Pursuant to Section 3-200-080 of the Land Use Code, William and Deann Snider ("Applicant") have applied to the Community Development Director of Pitkin County, Colorado ("Director") to amend the prior approval to extend the building envelope to the south and west property lines. 2. The lot is located off of Prince Creek Road on Cabin Drive, and is described as Tract 7, Stark Mesa Subdivision. 3. The lot contains 5.5 acres and is a noncoufonning size lot in the RS-30 zone district. 2. The Hearing Officer ("BOCC") granted 1041 hazard review and conceptual submission approval, pursuant to Determination No. 19-2005. TI>.e 1041 site plan was recorded in Plat Book 75 at Page 28. 3. The Director finds that the proposed amendment will not change the use of the proposed development or the basic chazacter of the land, is consistent with action taken during the original review, does not create additional impacts on 1041 areas or increase off-site impacts or the allowable floor area, and will not endanger the public health, safety or welfare. THE DIItECTOR DOES HEREBY APPROVE the Snider 1041 Hazard Review Amendment, subject to the following conditions, which shall run with the land and be binding on all successors in interest: I . All conditions of Hearing Officer Determination No. 19-2005 shall remain in full force and effect, except as amended herein. 2. Within 60 days of the date of this approval, the Applicant shall submit a revised 1041 Hazard Review Site Plaa to the Community Development Department for approval and recording. The mylar copy of the site plan must be signed by the owners prior to submittal for recording. The site plan shall be amended to extend the building envelope on the south and west sides to the property lines. 3. Any development located within setbacks shall require a variance from the Board of Adjustment. This approval does not assure approval of the variance. 4.
