Health Other: FILE STATUS AND LOCATION: ~o~L)~? ~. ~ r RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITRIN COUNTY, COIARADO GRANTING APPROVAL FOR A PROSPECTING PERMIT TO NORTHERN GEOPHYSICAL OF AMERICA IN ORDER TO CONDUCT SEISMIC EXPLORATION ACTIVITIES ALONG A LINE ENTITLED °D Resolution No. 87- SS WHEREAS, the Board of County Commissioners of Pitkin County, Colorado (hereinafter the "Board") reviewed a prospecting permit application by Northern Geophysical of America (hereinafter "Applicant") at a regular meeting on June 22, 1987 and WHEREAS, the proposal is along a l0 mile line approximately 4 miles south of Carbondale, Co; and WHEREAS, the applicant has demonstrated that the U.S. Forest Service has authorized a permit for the lands under Forest Service jurisdiction and has used the recommendations of the Division of Wildlife with regard to the time that the activity may take place and WHEREAS, the Board recognizes that the applicant shall notify surrounding landowners regarding the temporary distur- bances associated with the activity. NOW, '~Ri?FORE, BE IT RESOLVED, that the Board does hereby approve the application with the following condition of approval: 1) That the applicants notice the activity prior to commencement in the Valley Journal; notices shall be placed in public places in Redstone; and any residents within one mile of the Line shall be personally contacted in order to explain the activity. Verifica- tion that these contacts have been made and that adequate publicity has been accomplished shall be presented to the Planning Office prior to the commence- ment of the activity. The activity was proposed to begin on April 22 and be completed on May 13 of this year. The activity was completed on May 3,1987. The activity consisted of explosive shots along a 15 mile line. These were above ground explosions. Helicopters were used to fly the line and distribute the explosives to the station points along the line. Northern Geophysical is now requesting to shoot a second line Southwest of Carbondale 10 miles along a line to a point near the Redstone Campground. The same method of using above ground shoots and helicopters is proposed. The entire line runs across federal lands (USFS and BLM), no private lands are involved and therefore no permitting with private landowners is required. REFERRAL COMMENTS: 1. Environmental Health Department: In a memo dated may 27, 1987, Tom Dunlop of the Environmental Health Dept. states that there are no long term impacts associated with the application. He therefore has no real concerns with the proposal. 2. Engineering: In a memo dated June 8,1987, Tom Newland , the Planning Engineer does not identify any problems for the County with regard to the proposed application. STAFF COMMENTS: 1. The applicants have received the necessary permits from the USFS, BLM, and State Highway Dept. 2. As part of the USFS review, the Division of Wildlife has placed conditions on the Forest Service Permit with ~Q~~i~~ regard to the wildlife concerns and timing of the proposed operation. 3. The applicants commit to notifying the area residents of the noise and helicopter traffic associated with the operation. The staff is particularly concerned about the impacts on the Redstone Area residents. 4. The applicants received approval from the USFS and BLM for this line at the time they received approval for the earlier line that has been completed ,however they were told that they would be unable to begin activi- ties on this line until June 30th when the calving season is over. The Planning Office recommends that the Board approve a prospect- ing permit for line Seismic Line "D" with the following condi- tion: 1. Explosives. U of • Page 3 The permittee shall perform all work with explosives in such a manner as not to endanger life or property. All storage places for explosives and flammable material shall be marked "DANGEROUS". The method of storing and handling explosives and flammable materials shall conform to recommended procedures contained in the "Blaster Handbook," published by E.I. du Pont de Nemours & Co., and in all Federal, State, and local laws and regulations. 18. Operating Plan As a condition of the permit, the permittee agrees to abide by the provision of a mutually agreed to Operating Plan, a copy of which is attached and hereby made a part of this permit, and to any future revisions of said plan. The operator shall notify the Forest Service of any changes in the original notice or maps, and secure written approval of any changes prior to proceeding. If the amount of completed line is less than authorized, a map will be filed with the "Notice of Completion" showing the completed line. X_ Blasting or vibrating within 1/8 mile of Federally owned or controlled springs and flowing water must be approved in writing by the Forest Officer in charge. X_ No blasting will be permitted within 1/4 mile of historic trails, natural areas, identified archaeological sites, and recreation areas. An archaeological report must be approved prior to initiation of activity. _X_ All trash, flagging, laths, etc., will be removed and hauled to an authorized disposal site. Data on just under fourteen miles of seismic line would be collected by Northern Geopyhsical of America on National Forest Lands utilizing a polter/surface charge system. The purpose of this EA is to disclose possible environmental impacts of alternative ways of responding to this application. In examining alternatives, the following issues and concerns were identified and considered: I• Protection of soil and water resource values. z• Impacts on Forest users and adjoining land owners. 3. Protection of wildlife values. 4. Maintenance of visual quality. 5. Effect on Wild and Scenic River suitability of the Crystal River. 6• Public safety on Highway 133 7. Effect on Wilderness values in the Maroon-Bells Snowmass Wilderness An environmental assessment (EA) is not a decision document. It is a document disclosing the environmental consequences of implementing the proposed action and alternatives to that action. The decision is documented in a decision notice signed by the responsible official. The proposed action would also include activities on Bureau of Land Management (BLM) administered lands as well as private property. While the impacts on these adjoining properties is not specifically addressed, they would be very similar to the impacts described in this EA. The BLM has already issued a prospecting permit to Exxon and Pitkin County is currently reviewing the proposal. Two alternatives were considered. Alternative I is no action and would deny the application. Alternative 2 permits the proposed prospecting activities with mitigation measures for resource protection. A third alternative to require relocation of prospecting activities was not considered in detail because resource protection would not be significantly increased over Alternative 2 and the applicant's data requirements would not be met. The proposed activities are on National Forest Lands to the south and east of Carbondale, Colorado primarily in Crystal River and Thompson Creek drainages (see Map 1). Vegetation along the proposed lines consists of spruce-fir, aspen oooo~o ~ and open meadows at her elevations and pinon pine a~brush at lower ' elevations. Slopes along the line vary greatly from 1 than 6% to over 60%. Approximately 1.1 miles of the proposed line is located within the I•faroon Bells - Snowmass Wilderness just south of Avalanche Creek. The Crystal River has been determined eligible for inclusion in the Wild and Scenic River System and approximately 1/2 miles of the proposed activity is within this study corridor. Portions of line pass through big game winter range and calving areas. Forest Plan prescriptions along, the proposed route are shown on Map 2. The route would cross private land and Colorado Highway 133 as well as National Forest lands. In Alternative 1 no seismic data collection by_the applicant would be permitted on National Forest lands. There would be no change to the current situation. Utilization of geologic data which would have been gathered would be foregone. In Alternative Two, a prospecting permit would be issued to the applicant for collecting seismic data on just under fourteen miles of line on National Forest land. A polter system will be used with an average charge of 5-10 lbs. per shot, suspended by lath at approximately three feet above the ground. Forty eight shots per mile will be ignited with no single charge exceeding fifty pounds. Access along the line will be by motorized vehicles on existing roads or by foot with helicopter support except within the wilderness. No helicopter use, motorized vehicles, or explosives will be permitted within the designated wilderness. One mile of "trail" (sensing wire only - no charges set) would be allowed to be set by foot within the wilderness. All activities would be approved within a written operating plan. Current plans call for utilizing Redstone Campground and two undeveloped locations in the Thompson Creek drainage for staging areas. Travel on Forest System roads would be restricted during wet periods to protect roads. Any damage to roads would be repaired at the expense of the permittee. A performance bond will be required prior to initiation of activities. Surface disturbance along the line would not be significant. Some vegetation may be pruned during surveying, but no trees or brush would be removed. No subsidence or soil movements are expected to result from the activities. There is the potential for minor rock slides or snow avalanches to occur. The permittee will identify where these potential hazards exist and demonstrate to the Forest Service that adequate public safety protection has been taken. The time period for activity along the line would be limited to April 1, 1987 to May 15, 1987. This limitation effectively mitigates possible impacts to big game winter range and calving periods. Helicopter flight lines will be limited to the seismic lines and designated access routes to minimize the area of noise influence on wildlife and adjoining land owners. Significant flight traffic along any line segment near residences will not exceed three working days. Start up times for helicopters and charge ignitions near residences will be restricted to no earlier than 8:00 AM and no later than one hour before sunset to minimize noise impacts on adjoining land owners. Impacts from noise to wildlife and adjoining property will not be significant and will be short term in nature. The data collection activities with mitigation measures are consistent with Forest Plan prescriptions which are crossed by the line. Big game winter range will be protected and the Redstone Campground will not yet be opened to public use (campground season starts in late May). The temporary existence of a cable inside the Wildernessboundary away from trails and during a low public use period will have no significant or long. term impact,on wilderness resource values. Roads are closed except for main roads through the areas or roads open at speci- fic times. Management at tivlties are visually subordinate. Timber har- vest includes Ilea rcu tting, shel terwood, and selection. SA. Management Area - Management emphasis is on winter range in nonfor- es ted winter ranges. Winter habitat for deer, elk, bighorn sheep, and mountain goats is emphasized. During winter, the area is closed to motor- ized use and may be closed to all public use. Where conflicts occur, wi ldl lie is favored. 6B. Management Area - Intensive grazing management systems are favored G p over extensive systems. Conflicts between 17vestock and wildlife are re- U solved in favor of livestock. 1E. Management Area - Management emphasis is on wooo fiber production and utilization of large roundwood of a size and quality suitable for sawtim- [ ber. The harvest method by forest cover type is Ilea rcutting in aspen, C. lodgepole pine, and shelterwood in Englemann spruce-subalpine fir, inter- ior ponderosa .pine and mixed conifers on lands with slopes less than 40 percent. 8C. Management Area - Management emphasis is to provide for the protec- tion and perpetuation of essentially natural 6io-physical conditions. (1 Human travel is principally on system trails. Designated camp sites are U used and show evidence of repeated, but acceptable levels of use. Scien- tific and other authorized practices utilizing nonmotorized equipment but requiring up to season-long occupancy are compatible. 9A. Management Area - Rlpa rian area management. Resource use will be man- aged to protect and maintain the riparian area. Vegeta tf on treatment will 9 ~ enhance plant and animal diversity. Based of input from the Colorado Highway Department, appropriate measures for traffic control and public safety will be taken where the line crosses Highway 133. No permanent structures or surface disturbances will occur and therefore the visual resource values along the route will not be affected. All trash, flagging, laths, and other materials will be removed and hauled to an authorized disposal site. No oil or lubricant will be drained onto the ground surface. The potential for inclusion of the Crystal River into the Wild and Scenic River System would not be affected since no activities are being permitted which will impact the inventoried values which have made the Crystal River eligible. Decision Notice This EA is available for public review at Forest Service offices in Glenwood Springs and Carbondale, Colorado. .' IE is my decision to adopt Alternative 2 which calls for the issuance of a prospecting permit with mitigation measures for resource protection. These measures will provide for the protection of soils, water quality, visual quality, Wilderness resource values and the opportunity to designate the Crystal River as a Wild and Scenic River. My decision is based on the conclusion that this alternative will sufficiently protect the Forest resource values while allowing for the collection of geophysical resource data. Mitigation measures to be applied are included in the prospecting permit and the Practices to be Followed During Geophysical Exploration Operations. F~Ddi~g o~_No S~gnif~~nt Impact I have determined that this action would not significantly affect the quality of the human environment. Therefore, an environmental impact statement is not needed. This determination was made considering the following factors: 1) the proposal will have an impact only on the immediate environment; 2) there are no irreversible or irretrievable commitments of resources; 3) there are no apparent adverse cumulative or secondary effects; 4) there are no known threatened or endangered plants or animals affected by the proposal; and 5) the proposal is consistent with direction in the White River National Forest Plan. My decision is subject to appeal pursuant to 36 CFR 211.18, ae revis.ed on November 19, 1986. To initiate an appeal, a written notice of appeal must be filed with me at the address below within 45 days from the date of this decision.
