Special Review for Commercial Outdoor Use SUMMARY OF REQLTEST: The Applicant is requesting Special Review approval pursuant to Code Sections 4-30-040(q), 2-30-30(h)(2) and 2-40-20(c) to use properties located within Pitkin County, Jaffee Park, Stein Park and the Public Access River Easement on a parcel of land owned by Rick Neiley and maintained by Open Space and Trails as launching and/or take out sites for his commercial sledging operation APPLICANT: Aspen Seals/White Water Sledging Inc. LOCATION: The sites aze Wilton Jaffee Park in Woody Creek and Stein Park. The privately owned parcel of land is located on Gerbaz Way, and is described as Aspen Village River Homes Lot D, also known as "Parcel D, Only A Sma11 Portion". All locations are located along the Roazing Fork River. ZONING: Jaffee Park is zoned RS-20; Stein Park and Lot D Aspen Village River Homes, are both zoned AR-10. Lot D is currently undeveloped. BACKGROiJND: Aspen Seals/White Water Sledging Inc. has been operating on the Roazing Fork River since 2004 with verbal approval from the City of Aspen and Pitkin County Open Space and Trails (OS&T) Rangers. Per Code Section 4-30-040(q) Special Review approval pursuant to Sec. 2-30-30(h) by the Board of County Commissioners (BOCC) is required before allowing commercial business to operate on lands in the County that aze not separately listed in the Code and that occur on a repetitive or continuing basis more than six (6) times in any twelve (12) month period or on land owned by Open Space & Trails or on County roads. REFERRAL COMMENTS: This application was referred to, but no comments were received from, the Aspen Fire District. John Armstrong, the Pitkin County Open Space and Trails Ranger reviewed the application and issued an Open Space & Trails Approval/Permit to Aspen Seals/Whitewater Sledging, contingent upon BOCC approval. Brian Long, the City of Aspen Parks & Open Space Ranger, commented that Aspen Seals/White Water Sledging was granted a commercial rafting permit with the City of Aspen for the 2008 season to use Stein Pazk as a put-in spot. Brian Flynn, the City of Aspen's Open Space and Special Project Manager, which manages Henry Stein Park, also stated that Aspen Seals had completed its permit requirements for the use of Henry Stein Pazk, pending BOCC approval and Pitkin County permitting. Henry Stein Park is owned by the AVLT, not the County. • Martha Cochran of the AVLT sent an email, stating that the Aspen Pazks comments will serve for the AVLT. • Ellen Anderson, Pitkin County's Emergency Management Coordinator declined to comment based on a limited knowiedge of whitewater sledging. • The Woody Creek Planning Commission comments are attached. CRTI'ERIA FOR APPROVAL - SPECIAL REVIEW USES OR ACTIVITIES 2-30-30(h)(2) A. 77te Special Review shall consider 1. The applicable Couniy Master Plan; 2. County Lmad Use Policies in CJwpter 1,- 3. The intent of the zone district in which it is proposed to be located,~ and 4. 77ae character of the inmiediate riciniry of the parcel proposed for development mad surrounding land uses, or shall enhance the mixture of consplimentary uses rnad activities in the immediate vicir~ity of the parcel proposed for developnzent. Response: The Woody Creek Master Plan is the primary community plan regulating ]and uses associated with Jaffee Pazk. The document states that, "Recreational uses and activities, such as trails and pazks, are considered extremely importanY'. The goal of the plan in regards to parks and open space is to "preserve the rural chazacter of Woody Creek; enhance community involvement, reduce the perception of physical changes in the local environment by preserving existing open lands; and increase trail connection opportunities for safe commuting and recreating." The plan specifically regards Jaffee Pazk as a place that "...should be maintained as a passive park with improvements for landscaping, trail maintenance, and general clean-up." The Applicant shall be involved in the maintenance of the Pazk through clean-up duties, as well as provide a bond to OS&T. The RS-20 zone district is intended to preserve environmental resources and maintain the rural lifestyle while allowing low-density single-family residential development. The AR-10 zone district is intended to maintain the rural chazacter and appearance of the land while allowing large-lot residential development and small scale agricultural activities. Recreational uses such as sledging require a Special Review Approval in both zone districts. Commercial whitewater operations on the Roaring Fork River and the utilization of Jaffee Park have taken place for the last 25 years. The Applicants have made assurances, with a"Leave No Trace" principle, that proper treatment and clean-up of the Pazk will occur on a regular basis. The OS&T permit requires that each of the companies permitted post a deposit ($500 for the 2008 Season) to be used for restoration of riparian vegetation if damaged as a result of the rafring operations at Jaffee Pazk. Limitations on loading times and durations of parking shall be enforced as specified in their individual OS&T permit. The whitewater companies are required to maintain an ongoing analysis of their operations in order to obtain impact information on the Park. B. The location, size, design, cmd operating characteristics of the proposed special review use must be in harn~ony with the surrounding area and n:ininaize adverse afjects, i~scluding visual inapacts, invpacts on pedestriaiz and vehicular circu/ation, parking, trash, service delivery, air/water pollution or other impacts on natural resource, noise, vibrations ar¢d odor on surrounding properties. Response: As noted before, whitewater operations have taken place at Jaffe Park for the last 25 years. OS&T and the County require the permitting of the commercial operations in order to better understand the potential impacts, if any, on the use of Jaffe Park and other locals along the river. OS&T has been compiling data since 2002, and as noted by their approval, they felt that the addition of an additional company is appropriate at this time. In addition, OS&T has noted the Applicant has "demonstrated appropriate use of the property and good stewardship in the past " No unattended pazking of commercial vehicles will be allowed at Jaffee Pazk. The Applicant has assured, and is required through the OS&T permit, that all trash and equipment will be removed on a daily basis upon their departure from all the azeas. C. There must be adequate public facilities and services to serve tJze special review use, including but raot limited to roads, potable water, sewer, solid waste, parks, police, fire protectiora, emergency medical services, hospital and ntedical services, drainage systen:s and sclaools. Response: Tlie launching and take out areas are within close proximity to police, fire protection and emergency medical services. Aspen Seals carries a por[able toilet on the van to cover restroom emergencies. OS&T also collects a fee for the use of the port-a-potties at the Jaffee and Wingo areas. D. An application for a special review use ntust demonstrate to the Board of Cour~[y Comntissioners that tl~e proposed development will not: 1. Materially endanger the public health safety or welfare; and 2. Substantially injure the value of adjoining or abuttirrg properties. Response: Staff has no information that would indicate that the proposed use will endanger the public health, safety or welfare, or injure the value of adjacent properties. The Applicant has intentionally timed his activities to avoid setting up at the same time as other whitewater commercial operators (rafrers) and alleviating as much river and/or park congestion as possible. Staff feels that the proposed use should be approved based on OS&T granting of approval/permit yeazly for Aspen Seals/Whitewater Sledging. After further analysis of the impacts of the existing operations, OS&T may find the need to create limitations, but it does not seem to be the case now. USE SPECIFIC STANDARDS - COMMERCIAL 4-30-40(Ol A. Special Review Approval is required when the following conditions apply: l. In all zone districts, any outdoor recreational use that is not listed separately and that is subject to a Pitkin County Open Space & Trails permit requirenaent; and 2. Any con:mercial outdoor recreational use on Pitkin County Open Space and Trails property or on Com~ty-oN~ned property or roads subject to the criteria in Sec. 2-30-30(h)(2); Response: Aspen Seals/Whitewater Sledging is proposing a commercial outdoor recreation use which requires a Pitkin County Open Space & Trails permit and takes place on OS&T property, as well as County owned properry and roads subject to the criteria as listed in Sec. 2-30-30(h)(2) above. B. The BOCC is approving the Special Review based on a proposed use that exceeds the following thresholds: 1. Involves nsare than ten (10) persons on a given property/road at a~ry given point i~: tinte; and/or Response: The Applicant has stated that his number of clients would be, at masimum, eight (8) with two guides as well as the van driver, thus may at any given point in time involve more than ten (10) persons on a given property/road at any given point in time. 2. Utilizes parki~tg spaces for any si~rgle vehicle with a passenger capacity of more thars te~a (10) persor:s,- and/or Response: The Applicant utilizes a fifreen (15) passenger van for all sledging trips along with an additional trailer for equipment when the customer count exceeds four (4) persons. 3. Utilizes any given property/road more than hvice a day; and/or Response: During the course of a single day providing three (3) scheduled trip times, the proposed use would impact any given properiy/road more than twice per day. 4. Utilizes any given property/road n:ore than thirty (30) days per year. Response: Although the total number of days the proposed use may utilize any given property/road is dependant on the amount of run-off each year, the Applicant proposes an average of four (4) months of operation during each summer for an average total of one-hundred twenty (120) days per year. SPECIAL REVIEW USE 2-40-20(C) Review Standards and Limitations of Uses by Special Review A. Special Review Use Limitations under the Pitki~ County Land Use Code pursuant to Sea 2-40-20(c) include: 1. Conm7encement of Operatio~:: Approved special uses shall begin withirs three (3) years jollowing the date of approval of the developn~ent perntit, unless a longer period is specifred, or the approval shall beconse null and void. 2. Snecial Review Use: The decision making body n:ay approve a special review use subject to a linaited time period during which a use may operate. Submission ofAnnual Repart and Review of Annual RepOYts: The decision making body may require any person operating pursuant to a special review use to subn~it a statement to the Commurrity Developn:ent Director attesting to the continued confornaance of the use to the conditions of the approval. If after reviewing the statement, inspecting the site a~zd cor:sideri~tg any other relevant materials, the Comnrunity Development Director determir:es that the use is in conformance with the provisions of the Special Review Use approval, the use may continue pursuant to the provisions of approval. Ijthe Contn:unity Developntent Director determines Ihat the use is not in conjornzance N~ith d~e provisions of the Special Review Use approval, the Communiry Development Director may recon:n:end to the original review authority that it consider the withdrawal of such approval. Failure of any person operating a use under a Special Review Use approval to submit such a statement within the period specified above sha11 be considered a violatio~s of the provisions of Ilie special review approval and may be su~cient cause for withdraH~al of the approval ~. Approval Withdrawal Procedure: The decision-making body shall consider and act o~t approval withdrawal after a public liearing. Notice of the public hearing shall be n:ailed to the applicant and published in a newspaper of general circulation irs the Counry not later than thirty (30) days prior to the hearing. The notice shall state tlie time, location and subject n:atter of the hearing. 5. A~proval Expiratio»• Any Special Review Use shall expire after any continuous naelve (12) month period of non-use. Any unfu/filled obligations of the approva! shall cwitiraue to be binding after expiration of the approval. Response: The Applicant shall abide by all Limitations of the Land Use Code. Additionally, Staff supports the granting of the Special Use Review, subject to OS&T permitting and yearly review, for a term of five (5) years. RECOMIVIENDATION: Staff recommends that the Boazd of County Commissioners adopt a motion to approve Aspen Seals/Whitewater Sledging Special Review Perrnit subject to the conditions in the attacl~ed draft resolution. Draft Resolution ~xi-+~gir /~ 06/12/08 White Water Sledging, Inc Gary Pera 0201 Dakota Meadows Cazbondale, Co. 81623 RE: Wilton Jaffee, Sr. Pazk Special Use Permit Application Deaz (To Whom it may concem): This letter is White Water Sledging's authorization of the conditional use of the Wilton Jaffee, Sr. Park for 2008. This authorization is required by Pitkin County Code Title 12 Article 3 and Pitkin County Land Use Code Section 3-210. Conditions which must be met for authorized use by White Water Sledging are stated in the attached Commercial Rafr Operator Agreement form. Please read these conditions carefully before signing and returning to OST by May 1, 2008. The following fees and documents need to be submitted to our offices by May 1, 2008. 1. Commercial Raft Operator Agreement 2. Copy of your 2008 Colorado River Outfitters License 3. CertiScate of Liability Insurance indicating Pitkin County as additional insured party for the 2008 Season 4. Annual OST Renewal Fee of $50.00 5. Seasonal Fee of $50.00 for taking out at Wingo Junction (a copy of the BLM MOU is attached) 6. White Water Sledging's share of the port-a-potty fee for 2007 was $ 000.00 which included one for Jaffee and Wingo OST will continue to require log reports; I have attached a copy of the year end log and and an example of the bi-montly use ]og for your records. You will need to submit bi- monthly logs of White Water Sledging's use at Jaffee Pazk. In the unlikely event that the total use at Jaffee Pazk reaches 8,000 user days, OST may, at its discretion close Jaffee Pazk to commercial use for the remainder of the season. OST staff will contact you once the total user days reach 6,500. In addition, loading and unloading time shall not exceed 30 minutes as outlined in the Commercial Raft Operator Agreement. Authorized Use: White Watet Sledging is authorized to use the boat launch seven days a week, from May 1, 2008 , to August 30, 2008 , for commercial rafting at Jaffee Park, and for using the Wingo Junction site for taking out. This level of use will be revisited annually to determine if impacts to the conservation and recreational values of the property require modifications. Failure to comply with the above requirements may result in the revocation of this authorization. Any violation of the regulations contained within this permit or Title 12 of the Pitkin County Code may result in fines as outlined in Pitkin County BOCC Ordinance #2001-020. This authorization acknowledges the receipt of atl required documentation and fees for White Water Sledging satisfying Pitkin CounTy Open Space and Trails. This authorization is con6ngent on White Water Sledging receiving approval from Pitkin County Community Development. White Water Sledging is valid to operate from this date forward and will be made an annual pernut after acceptance by Community Development. OST staff is awaze that you have demonstrated approgriate use of the property and good stewardship in the past, and you continued cooperation with OST in our management of this Park. We thank you for your efforts and encourage you to continue to be a good steward of this special property. Sincerely, John Armstrong Open Space and Trails Ranger ExN~~rr ~ Pitkin County Open Space and Trails Commercial Raft Operator Agreement I, _Gary Pera representing White Water Sledging (raf[ing company/pernuttee) agree to abide by the following conditions for operating at Jaffee Park. Failure to agree to these conditions, or adhere to any of these conditions, may result in the revocation of White Water Sledging's authorization and permit to operate at Jaffee Pazk. Specific Conditions For Jaffee Park Commercial Raft Operators 1. Parking is prohibited for all commercial outfitting vehicles. Vehicles used for commercial purposes may load and unload guests and equipment, according to the following guidelines: • No permittee will proceed to the Jaffee Pazk boat ramp until such time as it is cleazly evident that space is available for them to load/unload safely. The ramp area will be kept clear at all times for loading and unloading activities. • The ramp azea is to be used for loading and unloading only. Loading/unloading time shall not exceed 30 minutes. • No vehicles will be left unattended at anytime. Attended vehicles will not be left in the ramp area or adjoining loop for over 30 minutes, space allowing. • No storage parking of vehicles is allowed anywhere in the park. Commercial vehicles left unattended anywhere in the pazk are subject to ticketing and towing. 2. Commercial users are not permitted to leave any equipment at Jaffee Park. 3. Commercial users must not leave any trash behind. Please note that Jaffee Pazk experiences a high level of activity from bears. Therefore, it is imperative that no food be left behind in the Pazk. 4. Commercial permit holders are required to keep a detailed log of daily commercial acfivities at Jaffee Park, including: date and time, use (put-in or take-out), type of trip {i.e., half day float) number of boats, number of guests, number of staff. Signed reports must be submitted to the Open Space and Trails office at fax number 920-5374 or e-mailed to johna c(~co.oitkin.co.us on than the first and the fifteenth day of each month, for the previous activity period. Permittee should use the attached log, use the e- mail address above to request an electronic logsheet. 5. Permittee must pay a user fee equal to $1.00 per guest taken by permittee during the permitted yeaz, for the totai number of guests. This fee is due by October 1, 2008, and must comport with the weekly use logs submitted for the yeaz. 6. Permittee aze required to post a$500 security bond, which will be used only if a permittee's activities aze identified as having impacts to the pazk, which require restoration or clean-up from Open Space and Trails staff. If this bond has not already been submitted to Open Space and Trails, it is due to the Open Space and Trails office by May 15, 2008. 7. Permittee agees to pay a$50 seasonal fee for taking out at Wingo Junction. 8. Permittee must provide Pitkin County with certificates of liability insurance indicating Pitkin County, as additionally insured parties for their insurance poticy for the 2008 season. 9. Permittee must provide the Counry with a copy of their 2008 Colorado River Outfitters License. 10. All permittees shall abide by the rules and regulations for use of the boat ramp and Jaffee Pazk which may be established from time to time by the Open Space and Trails Boazd and/or the Board of County Commissioners. Ail permittees aze responsible for educating their employees about these rules and regulations. Violation of these regulations may result in revocation of commercial permits and will be taken into account for future applications for certification to use Jaffee Pazk. ll. All permittees must pay for the installation of a porto-potty by Pitkin County. Each permittee will pay an equal shaze for the cost of installing and servicing the porto-potty, which will be due to Pitkin County at the end of the season. 12. All permittees must require their river guides to attend a river education class provided by the Roaring Fork Conservancy. Contact Tim O'Keefe at 927-1290 for class times and information. General Conditions 1. No implied rights or reservations are granted for parking spaces. Admission is on a fsst-come first-served basis. 2. All participants in the activity agree to abide by and obey all rules and regulations of Pitkin County Open Space and Trails, as specified in Title 12 of the Pitkin County Code, and any other regulations that may apply, including Adopted Management Plans for the property being used, and posted regulations. 3. Approval to hold this activity does not imply that extra services will be provided nor does it place any additional liabilities on Pitkin County Open Space and Trails. 4. The permittee agrees to hold hannless and indemnify Pitkin County Open Space and Trails and its staff from any death, injury or property damage occurring as a result of this activity. 5. The permittee shall supply all necessary manpower and equipment to safely conduct this activity. The permittee shall be responsible for any and a11 damage to pazk resources and/or facilities that result from this activity. 6. The area in which the activity takes place shall be cleaned up and restored to its prior condition, upon completion of the use. 7. Pitkin County Open Space and Trails maintains the right and authority to amend or cancel this permit at any time should the applicant fail to abide by conditions agreed to or if public health, safety and welfaze so dictate. 8. This permit does not grant exclusive use of the site. Permittee shall ensure that the rights and privileges of other pazk visitors aze recognized. 9. Permittee must demonstrate possession of applicable pernuts at all times during the permitted activity and present such permits upon request. 10. Permittee agrees to not disturb the natural or man-made features of the property. 11. Permittee agrees to not interfere with any other uses occurring on the property. 12. Permittee will not broadcast any audio on the property, or have any lights on the property without first obtaining special permission from OST. 13. Permittee will not remove any plant or item from the property without special permission from OST. 14. An OST Ranger or other staff may be present and check on permitted activities. Signature of Applicant Date _.. _ _ _ _ _ Memorandum of Understanding - °- ' =- ._ ._'Beiween the - .. ..-. _ - . ~ , _ ; Bureau of Land Management And Pitkin County Purpose This Memorendum of Understanding (MOU) is made and entered into behveen Pitkin County and the Department of the Interior, Bureau of Land Management (BLM), Glenwood Springs Field Office (GSFO). Both signatories of this MOU are herein referred to as Partners. The agreement is to establish a general framework of cooperation upon which the partners administer Special Recreation Permits (SRPs) on the Roaring Fork River beiween Jaffee Park and the Wingo Junction boat ramps in Pitkin County. Such cooperation complements both missions of the BLM and Pitkin County and are the in the best interest of the public. ~I. Obfectlves The objective of this MOU is to: Streamline the permitting process required for commercial use of the Roaring Fork River between Jaffee Park and Wingo Junction. Allow companies holding valid permits and paying required fees through Pitkin County to use the BLM boat ramp at Wingo Junction for no additional fee. 1l1, Authority BLM is authorized by Secfion 307 (b) of Federal Land Policy and Management Act of 1976 (43 U. S. C. 1737) to enter into partnership agreements involving management, protection, and development of public lands, IV. Background The Wingo Junction boat ramp was constructed by the Colorado Department of Transportation (CDOT) when Highway 82 was widened to four lanes. The commercial rafting companies worked with CDOT to design and construct the boat ramp, ensuring the public access to the river would be preserved. The boat ramp is on BLM managed land and therefore, an SRP is required to operate a commercial venture on that properly. Since 2000 the BLM has been issuing SRPs for the use of the ramp and charging a flat fee of $80-$90 to the commercial compa~ies using the ramp. The GSFO felt this {ee was appropriate since the GSFO was not responsible frx the construction of the ramp and did little on-site management In 2005, however the Glenwood Springs Field Office was directed to charge fees for this area in compliance with our regulations which require 3% of gross revenue. After much discussion with the SRP holders and Pitkin County Open Space and Trails, it was decided that the BLM could waive fees for companies putting in at Jaffee Park and taking out at Wingo Junction as long as the company had a valid permit with and paid the required fee to Pitkin County. This way the companies are not paying hvo agencies for the same trip. Companies putting in at Wingo Junction and taking out down steam will be required to have a permit with BLM and pay 3% of their gross revenue to BLM. A discount will be given for time spent off public lands. ' V, Mutual8enefits It is mutually beneficial for both Pitkin County and the BLM to work cooperatively to provide commercial recreation opportunities on the Roaring Fork River. Vl. Terms of Mutual Agreement Pifkin County will: • Continue to issue permits to companies utilizing Jaffee Park for commercial river related activities to include the Wingo Junction boat ramp for take-out. ~ Continue to collect fees set by Pitkin County, for commercial use of Jaffee Park. ~ Require that SRP hoiders add "US Govemment" as an additional insured to their insurance poticies and wii! ensure that the insurance policy meets ihe BLM minimum requirements ($300,D00 per occurrence, $600,000 annual aggregate, $30,000 property damage). Inciude "BLM Wingo Junction Boat Ramp" on the permit. • Not be responsible for any maintenance of the Wingo Junction boat ramp or related facilities. The BLM will: Continue to issue SRPs for commercial use of Wingo Junction to companies putting-in at Wingo, or taking out if Wingo if they are using a launch site other than Jaffee Park. ~ Charge 3% of gross revenue for trips putting-in at Wingo Junction, or taking out at Wingo if the launch site is other than Jaffee Park. The appropriate discount will be given for fime spent off of public lands. • Continue to provide basic management of the Wingo Junction boat ramp. !t ls mufua!!y agreed and understootl by the parfners that.~ • This MOU is neither a fiscal nor a funds o6ligaSons document. This agreement shal! not obligate either of the Partners to this agreement to expend appropriations or to enter into any contract or ofher obfigafion with the other partnerin this agreement • In carrying out this MOU, there shall be no discrimina6on against any person because of race, color, national origin, sex, age, religion, or disability. • This MOU shall not be interpteted to imply that the United States, the Department of the interior, or the BLM endorses any product, service, or policy of Pitkin County. Pitkin Counfy shall not fake any action or make statements that suggests or implies such endorsement. • Each signatory party shall obtain prior approval from the other of ail press releases, advertisements, or other statements regarding projects or work products intended for the public that refer to this MOU or to the BLM or name or title of any BLM employee involved in connection wiYh this agreement. • The Partners will consult, at least annually, to discuss actions to implement the purpose of this AAOU. V/l. Term of Agreement This agreement shall have a term of 5 years from the date signed, at which time, it will expire unless extended by issuance of a written amendment, signed and dated by both part'res. This agreement may be terminated by either party upon 90 days written advance no6ce. This agreement shalf be reviewed, by both Partners, annually to determine whether it should be continued, modified, or terminated. Aspen Sea1s offers White Water Sledging as commercial wlute water adventure sport to its customers. Trips are scheduled three times per day at 8am, 12pm, and Spm as to avoid setting up at the same time as rafting trips and alleviating as much river and/or park congestion as possible. The equipment needed to sledge includes: sledges (boards), wetsuits, life jackets, helmets, fins, fin retainers booties, gloves, and hoods. Training and instructions are provided by highly experienced, qualified, and certified Sledging guides. Customers are instructed and must practice on-land as well as in the eddy of the river where they put in. After evaluation and approval by the lead guide, the customers are then guided down the safest line of different class white water river sections. Aspen Seals has a website and links to other outdoor adventures sites such as Fourteener.net and Rafting-Colorado.net. Aspen Seals distributes its brochures throughout all public venues in Aspen and the Roaring Fork Valley through Aspen Activities Center. Aspen Seals is a member of Aspen Chamber Resort Association and Worldwide Outfitters Guide Association. Professionally produced and colorful signage featuring the Aspen Seals logo and stating White Water Sledging is clearly visible on the back and both sides of the company van. ~ Operation Plan aoos Base of Operations White Water Sledging, Inc. dba Aspen Seals is a home based business, physically situated at 0201 Dakota Meadows Drive Carbondale, CO 81623. Aspen Seals rents a storage shed from Aspen Storage Warehouse at the ABC for the three months of operations. This is where Aspen Seals stores the sledging equipment enabling us to operate more conveniently to clients in the Aspen & Snowmass area. Aspen Seals picks up all clients at their hotels, homes and agreed upon pick up sites around the town of Aspen & Snowmass. Operations Aspen Seals offers White Water Sledging as a commercial white water adventure sport. White Water Sledging is a form of river boarding. The difference from river boarding and sledging is the style of board. A Sledge is made of a tough plastic filled with foam and molded for the upper body and arms with metal handles to hold on to, they are approximately 41 inches in length, 27 inches wide, and 10 inches deep. They are made for the sole purpose of running river rapids providing the buoyancy and protection that is required to enable the rider to navigate the obstacles in the river. The trips are during the hours of daylight and are a total of three hours each from arrival at the put in to leaving the take out. Transportation, equipment and a snack are supplied for the trip. Equipment The equipment offered to the clients meets the requirements set by the Colorado State Parks/River Outfitter Licensing Program. Aspen Seals has been a licensed outfitter for ~ve years. The equipment is as follows: Helmet, Smm Hooded Vest, 3mm mitts, Smm Booties, Smm Wet Suit Jacket, Smm Wet Suit Long John, PFD Coast Guard approved, Swim fins, and Sledge. Sledging Orientation On arrival to the put-in, clients are assembled in one spot out of the other river users way. An introduction to Aspen and the Roaring Fork River area is given, with specifics on the river section that we are getting ready to sledge. Furthermore, a detailed safety and river orientation is given to _~_ ~ all clients at the rivers edge. This ensures that clients are aware of the safety and environmental concerns for the applicable river section to be run. The safety orientation is required by the Colorado State Parks/River Outfitter Licensing Program. Four cotorful charts are used to show the clients how the river's currents, eddies, hydraulics, and surf waves work and how best to work with them and use them to their advantage. Instructions will be given on land to show how the sledge is best controlled, this will also give clients a visual of the motions they will encounter in the river. Safety and awareness concerns are discussed. Personal medical issues will be addressed. During the safety orientation the other guides has arranged the equipment that each client wili use. After the orientation, clients are shown their equipment for them to dress into. Guides will assist clients with wetsuits and booties they will double-check fin straps PFD straps, helmet straps ~n retainers, and answer any question that may be asked of them. Clients will dress at the river put in locations or assigned parks. The put-in and take-outs have been chosen for the facilities available, safe and ease of entry and exit of rivers, tidy and presentable assembly areas for the clients and areas Aspen Seals are permitted to use. Sledging Preparation Once all clients are dressed they are positioned next to each other at an eddy on the waters edge where the Lead guide/trip leader & rear guide will give a short 15-minute water skills workshop. Clients will be shown how the sledge reacts in the rivers current then how and what needs to be done to respond to those changes. Each client goes through an individual test with a guide to ensure they can perform the tasks that are required to get them through the river section. Each client must be abie to kick strong to be able to propel forward, turn left and move forward, turn right and move forward, roll with the sledge from right and left, and rest chest on the sledge and let go of handle bars. Getting familiar with the sledge in the river current and the river environment helps clients relax and focus on the task at hand. The learning curve for the sledging is very short with this effective teaching technique and professional instruction offered by Aspen Seals. A first timer can easily learn the skitls required to navigate class 2-5 Rapids. Guides All guides on the water will have hand sign knowledge that Aspen Seals has designed. Aspen Seals has integrated international hand signs with local and sledging hand signs. These skills are mandatory for any and all employees of Aspen Seals. -Z- Waterproof two-way radios will be attached to the guide in a way that the sledging guide can easily be audibly reached. All guides on the trip will be in contact with each other through the duration of the trip weather it be audible, visual, or through hand signs. Aspen Seals currently has two guides that are experienced and qualified for sledging class 5 rivers. In the future, Aspen Seals will employ and train additional guides for sledging on class 3-5 Rivers. During the sledging trip clients will be shown the waves and holes and how to read and understand how the river works and how Aspen Seals works with the river, one of mother natures natural marvels. The safest line in the river will always be chosen. Choosing the safest line with deep water and controllable eddy's will always be the first choice enabling a safe and enjoyable adventure. TPl~1 Safety for the client is paramount, the trip begins after the Trip Leader has checked equipment with the other guides, completed the company check list, satisfied with his group's abilities after the water workshop, and confirmed all waivers are signed. The designated Trip Leader is the only one to give the green light for the group to move into the current of the river. Trip Leader does a radio check with the other guides and shuttle driver. Trip Leader contacts the shuttle driver with his intentions, and where he wants the shuttle driver to stop next for a confirmation/safety check. Trip Leader will complete a sweep of the preparation area making sure it is as it was found if not better, ensure all trash has been picked up, packed up and put in the van. When the Trip Leader has given the other guides the green light, all the clients will have the clients fins and fin retainers, PFD's and he-mets double checked and helped into the water. All trips will start with everyone getting into an eddy that has been chosen prior; this eddy is generally the same one the water workshop is held in. The Trip Leader will signal the other guides that he is ready and satisfied that all clients have the skills necessary to swim themselves down the river. The group will travel down the river like a snake 3-5 feet apart, one behind the other. The Trip Leader will choose the safest line and (ead the group down the river. This line is also referred to as the "client line". To begin, everyone will have their siedges face towards the middle of the river lined up right next to one another. The trip leader will be at the front of the line and the first one to swim into the current and everyone will follow leaving 3-5 feet between each other the rear guide will be at the end on the group. The Trip Leader will use several directional hand signs that were shown in the river safety orientation that he would use on the river to direct them. The two guides will control the group _ 3 /~ The Rear Guide will aiways be the last Sledger. The Rear Guide allows no client to be behind him. He will help to swim clients back in the snake like line and back in the current to keep the group moving forward safely. The guides wiil assist the clients in the eddies and through rapids reassuring their efforts all the way. Once in the current and moving down stream the front and rear guide will and can talk to clients reassuring them on how they are doing and to stay in the snake like line and ail is well. The lead guide choosing the safest line also designates a speed suitabte for the group to travel. The lead guide will use hand signals to visually instruct the clients the line he would like them to follow. Clients will be kept in a manageable group through the section of river. Stops will be chosen at appropriate intervals and safe eddies that will not interfere with the environment, flora, fauna or private land owners. Every section will have several emergency take-out areas that can be used for evacuations if required. Private land owners will be respected, trip leaders will be required to know these areas and avoid stopping in eddies on private property. Fluids 8c personal medication for clients can be carried in the guides waterproof safety kit. The rear Guide will carry a first aid, river safety and emergency kit in a waterproof backpack that will not hinder his or her abilities in the river to do their job professionally. Food Snacks are given at take out sites where the facilities are convenient and safe for the clients. All food is kept in airtight coolers with cooi packs inside to keep food fresh and healthy. Generaliy, we serve energy bars and bananas which allow for quick recovery after this sport as well as lemonade and filtered water with re-usable plastic cups. Site Set-up/Maintenance/Clean-up Due to small group size a maximum of 8 clients and two guides, Aspen Seals uses a minimum amount of space for the Safety Orientation and getting the clients dressed and down to the put-in of the river. Our trip times 8am, 12pm, & Spm have been scheduled to be earlier or later than rafting trips so that we can avoid any kind of congestion that may occur. We operate on the Leave No Trace principle. Trash bags are taken on each trip taking all trash with Aspen Seals vehicle at the put-in and take out. As well, cleaning the surrounding operating area, making sure clients understand the importance of a clean river environment. 4_ i/ ~~ Transportation Aspen Seals has one 15 passenger van and a trailer. Should the group size be less than four, we utilize the van only. The van and driver stay with the group during the safety orientation, set-up, and the designated safety check points. The driver has to stay in range of the group for the radios. The driver will stage at a parking area other that the parks untit 20 minutes prior to the group is scheduled to arrive then travel to the take out, they will assist the guides helping clients with their equipment and putting away the gear as quickly as possible so as not to congest the river take-out areas. If it is an exceptionally busy time of year i.e. July 4th weekend, the driver will park at Intercept Lot until the designated time to pick up clients thus making entry and exit of take-out points as quick and safe as humanly possible. Safety Requirements Safety is an intricate part of Aspen Seals operations; each river guide will carry all required rescue equipment in relation to the ROL (river outfitters license). Throw bag with a 70ft length of rope, knife, whistle, carbines, two-way radio, extra fin straps and retainers. Additionally the rear guide will carry a safety kit for repairs, a first aid kit and othet necessary items that may be needed on the trip. Aspen Seals Guides will be required to have a current first aid and CPR certificate, an accurate documented log book with a minimum of 1000 recorded commercial river miles, proving customer service, skills, abilities, guiding, training experience and physical fitness. Rope technique workshops will be carried out through the season refreshing employee's skills and maintaining rescue equipment. Equipment checks will be done every day to insure equipment quality and safety. Swift water rescue technician certificates will be required for Trip Leaders. Knowledge with two way radios, and ha~d signaling skills is a requirement of all guide employees. All guides will carry a throw bag with 70 ft of rope; they will be efficient with rope management skills and knots. Guides must be above average swimmers with and with out sledges, and have there own river equipment. Aspen Seals runs river sweeps to check for logjams and/or obstacles and removes hazards as they appear in the river to ensure safe lines for private and/or commercial users as well as for Aspen Seals clients. Aspen Seals informs other operators of hazards and works with other operators that use the rivers to ensure safety, good working relations, river etiquette while respecting other river operator's space. The shuttle driver will drive along the highway to several pre- selected points following the group on the section of river, and checking with trip leader by radio all the way. Having the shuttle driver follow the group adds another safety factor to operations. Aspen Seals will always re-evaluate trips to ensure safety is always the highest. Records will be kept of each trip for future research evaluations. These evacuation points will be clearly marked in several water proof maps that will be carried in the transportation van as well as in the rear guides safety carry back pack. All guides and employees of Aspen Seals will have to carry out mandatory workshops the beginn3ng of each season, identifying all of these evacuation points of each section of river and the names of all rapids. These evacuation points have be chosen for ease of entry and exit of the river for emergency personnel as weli as to an access road if a motor vehicle or ambulance is required. On sections where Aspen Seals use their own shuttle driver, the driver will foilow the group along the highway stopping at areas with a good radio or phone service checking with the trip leader on the group's progress. In the van, Aspen Seals will have a fully stocked first aid kit with accessory rescue equipment as well a radio and phone to communicate with the guides on the water. Evacuation points will be marked on the maps carried in the van to give accurate information to 911 in case of an emergency on how to reach the area required. Every Aspen Seals employee is required to hold a current CPRlfitst aid certificate and will go through Aspen Seals river rescue program run by owner/operator Gary Pera who holds a Mountain Recreation Level III swift water rescue NZQA certification.
