved to approve the variance request based on hardships relating to 1041 and railroad setback requirements and general site conditions. Throm seconded the motion. Members Olsen, Throm, Cooper, Head, Hunt and Krabacher voted unanimously in favor of the motion.
