HomeMy WebLinkAboutbocc.res.051.2008RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKiN COUNTY, COLORADO DESIGNATING THE EDWIN MCMILLAN RANCH CABINS TO THE PITKIN COUNTY HISTORIC REGISTER AND GRANTING INCENTIVES FOR THEIR DESIGNATION; AND AMENDING THE MORROW/WINGO JUNCTION RANCH SUBDIVISION/PUD GUIDE Resolution No.G6"~-2008 RECITALS 1. Robert T. Morrow ("Applicant") has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") to designate the four (4) Edwin McMillan Ranch Cabins to the Historic Register, and as an incentive for the designation, restoration and preservation of the cabins, to obtain a growth management exemption for 2,500 square feet of subgrade space on each of Lots 2-5 of the subdivision. 2. The cabins are located on Common Parcel ] ofthe Morrow/Wingo Junction Ranch PUD. 3. The Common Parce] contains 14.247 acres and is zone AR-10. 4. The BOCC granted Detailed Submission and Final Plat approval for the subdivision pursuant to Resolution No. 143-2005. The approval provided for the creation of five single family residential lots; two common parcels - one to contain two employee housing units, agricultural buildings and common uses (Common Parcel 1) and a second for recreational facilities; and a tract dedicated to Pitkin County for a trailhead parking area. In addition, a conservation easement was placed on the land above the Alexis Arbaney Ditch, including the BasalUOld Snowmass Trail, and an agricultural preservation easement was placed over the remaining historically irrigated pastures. The subdivision approval allows 8,250 square feet of floor area on each residential lot, with a maximum of 5,750 square feet above grade and 2,500 square feet below grade, and grants approval for the use of TDRs for the below grade space.. 5. The BOCC considered this application at a duly noticed public hearing on May 14, 2008, at which time evidence and testimony was presented with respect to the application. 6. The BOCC further finds that as an incentive for the historic designation, it is appropriate to grant a growth management exemption for up to 2,500 square feet of subgrade space for each of Lots 2-5 of the Morrow/Wingo Junction Ranch, so amending the previously approved requirement that TDRs be used for such subgrade spaces. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby designate the four (4) Edwin McMillan Ranch Cabins to the Pitkin County Historic Regist'er. BE IT FURTHER RESOLVED by the BOCC that it does hereby grant a growth management exemption for up to 2,500 square feet of subgrade space for each of Lots 2-5 of the Morrow/Wingo Junc[ion Ranch as an incentive for the historic designation, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of development permits for residences on Lots 2-5 or for restoration work on the historic cabins on Common Parcel 1, the Applicant shall: A. Record a covenant in a form acceptable to the County Attorney in which the Applicant agrees to restore and maintain the four cabins in accordance with the Secretary of the Interior s Standards for Rehabilitation or the County's design guidelines for historically designated properties, once adopted by the BOCC. B. Record an amendment to the Morrow/W ingo Junction Ranch Subdivision/PUD Guide to memorialize that the 2,500 square feet of subgrade space on each of Lots 2-5 is exempt from growth management without the use of TDRs. 4. Prior to issuance of a development permit for a residence on Lot 2, the Applicant shall provide a bond, letter of credit or other financial assurance deemed acceptable by the County Attomey to guarantee that the restoration work on the four (4) historic cabins loca[ed on Common Pazcel 1 shall be completed. Furthermore, no Certificate of Occupancy will be issued for the residence on Lot 2 until a developmen[ pertnit has been issued for and the restoration wark on the aforementioned historic cabins has been completed to the satisfaction of the Pitkin County Historic Preservation Officer and the Chief Building Official. 5. Prior to issuance of development permits for residences on Lots 3-5, the Applicant shall obtain permits for and complete the restoration work on the historic cabins and shall install the interpretive signage (interpretive signage content to be approved by the Pitkin County Historic Preservation Officer). The location and appearance of any signs located along the Rio Grande Trail or at the trailhead by the Wingo Bridge shall be approved by Open Space and Trails. 6. The Applicant commits to continue to work in good faith with the Basalt Regional Heritage Society and the Basalt Elementary School to establish a program to enable students to take field trips to the proper[y (Common Parcel 1) for leaming about the history of Basalt. Also, the Applicant shall not preclude other schools from scheduling such field trips. 7. Failure to comply with these conditions of approval may result in revocation of this permit or any subsequent permits related to this property or vested righ[s associated with this property.
