Coble; Robert Delaney being absent. .The following reaolutionwas adopted: RESOLUTION - - WREREAS„Leonard Short of Redstone, Colorado,. during 1959 applied for a restaurant license for the sale of-malt, wepousand -spirituous liquor. by the drink atRedatone, Colorado, .and notice of hearing.on each application was published, and hearing conducted thereon, but no license issued due to failure [o meet Sheaondi[iona specified-by. the Commiaeioeers and to-.aomply~with .steps necessary for issuance .of license, and WfffiREAS, ,during 1960 application was made for issuance of a restaurant license, likeviae for Che 'sale of malt, venous or spirituous liquor by the drink.. on premises ~cone[ructed by .Leonard Short at Redstone, Colorado, sand dt~wasrequired by.~.the,COmmieaionere .that. publication be made ~in the Aspen .Times, a weekly newspaper publ iahed in Pitkin County, of. -public hearing before this Board a[ [heCoor[house. in Aspen, Colorado, an. such application,. which application was duly and.properly made, .and WBEREAS,.in accordance with-said:publiahed notice, public hearing was-.conduc tad by this Board on May 18, 1960, at which all persona appearing were afforded full opportunity to be heard and express their opinionaand objections, and Che Chairmen of this Board having been designated to personally inspect. the premises sought to be licensed; the neighborhood, area and conditions relating to is~uance.of the license and having reported to this Board,. and the said premises having.been-inapegt~ed,by. Paul Adama,S[ate Liquor Inspector for the Department. of Revenue, and having been reported by him ascomplying with all .conditions for licensing,-and: all pe i itions„ lettera,xemonatraneea and other eoammnicakiona inrela[ion-[o [he am issuance of such license having been taken into account, and WHEREAS, the applicant Leonard Short has been found and determined to be qualified under the law to hold ouch license. NOW, THEREFORE, BB IT RESOLVED. by the County Commisaionera of Pitkin .County, Colorado, tha[thisBoard does hereby find as follows: 1. That said Leonard Short has made application to this Board for issuance of a restaurant license for the sale of malt, venous and spirituous liquor by the drink in premiaea owned by .him and now constructed-at ' Reda[one,.Colorado, which premises are in compliance withthe law for restaurant licensing and otherwise comply with the requirements of the law for the ieauance of the license applied for. 'h..,,,_ 2. That the said license application is in due form, properly executed, and that publication has been ~,,,,, made in the manner and for the time required by law, by appearing in [he Aspen Times, aweekly newspaper authorized by law to publish legal notices in Aspen, Colorado. 3. That there has heretofore been issued one restaurant license for the sale of malt, venous and spirituous liquor by the drink at Redstone, Colorado, which is now in use in connection with the operation of the Glemuood Hot Springs Company lodge and resort; that said resort has in the past been open only during the summer months and is cloned during .moat of the year and may reasonably be expected to continue closing during the winter months; that while the Glenwood Hot Springs.. Company lodge is open [o the general public, during the summer months when the same isopen, such establishment caters primarily to persona .residing at the premises, and to aua®er visitors conalating primarily of the tourist population. ' 4. That no other license fox the sale of malt, venous and spirituous liquor by the drink exieta in the Weet end of Pitkin County and that when said lodge ie closed, the nearest licensed premises for the ~' sale of such beverages is at Carbondale, Colorado, in Garfield County, a'dietance of some 18 miles from I Redstone over a rough, narrow and mountainous road and that the reasonable requirements of the inhabi[an[a of Redstone are no[ being adequately served by the said Glenwood Hot Springs Company licensed premiaea. ~' S. That the permanent, year around 'population of Redstone has-been constantly growing and may reason- ably be expected to grow, .due primarily to con®erc ial develppmente in that vicinity, including a large coal mining operation, transportation of coal, and other cammerc ial enterprises; that's aubatantial number of the workers involved therein are permanent, year around residents of Redstone; that the growth of Redstone may reasonably be expected to continue 'as is evidenced by extensive aubdiviaion plans; new construction, eatatiliahment of a post office, andother activities; [hat a majority of the permanent inhab i[anta of Reda[one favor the ieauance of the license-applied for and the establishment of a restaurant with the.' privileges permitted by ouch license. - 6. That moat of the objet bona and protests to the issuance of license applied for were based upon alleged proximity. of .the premises sought to be licensed to private dwellings; that objectors indicated they would not oppose other. commercial development in [he vicinity, but were opposed to a bar with Che sale of liquor; thatmos[ of such objectorahave Yndica[ed [hey would not object Sf the licensed premises were located elsewhere in the co®unity of Redstone; that the Commissioners have determined, that whether or not such objections are valid reasons for denial of a license, that the premiaea sought to be licensed isso construe tad, located and designed ae to cause little if any inconvenience to the objectors, and is not in such close proximity to their houses as to create any nuisance; that the premiaea are not conatruc tad, designed or adapted to use as a nightclub, dance hall of, similar enterprise. BE IT FURTHER BESOLVED that the application for license of Leonard Short shall be granted and the Chairmanand Clerk of this Board are authorized and directed to approve the same and to issue license accordingly. ere sing no f he business, the Board adjourned.
