Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ("Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. The Aspen Animal Shelter (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to conduct a benefit luncheon on July 10, 2008. The event will run from 11:30AM - 2:OOPM. Approximately 100 people are expected. 3. The Pitkin County Sheriffs Office, the Aspen Fire Department, and the Emergency Management Department have all approved this event. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. Environmental Health, City Streets, and County Road and Bridge have also approved the event. 4. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for the Aspen Animal Shelter Benefit subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. No emergency access shall be blocked. The Applicant shall have a minimum of 500 feet of road to park the 50 cars that are expected, cars shall only be parked on one side of Animal Shelter Road. 3. The Fire Marshall shall inspect the tent before the event. 4. Prior to the event, Applicant shall contact Tom Parry, Electrical Inspector for Pitkin County to determine if there is a need for an electrical inspection of its outdoor hook-up(s) to the Aspen Animal Shelter. The Applicant shall appoint one person to be in charge of alcohol issues and shall be aware of Tipsy Taxi procedures. Failure to comply with the conditions of approval may result in revocation of this permit. APPLICANT: Aspen Animal Shelter (hereafter, "Applicant"). LOCATION: The event will take place in the Animal Shelter and in front of the shelter on the lawn and sidewalks. The front parking lot south of the building will be tented to accommodate the lunch service. BACKGROUND: The event will be held July 10, 2008 from 11:30 A.M -2 P.M. Approximately 100 people will attend. REFERRAL COMMENTS: The application was referred to Tom Grady, Ellen Anderson, Ed Van Walraven, Kris Jewkes, the Pitkin County Clerk and Recorder, City Streets, County Road and Bridge, and Environmental Health. Ellen Anderson signed off on the application for Emergency Management and Ed Van Walraven approved the application for the Aspen Fire Department. Kris Jewkes reviewed and approved the Certificate of Insurance provided by Applicant. Tom Grady reviewed and signed off on the application for the Sheriffs Department. Environment Health reviewed and approved the application and a Liquor License has been issued. City Streets and County Road and Bridge reviewed and approved the parking plan. STAFF COMMENTS: Pursuant to Subsection 4-30-50(i) of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1. Police supervision (if necessary); 2. Public parking; 3. Insurance; 4. Site set-up, maintenance and clean-up; 5. Emergency services; and 6. Safety of operations. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in tum, below. Police Supervision: No special provisions are deemed necessary. The Sheriff's Office has signed-off on the application. Public Parkinu: Volunteers will direct parking which will be along one side of the road leading into the Animal Shelter. 30 to 50 cars are expected. Insurance: Applicant has provided adequate proof of insurance. Site Set-Up, Maintenance and Clean-Uo: The Aspen Animal Shelter is identified as the responsible party for any clean up required. Emeroencv Services: Applicant has provided a plan for dealing with emergencies during the luncheon. There will be a certified EMT at the event. 911 will be called in case of an emergency. Local emergency personnel will be notified of the event. Safety of Operations: In case of an emergency the various benefit staff will direct patrons away from the event and to the county snow dump area to the north of the Animal Shelter building. Conformance with Building Code: Electricity will be supplied from the Aspen Animal Shelter and Applicant is being requested to contact Tom Parry to determine if there is a need for an inspection of the hook-up. RECOMMENDATION: Staff recommends that the Director approve the Temporary Commercial Use/Special Event Permit application subject to Applicants compliance with each of the conditions in the attached Administrative Decision. The Aspen Fire Marshall has stated that the Animal Shelter demonstrated "a blatant disregard for public safety". Going forward, any Special Event Permit submitted by the Animal Shelter will be required to have a strong comprehensive parking and safety plan. Firstly, an occupant load figure for the premises must be established prior to the event. This can be done by having the applicant contact Pitkin County Community Development Department with measurements and they will then calculate the occupant load number. The tent must be permitted and inspected along with the seating plan. I also believe that just because the event takes place on "private property" that it does not need a safety plan; if someone is going to put 100 people in an area they better have a plan to evacuate should the need arise. Although the volunteers are monitoring the parking they must leave room for emergency vehicles at least 16' for access and 20 plus feet for operations near the structure. Switching gears as far as Boogies' event on McLain Flats Road is concerned. I don't have a problem with a three year permit. However the tent must be inspected at each yearly event. Please contact me if you have any comments or concerns. Friends of the Aspen Animal Shelter Cesaz Millan Benefit July 10, 2008 Safety Plan (please see the attached diagram) The event is being held at the Aspen/Pitkin Animal Shelter. There aze two main areas that will be in use. The first iincludes various sections of the animal shelter building included, but not limited to, the lobby, store, meeting room, cat room, kennels and dog yards. The building has the appropriate exit signs and safety measures built into the building in the case of an emergency. There will also be a lazge tent in the parking lot to accommodate the seating azea for the luncheon. The tent will have no sides unless there is bad weather and we must create shelter from rain. In the event of an emergency the various benefit staff will direct patrons away from the event and to the county snow dump azea to the North of the animal shelter building. Animal Shelter Road is approximately 27 feet wide (including shoulders) and pazking will only be permitted on one side of the road, therefore allowing 20 feet of access for emergency vehicles. In addition, there is a lazge azea of the pazking lot that will not be used that is available for emergency operations if needed. We have the following people that will be in attendance as a safety measure: Julie Puchkoff-trained and certified EMT Adam Goldsmith -trained in Colorado Mountain Rescue Adam Goldsmith will oversee any alcohol related issues including calling Tipsy Taxi when needed or arranging rides for intoxicated patrons.
