("Applicant") has applied to the Board ofCounty Commissioners of Pitkin County, Colorado ("BOCC") to extend the special use permit granted pursuant to Resolution No. 161-2000 for the Following uses: • Outdoor recreational uses: to host receptions, meetings, and similar activities in the botanical gardens that the applicant has created adjacent to the bam; • Club houses or recreational buildings used in connection with and accessory to a permitted outdoor recreational use: to utilize the barn in connection with receptions, meetings, etc. 2. The property is located on Prince Creek Road, and is more specifically described in Exhibit ..A „ 3. The property is zoned RS-30, and is comprised oftwo parcels containing a total of 422 acres. Both parcels are subject to a conservation easement held by the Aspen Valley Land Trttst, excluding the "headquarters parcel." The "headquarters parcel" is the subject of this application and includes the existing residence, barn, and guest cabin, and contains 11.88 acres. This area is located within the 224 acre parcel and is not a separate, legal parcel. The "headquarters parcel" is shown in Exhibit "B." 4. The BOCC reviewed the application at a duly noticed public hearing on July 25, 2001, at which time evidence and testimony were presented with respect to this application. 5. The BOCC finds that the limited proposed commercial uses (subject to the specific conditions set forth herein) represent an effort to address the economic issues associated with retaining land in ranching and agriculture, which is consistent with the Counts policies and the intent of the RS-30/PUD zone district to promote the economic viability of and to preserve agricultural lands and operations and to preserve the scenic quality of the ranch. 000001 er~3 Resolution Na.J~-2001 Page 2 6. The BOCC further finds that the Applicant has complied with [te conditions of Resolution No. 161-2000, and that the impact of the uses on the character of the surrounding residential and agricultural area, and on the quality of life of the residents of [his area, has been minimized, given the conditions, limitationsand mitigation measures specified in said Resolution. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby approve the Flying Dog Ranch Special Review Permit Extension, subject to the following conditions: The Applicant shall abide by the conditions of BOCC Resolution No. 161-2000, except as amended herein. 2. The permit for outdoor recreational uses and an associated clubhouse (the bam/event center) shall expire 4 years from the date of approval of this resolution. Prior to the expiration of the permit, the permit shall be reviewed by the BOCC at a public hearing to evaluate an extension of the permit or any changes to the conditions. 'the Applicant shall submit an annual report to the Community Development Director at least 45 days prior to the anniversary of the BOCC's approval, which demonstrates the continued conformance of the use to the conditions ofthe permit. If the Director determines that the use is not in conformance with the conditions of the permit, the Director may recommend to theBOCC that it consider withdrawal ofthe permit, pursuant to a duly noticed public hearing. 3. The annual report shall specify the number of people who ride the shuttles, in addition to the information required in condition #5 F of Resolution No. 161-2000. 4. The Applicant shall adhere to all material representations made in the application or in public meetings and hearings. Thin report reflects events from Jane 1, 2003 -May 31, 2004. We had a total of 12 events. The evems were in compliance wkh the rnnditioas of the Permit. We had no complaints to date. We bad 8 events which served slcobot. The shuttle was need for event of over 50 attendees or when ak~hol was nerved. The breakdown of eveuta is as follows: l2 events 1 event of 150 or leas attendees 7 eventa of 100 or less attendees 4 events of 50 or less attendees. Resolution No. 161-2000 extended and amended the original permit granted pursuant to BOCC Resolution No. 99-75. The Applicant submitted an application prior to the expiration date of the oneyear permit for events in the barn, and is requesting a four year extension of the permit so the expiration date would coincide with the expiration of the permit for the guest ranch and arts and crafts studio. APPLICANT: Richazd and Lydia McIntyre; Flying Dog West Ranch, Inc. LOCATION: 1625 Prince Creek Road ZONING: The property is zoned RS-30 PUD. The ranch is comprised of two pazcels containing a total of 422 acres of land (224 in one parcel and 198 in the other). The "headquarters" parcel, which contains the existing residence, barn, guest cabin, etc. contains 11.88 acres, and is located within the 224 acre parcel. REFERRAL COMMENTS from the Environmental Health Department are incorporated into the staff comments below and are attached for reference. The application was referred to, but comments were not received from, the Crystal River Caucus. STAFF COMMENTS: Compliance with Resolution No. 161-2000: The Applicant is limited to a maximum of 40 events per year with additional limitations on the number of attendees per event, number of vehicles or}site, etc. The Applicant's annual report (July 2000-June 2001) demonstrates compliance with these limitations (attached). The Applicant also provides monthly reports to the Environmental Health Department ("EHD") showing water usage. Nancy MacKenzie with EHD states that the reports were submitted on time and indicate that the Flying Dog Ranch has been in compliance with the special review permit aid that the water usage is well below the capacity that can be treated by the septic system. The Applicant commits to continue to abide by the conditions of Resolution No. 161-2000. The Applicant and staff have not received any complaints regarding specific events during the last dear. Limitations of Approval: The Applicant is requesting, and staff supports, afour--year permit for the continued use of the barn for events. Staff finds that the use is consistent with the special review criteria in the Code, and that the impact of the use on the chazacter of the surrounding residential and agricultural area, and on the quality of life of the residents of this area, has been and will be minimized, given the conditions, limitations and mitigation measures specifiedin the approval. Staff suggests that the Applicant be required to submit an annual report to the Community Development Director at least 45 days prior to the anniversary of the BOCC's approval attesting to the number of special events, the number of people attending, the number of passenger vehicles, and the number of shuttles provided, etc. Afrer four yeazs, the permit shall be reviewed by the BOCC at a public hearing to evaluate an extension of the permit or any changes to the conditions. Elk Mountain Lodge Code Amendment: The BOCC approved use of the Flying Dog Ranch and the Elk Mountain Lodge for special events/receptions under the following special review uses: Y "Outdoor recreational uses," which was interpreted by the BOCC to include weddings and receptions. Y "Club houses or recreational buildings used in connection with and accessory to a permitted outdoor recreational use." 000023 Staff has been concerned with the interpretation of outdoor recreational uses that was made when the Elk Mountain Lodge was originally approved in 1996 and subsequently carried over to the Flying Dog Ranch approval. Therefore, staff proposed a code amendment in association with the extension of the Elk Mountain Lodge's permit, which will be reviewed by the BOCC in September. Staff has recommended that the AFR-10 zone district be amended to include a new special review use- "reception hal Is and meeting facilities." This use would be defined as "facilities for the holding of events, including but not limited to weddings, receptions, meetings and group gatherings." Staff believes that this use reflects the actual use occurring at the Elk Mountain Lodge, as well as at the Flying Dog Ranch. The code amendment reviewed by the Planning Commission was only for the AFR 10 zone district, and not the RS-20 and RS-30 zone districts. However, staff feels that it would be appropriate also to include"reception halls and meeting facilities" as a special review use in the RS-20 and RS-30 zone districts. If the code amendment is approved by the BOCC in September, the permit for the Flying Dog Ranch could be amended to be fora "reception hall and meeting facility," rather than for "outdoor recreational uses and a clubhouse." RECOMMENDATION: Staff recommends that the BOCC adopt a motion "to approve the Flying Dog Ranch Special Review Permit Extension, subject to the conditions in the attached Resolution." Attachments A. Flying Dog West Ranch Inc. ("Applicant") has applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") to extend the special use permit granted pursuant to Resolution No. 99-75 for the following uses: • Guest ranch: to lodge guests in an existing cabin which accommodates six people and to wnstruct a second cabin to accommodate four people; • Outdoor recreational uses: to host receptions, meetings, and similar activities in the botanical gardens that the applicant has created adjacent to the barn; • Clab Louses or recreational buildlogs used in connection with and accessory to a permitted outdoor recreational use: to utilize the bam in connection with receptions, meetings, etc.; • Arts and craft studios: to create one or two small studio spaces (less than 500 square feet) within an equipment shed for use by artisans. 2. The Applicant also proposed to modify certain conditions with regard to the use of the tam for functions. 3. The property is located on Prince Creek Road, and is more specifically described in Exhibit ..A „ 4. The property is zoned RS-30, and is comprised of two parcels containing a total of 422 acres. Both parcels are subject to a conservation easement bald by the Aspen Valley Land Trust, excluding the "headquarters parcel." The "headquarters parcel" is the subject of this application and includes the existing residence, barn, and guest cabin, and contains 11.88acres. This area is located within the 224 acre parcel and is not a separate, legal parcel. The "headquarters parcel" is shown in Exhibit "B:' 5. The BOCC reviewed the application at a duly noticed public hearing on July 26, 2000, at which time evidence and testimony were presented with respect to this application. 7. The BOCC finds that the limited proposed commercial uses (subject to the specific conditions set forth herein) represent an effort to address the economic issues associated with retaining land in ranching and agriculture, which is consistent withthe County's policies and the intent of the RS-30/PUD zone district to promote the economic viability of and to preserve agricultural lands and operations and to preserve the scenic quality of the ranch. 8. The BOCC further finds that the Applicant has complied with the conditions of Resolution No. 99-75, and that the impact of the uses on the character of the surrounding residential and agricultural area, and on the quality of life of the residents ofthis area, has been minimized, given the conditions, limitations and mitigation measures specified in said Resolution. NOW, THEREFORE, BE 1T RESOLVED by the BOCC that it does hereby approve the Flying Dog West Ranch Special Review Use Permit Extension, subject to the following conditions, which shall supereede the wnditions of Resolution No. 99-75: 1. The permit for outdoor recreational uses and an associated clubhouse (the barn/event center) shall expire 1 year from the date of approval ofthis resolution, Prior to the expiration of the permit, the permit shall be reviewed by the BOCC at a public hearing to evaluate an extension of the permit or any changes to the conditions. The Applicant shall submit an annual report to the Community Development Director at least 45 days prior to the anniversary of the BOCC's approval, which demonstrates the continued conformance of the use to the conditions of the permit. If the Director determines that the use is not in conformance with the conditions of the permit, the Director may recommend to the BOCC that it consider withdrawal of the permit, pursuant to a duly noticed public hearing. 2. The pemtit for two guest ranch cabins and one arts and crafts studio shall expire 5 years from the date of approval of this resolutlon, Prior to the expiration of the permit,the permit shall be reviewed by the BOCC at a public hearing to evaluate an extension of the permit or any changes to the conditicns. Within 60 days of the BOCC's approval, the Applicant shall: A. Submit a septic permit to the Environmental Health Department to expand the existing septic system for the barn in order to comply with the current regulations, if required. If the property generates average wastewater flows in excess of 2,000 gallons, the Applicant shall submit a site application for a sewage disposal system to the Stato for review and approval by the Water Quality Control Division. B. Provide documentation to the Environmental Health Departrnent as to adequate quantity of water for the uses on-site. 5. The Applicant shall comply with the following conditions regarding use of the bam and gardens for functions: A. A maximum of 40 functions per calendar year shall be allowed, subject to the following limitations: 1) Maximum of 3 functions per week, only 1 of which may accommodate more than 50 attendees; 2) Maximum of 10 functions of up td I50 attendees per year, 5 of which may have amplified music and 5 of which may not have amplified music; with no more than 2 events of up to 150 attendees in any month; 3) Maximum of 10 functions of up to 100 attendees par year; 4) Maximum of 20 functions of less than 50 attendees per year. B. A maximum of 60 vehicles shall be allowed on-site during any function, including vehicles for staff for functions, occupants of the guest cabins, workers utilizing the arts and crafts studios, and residents of the property. Pazking shall be prohibited on Prince Creek Road. C. A shuttle service shall be provided for functions of more than 50 attendees or for any function at which alcohol is served. The Applicant shall provide written proof of permission to park vehicles off-site when the shuttle service is provided. When alcohol is served at a function, guests shall be required to utilize the shuttle service, except when a glass of wine or a beer is served following a meeting or seminar. D. Amplified music of all kinds shall end by 7:00 PM. Functions may not continue outdoors after dark; functions shall move indoors if they continue after dark, and the barn doors and windows shall be closed at that time. E. The Applicant shall utilize shielded lighting fixtures on the bam that direct light down to minimire the impact of any lights on the neighbors. F. The Applicant shall keep a record of any complaints received, including the nature of the complaint, the name of the complainant, the date and time of the alleged violation, and the response thereto. H. The Applicant agrees not to engage in atry use that requires a liquor license; otherwise, the Applicant shall comply with all applicable state and local liquor licensing laws and regulations. The Applicant shall comply with the Chemical Dependency Task Foree's recammendadons, as follows: 1) Require alcohol servers to show proof of TIPS (alcohol server) training. 2) Require all vendors who serve at the facility to have an established drug free workplace policy. 3) Require that non-alcoholic beverages ba available at no charge for designated drivers. 4) Limit hours of alcohol service for functions: do not start serving alcohol until after 12:00 PM and stop serving alcohol at least one hour before an event ends. 5) Require food to be served when alcohol is being served. 6) Provide water at all functions. 7) Prohibit use of alcohol or other drugs by staff, vendors and volunteers on duty. Food shall not be prepared on-site, nor shall dishes be washed on-site. K. Provide monthly reports to the Environmental Health Department documenting the water usage, particularly the water usage per event. 6. Guests using the bam facilities and guest cabins shall keep dogs leashed at all times. 7. Retail sales of products prepared in the arts and crafts studio are prohibited on-site. No studios shall be allowed that could produce toxic or hazardous waste. S. Curly two guest ranch cabins, each of which may contain two bodrooms, shall be rented. 9. The 1940s bam shall not be demolished and replaced with the second guest ranch cabin. The bam maybe renovated to accommodate the second guest ranch cabin or may be repaired and retained as a hero, subject to approval by the Historic Preservation Officer. 1041 hazard review may be required to approve the location of the second guest ranch cabin. 10. The Applicant shall adhere to all material representations made in the application or in public meetings and hearings. 11. This approval may be revoked with fourteen (14) days notice of a revocation hearing before the Board of County Commissioners. We are envisioning a future more closely aligned with the ranch, the conservation easement, the neighborhood and our lives. We have become increasingly sensitive to the impacts upon our property, the neighborhood and the liability of large celebratory events [150 people] ie. weddings. It has been an essential tool in funding the ranch operation. However, as we mature in these alternative ranching endeavors we envision a different, more serene existence. One that hopefully will provide the same financial support for the ranch. In our special use review (permit extension) on 7/26/00 we stated in our presentation that our emphasis was on holding conferences and developing corporate retreat potential. Since this time we have done extensive research and developed a business plan to support this new emphasis. Without goirig into financial details and specific operations the retreat could function as follows; the existing guest cabin would house the corporate guest (motivational) speaker. The meeting rooms would accommodate corporate participants for lectures and meals" We would arrange recreational opportunities and transportation for the clients. Based on our reseazch our facility would appeal to the 20-40 yeaz old young executive, who enjoy and pursue outdoor recreational activities. Our research also illustrates that this type of corporate retreat functions ideally with less than15 people (including speakers) and the duration of each retreat is usually 5-7 days. The Roarin Fork Valley's variety of outdoor recreational opportunities make it ideal for 12-14 weeks of our summer. Ideally this scenario would exponentially reduce the impacts of noise, alcohol, transportation (recently purchased a 25 passenger van) and the overall deterioration of our land and facilities. The red barn would continue to hold small conferences for community based themes and local non profits. These events are generally 25 people or less, no music, no alcohol and minimal traffic. The records of this past yeaz will attest to the regular demand of local community organizations and non profits seeking meeting space. We believe this scenario will be embraced by one and all given the support of the county. We would require the ability to erect 6 traditional native American Indian tee pees. The tee pees are produced in Montrose Colorado and would accommodate 2 people per tee pee. They would be erected on wooden decks and dismantled for the winter months. They would be constructed in a wooded area, and be visible only to our private home and accessible only on foot or by mountain bike. There is electricity from the irrigation pump house in the vicinity, however, we aze exploring solaz options with SEI (solar energy institute). We ask that you consider our request in hopes that we may all benefit from a more ecologically sound and neighbor friendly variation of our special use permit. If approved we would build the decks this summer anticipating setting up tee pees in the spring of 2002. Soon we will be scheduled for our annual review of June 2001, and would welcome the annual review process to continue for as long as the'county deems necessary.
