Decision No.~-2008 RECITALS 1. Pursuant to Subsection 4-30-50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado (°Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. Aspen Productions (hereafter, the "Applicant") has applied to the Director for approval of a Temporary Commercial Use/Special Event Permit to conduct a photo shoot for Ralph Lauren June 9'" and 10"' with a weather day on the 11th. The photo shoot will take place at the T Lazy 7 Ranch and Buttermilk Mountain. The photo shoot will take place from 6 A.M. to 7 P.M. the cast and crew consist of 25 to 30 people. 3. The Pitkin County Sheriffs Office, the Aspen Fire Department, and the Emergency Management Department have all approved this event. County Risk Management has received and approved a Certificate of Insurance covering this event and naming the County as an Additional Insured. 4. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4-30-50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for the Ralph Lauren Photo Shoot, subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. This permit is contingent on the Applicant securing any necessary permits from the U.S. Forest Service prior to the event. 3. No emergency access shall be blocked. 4. Failure to comply with the conditions of approval may result in revocation of this permit. APPLICANT: Aspen Productions (hereafter, "Applicant"). LOCATION: T Lazy 7 Ranch and Buttermilk Mountain. BACKGROUND: This is a photo Shoot for Ralph Lauren Clothing which is proposed for June 9`" and 10`" with a weather day on June 11`". The cast a crew consist of 25 to 30 people. Shooting will take place between 6 A.M. and 7 P.M. REFERRAL COMMENTS: The application was referred to the USES, Tom Grady, Ellen Anderson, Ed Van Walraven, and Kris Jewkes. Ellen Anderson signed off on the application for Emergency Management. Ed VanWalraven approved the application for the Aspen Fire Department stating that the Applicant shall not block any emergency access. Kris Jewkes reviewed and approved the Certificate of Insurance provided by the Applicant. Tom Grady reviewed and signed off on the application for the Sheriffs Department. The USFS denied the Applicant's request to shoot at the East Maroon Portal. We are awaiting their answer on Buttermilk Mountain. STAFF COMMENTS: Pursuant to Subsection 4-3-50(i) of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1. Police supervision (if necessary); 2. Public parking; 3. Insurance; 4. Site set-up, maintenance and clean-up; 5. Emergency services; and 6. Safety of operations. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in turn, below. Police Supervision: No special provisions are deemed necessary. The Sheriffs Office has signed-off on the application. Public Parking: Parking at the T Lazy 7 will be on private property and parking for Buttermilk Mountain will be in Aspen Skiing Company lots. 000001 0{~ ~v Insurance: The Applicant has provided adequate proof of insurance. Site Set-UD. Maintenance and Clean-Uo: Aspen Productions is identified as the responsible party for any clean up required. Emeraency Services: The Applicant has provided a plan for dealing with emergencies during the photo shoot. While shooting at the T Lazy 7 Ranch Rick Dean who is a registered first responder will be with them. Safetv of Operations: The Applicant will have radios is any area where there is no cell service. The Applicant will also have a Suburban ready to transport anyone in need to the hospital. RECOMMENDATION: Staff recommends that the Director approve the Temporary Commercial Use/Special Event Permit application subject to Applicant's compliance with each of the conditions in the attached Administrative Decision. 00000? Please provide the following information as it applies to your event Note that some questions will not be applicable, or appropriate, given the nature and/or scale of your event.
