Howell; Commissioners Oreat A. Gexbaz and Samuel W. Howell; Peggy E. Coble, Clerk and Robert Delaney, County. Attorney. Bills were audited approved and ordered paid from the various funds as follows: ~, OLD AGE PENSION: $5789.64 WELFARE: $1156.23 ~I' HOSPITAL FUND: $1513.64 ~I HOSPITAL II~ROVE: $11,839.50 Mr. William Dunaway, Publisher of the Aspen Times, appeared before the Commissioners and requested [haul 'hey initiate an investigation of the financial affairs of the Aspen Fire Paotection Die[ric t. After discussion slit was determitred Chat nothing had been presented and nothing gppeared that would come within purview of the ommiasionere duties; that the Aspen Fire Portec[ion District is a separate and distinct agency of Government nd the Commissioners have no jurisdiction over that body, and therefore that the Commiasionelrs should not ~ stoma involved. in ahch an investigation, whether i[ was or was not merited. Mr. Whitey Davie appeared before the Commissioners requesting permiea ion to install a garage and ~, utomobile repair shop on property of Sparovica in the R-15 zoned area of Pitkin County. He was referred [o it he Board of Adjustment. ~~ On recommendation of County Engineer G. E. Buchanan, Mr. Hal Hartman was authorized to paint the true ,[h Bridge across the Roaring Fork River. Mr. John Oyharcabal, representing the Televia ion Committee discussed [he proposed installation of the ~tranalator or booster station at Redstone, and was authorized [o proceed on behalf of the County with the other ~ era of the Committee as outlined in resolution adopted by the Co®isaioaera. The Cos®isaioaera discussed in detail [he matter of a check for .$1,000.00 tendered to the County by St. Benedic[s Monastery ihnlieu of taxes on cattle and ranch property being used at the monastery. The Commissioners were advised that ouch propertyhad been removed from the tax rolls by the Assessor upon direction f the Colorado Tax Commission. The County. Attorney advised that there would be a question as to the tax exempt tatus afgproperty used for income producing purposes, even though owned by a regigious or charitableorganiza[io hat [he Commissioners did hot have power or authority to compromise taxes, or accept contributions in lieu of, . ..._ _ __, _~_~ ..L_ .... «,...-a «.. ..,ate .ocrri o.t ed to the or,.vis ions relatine to the Board of Equaliz ti . 1 i and to the power to grant abatements or refunds of taxes illegally assessed or collected, and that therefore the Commissioners could not as a matter of contract accept such contributions in .lieu of Coxes, if any were owed. The County Attorney was thereupon instructed to teturn the-check [o the Monastery with an explanation and also to express the Commissioners sincere thanlca for the generous act of the Monastery in offering [he check. BE IT FURTHER RESOLVED that said petition as it relates to Tax Schedule No. 535, to Minnie B. Fora land for an abatement of $49.57 is hereby denied, for the reason that the Commisa ionera have determined that [he trailer house therein described was riot licensed-during the .gear 1959 and that [he tax is. just and should be paid, and it is directed that [he Treasurer proceed to enforce collection thereof. BE IT FURTFIER RESOLVED that the said petition as i[ relates to Tax Schedule No. 536 to Niles B. or Oscar Foralund for abatement of $39.66 is hereby denied for the reason [hat it appears to the Commissioners that the trailer assessed in said schedule. was..not licensed during [he year 1959, and that the tax thereby assessed should be paid, and the Treasurer is 'directed-to proceed forthwith to the collection of said [ax. BE IT FURTHER RESOLVED that the assessor and treasurer are hereby directed that they shall no[ in [he future attempt any abatements, [ax refunds, or revis lone of the tax rolls after ~[he same have been certified to the Treasurertunlea s._and until petition for abatement is granted by the Co®isaionera and approve by the Tax Commission as regitiired 'by. 18w.
