imonaly decided to accept option No. 2 ea follawss "that the County abandon t21e old Canon Roar
and fence the new road on land bt Duronx--no coat per acre". •

a Quit Claim Deed to the old Canon Road in consideration of his granting a Right of Way for

Miller, 63 Co.b. 304, 165 Pac. 774, that the County is required to pay all coats incurred by
'dePendint in a condemnation proceeding unless the costa were unrbaeonably or cbnttimacionsly
incurred. I am afraid that w e could nbt establish that~any of the
boats incurred bit Arbaney were so unreasonable or otherwise improper as to excnae the County„
from paying the same. It Is~therePore my opinion that the County will have to pay the witness
certificates for respondent s witnesses in t hat case. ti'Vill advise you as to the Thompson

Dear Mr. Neihardts IInder thb ihcta existing in the case oP the People vs. Thompson, it is
my conclusion that it is entirely optional frith the Board oP Courity Commissioners to pay or t
repose the .bill submitted by th3 Justice oP the Peace in connection with that proceeding.
' Aa a practical consideration,'the Sheriff hsa little'discreti on when a warrant is placed in
his heads. Therefore, I am taking the liberty to suggest that the Sheriff is somatimea entitl
to consideration on that account, and possibly iF he trould submit a new bill Por ouch amount
as the Comarissionera think is reasonable, it would be the beat way to handle the situation.
The Commissioners would babe thb right to pay such a bill iP they saw Pit to do so.
