ADMINISTRATIVE DECISION OF THE COMMUNITY DEVELOPMENT DIRECTOR OF PITKIN COUNTY, COLORADO, APPROVING A THREE YEAR TEMPORARY COMMERCIAL USE/SPECIAL EVENT PERMIT FOR THE INDEPENDENCE PASS FOUNDATION RIDE FOR THE PASS ON MAY 17, 2008 Administrative Decision No.~-2008 RECITALS Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. The Independence Pass Foundation, (hereafter, the "Applicant') has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to conduct the Independence Pass Foundation Ride For The Pass on May 17th, 2008. The event will be staged from the winter gate on Independence Pass up to the Independence Ghost Town. The event will run from 7:OOAM - 1:OOPM. Approximately 500 people are expected. 3. This is the fourteenth year for this event. It was last granted a Temporary Commercial Use/Special Event Permit in 2007. 4. The Pitkin County Sheriff's Office, the Aspen Fire Department, and the Emergency Management Department have all approved this event. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. CDOT and CSP have both reviewed and approved the application. The County Engineer and the USFS have also reviewed and approved the application. 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. The Director further finds that based on the historical safety and success of the event that it qualifies for a three year permit. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for the Ride For The Pass subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. No emergency access shall be blocked. 3. The Applicant shall notify the Community Development Department 60 days prior to the event to identify the date and location of the event and any changes in the nature, size, or activities to be conducted since the preceding event covered by the permit. If the Community Development Department determines that changes in the event were not anticipated or covered by the existing permit, and could have unanticipated adverse impacts on surrounding properties or traffic on County rights-of-way, or the event has not complied with provisions of the previous approval it may be revoked and/or the Department may require that the Applicant (a) apply for and receive a C') ~ z new temporary use permit, or (b) modify the event to avoid the unanticipated adverse impacts. If the Community Development Department does not respond to the notice with concerns about unanticipated adverse impacts, the event may proceed without the need to obtain a new temporary use permit. 4. This is not a vested approval and the event is subject to any new Code or County Safety Committee requirements through the life of this permit. 5. This permit shall expire in 2011. 6. Since the Pass is out of range for most radio frequencies, we rely on the emergency channel (#14) to communicate critical events. We have, never needed to use this channel in the history of the event. Typically radios are placed at the start and finish line and at the aid stlations and with at least 2 ride-along EMT's. If transport to the hospital is required, there are vehicles available at the aid stations 8nd the start and finish line. The emergency channel would be used to summon an ambulance if necessary. In addition, a motorcycle-equipped forerunner sweeps the course at least once during the ride once at the conclusion of the ride to make sure there are no riders in distress. All the aid stations and the start and finish lines are equipped with first-aid kits and bike repair kits for minor injuries and repairs. The first -aid kits have never been needed in the history of the event. Finally, there is a Colorado State Patrol officer stationed at the Start Line during the ride, who is available for emergency assistance if needed. Parking: There is parking available at the Start Line area for approximately 40 vehicles. Parking is also provided at Dlfficult Campground approximately 2 miles east. Shuttles transport riders and bikes from Difficult to the Start Line between 7 AM and 8:30 AM. Many riders park at Difficult and ride to the Start Line and many riders ride from Aspen to the Start Line. Parking is also available at numerous pull-outs between Difficult and the Start Line. Since the Pass is not open to vehicular traffic, and because the ride is generally over by 12:30 PM, there is very little conflict with other vehicles. Transportation: There will be a minimum of seven vehicles that will transport staff from the Start Line to the Finish Line and points in between. The City of Aspen timing staff will have a van that they will take to the Finish Line approximately 1/2 hour prior to the start. Two vehicles will go to the aid stations and transport any clothing or other gear that belongs to riders who are only going as far as those stations. Two vehicles, including a small RFTA bus, will transport equipment and staff, including course marshals, to the Finish Line and points in between, leaving approximately 15 minutes prior to the start. The motorcycle forerunner will leave immediat0ly before the start and will pace the riders up the hill, watching for any last-minute road hazards or problems. The RFTA bus will be the last vehicle down the hill after the Ride and will sweep the course for riders, staff and equipment. In addition, one of the Difficult shuttles (from Blazing Adventures) will go to the finish line and be available for emergency transportation of riders and bikes in case of emergencies, inclement weather, etc. Rider Notice: Since the event is very weather-dependent and because it is in a remote location where communication is difficult, last-minute notice to participants regarding conditions is very challenging. There are no plans or opportunities for an altemate event date so if the event needs to be cancelled for any reason, refunds will be offered but no alternate date or event will be provided. Radio, newspaper and Internet communications have been used in the past to announce the event and to provide event informatign and that will be the case this year, but those venues are not useful for ride-day communications. Announcements of condition3 and course problems will be made at the Start Line as necessary. We do not anticipate having any vendors or security staff needs. The event is open to the public. Fees aze $40 for individual 'J riders and $70 for families of 2 or more. We have never needed to limit ridership and do not anticipate doing so this year. Volunteers will be trained in advance by way of e-mail and pre-race conferences. Most volunteers have been doing so for many yeazs and know their duties already. There will be no amplified music. Since the Road will be closed to vehicular traffic there will be no need for traffic control beyond the start line at the winter gate (mm 47) on Highway 82. There will be a number of tables and chairs at the start line to facilitate race-day registration and timing chip pickup. There will be some rudimentary food services (water, fruit, energy bazs, etc.) at the start and fidish lines. THere will also be a small temporary timing tent at the finish line located at the Independence Ghost Town (mm 57). There will be 6 portable toilets, 2 at the finish line, 2 at the start line and I each at the aid stations located at mm 51 at~d mm 55. The Aid Stations will also have water, first aid supplies, trash bins and some bike repair tools. There will also be trash receptacles at the start and fmish and a small dumpster at the start line. All trash will be collected and transported off the race route. Four EMTs will be in the Ride field and will ride along with the riders.Pazking will be provided at the Start Line and at Difficult Campground.
