PITKIN COUNTY, COLORADO, APPROVING THE SILVERMAN ACTIVITY ENVELOPE AND
MINOR PLAT AMENDMENT

RECITALS
l . Michael and Yvonne Silverman ("Applicant") have applied to the Community Development Director of
Pitkin County ("Director") to establish an activity envelope aoound the existing house and associated
development to accommodate construction of a new residence. In addition, the Applicant proposes to
amend the recorded plat to allow redevelopment on Terrace II of the lot.
2. The lot contains 5.2 acres and is nonconforming in size within the RS-30 zone district.
3. The lot is located at 5720 Snowmass Creek Road, and is described as Lot 1, Hidden Meadows
Subdivision.
4. The Board of County Commissioners ("BOCC") granted subdivision exemption approval for the Hidden
Meadows Subdivision in 1977; the plat is recorded in Plat Book 6 at Pages 40-41. The plat includes a
note that reads, "Buildings located on Lots 1, 2 and 3 shall be located on Terrace IIL" The property is
improved with a single family residence originally built in 1980; the house is built predominantly on
Terrace II.
5. The lot is exempt from Growth Management up to 5,750 square feet, pursuant to Land Use Code Sec. 6-
30-100(6).
6. The Director finds that the proposed activity envelope is consistent with the applicable requirements of
the Code, as follows:
A. The activity envelopes are located more than 100' from the high water line of Snowmass Creek, with
the exception of a small activity envelope around the existing well, which is approximately 75' from
the high water line.
B. The activity envelope primarily contains slopes of less than 30%, and the areas of slopes in excess of
30% qualify as minor slope anomalies pursuant to Sec. 7-20-20(c)(3) ofthe Code.
C. The wildfire hazard is rated as low, and can be mitigated pursuant to the provisions of Sec. 7-20-
60(c) of the Code.
D. Replacement of the residence will not create any additional impacts on wildlife habitat areas.
E. The property is not impacted by any geologic hazards.
7. The Director further finds that it is appropriate to amend the plat to allow construction of a new
residence on Terrace II since this portion of the lot is not affected by potential geologic hazards. Both
a 1974 Chen and Associates, Inc. report and a 2008 Yeh and Associates, Inc. report assert that
Tercace 11 is suitable for development and avoids geologic hazards.
APPROVED by the Director, subject to the following conditions, which shall run with the land and be
binding on all successors in interest:

2. Prior to submission of any building or other development permit applications to redevelop the
existing residence, the Applicant shall be required to submit for approval an application for Site Plan
Review, pursuant to Secs. 2-30-20 and 7-10-50 of the Code. The Site Plan Review application shall
address the following, in addition to the other requirements specified above:
A. Demonstrate compliance with the standards in Sec. 7-20-120.d for development within the Scenic
View Protection Area and the rural character guidelines for building location in Sec. 7-20-120.e
of the Code.
B. Demonstrate that the site can accommodate an on-site wastewater treatment system (OWTS) that
complies with the then current OWTS regulations.
3. Prior to submission of the Site Plan Review application, the Applicant shall be required to submit for
approval by the County Attorney and Community Development an amended Plat and Activity
Envelope Plan in accordance with Land Use Code Section 2-30-20(8)(3) and (5) and Application
Manual Sections 2.1.1 and .The above referenced approvals shall be a condition precedent to
finalization and recordation.
4. Prior to issuance of a building permit application for the new residence, the Applicant shall:
A. Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and
fire protection purposes, and for irrigation purposes, if applicable, to the Environmental Health and
Natural Resources Department.
B. Complete afireplace/woodstove registration form with the Community Development
Department, if necessary.
C. Submit a drainage and erosion control plan for review and approval by the Planning Engineer. [f site
disturbance exceeds one (1) acre, the Applicant shall obtain a stormwater permit from the State of
Colorado.
D. Submit a construction management plan for review and approval by the Planning Engineer.
E. Pay the applicable road and employee housing impact fees.
F. Obtain a permit from Environmental Health and Natural Resources for the new on-site
wastewater disposal system.
G. Submit a detailed revegetation plan for disturbed azeas with appropriate seed mixes. The plan shall
specify the native seed mix to be used, the rate at which it will be applied and the method of
cover.
5. No structural development in excess of 30" above or below natural grade shall occur within the
setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above
or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from
the most restrictive grade. Any development located within setbacks mandated by County zoning
regulations that does not comply with these restrictions shall require a variance from the Board of
Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a
variance.
6. The Applicant shall comply with the following standards for Development in a Low Wildfire Hazard
Area:
A. Defensible Space: The area around all buildings/structures, limited by property boundaries that
may limit a property owner's ability to comply with this section, shall incorporate landscaping
with wildfire defensible space considerations as follows (note: actual vegetation manipulation to

meet these conditions may not be necessary where the natural vegetation patterns have already
fulfilled these conditions):
1) Brush, debris and non-ornamental vegetation shall be removed within a minimum ten-foot
(I 0') perimeter around all structures.
2) Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a
minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater
slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners,
which provides general guidelines that may be modified by a wildfire expert acceptable to the
County).
3) Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be
a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be
equal to the height of the fuel. All measurements shall be from the edges of the crowns of the
fuel.
4) Al] branches From trees and brush within the thirty (30) foot perimeter shall be pruned to a
height of ten (10) feet above the ground with removal of ladder fuels from around trees and
brush.
5) Tree crown separation within the thirty (30) foot perimeters shall have a minimum often (10)
feet between the edges of the crowns, except for mature stands of aspen trees where ladder
fuels have been removed. In areas of aspen regeneration, understory shrubs and down and
dead materials shall be removed.
6) All branches that extend over the roof eaves shall be trimmed and all branches within fifteen
(15) feet of chimneys shall be removed.
7) The density of fuels up to a one hundred (100) foot perimeter of the structures shall be
reduced where natural reduction has not already occurred.
8) All deadfall up to a one hundred (100) foot perimeter shall be removed.
9) No new conifer trees shall be planted within ten (] 0) feet of a residence.
10) No flammable mulches shall be placed within two (2) feet of a residence.
B. Roofing Materials: Class A covering or Class A assembly as defined by the currently adopted
Building Code. No wood shakes or shingles. All other adopted Building Code compliant
methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they
comply with the following:
1) All roof coverings shall be constructed of non-combustible materials and instal led on a Class
A roof assembly.
2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof
debris.
3) Protrusions above the roofline, such as parapets, shall be prohibited.
4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum
pitch of 1:48.
5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the
Fire Marshal prior to submittal of a building permit application.

C. Maintenance and Miscellaneous Requirements
1) Roofs and gutters shall be kept clear of debris.
2) Any outbuilding shall adhere to the same wildfire requirements.
3) Yards shall be kept clear of all litter, slash and flammable debris.
4) All flammable materials shall be stored on a paral lel contour a minimum of fifreen (15) feet
away from any structure.
5) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more
than six (6) inches.
6) Firewood/wood piles shall be stacked on a parallel contour a minimum of fifreen (15) feet
away from the structure.
7) Swimming pools and ponds shall be accessible by the local fire district.
8) Fences shall be kept clear of brush and debris.
9) Wood fences shall not connect to other structures.
] 0) Fuel tanks shall be installed underground with an approved container.
11) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on
a contour away from the structure with standard defensible space vegetation mitigation
around any aboveground tank. Any wood enclosure around the tank shall be constructed with
materials approved for two (2) hour fire-resistive construction on the exterior side of the
walls.
12) Each structure shall have a minimum of one ten (] 0) pound ABC fire extinguisher.
13) Addresses shall be clearly marked with two (2) inch non-combustible letters and shall be
visible at the primary point of access from the public or common access road and installed on
anon-combustible post.
14) New utility lines shall be extended underground.
7. The Applicant shall comply with the applicable codes and requirements of the Snowmass-Wildcat Fire
Protection District, including but not limited to access, turning around of fire apparatus, installation of an
approved fire sprinkler system and a water supply for fire fighting.
8. The Applicant shall comply with the following measures to mitigate impacts to wildlife:
A. Native vegetation shall be maintained outside of the activity envelope.
B. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the
County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to
issuance of a certificate of occupancy. Bear resistant containers shall be provided by the
contractor for all edible and food related trash.
C. Fencing shall comply with the following, except for fencing immediately adjacent to the
buildings to contain pets or livestock:
1) Wood fencing shall employ three rails or less, be the round or split rail type, shall no[ exceed
48 inches in height above ground level and 12 inches in width (top view), and shall have at
least 18 inches between two of the rails.
2) Wire fencing shall consist of no more than 3 strands of smooth wire and shall not exceed 42
inches in height.
D. Construction workers shall be prohibited from bringing dogs on-site during construction.
9. No development including grading, excavation, fill placement, berming, landscaping, vegetation
removal or disturbance, well or septic system shall occur outside of the approved activity envelope,
except as necessary to comply with the wildfire mitigation measures described above.

10. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake
the corners of the activity envelope and install construction fencing around the construction site
within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a
Certificate of Occupancy.
11. All areas disturbed by construction shall be re-vegetated with native shrubs and grasses within one
growing season of the project's completion.
12. Exterior lighting shall comply with the County's lighting regulations in effect at the time of
installation.
13. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements
have been conducted. These requirements will be considered at the time of building permit.
14. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.
15. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
C de § 2-20-170 and C.R.S. § 24-68-105. The statutory vested rights granted herein shall expire on

Dear Cari Ann Holcomb:
Yvonne and Michael Silverman (applicant) are the owners of a property improved with a
single family residence located at 5720 Snowmass Creek Road (PID # 2645-144-01-001).
The applicant is represented by Davis Hom Incorporated in this land use application.
Please refer to Attachment 1, a Vicinity Map, which depicts the location of the subject
property. The subject site contains approximately 5.2 +/- acres and is legally described
as Hidden Meadows Subdivision Lot 1.
This land use application seeks approval to amend the Hidden Meadows Subdivision Plat
to establish an Activity Envelope which generally encompasses the existing developed
area on the Lot.
The application is divided in the following sections:
1. Background;
2. Existing Conditions;
3. Project Description;
4. Land Use Approvals; and
5. Summary.
BACKGROUND
The development of the Hidden Meadows Subdivision was initiated in 1972 at a time
when Pitkin County was approving new land use regulations to control the development
of rural Pitkin County. In 1974, Pitkin County filed a lawsuit against the developers of
the Subdivision claiming that the subdivision violated Pitkin County Subdivision
Regulations. The lawsuit was settled, however the developers were required to obtain
subdivision exemption approval from Pitkin County.

On April 16, 1975 the Pitkin County Planning and Zoning Commission approved
Resolution 75-13 recommending conditional approval of the Hidden Meadows
Subdivision Exemption (see Attachment 2). Resolution condition E required "buildings
on lots 1, 2 and 3 to be located on the Terrace III as shown on the Engineering Geology
Reconnaissance of Hidden Meadows Subdivision" as prepared by Chen and Associates,
June 21, 1974 (see Attachment 9 for copy of geologic report).
The Boazd of County Commissioners considered the Hidden Meadows Subdivision
Exemption at several meetings after April 16, 1975 and for a variety of reasons related to
access through the neighboring Snowmass Springs Subdivision did not approve the
Hidden Meadows Subdivision Exemption Plat until September 26, 1977.
The Hidden Meadows Plat which is recorded at Book 6 Page 40 includes note 4 which
reads (see Attachment 3):
"Buildings located on Lots 1, 2 and 3 shall be located on Terrace III."
Our review of Pitkin County records indicates that the existing house located on Lot 1
was inadvertently approved by Pitkin County despite being located predominantly on
Terrace II. We have discussed this matter with Lance Clarke, Pitkin County Planning
Director. According to Lance, the house may continue to exist in the current location,
however if the site is redeveloped with a new footprint, a new house must comply with
the preceding plat note. In the alternative, Pitkin County would consider a land use
application to change the plat restriction.
EXISTING CONDITIONS
The subject lot contains approximately 5.2 acres and is improved with a single family
dwelling unit. The entire Snowmass Creek Valley including the site is zoned RS-30
(Resource). Single family residential land uses and customary accessory uses are
permitted in the RS-30 zone. One dwelling unit is permitted for every 30 acres of land in
the zone. The subject site is a legally created sub-standard size or non conforming lot. A
legally created non-conforming lot located in Pitkin County maybe redeveloped in the
same manner as a conforming size lot.
The lot theoretically maybe improved with up to 8,250 square feet of floor azea. A
residential Growth Management Quota System allotment or a TDR is required to develop
more than 5,750 square feet of floor area on the site.
The Pitkin County Assessor's records show the site is improved with a house containing
approximately 4,565 squaze feet of heated space. Heated space is not "floor area" as
defined in the Pitkin County Land Use Code (Code or Land Use Code), but is an
indicator of the amount of floor area.

Attachment 4 is a copy of a 1991 Pitkin County Certificate of Occupancy (CO) for an
addition to the house. Attachment 5 shows that the Onsite Waste Water Disposal System
was upgraded in 2002 and the upgraded system was approved by Pitkin County. A
December 6, 2002 letter from Church & Associates, Inc. which was received by the
Pitkin County Environmental Health Department on April 10, 2003 documents that the
onsite waste water disposal system was installed in conformance with the permitted plans
and specifications.
The subject site is traversed by Snowmass Creek. Attachment 6, Hidden Meadows Lot 1
Slope Analysis, shows there are three distinct topographic areas or terraces on the
property. Terrace I, the lower terrace, is located adjacent to the Creek. Virtually the
entire lower terrace is restricted against development by the Hidden Meadows
Subdivision Plat and the Land Use Code which both require a 100 foot setback from the
Creek. The existing house is setback a little more than 100 feet from the Creek.
The majority of the existing house is located on the middle terrace (terrace II) and the
garage is located on the upper terrace (terrace III).
PROJECT DESCRIPTION
The applicant acquired the property in 2007. The applicant is seeking approval for an
Activity Envelope and a Minor Plat Amendment to develop a new house on the property
in approximately the same area as the existing house. At this time, the applicant plans to
utilize the existing driveway. If the Activity Envelope is approved the applicant will
initiate plans for the new house and then seek Site Plan Review approval.
Attachment 7 depicts the proposed Hidden Meadows Subdivision Lot 1 Activity
Envelope Site Plan. The applicant is proposing an Activity Envelope which generally
encompasses the existing site improvements.
LAND USE APPROVALS
This section of the land use application demonstrates compliance with the standards
identified in the Pitkin County Pre-Application Conference Summary Sheet (see
Attachment 10).

Refer to Attachment 7 which has been prepazed in compliance with these sections of the
Land Use Code. These Code sections have been met.
Minor Amendment to a Development Permit
Section 2-20-150
This section demonstrates compliance with the standards for a Minor Amendment to a
Development Permit. The standazds are given in bold with the applicant's response
following.
(t) Consistent with action(s) taken during previous development approvals for the
property; and
The proposed amendment is minor and is consistent with the prior approvals. The
amendment simply creates an activity envelope according to the Code to refresh the
approvals and to encompass land azea which is already developed. The key issue is the
plat requirement limiting development to Terrace III.
(2) Does not change the use of the proposed development between residential,
commercial and tourist accommodation uses;
There aze no changes proposed between these land use categories.
(3) Does not change the basic character of the approved use of land on which the activity
occurs, including basic visual appearance and method of operation; and
The proposal does not change the chazacter or visual appearance of the property.
(4) Does not constitute a new land development activity; and
The primazy land use activity approved for the site will not change as a result of the
amendment application.
(5) Does not increase off-site impacts in the surrounding neighborhood; and

The proposed amendment will have no negative impact on the surrounding
neighborhood.
(5) Does not endanger the public health, safety or welfare; and
The proposed amendment will not affect the public health safety and welfare.
(7) Does not violate any Land Use Code standard; and
The proposed amendment does not violate any Land Use Code standard.
(8) Does not substantially increase the need for on-site parking or utilities, or affect
affordable housing generation; and
There will not be any increase in on-site pazking resulting from the proposed amendment.
The demand for affordable housing will not be increased.
(9) Does not increase the floor area of the use by more than five (5) percent or
decrease the open space on the site by more than five (5) percent.
Floor area and open space will not be impacted.
The proposed Minor Amendment to an approved Development Permit will be consistent
with the prior land use approvals; is not changing land use categories; will not change the
basic character of the approved uses; does not increase off-site impacts resulting from
development; does not endanger the public health, safety and welfare; does not violate
any Land Use Code standard; does not affect on-site parking or utilities, or affect
affordable housing generation; and open space is to affected by the proposed amendment.
Minor Plat Amendment
Section 2-30-20 (5)
The proposed amendment complies with Section 2-30-20 (5) b. of the Land Use Code.
The amendment does not affect the degree of compliance with the standards of the Code.
The amendment is being made to a recorded plat and is consistent with the geologic
report considered in the original land use review process. Refer to Attachment 9, the
Geologic report.
Steep and Potentially Unstable Slopes
Section 7-20-20
This section of the application demonstrates compliance with Section 7-20-20 of the
Code.
Slope Delineation
Slopes shall be delineated within the Activity Envelope with two (2) foot contour intervals.
Slopes between each two (2) foot contour in each of the following categories shall be
designated by a distinct graphic pattern.
(1) Slopes that are fifteen (15) percent or greater, but less than thirty (30) percent;
(2) Slopes that are thirty (30) percent or greater, but less than forty-five (45) percent;
(3) Slopes that are forty-five (45) percent or greater.

Attachment 6, Slope Analysis delineates the slopes on the site. Most of the site is either 0
to 15 % in grade or 15 to 30% in grade with a few steeper anomalies.
The Code states specific criteria for lands over 45% in grade, 30% to 45% in grade, and
between 0 and 15% in grade. The specific details of the Code standards have not been
repeated here, but the applicant will comply with all the applicable standards.
Attachment 9 is an Engineering, Geology Reconnaissance Hidden Meadows Subdivision
on Snowmass creek prepared by Chen and Associates. The report finds that signs of
slope instability were not found. It is recommended that home sites be located on the
Terraces II and III. The report does not recommend limiting development to Terrace III.
However, it does recommend that Ten•ace I remain undeveloped.
Site Preparation and Grading
Section 7-20-10
This section of the land use application demonstrates compliance with Section 7-20-10 of
the Code. Standards appear in bold followed by the applicant's responses.
7-10-20:
7-10-30: SITE PREPARATION AND GRADING
(a) Grading and Fill Placement
Grading and filling on a site shall take place only within a defined Activity Envelope. All
grading and fill placement that exceeds fifty (50) cubic yards shall be indicated on the Site
Plan.
The applicant will comply with this standard.
(b) Clearing, Grubbing, and Vegetation Removal
Clearing or grubbing of land, or removal of vegetation shall take place only within an
approved Activity Envelope, except removal of noxious weeds may occur outside of an
Activity Envelope. Each Site Plan shall document compliance with the requirements of
this Sec. 7-20-10(b) and Sec. 7-20-130.
Grubbing will not take place on the site. Vegetation disturbance will be limited to within
the activity envelope.
(c) Tree Removal and Mitigation
Each tree with slx (6) inches or larger diameter at breast height (D.B.H.) that is removed
within the Activity Envelope shall be replaced with one (1) or more trees with total D.B.H.
at least equal to the caliper(s) of the tree(s) removed, to the maximum extent practicable.
Any tree that (i) is diseased, or (ii) is required to be removed pursuant to the provisions of
Sec. 7-20-60, as those requirements may be varied by a wildfire expert approved by the
County, may be removed and no replacement shall be required. All revegetation shall also
comply with the Pitkin County Revegetation Guidelines. Required replacement trees that
do not survive for at least one (1) year after installation shall be replaced at the owner's
expense, and the County may require financial security for such replacement pursuant to
Sec. 7-20-130(b)(7).

(d) Protection of Natural Terrain
The County Engineer or Community Development Director shall suggest and may require
design and construction techniques that lessen or mitigate any physical and visual
damage caused by the proposed activity or development to Constrained Areas or to the
natural terrain, stream vegetation, and other natural features of the landscape within the
Activity Envelope. Techniques shall include, but are not limited to:
(1) REVEGETATION
Revegetation and reforestation utilizing native or similar horticultural material, to be
completed during the first planting season after construction; where vegetation is
removed, it shall be replaced with vegetation that will reach similar density and height
to that removed within two (2) years following conclusion of construction.
(2) TOPSOIL
Removing and saving topsoil prior to any grading or excavating and replacement for
revegetation.
(3) WEED PREVENTION
Weed prevention, thistle management, and prohibition of non-native plants, which
may include reducing animal damage to vegetation cover, as determined by the
United States Soil Conservation Service Soil Survey.
(4) UTILITYINSTALLATION
Locating and installing utilities in a manner minimizing damage to the natural
environment and scenic quality.
(5) EROSION, SEDIMENTATION, AND STORMWATER MANAGEMENT
(a) Land uses shall:
1. Not cause erosion problems and, if practicable, retain all soil on site;
2. Minimize disturbance of natural vegetation and soil cover;
3. Ensure that all cuts and fills are adequately designed and vegetated to
control erosion as well as stability of the slope area;
4. Ensure that natural drainage patterns are preserved and protected from
increased water flows that subject existing channels and adjacent areas to
increased erosion; and
5. Preserve natural vegetation and soil cover within those buffer distances
adjacent to rivers, streams, lakes, reservoirs and wetlands/riparian areas
established in Sec. 7-20-80.
Mitigation measures identified in an approved erosion, sedimentation, or
stormwater management plan shall remain in place until revegetation is viable.
The applicant shall comply with the preceding standards.
Water Courses and Drainages
Section 7-20-30
Snowmass Creek Traverses the lot. The proposed Activity Envelope is located more than
100 feet from the Creek. The only exception is Activity Envelope # 3 which
encompasses the existing water well and a corridor for a water line replacement from the
water well to the primary Activity Envelope.
Floodplain Hazards

The Snowmass Creek 100 year or intermediate regional flood has not been mapped by
the Federal Emergency Management Agency (FEMA). Therefore, the proposed Activity
Envelopes depicted by Attachment 7 avoids all lands within an area 20 feet horizontal
and five feet vertical from the existing high water mark of Snowmass Creek.
Wildfire Hazards
Section 7-20-60
The wildfire hazard on the site is low. The applicant is not proposing to build or expand
any structures. The requirements for low wildfire hazards will be met, when
appropriate.
Wildlife Habitat
Section 7-20-70
The property is not located within a critical wildlife habitat azea. This standard is not
applicable.
River and Stream Corridors and Wetlands
Section 7-20-SO
As noted above, the proposed Activity Envelopes with the exception of the water well
enveloped aze located over 100 feet from Snowmass Creek. The propose envelopes are
more than 100 feet from any wetlands or riparian azeas on the property.
Summary
This land use application has demonstrated compliance with the Land Use Code

As reyuested, we investigated subsurface conditions at the site and designed an onsrte wastewater systAm
t C1U'Sj upf:rade for the remodel. The previous design dated August 36, 2002 should he discarded ro avoid
confusion. The subsurface investigation was perfomtcd on May 29, 2001.
SITE CONDITIONS
The property is in a rural residential area of Pitkin County, where OWS are required. The existing residence
intends to convert three existing rooms to three bedrooms. The additional bedrooms will serve a separate
OWS. A separate stub-out will be needed to serve the proposed OWS. The existing septic tank and drain
field will remain in use. There is a lined water feature 10 feet south ofthe southeast corner ofthe house. The
proposed drain field area has a 2% slope to the west and a moderate cover of native },?asses. The site is
supplied water by a well, located 102+ feet from the proposed drain field.
CONSTRUCTION
A remodel completed in 2001 created additional area for conversion of three rooms to bedrooms. The total
living area is 5000 square feet (SF). The three additional bedrooms will be served by a separate O~1'S, as
indicated on Figure 1. The OWS was sized based three bedrooms and 600 gallons per day (GPD) using
Pitkin County Environmental Health Department (PCGf lD) loading of ] 00 gallons per day per person. The
loading with a peaking factor of ] 75 is 1050 GPD. 'i'bis includes washing machines and garbage grinders.
SU13SU12PACE CONDITIONS
:1 subsurface investigation was perforrned by digging three percolation holes, 37 to 44 inches deep, and one
profile pit at the locations indicated nn Figure 1. Subsurface materials in the profile pit consisted of ] 5 feet
of sandy topsoil, underlain by slightly clayey sand with gravel and boulders to the maximum depth explored
of k feet. No ground water was encountered Percolation tests indicate percolation rates of S to 10 minutes

minimize compaction of the receiving soils. The bottom of the bed should he scarilied wish a pick,
shovel, or backhoe bucket teeth prior to the addition of chambers.
The surface of the field should be seeded after installation of the fields. A native seed mis should be sown at
the drain field to revegetate the surface. These mixes do not require irrigation and develop a growth I ~ ~ to
15 inches high. No automatic sprinkler system should be installed over the fields
OPERATION ANU MAINTENANCE
The owner realizes an OWS is different from public sewer service. The owner must assume
responsibility for maintenance of the system. In the absence of a monitoring program, the septic tank
should be pumped every two years. Effluent filter and screened vaults, as applicable, are to be cleaned
during pumping. There are daily considerations such as not putting plastic or other nonbiodegradahle
materials into the septic system. Garbage disposal use should be minimized
The backwash of a water softener may be harmful to the OWS. A separate drytvell should be constructed
for the backwash waste, if a softener is installed. Chemically treated water from a swimming pool or ,pas
should not be introduced to the OWS.
L1A11TATIONS
An OWS design should be installed by a contractor who is experienced in its installation. Our investigation,
layout, desigm and recommendations arc based on data submitted. If subsurface conditions different from
those described in this report are encountered, we should he notified to evaluate the change on the proposed
OWS. If the health department modifies this design, we should he contacted to evaluate the impact on the
performance of the OWS. The county and our firm must be contacted upon completion ofthe OWS
All construction is to be in accordance with the ISDS regulations. Pipe type and size, burial requirements.

As requested, we observed the installation of the onsite wastewater system for the subject sne un :~u~~ust
7 and November 27,'_002. The system was designed under our Job No. 1 ~709W, dated Aucust_v. 2002
and revised September 10, 2002. -
The system includes the installation of a 1500-gallon, two-compartment, precast concrete septic tank with
a BiotubeT"' pump vault in the second compartment. Four chamber-trenches and athree-outlet concrete
distribution box were installed. Two trenches had 1 row of seven chambers each, one trench had 1 row
of 4 chambers, and one trench had 1 row of 3 chambers for a total of 21 chambers and of ;35 ~ square
feet of infiltrative area. To achieve even distribution, each outlet on the distribution box directed eRhrcnt
to seven chambers..M as-built drawin5 is included as Figure 1. The PVC drain line for the water lectures -
should be monitored for signs of odor or effluent, in the unlikely event of a broken sewer prpe ~ ~

CONCLUSIONS
(1) lio conditions of a geologic nature were observed that would render
the proposed development infeasible.
(2) Some existing site conditions should be considered during planning
and construction. These conditions are related to flood potential,
,shallow ground water, and possible slope instability caused by
excessive grading on the steep slopes.
SCOPE
The results of an engineering geology reconnaissance at the Hidden
Meadows Subdivision on Snowmass Creek, Pitkin County, Colorado, are presented.
The report is preliminary and suitable for site feasibility evaluation with
respect to the existing geologic conditions. The opinions presented are
based on observations made during a field reconnaissance at the site on
June 6, 1974 and »ur experience in the area.
PROPOSED DEVELOPMENT
We understand that the 35 acre parcel will be subdivided Into six lots
for single family residences. The smallest lot is 5.1 acres. The developer
will provide two access roads and the necessary bridges to cross Snowmass
Creek. Individual residences will be constructed by lot owners. At the
present time, on-site sewer and water systems are proposed. At sometime
in the future the subdivision will become part of the Wildcat Water and
Sanitation District.
SITE CONDITIONS
The Hidden Meadows Subdivision is located about 4} miles south of the
town of Snowmass, Pitkin County, Colorado. The subdivision covers part

of the SEA of Sec. 14, T.95., R.II6W, Access to the property Is via a gravel
county road.
The subdivision is located on the valley floor adJacent to Snowmass
Creek. Very steep valley sides flank the subdivision on both the east and
west.. On the west side of Snowmass Creek, moderately steep to very steep
(15~ to 50$) valley sides extend down to the stream channel. To the east
of Snowmass Creek, where the majority of. the subdivision is located, three
terrace levels occur within the property. These terraces give way to a
very steep valley side near the extreme eastern boundary of the subdivision.
The first. terrace level occurs as a discontinuous surface adJacent to Snowmass
Lreek; the second terrace level lies from 15 to 30 feet above the level
of the first., A steep escarpment separates the two terrace surfaces, as
shown on Flg. 1. The third terrace lies from 10 to 15 feet above the second
terrace level and is separated from the second ferrate by a steep escarpment.
The slope on the terrace surfaces ranges from nearly level to strongly sloping
(from less than 3$ to 15~)•
Snowmass Creek, a moderate sized mountain stream, flows northward through
the western part of the subdivision. The creek is situated to a relatively
deep channel formed by the valley side to the west and the escarpment separating
th'e first and second terrace to the east. The only other drainage way crossing
through the site is a small, secondary drainage which Joins Snowmass Creek
near the northern part of the parcel. An irrigation ditch, Snowmass Ditch,
parallels the southeastern property boundary. This ditch had water flowing
In It at the time of this lnvestigatlori and has been used to irrigate meadow
land on the second and third terrace. Some water was leaking from the ditch
on to the terrace surfaces. An area of shallow ground water occurs on the

second terrace level, as shown on Fig. 1. This shallow ground water may
In part be related to leakage from the irrigation ditch.
No construction had begun at the site except for the pouring of bridge
abutments adJacent to Snowmass Creek and the rough grading of the south'
access road. Aspen, conifers, and cottonwood grow .adJacent to Snowmass
Creek. Scrub oak with a few scattered aspen grow along the escarpment between 1
the second and third terrace and on the east valley side. Scrub oak and
sagebrush grow along the west valley side. The terrace surfaces are primarily
covered in grass with willows and reeds growing. in the marshy area on the
second terrace.
The region has a cool, humid, continental mountainous climate. U. S.
Weather Bureau records indicate a mean annual precipitation of 18.5 Inches
with a mean annual snowfall of 134 Inches. Precipitation Is fairly evenly
distributed throughout the year, The mean annual temperature is 40° F.
January maximum and minimum mean daily temperatures are 32° F, and 4° F.
`duly maximum and minimum mean daily temperatures are 78o F. and 44° F.
GEOLOGIC SETTING
The subdivision Is located In a.portion of the valley that was filled
by glacial ice in the Pleistocene. The valley floor and valley sides are
mantled by glacial drift deposited by the ice. The drift consists of 'a
poorly sorted mixture of boulders, cobbles, and gravel In a clayey sand
matrix. The matrix comprises approximately 50$ of the deposit. Some boulders
are very large and exceed 10 feet to diameter. All three terrace levels
In the vicinity of the subdivision are underlain by glacial drift which
is expected to extend well below normal foundation depth. The terraces a,re
the result of cyclic downcutting of Snowmass Creek. i

Intrastratified claystone and shale of the Cretaceous age Mancos~Shale
underlies the drift. No bedrock outcrops were observed on the property,
although isolated outcrops of shale were observed along the western valley
side to the west of the subdivision.
GEOLOGIC CONDITIONS AFFECTIWG THE PROPOSED DEVELOPMENT
The proposed development is feasible from a geologic point of view
provided certain precautions are taken with respect to potential floods,
potential slope Instability, and shallow ground water.
Potential Floods: The areas immediately adjacent to Snowmass Creek are
potential fioodways. A hydrologic investigation would be needed to accurately
determine the frequency and magnitude of future flooding. In our opinion,
an investigation of this type is probably not warranted for the project
provided that building sites are located on higher ground away from the
stream. The second terrace level lies from 15 to 30 feet above the stream
channel and should be well above any future flood level.
Potential Slope insta611ity: No signs of slope instability were observed
within the parcel or on the adjacent steep valley sides, and we do not anticipate
any problems pr-0vided excessive grading is not done. Grading can be kept
to a minimum if building sites are located to the east of the creek on the
gentler slopes of the second and third terrace. Cut and fill slopes should
not exceed 8 feet in height and be no steeper than 2:1 and preferably flatter.
More extensive grading may be possible, but should be, studied on an individual
basis. Good construction practices should be followed during all grading
operations. Some problems could arise on the steep slope to the west of

The feasibility of building
If excessive grading is allowed or the existing drainage conditions
altered on. the steep valley sides adjacent to the subdivision, then there
is the possibility that unstable conditions could be created which could
have•an effect on the subdivision.
Shallow Ground Water: An area of shallow ground water was observed on the
second terrace level. See Fig. 1. All other areas within the subdivision
appear to be well drained. If, construction is necessary in the area of
shallow ground water, then ground floor elevations should be placed above
maximum water level. It may be desirable to elevate the ground surface
by the placement of fill
construction of subdrains.
Ground water levels couldalso be lowered by the
Foundations: Based on soils exposed in road cuts. and .stream cuts, we believe
spread footings will be feasible for most lightweight structures. Once
specific building sites have been determined, we recommend that a subsoil
investigation be done in order to determine specific design criteria for
foundations.
On-Site Sewage Disposal: Soil percolation tests conducted by the county
on Lot b indicate a percolation rate of 30 minutes per inch. This percolation
rate is expected to be typical for the subsoils throughout the subdivision.
It should be feasible to locate individual leaching field type septic systems
on each proposed lot. The only problem that we can foresee would be in areas
of shallow ground, water which is apparently restricted to the second terrace
level. Once specific leaching field locations have been determined, we_
criteria. - ,
recommend that a subsoil investigation be done In order to determine specific

is consistent with other background radiation readings found elsewhere in
the Aspen area and does not constitute unusually high radiation .level for
the region.

be feasibly developed if the precautions outlined in this report are followed.
We recommend that once specific building sites have been determined, a subsoil
investigation be conducted in order to determine design criteria for foundations
and septic systems.

Summary: Some potentially hazardous conditions do exist but can be avoided
if building sites are carefully selected. Each lot appears to have good
building sites. We recommend that building sites be located on the gentle
slopes of the second and third terrace levels away from areas of shallow
ground water. A min4mum setback of 1:1 (horizontal to vertical) is recommended
for structures located adJacent io the escarpment bordering Snowmass Creek.
Building sites west of the creek should be carefully studied to determine
feasibility.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 32-2002 establishes a fee
structure for land use applications and the payment of all processing fees is a condition precedent to a detartnination of
application complexness. The fee structuro is based on the COUNTY'S policy that developmem shal- pay, in full, the
cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to roflect the
expense incurred in providing such services to the public.
3. APPLICANT end COUNTY agree that because of the sirx, nature or scope of the proposed PROJECT, it
may not be pouiblt st the lima of application to ascertain the fuq extent of the costs involved in processing tiw

approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agroes that in consideration of the COUNTY'S waiver of its right to collect full
foes prior to a date~~ation of application completeness, APPLICANT shall pay a box fee in the smoum of S~
which is based on~7rours of stafftime, and if actual time spent by staff to process the application exceeds the average
number of hours by more than 20Yo, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.

Since the Silverman proposed activity envelopes encompass the existing home and disturbance area, there should
not be any additional impacts to wildlife. The applicant needs to be aware that this specific residence has had
significant black bear conflicts in the past and they will need to take the necessary precautions to minimize
conflicts. During construction/tear down, the contractors need to provide a bear resistant container for all edible
and food related trash. There has been significant noncompliance with this code requirement which has led to
increased food habituation and conditioning of black bears. This results in increased human-bear conflicts.

The Snowmass-Capitol Creek Caucus Board has reviewed this application for a minor
plat amendment to relocate the activity envelope, following a site visit and favorable
recommendation by our Land Use Committee.
At its monthly Board meeting tonight, a divided Board voted to recommend approval of
the plat amendment, enabling the applicants to seek to build a new home on Terrace II,
rather than on Terrace III where the existing home was originally approved and to have
been constructed. A minority of the Board (4 of the 16 present) voted to deny the plat
amendment, which will authorize a replacement home closer to Snowmass Creek.
The Board explicitly did not evaluate the suitability of this parcel for a TDR to increase
house size, since no such request or supporting information has been presented. And a
unanimous Boazd emphasized that, in its Master Plan [see, 1.1.2 and Objective 1.1.2(c)],
"the Caucus strongly supports the existing [maximum] house size (floor area) limitation
of 5,750 squaze feet" to preserve the rural character of these valleys. The Board
rigorously applies the exceptional circumstances standard.
Finally, due to the proximity of this site to Snowmass Creek and the 100' setback
requirement, the location, type and requirement of annual maintenance of any septic and
leach field will be carefully evaluated as further land use approvals are sought.

The Snowmass-Wildcat Fire protection District does not agree with the low wildfire assessment given in
Section 7-20-60 of the review materials submitted concerning this property.
It is our observation from site visits that the Hidden Meadow subdivision and this property is located within a
moderate to high wildfire area with very limited "dead end" access and no reliable subdivision or individual
firefighting water supplies.
Should any development or improvements be requested for the properties at 5720 Snowmass Creek Road please
notify us as it is located within the Snowmass-Wildcat Fire protection District. It would be our intention to
require mitigation in the form of water supplies, automatic fire suppression and proper "Defensible Space" for
new structures.

Subject: Geological Hazard Evaluation and Review of 1974 Geology Report, 5720 Snowmass
Creek Road, Pitkin County, Colorado.
Dear Mr. and Mrs. Silverman:
This letter presents the results of Yeh and Associates, Inc. geological hazards evaluation for the
subject property. This evaluation is intended to provide an assessment of the geological hazards
which may affect development of the property. This evaluation consisted of field reconnaissance
and review of existing literature. Our investigation was conducted in accordance with Section 7-
20-20 Steep and Potentially Unstable Slopes and Section 7-20-50 Geologic Hazards, Sections (b)
through (i) of the Pitkin County Development Standards. This evaluation does not include
environmental or avalanche assessment.
The parcel covered by this report is located in the Hidden Meadows Subdivision, Lot 1, Pitkin
County Colorado. There is an existing residential structure on the lot. Planned improvements
within this area include an addition to the house. We were provided with a June 21, 1974
"Engineering Geology Reconnaissance" report by Chen and Associates, Inc. which assessed the
geological conditions for the subdivision as a whole.
INVESTIGATION AND LITERATURE REVIEW
Our investigation consisted of a site visit and review of three map sets, "Pitkin County, Lower
Roaring Fork Valley, Potential Geologic Hazards, by Colorado State University, 1974;
"Geologic Map of the Roaring Fork and Crystal Valleys", 1974 by F. M. Fox and Associates,
Inc.; and the "Environmental and Geologic Constraints Map of the Roaring Fork and Crystal
Valleys", 1974 by F. M. Fox and Associates, Inc. In addition, we reviewed the above mentioned
report by Chen and Associates. We conducted a site visit to the property on June 11, 2008.
The mapping did not show any potential geological hazards at the site of the proposed
improvements. The Chen report describes three alluvial terraces at slightly differing elevations
on the parcel. The report names the lowest terrace, closest to the creek as # 1. Terraces #2 and #3
are successively higher and farther from the creek. The report recommends that development be
avoided on Terrace # 1 but indicates that Terraces #2 and #3 are suitable for development.

Site conditions at the parcel are generally well described in the Chen report and are not repeated
here for the sake of brevity. Lot 1 can be briefly described as consisting of a grassy meadow on
the three alluvial terraces. The parcel slopes gently toward Snowmass Creek. We did not note
any signs of slope instability or other potential geological hazards during our site visit.
SUMMARY

LIMITATIONS
This report has been prepared in accordance with generally accepted geological practices in this
area for use by the client for preliminary planning purposes. If geological hazard mitigation is
included in the site-specific development plan, Yeh and Associates, Inc. should review the
proposed design and construction procedure. The preliminary conclusions and recommendations
submitted in this report are based upon data obtained from the observations made in the field.
The findings and recommendations given in this report are site-specific, and are only valid for
the subject site.

Re: Land Use Analysis of Hidden Meadows Subdivision Lot 1
Dear Yvonne & Michael:
This letter summarizes the reseazch which we did this fall regarding the proposed
redevelopment of Hidden Meadows Subdivision Lot 1 located in the Snowmass Creek
Valley in Pitkin County, Colorado. The address of the site is 5720 Snowmass Creek
Road and the Colorado State Parcel identification number is 2645-144-01-001.
This letter addresses existing conditions, background affecting the property and potential
redevelopment.
EXISTING CONDITIONS
The subject lot contains approximately 5.2 acres and is improved with a single family
dwelling unit. The entire Snowmass Creek Valley including the site is zoned RS-30
(Resource). Single family residential land uses and customary accessory uses aze
permitted in the RS-30 zone. One dwelling unit is permitted for every 30 acres of land in
the zone. The subject site is a legally created sub-standard size or non conforming lot. A
legally created non-conforming lot located in Pitkin County may be redeveloped in the
same manner as a conforming size lot.
The lot theoretically may be improved with up to 15,000 square feet of floor azea.
However, given current Pitkin County and Snowmass/Capitol Creek Caucus land use
policies it would be virtually impossible to develop more than 8,250 squaze feet of floor
area on any lot in the Snowmass Creek Valley. In fact, it is likely that the Caucus would
recommend that any floor azea developed on site in excess of 5,750 square feet be located
in a basement. A residential Growth Management Quota System allotment or a TDR is
required to develop more than 5,750 square feet of floor azea on the site.
The Pitkin County Assessor's records show the site is improved with a house containing
approximately 4,565 squaze feet of heated space. Heated space is not "floor area" as
defined in the Pitkin County Land Use Code (Code or Land Use Code), but is an
indicator of amount of floor azea . Floor azea as defined in the Code is a very inclusive
term. Virtually any space under a roof counts as floor azea based upon the Code floor
area definition.

Attachment 1 is a copy of a 1991 Pitkin County Certificate of Occupancy (CO) for an
addition to the house. Attachment 2 shows that the Onsite Waste Water Disposal System
was upgraded in 2002 and the upgraded system was approved by Pitkin County. A
December 6, 2002 letter from Church & Associates, Inc. which was received by the
Pitkin County Environmental Health Department on April 10, 2003 documents that the
onsite waste water disposal system was installed in conformance with the permitted plans
and specifications.
The subject site is traversed by Snowmass Creek. There are three distinct topographic
areas or terraces on the property. Terrace I, the lower terrace, is located adjacent to the
Creek. Virtually the entire lower terrace is restricted against development by the Hidden
Meadows Subdivision Plat and the Land Use Code which both require a 100 foot setback
from the Creek. The existing house is setback a little more than 100 feet from the Creek.
The majority of the existing house is located on the middle terrace (terrace II) and the
garage is located on the upper terrace (terrace III).
BACKGROUND
The development of the Hidden Meadows Subdivision was initiated in 1972 at a time
when Pitkin County was approving new land use regulations to control the development
of rural Pitkin County. In 1974, Pitkin County filed a lawsuit against the developers of
the Subdivision claiming that the subdivision violated Pitkin County Subdivision
Regulations. The lawsuit was settled, however the developers were required to obtain
"subdivision exemption" approval from Pitkin County.
On April 16, 1975 the Pitkin County Planning and Zoning Commission approved
Resolution 75-13 recommending conditional approval of the Hidden Meadows
Subdivision Exemption (see Attachment 3). Resolution condition E required "buildings
on lots 1, 2 and 3 shall be located on the Terrace III as shown on the Engineering
Geology Reconnaissance of Hidden Meadows Subdivision as prepared by Chen and
Associates, June 21, 1974."
The Board of County Commissioners considered the Hidden Meadows Subdivision
Exemption at several meetings after April 16, 1975 and for a variety of reasons related to
access through the neighboring Snowmass Springs Subdivision did not approve the
Hidden Meadows Subdivision Exemption Plat until September 26, 1977.
The Hidden Meadows Plat which is recorded at Book 6 Page 40 includes note 4 which
reads:
"Buildings located on Lots 1, 2 and 3 shall be located on Terrace IIL"
Our review of Pitkin County records indicates that the existing house located on Lot 1
was inadvertently approved by Pitkin County despite being located predominantly on
Terrace II. We have discussed this matter with Lance Clazke, Pitkin County Planning

Director. According to Lance, the house may continue to exist in the current location,
however if the site is redeveloped with a new footprint, a new house must comply with
the preceding plat note. In the alternative, Pitkin County would consider a land use
application to change the plat restriction.
POTENTIAL REDEVELOPMENT
This section of the letter addresses potential site redevelopment with a new single family
residence. Redevelopment will require Pitkin County Site Plan and Scenic View
Protection land use approvals. The following standazds and policy will be considered in
the land use review process include.
1. Avoidance of steep slopes in excess of 30 percent.
2. Setback of 100 feet from the Creek, wetlands and riparian vegetation.
3. Minimizing the visual impact of house development as viewed from Snowmass
Creek Road.
4. Adequate ingress and egress for emergency service vehicles.
5. On site waste water disposal standazds.
6. The Neighborhood compatibility policy, specifically potential impacts on the
upvalley and downvalley neighboring properties.
We have discussed the possibility of redeveloping the existing house utilizing the existing
footprint. Although redevelopment matching the existing footprint may be possible given
the Land Use Code, we agreed that such a redevelopment plan is not desirable. You will
have to obtain Pitkin County land use approvals for a Major Plat Amendment in order to
redevelop a house with a new footprint located on Terrace II. This land use review may
be combined with the Site Plan and Scenic View Protection land use reviews. The land
use application will be considered by the Planning and Zoning Commission and the
Board of County Commissioners. The land use review process will probably take five
or six months to complete following the submission of a complete land use application.
Our review of the Engineering Geology Reconnaissance of Hidden Meadows Subdivision
which was referenced in the original land use review records did not indicate that there
was a compelling recommendation in the geologic study to warrant the prohibition of
development on Lot 1, Terrace II. In fact, the public records do not indicate that there
was any reason for prohibiting development on Terrace II. Nevertheless, the burden will
be placed upon you to demonstrate to Pitkin County that development on Terrace II
complies with the land use standards and is consistent with the policy referenced in this
letter. We aze particularly concerned about the possibility of negative comments from the
neighboring property owners. Since the owners of Hidden Meadows Lots 2-6 are the
beneficiaries of the plat restriction, it is possible that those owners may have to consent to

the plat amendment. However, typically Pitkin County only requires notice to the other
property owners in the subdivision.
SUMMARY
This letter summarizes our investigation of the land use factors which affect the potential
redevelopment of Hidden Meadows Subdivision, Lot 1. Redevelopment of the subject
site with a new house up to 5,750 squaze feet in size is possible subject to obtaining
Pitkin County Site Plan Review and Scenic View Protection approvals. The most
challenging land use issue affecting site redevelopment is whether Pitkin County will
approve a Major Plat Amendment permitting development on Terrace II.
The information presented in this letter is based upon our review of the facts acid
regulations pertinent to the subject site. The Pitkin County land use review process is
highly subjective and interpretations of relevant Code provisions may vary with changes
in staff and elected and appointed officials. The Boazd of County Commissioners is
ultimately responsible for Code interpretations and land use decisions. Consequently, no
warranty of facts, opinions or interpretations contained in this analysis is either expressed
