MEMORANDUM TO: Board of County Commissioners Regulaz Meeting -June 25, 2008 THRU: ~(' ~"C~ Cindy Houb~n`; Community Development Director FROM: Cazi Anne Holcomb, Planner ~: Morrow/Verizon Wireless Special Review for a Cellulaz Facility SUMMARY: The Applicant is requesting a Special Review approval pursuant to Code Sections 2-30-30(h), 4-30-40(g) for the permanent construction of a 33-foot mono-pine, freestanding cell tower and associated mechanical equipment (see attachment ). The facility will be located within an 800' SF lease area and replace an existing, temporary cellular facility on the property. The existing facility is a temporary Verizon facility approved and built pursuant to BOCC Resolution No. 160-2005, which allowed the COW use until December 31, 2006. The temporary commercial use permit was extended several times under Resolutions Nos. 128-2006, 25-2007, and 94-2007 and finally 36-2008 extending the permit through October 31, 2008. APPLICANT: Verizon Wireless/Colorado RSA No. 3 Limited Partnership (Robert T. Morrow is the owner of the property) REPRESENTAIVE: Ann Closser LOCATION: 0097 Sherman Lane; Common Parcel 1, Wingo Junction Subdivision ZONING: AR-10 REFERRAL COMMENTS: The application was referred to the Holland Hills HOA and the Town of Basalt; their comments are attached. Emma Caucus was also referred with no comment. EXISTING CONDITIONS: The property is currently developed with an existing 28-foot mono- pine freestanding cell tower and existing equipment shed on one of two common pazcels within the Wingo Junction P.U.D. The surrounding properties include Holland Hills, Hoaglund P.U.D., the Koch Lumber Site, the Barta Family pazcel, and Samuelson Tracts. STAFF COMMENTS; Special Review Standards Section 2 30 30(hl A cellular telephone facility is considered a Special Review Use requiring approval within the AR-10 zone district: A. The special review use shall be consistent with the applicable County Master Plan. Response: The proposed site is within the mapped scenic foreground area as defined by the Pitkin County Down Valley Comprehensive Plan. The purpose of the scenic foreground is to "steer development away from highly visible sites and to minimize the visual impacts of limited development which may occur in the foreground so as to obtain an aesthetically pleasing, rural approach to the resorts." The proposed development will have negligible impact on the scenic quality as it will be "disguised" as a pine and screened by required vegetation. It is currently almost non-visible from Highway 82 due to the berm and elevation differences. B. Tlae special review use shall zaot conflict with any applicable sections of the Pitkin County Land Use Code, including the County Land Use Policies in Chapter 1. Response: The proposed development is consistent with applicable Sections of the Code C. The proposed development must not materially endanger the public Izealtla, safety or welfare. Response: Staff has no information that would indicate that the development would materially endanger the public health, safety or welfare. D. The proposed development must not substantially injure the value of adjoinizlg or abutting property. Response: Staff has no information that would indicate that the development would injure the value of adjacent properties. The Applicant has been extremely concerned with providing an aesthetically pleasing development and working with the County to avoid any complications and controversy. E. Tlae special review use shall be consistent with the intent of tlae zone district in which it is proposed to be located. Response: The intent of the AR-]0 wne district is to "accommodate...residential development that maintains the rural chazacter and appearance of the land." The proposed facility in large part will retain the scenic quality of the land due to the pine-like appearance and vegetation screening. The maintenance shed has been designed to match nearby rustic cabins to further mitigate any impacts. E The special review use shall be compatible with the character of the immediate vicinity of the parcel proposed for development and surrounding land uses, or shall enhaaace the mixture of complimentary uses and activities in the inaznediate vicinity of the parcel proposed for development. Response: The character of the immediate vicinity is primarily residential. Several (over thirty) other poles for various uses including electrical transmission lines and transformers blanket the neazby azea. G. The location, sue, design and operatizag characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse effects, including visual impacts, izzzpacts on pedestrian and vehicular circulation, traffic generation, parking, trash, service delivery, air/water pollutiozz or other impacts on zaatural resources, noise, vibrations and odor on surrounding properties. Response: The proposed facility will have minima] visual impacts on the surrounding environment due to the disguise of the stealth pole as a pine. Also the equipment shelter has been designed to replicate the nearby rustic cabins. A manicured earth berm with substantial landscaping will be installed to screen the facility on both the north and east sides. The proposal will not adversely effect pedestrian or vehiculaz circulation, pazking, trash, service delivery, noise, vibrations, and odors on the parcel or surrounding properties. H. There must be adequate public facilities and services to sense the special review use, including but aaot limited to roads, potable water, sewer, solid waste, parks, police, ftre protection, emergency medical services, hospital and medical services, drainage systems, and schools. Response: The location currently provides adequate services to support the proposal, as there is an existing service road to the facility. The landscape will be irrigated with water from an existing system on the property. The Applicant will be required to gain an access easement as well an easement for the facility. Cellular Telephone Facility Section 4-30 40(Gl A. Freestanding Towers A non-stealth, feestanding tower shall not be located within two hundred (200) feet of an existing urbaaa/suburban residential district. Freestanding non-stealth telecomn:aaaaication towers located more than hvo hundred (200) feet from an urbaaa/suburban residential, commercial, or special purpose roase district may be permitted through special review. The naaxinaunt permitted height for freestanding towers is forty (40) feet. Response: The proposal is in compliance with the setbacks and height. B. Co-Location Required Each anew tower shall be designed to accommodate one (I) additional user's equipment. Response: The Applicant will be required to comply. C. Setbacks 1. All towers, both concealed and not concealed, shall be set back from all existing dwellings and other urbaz/suburban zone districts property by a minimum of two hundred (200) feet, or at least two (2) times the height of the proposed tower, whichever is greater. 2. All towers, both stealth and non-stealth, in a business, commercial, or special purpose zone district shall be set back a distance equal to the height of the proposed tower from the property boundary or rights-of--way, whichever would require the larger setback. Response: The proposal coanplies with the 200 foot setback requirements. D. General Development Standards 1. Design and Neighborhood Compatibility a. The exterior appearance of all towers mad associated support structures and buildings shall be compatible with other buildings and/or tlae natural environment in the surrounding area. b. The Bom~d may require the applicant to apply to the Federal Aviation Administration (FAA) for compliance with FAA standards for a dual lighting system rather than a red mad white marking pattern, wheaa tlae Board determines suck a marking pattern would cause aesthetic blight due to the visibility of the tower. 3 c. This provision does not prohibit the periodic maintenance or periodic monitoring of equipment azad instruments. d. No advertising sign or logo shall be permitted on any teleconmzunications facility. e. The decision-making body zzzay require may other conditions to nzltigate the impact of the tower on adjacent properties and uses. Response: The exterior appearance of the facility, in general, is compatible with the surrounding area. The tower will be partially shielded on three sides at the bottom by the landscaped berm, while the tower itself will be well designed to blend with plantings on the berm. The FAA requirement is not applicable and the support building is for mechanical only. There will be no advertising on the facility. 2. Buffering mad Screening a. All fences and walls shall be screened with landscaping meeting the requireazzeuts of Sec. 7-20-130(d)(2)(a). The Board may require all materana(ae) be appropriately screened to safeguard surrounding property provided that such screening will not interfere with tlae transmission mad/or reception capabilities of any antennae located on tlae tower. b. Output power levels from the tower and/or all associated antennae shall not exceed the current federally approved levels for the tower as a whole for exposure to electromagnetic radiation. c. Radio, television, or other electronaagzetic transmission(s) or reception on other properties shall not be disturbed or diminished. Response: The Applicant has committed to compliance with these requirements. E. Existing Towers New antennae may be co-located upon towers that exist on [he 5°' of July, 2006 without the need to obtain a separate special review approval. Response: N/A RECOMMENDATION: Staff recommends the BOCC adopt a motion approving the Verizon Wireless Special Review, and Activity Envelope Review for a Cellular Telephone Facility citing compliance with Code Sections 2-30-30(h) and 4-30-40(g). Draft Resolution RESOLUTION OF THE BOARD OF COUNTY CONIl1'HSSIONERS OF PTTHIN COUNTY, COLORADO, GRANTING APPROVAL FOR THE VERIZON SPECIAL REVIEW FOR A NEW CELLULAR TELEPHONE FACII.ITY STTE LOCATED AT 97 SHERMAN LANE Resolution No. -2008 RECITALS 1. Verizon Wireless ("Applicant") has applied to the BOCC for Special Review approval pursuant to Code Section 2-30-30(h) and 4-30-40(g), for the construction of a 33-foot mono-pine, freestanding cell tower and associated mechanical equipment. The facility will be located within an 800 square foot lease azea adjacent to an existing temporary cellular facility on the property. 2. The property is located at 0097 Sherman Lane and is owned by Robert T. Morrow. The properly is known as Common Parcel 1, Wingo Junction Subdivision. 3. The property is caned AR-10 and contains 14.25 acres. 4. The property is located within a low wildfire mapped area. 5. The Applicant submitted a complete application after July 6, 2006, therefore, the application is being considered pursuant to the 2006 Land Use Code. 6. The BOCC heazd this application at a duly noticed public hearing on June 25, 2008, at which time evidence and testimony were presented with respect to this application. 7. The BOCC finds that the proposal is consistent with the applicable master plan and the Special Review Criteria in the Land Use Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners that it hereby grants approval to the Verizon Wireless Special Review for the construction of a 33-foot mono-pine, freestanding cell tower and associated mechanical equipment subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and public meetings. 2. All previous conditions of approval on the property shall remain in effect unless modified by terms of this approval. 3. No calculations for height, bulk, setback, size, floor azea, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit review. Structures represented in the application may not be permitted under building and zoning regulations. 4. All development associated with the facility including access, reclamation and landscaping as described in the application, shall be allowed only within the leased area. Resolution No. _-2008 Page 2 5. Prior to building permit application, the Applicant shall record a copy of the lease agreement between the carrier and the property owner. The entire extent of the lease shall run for a period, including all renewal terms, of no longer than nineteen (19) years. 6. Prior to building permit application, the Applicant shall be required to submit for approval by the County Attorney and Community Development Director a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2-30-20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The Mylar copy of the plat shall be signed by the owner prior to submittal for recording. The plan shall also incorporate the following changes: a. Change the title to "Mon•owNerizon Cellular Facility Activity Envelope and Site Plan"; b. Provide (1) 1" = 20' plan view of the site; c. Include the earthen, landscaped berm so it is located within the Activity Envelope; d. Clearly designate and label the Activity Envelope from the Verizon Wireless Lease Area; e. Include, clearly designate and label all utility and access easements associated with the cellular tower facility; f. The Activity Envelope and Site Plan shall include a signing block for the Community Development Director; Prior to building permit application, the Applicants shall submit a landscape plan to the Community Development Department for review and approval which extends the earthen bean and vegetation on both the East and West sides of the mono-pine tower, and that reasonably screens the tower on these two sides. Landscape treatments shall use indigenous species of shrubs and trees and shall be sufficient to block visibility of seventy- five (75) percent of the equipment within three (3) years of planting. 8. All azeas disturbed by construction of the permanent facility shall be re-vegetated with native shrubs and grasses within one growing season of the project's completion. Any vegetation which is disturbed during construction shall be restored to its original condition. Planting used for restoration shall be similar to the existing vegetation in the area. Applicant must adhere to use of Pitkin County Seed Mix for re-vegetation of area. Applicant shall provide the county with a landscape bond of $22,000 to assure establishment and maintenance of the landscaped berm. 9. Prior to the building permit issuance, the Applicant shall: a. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. All slopes steeper than 2:1 shall utilize erosion control blankets. b. Submit a construction management plan for review and approval by the County Engineer showing the locations of staging, material storage and employee and construction traffic parking. c. Obtain an Earthmoving permit for the earthen berm. Resolution No. _-2008 Pale 3 10. No development shall occur outside the approved envelope. No structures shall be permitted outside of the approved activity envelope: Applicant shall be required to obtain an Earthmoving Permit for any work outside the approved envelope. 11. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing azound the construction site within the perimeter of the building envelope. The fencing shall remain in place until issuance of a Letter of Completion. 12. Prior to final signoff of the building permit, all equipment and development associated with the temporary cellular facility shall be completely removed. All areas of disturbance associate with the temporary facility shall be re-vegetated within sixty (60) days of removal. Planting used for restoration shall be similar to the existing vegetation in the azea. 13. The tower shall be set back from all existing dwellings and other urban suburban zone districts property by a minimum of 200 feet. 14. All equipment associated with the wireless telephone facility shall be set back a minimum of 100 feet from the highway right-of--way. 15. No advertising sign or logo shall be permitted on any of the equipment associated with the facility. 16. The mono-pine tower, including the pedestal, shall not exceed 33 feet in height above the natural or finished grade, whichever is most restrictive. No component of the mono-pine "tree," including branches, may exceed 40 feet in height from the natural or Finished grade, whichever is most restrictive. 17. The antennae upper most edge shall be located no higher than 28 feet in height above the natural or finished grade, whichever is most restrictive and shall be cloaked in antennae wrap of a color matching the foliage to best camouflage the antennae. 18. The antennae and mounting hardware shall be painted to match the orange-brown to gray-brown scaled color of the "faux" pine tree truck/branch bark. 19. The antennae array shall be completely screened by foliage so that the antennae aze reasonably invisible to an observer within 150 feet of the tower. The diameter of the antennae array shall be less than the "drip line" diameter of the foliage at any point of the array placement. 20. The branches for the mono-pine shall be similar in shape, color and number of branches, to an actual 33-foot Lodgepole Pine (Pinus contora var. Zatifolia) - a tree shape that is mostly tall, slender and columnar with a narrow rounded crown, with yellowish-green, 2- 2.5 inch needles in groups of two, usually curved and slightly twisted. The constructed pine shall appear healthy, full and vigorous. 21. At a minimum, the mono-pine branches shall be maintained at a medium density, consisting of two (2) branches for each one (1) foot of pole, with the branches located no lower than IS feet in height above the natural or finished grade whichever is most restrictive to simulate the look of natural Lodgepole Pines. Resolution No. _-2008 Pale 4 22. The colors applied to the mono-pine (i.e. faux trunk, branches and leaves) shall be natural appearing and simulate a Lodgepole Pine -yellowish-green needles with thin, orangey- brown to gray-brown trunk with many small, close scales. The design of the mono-pine tower (i.e. trunk) shall also have the ability to be easily modified (e.g. new/additional and/or replacements of damaged/color faded branch attachments, re-barking of trunk, etc.). 23. The equipment shed shall be designed and painted a color to blend with the neazby rustic cabins on the property. 24. The mono-pine tower shall be designed to accommodate at least one (up to two) additional wireless telecommunications carriers. To ensure the design is not compromised, the design and size of the mono-pine shall be designed to accommodate an additional carrier without the need for significant alterations to the stealth tower. 25. The Applicant shall maintain the wireless communication facility (mono-pine tower and associated equipment) in good condition and shall agree to reasonable repairs and replacements of equipment, stealth and structural components, due to damage caused by outdoor exposure and/or inclement weather. Under this condition, if the faux branch attachments, pine needles and/or trunk bark, among others, fade in color due to outdoor exposure, the applicant shall replace such components within 90 days of written notice by the Community Development Director If the work cannot be completed within 90 days, the applicant shall provide the County with a bond or certificate of deposit in the amount of the valuation of the requested repair and completion timelines to guarantee the work. 26. All equipment associated with the facility, including cooling must comply the noise ordinance specifications as described in the Pitkin County Code, § 6.36.030. Ventilation fan exhausts shall be located so they are not on a side of the building that is adjacent to a residence. 27. The facility shall operate at all times in compliance with all Federal Communications Commissions (FCC) standazds for Radio Frequency Radiation (RFR) emission levels. Access shall be provided upon request to Pitkin County to conduct an independent RFR emission study to ensure that the tower equipment is operating within those FCC standards. If said emissions exceed safe RFR emissions standazds, as defined by the FCC, then said emissions levels shall be remedied by the property owner within five (5) working days of notice by Pitkin County. Such remedy shall be confirmed within those five (5) working days by independent RFR measurement at the facility owner's expense. If the remedy is not available within 5 days of notice by Pitkin County, the equipment generating the excessive RFR emissions shall be turned off until a remedy is operational. 28. The finished height of the equipment shed shall not exceed fifteen (15) feet in height above the natural or finished grade, whichever is most restrictive. 29. Exterior lighting associated with the telecommunications facility shall be limited to one (1) small, covered light above the entrance door of the equipment shed and will meet all Lighting Code Standards as outlined in the Pitkin County Land Use Code §7-20-140 and all Building Codes as specified by the 2005 National Electrical Code (NEC). 30. The Applicant shall comply with the requirements of the Basalt and Rural Fire District. Resolution No. _-2008 Page 5 31. Standards Applicable to All Wildfire Hazard Areas: Development is allowed in wildfire hazard areas subject to confortnance with the following development standazd. A. Defensible Space: The area around all buildings/structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): a) Brush, debris and non-ornamental vegetation shall be removed within a minimum ten-foot (10') perimeter around all structures. b) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines for Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). c) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. d) All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. e) Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten (10) feet between the edges of the crowns, except for mature stands of aspen trees where ladder fuels have been removed. In areas of aspen regeneration, understory shrubs and down and dead materials shall be removed. f) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. g) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. h) All deadfall up to a one hundred (100) foot perimeter shall be removed. i) No new conifer trees shall be planted within ten (10) feet of a residence. j) No flammable mulches shall be placed within two (2) feet of a residence. k) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Access Access roads and driveways shall be built to County standards; however, these standards may be increased to mitigate wildfire hazards based on comments provided by the Colorado State Forest Service, the Sheriff s Departrnent, local fire protection districts and/or a person approved by the County as an expert in wildfire area designation and mitigation. Resolution No. _-2008 Page 6 C. Water Supply for Fire Safety a) When access to a public or private pressurized water system is not available or if it is necessary to augment fire protection water systems, private ponds may be used if approved by the Community Development Department and the local fire district. b) Any Fire department recommendation for individual structwe water supply and storage shall be accessible to fire department vehicles from the exterior of the structure through a fire department approved mechanism (such as a fire hydrant). The amount of storage capacity on the parcel shall be determined by the Fire District. c) All new development shall conform to the appropriate building Code(s) with regazd to sprinkling structures. D. Roofing Materials, Roofing Vents and Projections At and Below Roof Line. Unless the wildfire expert has recommended a different method of construction, roofs and projections at or below roof line in Low, Medium and Severe Wildfire Hazard Areas shall be constructed according to the following specifications: a) Low Hazard Area 1. Roofing Materials 2. Class A covering or Class A Assembly as defined by the currently adopted Building Code. 3. No wood shakes or shingles. 4. All other adopted Building Code compliant methods and materials permitted. E. All Hazard Areas: Roofs with less than a 3:12 pitch are not permitted in Low, Medium, or Severe Wildfire Hazard Areas unless they comply with the following: a) All roof coverings shall be constructed of non-combustible materials and installed on a Class A roof assembly. b) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. c) Protrusions above the roofline, such as parapets, shall be prohibited. d) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. e) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. F. Maintenance and Miscellaneous Requirements a) Roofs and gutters shall be kept clear of debris. b) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one- fourth ('/<) inch maximum. c) Yards shall be kept clear of all litter, slash and flammable debris. Resolution No. _-2008 Pale 7 d) All flammable materials shall be stored on a parallel contour a minimum of fifteen (IS) feet away from any structure. e) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. f) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. g) Fences shall be kept cleaz of brush and debris. h) Wood fences shall not connect to other structures. i) Fuel tanks shall be installed underground with an approved container. j) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standazds and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire-resistive construction on the exterior side of the walls. k) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 1) Structures greater than 5,000 square feet shall be sprinkled. m) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be visible at the primary point of access from the public or common access road and installed on anon-combustible post. 32. Upon completion of the construction, the facility will be evaluated for compliance with the conditions of approval herein and the building permit. A Letter of Completion shall be issued when all conditions are met. 33. The Applicant shall provide written notification to the Community Development Director upon cessation of operations at the site. The applicant shall remove all obsolete or unused facilities from the site within 6 months of termination of its lease, cessation of operations or expiration of its permit, subject to the determination of the Planning Director that the use of the site has ceased for a period of 6 months. Should the equipment owner fail to effect such removal, the properly owner shall be responsible for the removal of the equipment. 34. All structures associated with the cellular telephone facility use shall be removed when the lease expires or when the use permanently ceases and site shall be restored to original condition of agricultural field with Pitkin County Seed Mix used for re-vegetation. 35. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in the Pitkin County Land Use Code § 2-20-170 and C.R.S., § 24-68-105. The following comments reflect the opinions of the Basalt Planning Staff. Comments: 1. The proposed tower may be seen from both Highway 82 and surrounding neighborhood properties. If approved by the County, it is important that it not be perceived as a fake tree. Staff recommends that Pitkin County require the Applicant to provide amock-up of the proposed facility to help better understand the visual implications to surrounding and nearby properties. It is not recommended to disguise the tower in a way that makes it stand out. In accordance with 4-30-40(g) of the Pitkin County Land Use Code, Staff questions whether the tower will be compatible with the natural and historical context of the surrounding area. If approved, Staff would recommend that the County require an on-going maintenance of the "tree" materials to assure that it remains in good shape. 2. Although screening with vegetation is encouraged to mitigate the visual impacts of the cellular facility, placing large trees (non-native Austrian Pines) on top of an existing 8 foot berm will not only make it difficult for these species to survive, they may actually draw attention to the site. A more subtle approach should be considered that may include a mixture of small native shrubs on top (i.e Skunk Brush, Service Berry) with larger tree species at the foot of the berm (i.e. native Juniper). The Applicant should submit a noxious weed mitigation plan for approval by the County. 3. If approved by Pitkin County, the tower should be located so that the base is hidden from view by either the berm or the equipment shelter. Staff suggests moving the tower to the east while placing the shelter immediately to the west so that the tower is somewhat screened from the direction of Highway 82. 4. If the County does not have a standard process or policy for regulating radio frequency, Staff would recommend the following procedures: Within three months after the construction of the facility, the maximum radio frequency radiation should be measured and documented in a written report to the County. The measurement and report should be performed and prepared by a qualified, independent testing service/consultant retained by the County at the Applicant's expense. The maximum radio frequency radiation must not exceed the most current FCC standards. The Applicant should have the site tested on a yearly basis and should be required to submit a written affidavit indicating that the facility still complies with the most current FCC standards. The Town is beginning the process of undertaking a study to develop a telecommunications plan. Staff would ask that Pitkin County work with the Town in formulating this plan for identifying and predetermining sites for cellular facilities within and adjacent to the Town limits. The comments above are referral recommendations made to Pitkin County. Staff recognizes that Pitkin County is responsible for reviewing all of the input on this matter and the Town does not have the jurisdictional authority to make decisions on these issues. The proposed location for the cell towers is on Common Area Parcel 1 of the Morrow Subdivision, which is adjacent to the Rio Grande Trail, and the 1-acre trailhead, both assets managed by OST. The site fox the proposed facility is on the fax side of the lot from the trailhead and trail, approximately 500 feet away and is not easily visible from trailhead, but is visible from the eastern portion of the trail. Vexizon has an existing temporary facility in this location, and its existence has not caused a severe detraction from the enjoyment of the trail. The property has, however, been impacted with construction activity for the duration of the temporary facility's existence. It is anticipated that once construction is complete and the property landscaped, the facility's visual impacts will become more apparent. Colorado RSA No. 3 Limited Partnership, d/b/a Verizon Wireless intends to construct and operate a new (and permanent) cellular facility on property owned by Robert Morrow, Common Parcel 1, Wingo Junction Subdivision, PID # 24671200003. Backs~round Information The Verizon Wireless facility is necessary because the previous site on Basalt Mountain was dismantled on approximately April 30, 2006. The property owner of that site, the Division of Wildlife, would not renew the Verizon Wireless lease agreement. The site had been operational for over a decade, and due to the high geographic location, it provided cellular coverage to an expansive area. Tc replace some of the coverage provided by the erstwhile Basalt Mountain site, a temporary Verizon Wireless facility was placed at Wingo Junction. This application seeks special use approval to remove all improvements associated with the temporary site and construct a permanent installation. It is essential to maintain this installation permanently to prevent a significant gap in coverage along portions of Hwy. 82 in the Wingo area. Prior Aoarovals and Permits The Morrow/Wingo Junction Ranch Subdivision/PUD was approved by the Pitkin County Board of County Commissioners on April 25, 2006 and recorded April 26, 2006 at Rec. No. 523402. The plat of Lot 1 was recorded at Rec. No. 523393 on April 26, 2006.The existing temporary telecommunications facility on the proposed site was approved by the Pitkin County Board of County Commissioners on December 7, 2005 by Resolution No. 160 - 2005. That approval allowed the temporary facility to remain on the property until December 31, 2006. Due to uncertainties with the replacement site (High Country Tree Property), the temporary commercial use permit was extended by Resolution No. 128 - 2006 through June 30, 2007. The temporary commercial use permit was again renewed by Resolution No. 25-2007 to extend the permit date to December 31, 2007. However, Verizon Wireless was subsequently advised that the High Country Trees property was sold by Mr. Ed Booher. Verizon Wireless was essentially back at square one relative to the permanent installation. It decided to pursue the Morrow property for its permanent site. As a result, the temporary commercial use permit was extended through June 30, 2008 by Resolution no. 94-2007 which will expire on June 30, 2008. Copies of all Resolutions are included with this submittal. The temporary facility was constructed in mid April 2006. Since that time, there have been no complaints or issues associated with the installation. Facility Location The property is located northeast of Hwy. 82, near the Holland Hills Subdivision, and is legally described as Common Parcel 1, Wingo Junction Subdivision. The leasehold will contain 800 square feet or .018 acres. The site location is illustrated on the vicinity map which is included with this submittal. Project Description The Verizon Wireless facility will have three components; equipment, antennas, and a pole to support the antennas. (1) The equipment shelter will contain all the necessary electronic equipment, as well as backup batteries and a diesel generator to keep the site operational in the event of an extended power failure. The dimensions of the shelter will be: 28' long x 13'11" wide x 14'8" tall. The shelter will be designed to resemble a rustic cabin with 7" quarter-sawn log siding, rag-stained to age the appearance of the shelter. The roof will be a green standing seam metal matched to nearby structures. The metal doors will be faced with wood siding and designed to resemble barn doors. (2) The facility will contain two sets of 2 directional antennas which will be mounted on a "monopine" pole. Each panel antenna will be rectangular in shape, the dimensions of which will be approximately 4' high by 8" wide by 6" deep. The two sets of antennas will be pointed in roughly opposite directions (northwest and southeast). (3) A 33' steel "monopine" pole will support the two sets of antennas as illustrated in the photosimulation. The antennas will be camouflaged by green "branches" of the pine tree design. The top of the antennas will be at 28', with an additional 5' extension of "pine branches" above the antennas to completely 2 disguise the equipment. This is 17' less than the maximum height limit allowed for stealth towers. The pole will be approximately 24" in diameter at its base will be painted with non-reflective brown paint to resemble a tree trunk for maximum compatibility with the surroundings. This location has been selected because: 1) It will effectively meet the Verizon Wireless coverage objectives while adhering to the County's 40' height limit. 2) I will require little disturbance to the natural topography. An existing access road runs directly to the proposed site. No additional access road will be required. 3) The permanent installation will be a significant improvement over the existing temporary facility. The tree pole and log cabin will effectively conceal the presence of a cellular facility. To the casual observer, the cell site will not be detectable. 4) All of the improvements will be within an earth bermed area, which berm will contain substantial landscaping. The installation will hardly be visible from the north, east and west sides. The predominant view of the improvements will be toward Hwy. 82. Power and telephone service will come from Sherman Lane along an existing Verizon Wireless 5' wide utility easement. All new power and phone lines will be buried. Power will be provided by Holy Cross Energy, phone service by Qwest. No water, sewer or waste removal service will be required for this site. During construction there will be daily traffic to and from the site. After an approximate 6-week construction period, the site will be visited only once or twice a month for routine maintenance by a technician driving afour-wheel drive truck. Consent from the property owner and Verizon Wireless to process the application (1 copy each); 9. List of all adjacent property owners with a map illustrating the pertinent properties; and 10. Copy of this preapplication conference form. - -••~~ ~•••• ~~~~~~n ~-emu-w n ana section 4-30-40 :Per the preapplication conference summary, these two sections must be addressed. 2-30-301h- Special Review Criteria General: This application complies with all applicable provisions of the Pitkin County Land Use Code, all applicable policies and all prior development approvals applicable to the subject property. Compliance with these policies is addressed below (See STANDARDS, below). The purpose of the proposed telecommunications site is to provide a seamless network of telecommunications for Pitkin County residents and the traveling public. The proposed site is designed to have the least possible impact on existing adjacent neighborhoods and the environment. Development of the site will not disturb natural drainage patterns, will not contribute to soil erosion, will not degrade air quality, will not impact water resources. No water or sewer service is required for the site and all power lines will be underground. Sec. 1-60-360 encourages adequate, minimal impact regional and community telecommunications facilities. Consistent with this section, the proposed tree pole has been structurally designed to accommodate an additional carrier with comparable antennas. 2. Special Review Uses or Activities: (a) The proposed use is consistent with the County Master Plan as described below (See STANDARDS, below). The proposed use provides telecommunications service that supports existing and future development. (b) The proposed use is not in conflict with any applicable sections of the County Land Use Code or Policies, as described herein (See STANDARDS, below). (c) The proposed use will not materially endanger public health, safety or welfare. This installation will actually promote the public health, safety, and welfare by ensuring continuous wireless telecommunication services to police, fire, and ambulance as well as those residing, recreating, or traveling in the area. (d) The proposed use will not substantially injure the value of adjoining property. The temporary site has been operating at the proposed site for approximately two years. There have been no complaints about the installation. Mr. Morrow is developing several deluxe homes on his property. If anyone would be sensitive to property values, it would be Mr. Morrow. Verizon Wireless has taken great measures to design a well camouflaged installation. The tree pole and cabin will have no impact on surrounding property values. The berm and substantial landscaping will further mitigate any visual impact of the facility. Property values will not be affected even to the slightest degree. (e) The proposed use is consistent with the intent of the AR-10 zone district. The intent of the AR-10 zone district is to accommodate small scale agricultural activities and large-lot residential development that maintains rural character and appearance of the land. Visual disruption of the natural landforms should be minimized. The proposed facility will create minimal disruption of the natural landscape. 4 (f) The proposed use is compatible with the character of the immediate vicinity, i.e., the Wingo Junction Subdivision. The location, size and design characteristics of the, proposed use will be in harmony with the surrounding area and visual impacts will be minimized with sensitive site design: an equipment shelter specially designed to resemble a rustic cabin and a stealth "monopine" tower . An earth berm to screen the facility from the north, as well as substantial landscaping. (g) The location, size and operating characteristics of the proposed special review will be in harmony with the surrounding area. The design (log cabin) and tree pole are in harmony with this agricultural/rural environment. In fact, the shelter was designed to match an existing cabin in the vicinity. The operational characteristics are negligible. After the initial period of construction, the site will be visited once each month for routine maintenance. This is less traffic than that associated with most residential land uses. There will be no impacts to natural resources, or traffic circulations. There will be no negative off-site impacts as the use will not generate traffic, trash, odor, air/water pollution or other impacts to natural resources. Any noise associated with the back up generator will be identical to the existing improvements. The generator will be tested for 30 minutes each week, and will be within all operative noise limitations. (h) There are adequate public facilities to serve the proposed use. The site will not require water or sewer service and will not impact other public services. Only underground electric power will be required for the site. (i) The proposed use complies with requirements of Sec. 4-30, as noted below. 4-30-401s~) Cellular Teeeahone Facility (1) Principal Use of Land: The cellular telephone facility is a principal use of the land but does not require additional acreage to be included as a second principal use. No additional acreage is proposed. A minor building envelope amendment may be required. (2) Building mounted antennas: Not applicable. (3) Freestanding towers: The tower is 33' high, within the forty (40) foot height limit. (4) Co-location required: The proposed tree pole will be structurally designed to accommodate the antennas and associated cabling for one additional carrier. (5) Setbacks: (a) The proposed stealth pole is set back from all existing dwellings and other urban/suburban residential zone districts by 200'. (b) Not applicable. (ti) General Development Standards: (a) Design and Neighborhood Compatibility (1) The exterior appearances of the "monopine" stealth tower and equipment building are compatible with the surrounding environment. The tower will be camouflaged as a pine tree and the building will be designed to resemble a rustic cabin. (2) Not applicable. (3) The support building will not be used as an employment center. The site is visited approximately two (2) times per month by Verizon Wireless personnel for routine maintenance only. (4) There will be no advertising or logos on the site. (5) AT this time, no conditions have been suggested as necessary to further mitigate the impact of the tower on adjacent properties. (b) Buffering and Screening (1) There will be no fences at this site; however, sheet Z2 illustrates proposed landscaping which includes indigenous species of shrubs and trees including Austrian pine, Rocky Mt. scrub oak, rabbit brush, little bluestems and Arkansas Valley Foothills mix with wildflowers. (2) The antennas will be effectively screened by the "branches" of the ~~ 'monopine tower. In addition, the proposed landscaping materials will provide screening around both the tower and equipment building. (3) Anticipated radio frequency emissions will be well within the guidelines established by the FCC. (4) No radio, television or other transmissions will be disturbed or diminished. FCC licenses prohibit and prevent any possibility of such disturbance. (7) Existing Towers: Not applicable. (8) Outside Experts and Disputes: Not applicable.
