The Board of Co my Commissioners of Pit kin County, Colorado, met at 10:00 AM,
November 16, 1959 with the following members present: Chairman, T, J, Sardy; Commissioners
Orest Gerbaz and Samuel Howell; Peggy E,Coble, Clerk; Robert Delaney, County Attorney.
Minutes of the meeting of November 2, 1959 were read and approved,
Bills were audited, approved and ordered paid from the Various-Welfare Funds as
follows:

Walter B, Mills, owner of lands including portions of-Snow Bunny Subdivision, and
the area of the proposed gold' course north of Colorado $2 and west of Castle Creek, appeared
and advised the Commissioners that he and other residents of that area were having a great
deal of difficulty with horsed running on the public roads, betting on his lands and on the
lands of other people in that neighborhood; had been ruining the greens of the golf.' course
now under development, as well as lawns and generally causing substantial damage. Mr, Mills
!requested permission of the Board to install a cattle guard at the intersection of Colorado
I~Iighway 82 and the Cemetery Lane, and after discussion, Mr, Mills was advised that the
Iommissioners would make further inv estigation of the ma ?;ter, and give the matter further
!consideration and thereafter advise him as to whether the County would consent to the
Installation of such a cattle guard,
! Mr, James Snyder appeared before the Commissioners requesting information pertain-
ing to the County~s commencing maintenance and snow removal on Hop]~ins evenue in East Aspen,
dvising that Mr, Hans Cantrup had informed him that the County was agreeable to assuming
such maintenance provided the ditch now located in the street was covered, {end that Mr,
~trup had requested Mr. Snyder~s cooperation in placing boards over the ditch, Mr, Snyder
as advised that the Commissioners had not agreed to assume and undertake the maintenance
and snow removal of Hopkins Avenue in its present condition, rather that they had advised
r. Cantrup that as the roadway now exists it would not be possible for the County to assume ',
is responsibility, a1d had advised him that they would confer with him about alternate plans''
for maintenance and snow removal by the County, and was f urther advised that the Commissioner
did not consider the idea of covering the ditch with boards as being practical and did not
feel this would be a feasible solution to the problem.
It was reported that Mr, Charles V, Kettering had requested information ascto Iii
Nether the Planning and Zoning Commission and the Board of County Commissioners would agree '~i
to remove zoning restrictions from the area near the railroad tracks west of Mill Street ~
ad3acent to Aspen, and had further advised that if such area were removed from 7~oning control}
that prospective development might occur. The Commissioners concluded and advised that they
would not consHntrto removal of zoning restrictions from this area, and that if any plan of
!,development was contemplated that would necessitate a change of zoning classification, that ~
jthe proper procedure would be be to petition for suEh zoning classification which would then '

Budget and as provided by tax levy, and other revenues of said County, for the fiscal year
1960, are hereby appropriated in the amounts according to the funds specified in said
Budget for the purposes of meeting the expenditures in this resolution authorised.

~osn, ^erbaz reported that '~e had been contacted 'o~~ Stanley Natal concerning a Quit
Claim Deed and vacation resolution as to portions of a vacated county road right-of-way
through Mr, Natal~s property, and upon reviewing theminutes it was concluded and determined
that since Mr, Natal had conveyed to the County a right-of-way for the relocated road
extending up Woody Creek constructed by the United States Forest Service, under agreement
whereby the unused portions of the former rift-of-way would be vacated and reconveyed to him
that a proper description and Deed should be prepared, and the Chairman was authorized and
directed to act as Comm'ssioner to convey for the County, and to convey such vacated and
unused portions of the former County right-of-way as were no longer needed, within the
boundaries of T~?r, Natal~s land to him.
The County Attorne~r reported that the latest revision of the Operating Contract
with the Mennonite Board of PTisstons and Eharities had been approved by that Board, and had
also been adopted by the Pitkin County Hospital Board, whereupon on motion duly made seoond-
ed and unanimously adopted, the Chairman and Clerk were authorized and directed to execute
the contract on behalf of the County Commissioners.
n?r, Ro Vroom arreared requesting inf,rmation from the Commissioners as to how .long
the gravel crus~ng and related operations might be expected to continue on the Henry Stein
land westerly of the cemeteryland road. P?r, Vroom was advised that at the present time
it was impossible to determine how long this operation would continue, since it was essential
tb the Countyts road improvement program in that vicinity and extent of that Pz'ogram is
presently undetermined.
Liquor License application for a package liquor store license submitted by
O,R, Ylhite of Redstone was considered and upon recommendation of the County Attorney, the
application was retuned for amendment on account of references tr in such application to
xistence of a 3,2 Beer License being used and the County Attorney advised he would check
~rith Mr, White and also the State Liquor License Department concerning the use of two
icenses,
Consideration was Piven to the setting of a date for hearing on Zoning changes i,
~ d it was concluded that this matter should be deferred until a later meeting, looking to a
Baring after the first of January 1960. i~
G A request by the Pi~.n County Zoning Commission that the Commissioners consider
~he adoption as a part of their zoning regulations of a building code the same or similar
~ ito that adopted by the City of Aspen was considered, and the Clerk was requested to procure
opies of such building code for consideration b- the Commissioners and the County Attorney.
Representatives of the Addressograph Company appeared before the Commissioners arsi
~ xplained the value of the addressograph system and were advised that the Commissioners were it
of presently in a position to consider the purchase of such equipment, but were interested
the savings in time and expense that would probably result from the use of such equipment, 1,
particularly in the assessors office and treasurers office, and it was suggested that these~!i
representatives appear before the Commissioners at a later date.
Clinton B, Stewart appeared on behalf of Nino Hirsig regarding outstanding tax Sal
ertificates on the East 25 ~ of Lot Q Block 32 East Aspen and after investigation the
I ollowing resolution was adopted:

and they or their predecessors in title have erected valuable improvements thereon and paid
taxes £or many years thereon based upon Pitkin County Treasurers Deed recorded in Book 173
at Page 42 based upon Tax Sale Certificates assigned by this Board to former owners for a
valuable consideration, and it was the intention of this Board to transfer all certificates
for taxes upon said lbts at the time of former assignments thereof, but it has been discover
ed that many certificates are still held by the County creating a cloud upon the record titl /^~
to said property,
NOW, THEREFORE, BE IT RESOLVED by the Board of Co my Commissioners of Pitkin
County, Colorado, that the Pitkin County Treasurer, in consideration of the sum of '1.00 for
each certificate to be paid at or before assignment, is hereby directed to assign to
Herman F. Hirsig and Elsy B. Hirsig all of the following described tax sale certificates
held by Pitkin County, to-wit:
