PITKIlV COUNTY, COLORADO, APPROVING THE SHARP MINOR AMENDMENT TO A
DEVELOPMENT PERMIT
Administrative Decision No. ~-2008
RECITALS
1. Pursuant to Section 2-20-150.b of the Land Use Code, Christina and Grant Sharp ("Applicant") have
applied to the Community Development Director of Pitkin County, Colorado ("Director") to amend
the recorded 1041 site plan to relocate the utility envelope to accommodate a portion of the on-site
wastewater treatment system ("OWTS"). The previously approved utility envelope is not set back far
enough from Capitol Creek to comply with the OWTS regulations.
2. The lot is located at 37 Starlit Lane off of East Sopris Creek Road, and is described as Lot 2, Capitol
Woods Subdivision.
3. The lot is zoned R-30 and contains 1.4741 acres.
4. The plat for the Capitol Woods Subdivision is recorded in Plat Book 4 at Page 288. The Community
Development Director approved a 1041 hazard review and minor plat amendment to accommodate
expansion of the existing residence, pursuant to Administrative Decision No. 20-2006. The site plan
was recorded in Plat Book 78 at Page 74.
5. The Director finds that the proposed envelope amendment complies with the applicable provisions of
the Land Use Code, and that the proposed development will not change the use of the proposed
development or the basic character of the land, is consistent with action taken during the original
review, does not increase off-site impacts or the allowable floor area, and will not endanger the public
health, safety or welfare.
THE DIRECTOR DOES HEREBY APPROVE the Sharp Minor Amendment to a Development
Permit, subject to the following conditions, which shall run with the land and be binding on all successors in
interest:
1. All conditions of Administrative Decision No. 20-2006 shall remain in full force and effect, except as
amended herein.
2. Prior to issuance of an OWTS permit, the Applicant shall be required to submit for approval by the
County Attorney and Community Development Department an amended Site Plan. The above
referenced approvals shall be a condition precedent to finalization and recordation. The mylar copy
of the site plan must be signed by the owner prior to submittal for recording. The site plan shall be
amended as follows, prior to submission:
A. Extend the utility envelope to the building envelope to accommodate the pipe to the absorption
trenches.
B. Include a note specifying the purpose of the amendment.
3. The Applicant shall adhere to all material representations made in the application.

Dear Suzanne,
This is an application to amend the recorded 1041 site plan for the Sharp property,
located at 37 Starlit Lane. The legal description of the property is Lot 2, Capitol Woods
Subdivision. Capitol Woods is aBoard-approved subdivision whose plat is recorded in
Plat Book 4 at Page 288. The property's Parcel ID # is 264503201005.
The purpose of this minor amendment is to alter the property's previously approved utility
envelope. This amendment is necessary because the Environmental Health Department
determined during the property's building permit review that the approved envelope did
not fully comply with the required setback from Capitol Creek. There is adequate room
within the property boundary to locate an envelope that does comply with the setback.
The application is being submitted by the owners of the property, Grant and Christina
Sharp (hereinafter, "the applicants"). Proof of the ownership of the subject property is
provided in the warranty deed and quit claim deed, attached hereto as Exhibit #1. The
applicants are being represented for this application by Alan Richman Planning Services.
A letter from the applicants confirming this arrangement is attached as Exhibit #2.
I discussed this project with you and you suggested that apre-application conference
was not necessary for this minor application. Instead, you informed me that the review
procedure that is applicable to this proposal is as follows:
Minor Amendment to a Development Permit, pursuant to Section 2-20-150 (b) of the
Land Use Code.
The following sections of this application identify the provisions of the Land Use Code
applicable to this procedure and provide responses to the applicable County standards.
First, however, a brief description of the property and a further explanation of the
proposed amendment are presented below.

Property Description
This property is an irregularly-shaped parcel of land that is approximately 1.4741 acres
in size. Since the property is zoned RS-30, it is anon-conforming-sized lot of record.
Access to the property is from Starlit Lane, a short unpaved road that intersects with East
Sopris Creek Road, just after East Sopris Creek Road splits off from Capitol Creek Road.
The property is improved with a small two story cabin, a garage, a shed, and a small
geodesic dome.
The property is split into three distinct areas. The upper portion of the property is located
above Starlit Lane. This area is a dry hillside, generally with slopes that are greater than
30%, but with some areas that are 15% to 30%. The existing garage was built into the
lower portion of this hillside many years ago, and there is a small shed located next to
the garage. An overhead power lines traverses this hillside.
The middle portion of the property is located between Starlit Lane and Capitol Creek.
This relatively narrow area (generally 75' to 80' in width) is where the existing residence
is located. It is quite flat, except where it drops down by a few feet to the banks of
Capitol Creek.
The lower portion of the property is located between Capitol Creek and Snowmass Creek
Road and is an essentially undeveloped portion of the property.
The property was granted 1041 Hazard Review and associated land use approvals by
the Community Development Director pursuant to Administrative Decision 20-2006 (see
Exhibit #3). The 1041 Site Plan and Amended Plat for the property are recorded in Plat
Book 78 at Page 74.
A proposed amended site plan accompanies this application letter. It shows the revised
location for the utility envelope. The previously designated envelope has been entirely
removed from the proposed site plan.
The utility envelope would be located just above where the utility envelope was previously
designated, in an area with slopes that are in the range of 15%to 30%. This location has
been designated based on the attached on-site wastewater treatment system design
prepared by Bullseye Engineering, Inc. This system has been designed to comply with
all applicable standards of the Pitkin County Code.

Minor Amendment to a Development Permit
As noted above, staff has determined that this application can be processed as a minor
amendment to a development permit. Section 2-20-150 (b) of the Code authorizes the
Community Development Director to grant a minor amendment to a development permit.
This section states that a minor amendment shall meet the following criteria:
1. Is consistent with action(s) taken during previous development approvals for the
property.
Response: This very minor alteration to the location and configuration of the utility
envelope is consistent with the original approval.
2. Does not change the use of the proposed development between residential,
commercial and tourist accommodation uses.
Response: No change in use is proposed
3. Does not change the basic character of fhe approved use of land on which the
activity occurs including basic visual appearance and method of operation.
Response: The proposed utility envelope will not change the basic character of the land
use approval granted to the property. It will not alter the visual appearance of the
property since it will only allow for a subgrade improvement.
4. Does not constitute a new land development activity.
Response: The proposed amendment does not constitute a new land development
activity. Rather, it is a minor change that is accessory to the primary residence.
5. Does not increase off-site impacts in the surrounding neighborhood.
6. Does not endanger the public health, safety, or welfare.
Response: The proposed envelope will not increase off-site impacts nor will it endanger
the public health, safety or welfare. In fact, it will promote public health, safety and
welfare by bringing the wastewater disposal system into compliance with the County
Code minimum setback from rivers and creeks.
7. Does not violate any Land Use Code standard.
Response: The proposal does not violate any Code standard

8. Does not substantially increase the need for on-site parking or utilities, or affect
affordable housing generation.
9. Does not increase the floor area of the use by more than five percent (5%) or
decrease the open space on the site by more than five percent (5%).
Response: The proposal will have no impacts on the need for parking, utilities or
affordable housing, and will not change floor area or open space calculations on the site.

RECTTALS
I . Christina and Grant Sharp ("Applicant") have applied to the Pitkin County Community Development
Director ("Director's for 1041 Hazard Review approval to establish building and accessory envelopes
that encompasses the existing single family residence and other improvements. The Applicant is also
requesting a minor plat amendment to eliminate a "leach field easement" that benefits Lots I and 2.
2. The lot is located at 37 Starlit Lane off of East Sopris Creek Road, and is described as Lot 2, Capitol
Woods Subdivision.
3. The lot is zoned R-30 and contains approximately 1.4741 acres.
4. The plat for the Capitol Woods Subdivision is recorded in Plat Book 4 at Page 288.
5. The Applicant provided notice of the application to the adjacent property owners, as required pursuant
to Section 5-80.010(1) of the Land Use Code ("Code"). No objections were received within 30 days
from the date the notice was postmarked (January I I, 2006).
6. The Director finds that the wildfire hazard within the envelope is rated as fow and can be mitigated;
that the envelopes are located on slopes of less than 30% and avoid the 100 year floodplain and
riparian areas; and that while the property is within mapped mule deer winter range, no additional
impacts will be created.
7. The Director finds that neither Lot 1 nor Lot 2 utilize the "leach field easement" for their leach
fields, and that the owners of both lots have agreed to eliminate the leach field easement as they do
not need this area for this purpose, and, therefore, that the proposed plat amendment is consistent
with the applicable standards of the Code.
THE DD2ECTOR DOES HEREBY APPROVE the Sharp 1041 Hazard Review and Minor Plat
Amendment, subject to the following conditions, which shall run with the land and be binding on all
successors in interest:
Prior to submission of any building permit applications for new development, the Applicant shall
submit a 1041 Hazard Review Site Plan to the Community Development Department for approval and
recording. The mylar copy of the site plan must be signed by tfie owner prior to submittal for recording.
Prior to issuance of any building permits for the replacement residence, the Applicant shall:
A. Complete a fireplacelwoodstove registration forth with the Community Development
Department, if necessary.
B. Obtain a County access/driveway permit to improve the driveway, if applicable.
C. Submit a drainage and erosion control plan for review and approval by the County Engineer.
D. Submit a construction management plan for review and approval by the County Engineer
showing the locations of staging, material storage and employee and construction traffic parking.
E. Pay the applicable road and employee housing impact fees.

F. Obtain approval of a septic permit from the Environmental Health Department, if expansion of the
existing system is required. The septic system shall be located entirely within the approved
building or utility envelopes, and must comply with the setback requirements from surface and
groundwater sources.
3. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the
corners of the building or accessory envelopes and install construction fencing around the perimeter
of the envelopes. Silt fencing shall be installed along the eastern and southern boundaries of the
building envelope adjacent to the riparian areas and the creek. The fencing shall remain in place
until a Certificate of Occupancy is issued for the residence.
4. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation
standards:
A. Brush, debris and non-ornamental vegetation shall be removed within a minimum 10' perimeter
around all structures.
B. No branches shall be within 15' of chimneys.
C. Thin brushy species to 3 times the height of the brush species within 30' of the structures
(excluding willow species and other riparian shrubs and trees).
D. Mow grasses to less than 6"within 30' of the outbuildings during the summer and fall months.
E. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation
requirements.
5. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the
International Building Code (IBC) Section 1505.2. Wood shake/shingle roofcoverings are
prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the
following:
I) All roof coverings shall be noncombustible materials and instal led on a Class A roof assembly.
2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the
roof.
3} All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above
the roofline, such as parapets, sha{I be prohibited.
4) Roofs shall be installed as required by the adopted building code and shall have a minimum
slope of I :48.
5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire
Marshal prior to submittal ofa building permit application.
B. Vents shall be screened with corrosive resistant wire mesh with mesh '/. inch maximum.
C. Roofs and gutters shall be kept clear of debris.
D. Yards shall be kept clear of all litter, slash, and flammable debris.
E. All flammable materials and firewood/wood piles shall be stored on a parallefcontour aminimum
of I S feet away from any structure.
F. Weeds and grasses within a 10 foot perimeter of all sVUCtures shall be maintained to a height of
not more than 6 inches.
G. Swimming pools or ponds shall be accessible to Fire Department vehicles.
H. Fences shall be kept clear of brush and debris.

I. Wood fences shall not connect to the structure.
J. Fuel tanks shall be installed underground with an approved container.
K. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the
structure with standard defensible space vegetation mitigation around any above-ground tank.
Any wood enclosure around the tank shall be constructed with materials approved for 2 hour ftre-
resistive construction on the exterior side of the walls.
L. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in
a visible and accessible location.
M. Addresses shall be clearly marked with 2 inch non-combustible letters and shall be visible and

6. The Applicant shall comply with the following to mitigate ecological impacts:
A. Install and use approved bear-proof trash containers.
B. Maintain native vegetation outside of the building and other envelopes.
C. Surface and ground water Flows shall not be diverted away from existing wetlands.
7. No development, including, grading, excavation, fill placement, terming, landscaping, vegetation
removal or disturbance, entry or ranch gates, well or septic system shall occur outside of the
approved building envelope.
8. All areas disturbed by construction shall be revegetated to limit water consumption and additional
runoff within one growing season afrer completion of construction.
9. The Applicant shall comply with the applicable codes and requirements of the Basalt Fire District.
10. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.
11. The Applicant shall adhere to all material representations made in the application and shall consider
those representations to be conditions of approval, unless amended by other conditions.
12. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
Code, § 4-140 and C.R.S., § 24-68-105. The statutory vested rights granted herein shall expire on
2009.
