RECITALS
I. Robert Pew ("Appellant") has requested an appeal to be heard at the Pitkin County Board of County
Commissioners ("BOCC") for the denial of Administrative Decision No. 65-2008 which denied the
Appellant's request to construct solar panels on slopes > 45% .
2. The Appellant submitted an application after July 6, 2006, therefore, the application is being considered
pursuant to the 2006 Land Use Code, as amended.
3. The parcel is located at 105 River Rock Lane, Woody Creek. PID/k: 2643-162-00-024 (Legal
Description, Attachment A). The parcel is in the AR-2 and AR-]0 zone districts and contains
approximately 5 acres.
4. The BOCC heard the appeal request at a public meeting on August 27, 2008, at which time, evidence
and testimony were presented with respect to this appeal
5. The BOCC finds that the request to allow construction of solaz panels on slopes > 45% is inconsistent
with Section 7-20-20(b) of the Code.
NOW THEREFORE BE IT RESOLVED by the BOCC that it hereby upholds Community
Development Director Administrative Determination No. 65-2008, and that it denies the Appellant's
appeal.

REQUEST: The Appellant requests an appeal of a Community Development Director Decision pursuant to Section
2-20-180 of the 2006 Land Use Code. The appeal requests approval to construct solaz panels on steep slopes.

LOCATION: 105 River Rock Lane, Woody Creek. PID# 2643-162-00-024.
ZONING/LOT SIZE: The parcel contains approximately 5 acres and is split by the AR-2 and AR-10 zone districts.
BACKGROUND: The parcel received 1041 Hazard Review approval to construct a single family dwelling pursuant
to BOCC Resolution 86-41. The parcel most recently received 1041 Hazard Review approval pursuant to Hearing
Officer Determination No. 53-2006 (Rec. No. 533539) and Site Plan and Special Review for a TDR Receiver site
pursuant to Hearing Officer Determination No. 11-2007 (Rec. No. 536952). The approved envelope was amended to
accommodate the replacement of sewer and irrigation lines pursuant to Administrative Decision 18-2008. Most
recently, a Minor Amendment to a Development Permit request was denied pursuant to Administrative Decision 65-
2008. This application was denied because the Applicant proposed to construct a solaz array on slopes > 45%, which
is prohibited by the Code.
REQUEST:
The Appellant has appealed Administrative Decision No. 65-2008 (Attachment A). The Appellant's appeal letter and
argument is attached separately.
STAFF COMMENTS:
Pursuant to Section 7-20-20(b), development is prohibited on slopes > 45%. Currently, there is no avenue in the code
for allowing development on these steep slopes. If construction of solar panels were to be permitted on steep slopes,
the Code would need to be amended.
RECOMMENDATION:
Staff recommends the BOCC adopt a motion denying the appeal to allow development on slopes > 45%.

The Woody Creek Caucus District Planning Commission has reviewed the application by
Rob Pew for a Minor Amendment to a development permit and site plan review for the
placement of additional solar collectors and photovoltaic collectors; we support the
application. Mr. Pew stated the footers would be hand dug minimizing the hillside
disturbance. This is a green energy system that is welcomed to Woody Creek. The
applicant stated that the system is not visible from any neighbors and is largely covered
by the Pew house. The Woody Creek Caucus prefers the collectors down the hill at the
proposed location even though there are more than 30 degree slopes and we feel that this
variance is acceptable.

THIS LETTER IS A FORMAL APPEAL TO THE ADMINISTRATIVE DECISION NO. 65-
2008 SIGNED ;July 7, 2008 and received by e-mail July 10, 2008.
This appeal is for the Pew Minor Amendment to a Development Permit and Site Plan for the
purpose of placing solar hot water and photovoltaic electric collectors on the hill side behind the
existing house.
Reason for the appeal is that the code does not allow any construction on slopes more than 45%
even though the placement of collectors on steep slopes improves functionality and, in this case,
allows the collectors to be placed close to the residence which increases efficiency.
The existing code does not address any exceptions for slopes in excess of 45% for "green"
energy, hot water collectors, photovoltaic collectors, hydroelectric or wind turbines as
exceptions.
The owner is requesting an exemption from the slope requirements for the proposed hot water
solar collectors and the photovoltaic collectors as there is no other option. There are existing hot
water collectors on the slope in question which have been there for years. The Owner is simply
expanding the existing system. Relocation is not feasible. The photovoltaic collectors can be
placed in an alternate location, but they will be more visible to the neighbors.
The main concerns of the 45% slopes:
1. Structural stability
2. Erosion
3. Loss of vegetation
4. Visual impact
Addressing 1 Structurally the engineering required to place the collectors on a frame above the
ground with small anchors is minimal.
Addressing 2 The collectors will protect the slope, and the hill side is
predominately rock.
Addressing 3 There is low vegetation in the area proposed with no trees.
Addressing 4 There are no alternative locations as the rest of the site is covered in trees or
requires installation on the top of a hill with to long of run for it to function.
The photovoltaic collectors set at the top of the hill have a visual impact on the
Woody Creek Trailer Park as well as neighbors across the river and can be seen
from the Highway 82

For the reasons stated above the Owner requests the County Commissioners to either approve an
exception to the provisions of Section 7-20-20(b) or authorize and direct staff to process an
amendment to the Land Use Code to allow solar hot water and photovoltaic electric collectors to
be located on slopes in access of 45%. The Owner wishes to be scheduled for the first available
meeting.

Need Special Review for location of Green Energy collector's type of envelope
Sec. 7-10-50: Site Plan;
a). An Activity Envelope was created for utilities at the top of the hill, but the run down to
the house by using less then 30 degree slopes is over 525 to 550 ft., and would not function for
solaz collectors at that distance for water circulation. The Photovoltaic collectors would work
in the approved Activity envelope for utilities, but the collectors would be more visible and the
Woody Creek Caucus would prefer them down on the hill

b, c). It is a rocky hillside with natural grasses and some scrub oak bushes occupy the area
proposed for the collectors location. There is no specimen 6" or lazger scrub oak, normal size
bushes with minimal amount needed to be removed.
d). There will be minimal excavation for the collector stands as they aze in groups of 6
which will require 6 piers of 8" with no footer and minimal penetration into the hill, just
enough for anchoring and not to frost line
The collectors will protect the piers from erosion and visibility as they aze covering them
Sec. 7-20-20: Slopes
There is no azea near the house and the solar storage for collectors on the lower terrace
Activity Envelope. The upper terrace is less than 0 to 15 degrees but is to faz away for the
solaz collector storage system to work, based on the engineer and solar consultant.
There are minor slope anomalies on the hill in the azea being proposed and appeaz to be in the
45 to the 50 degree azea, as the hill is basically consistent.
The slope is however ideal for solaz and photovoltaic collectors as they need the sun angles

across the river
Sec. 7-20-130: Landscaping and vegetation Protection.
1). The location of the collectors is screened by the lazge Cottonwood trees on the river
and lower terrace as well as the new addition of the house
2). Being lower on the hill the collectors aze not visible from Highway 82
4) The collectors would not come close to the top of the hill
5). It complements the natural topography
6) The proposed location does not involve any irrigated meadows

The proposed location would be compatible with the predominately rocky hill side, with
minimal disturbance from hand excavation of the pier anchors.

The proposed layout on the site plan places the solaz water collectors adjacent to the existing
units on the hill side. The hill side is @ 45% to 50% slope. This is good for the solar collectors as
the optimum performance of solar water collectors is 50 degrees from the horizontal, which then can
be placed right on the hill will less tilt and frame. This will put the collectors close to the ground of
the hill and blend in. Also the adjacent existing collectors can be tied into and use the existing tines
that are going down the hill to the house storage system, without disturbance to the hillside.
Another advantage of locating the collectors in the proposed location is they are low enough
on the hill that they can not be seen from Highway 82, from Woodycreek Trailer Pazk, and the houses
across the river, as the house itself and the trees at the river cover them up.
The alternate upper location is 525 to 550 feet from the house storage and is up hill @ 50 +
feet, which is to faz from the house for the solaz system to work according to the mechanical engineer
Mazk Burggraaf, and the solar consultant, Aspen Solar. Therefore the water solar collectors would be
eliminated if not done in the proposed location. There is no other location on the lower terrace at the
Building Activity Envelope.
The photovoltaic collectors need 30 degrees from the horizontal for optimum performance so
they can be put approximately flush with the hillside, and are shown directly above the water solar
collectors. The electrical connection to the house controls would hook into the existing power poles
and go overhead to the house. The anchoring into the hill would have minor disturbance to the hill
using 8" concrete Sono tube bases, which would be hand dug with minimal depth. The collectors
would be build in banks of six, with 6 anchors, 2 at each ends and 2 in the middle, with a aluminum
frame spanning between the piers and connecting them together. There would be three strips of 6
photovoltaic collectors, 3.5' x Tand about 2' off the ground for allow for snow buildup and drainage
below. There would be one strip of 6 new solar water collectors, 4' x 8' each. The collectors cover
up the anchors and the aluminum frame.
The slope of the hill is ideal for the sun angle need in green energy systems and they can be
placed low enough on the hill not to be seen.
The alternate site for the photovoltaic collectors is at the top of the hill in the Activity
Envelope designated for utilities etc. which we were originally going to place them there. This is the
top of the hill and would require a frame at a 30 degree angle to the horizontal to place the 7 foot high
collectors at about 3.5' above the top of the hill. This makes them very visible from Woody Creek
residents, across the river houses and from Highway 82, and the water collectors would not work.

This letter is a request by the Applicant to amend the existing 1041 Review and Site Plan, to
allow for the placement of additional solar collectors and new photovoltaic collectors on the site.
The proposed layout on the site plan places the solar water collectors adjacent to the existing
units on the hill side. The hill side is @ 45% to 50% slope. This is good for the solar collectors as the
optimum performance of solar water collectors is 50 degrees from the horizontal, which then can be
placed right on the hill will less tilt and frame. This will put the collectors close to the ground of the hill
and blend in. Also the adjacent existing collectors can be tied into and use the existing lines that are
going down the hill to the house storage system, without disturbance to the hillside.
Another advantage of locating the collectors in the proposed location is they are low enough
on the hill that they can not be seen from Highway 82, from Woodycreek Trailer Park, and the houses
across the river, as the house itself and the trees at the river cover them up.
The alternate upper location is 525 to 550 feet from the house storage and is up hill @ 50 +
feet, which is to far from the house for the solar system to work according to the mechanical engineer
Mark Burggraaf, and the solar consultant, Aspen Solar. Therefore the water solar collectors would be
eliminated if not done in the proposed location. There is no other location on the lower terrace at the
Building Activity Envelope.
The photovoltaic collectors need 30 degrees from the horizontal for optimum performance so
they can be put approximately flush with the hillside, and are shown directly above the water solar
collectors. The electrical connection to the house controls would hook into the existing power poles and
go overhead to the house. The anchoring into the hill would have minor disturbance to the hill using 8"
concrete Sono tube bases, which would be hand dug with minimal depth. The collectors would be build
in banks of six, with 6 anchors, 2 at each ends and 2 in the middle, with a aluminum frame spanning
between the piers and connecting them together. There would be three strips of 6 photovoltaic
collectors, 3.5' x 7'and about 2' off the ground for allow for snow buildup and drainage below. There
would be one strip of 6 new solar water collectors, 4' x 8' each. The collectors cover up the anchors
and the aluminum frame.
The slope of the hill is ideal for the sun angle need in green energy systems and they can be
placed low enough on the hill not to be seen.
The alternate site for the photovoltaic collectors is at the top of the hill in the Activity
Envelope designated for utilities etc. which we were originally going to place them there. This is the top
of the hill and would require a frame at a 30 degree angle to the horizontal to place the 7 foot high
collectors at about 3.5' above the top of the hill. This makes them very visible from Woody Creek
residents, across the river houses and from Highway 82, and the water collectors would not work.
Woody Creek Caucus would prefer the collectors down the hill in the proposed location.

the house by using less then 30 degree slopes is over 525 to 550 ft., and would not function for
solar collectors at that distance for water circulation. The Photovoltaic collectors would work
in the approved Activity envelope for utilities, but the collectors would be more visible and the
Woody Creek Caucus would prefer them down on the hill

proposed for the collectors location. There is no specimen 6" or larger scrub oak, normal size
bushes with minimal amount needed to be removed.
d). There will be minimal excavation for the collector stands as they are in groups of 6
which will require 6 piers of 8" with no footer and minimal penetration into the hill, just
enough for anchoring and not to frost line
The collectors will protect the piers from erosion and visibility as they are covering them

There is no area near the house and the solar storage for collectors on the lower terrace
Activity Envelope. The upper terrace is less than 0 to 15 degrees but is to far away for the
solaz collector storage system to work, based on the engineer and solar consultant.
There are minor slope anomalies on the hill in the area being proposed and appear to be in the
45 to the 50 degree area, as the hill is basically consistent.
The slope is however ideal for solaz and photovoltaic collectors as they need the sun angles

RECITALS
I. Robert Pew ("Applicant's has applied to the Pitkin County Hearing Officer {"Hearing Officer"} for Site
Plan Review, Special Review for a TDR Receiver Site, and Special Review for a CDU.
2. The parcel is located at 105 River Rock Lane. P1DM 2643-162-00-024. (Legal Description Attachment
A)
3. The parcel contains approximately 5 acres and is split by the AR-2 and AR-] 0 zone districts.
4. The Applicant submitted a complete application after July 6, 2006, therefore, the application is being
considered pursuant to the 2006 Land Use Code.
5. The parcel received 1041 Hazard Review approval to constn7LK a single family dwelling pursuant to
BOCC Resolution 86.41. The parcel most recently received 1041 Hazard Review approval pursuant to
Hearing Officer Determination No. 53-2006 (Rec. No. 533539). A 1041 Hazard Review Site Plan has
not yet been recorded for this approval.
6. The Hearing Officer considered this application at a duly noticed public hearing on April 17'", 2007 at
which time evidence and testimony were presented with respect to this application. A letter of concern
from a neighbor was received during the public comment period. The neighbor concerns were brought
to the attention of the Hearing Officer at the public hearing.
7. The Hearing Officer finds that the proposed site plan is consistent with the Code.
8. The Hearing Offcer further finds that the parcel is (]) eligible to receive a TDR; and (2) can
accommodate a detached CDU.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Community Developmer7t
Hearing Officer that he does hereby approve the Pew Site Plan Review, Special Review for a TDR
Receiver Site, and Special Review for a CDU subject to the following conditions, which shall run with the
land and be binding on al! successors in interest.
1. The Applicants shall adhere to all material representations made in the current or prior applications
or in public meetings or hearings and shall consider those representations to be conditions of
approval, unless amended by other conditions.
2. At the time of building permit submittal, the Applicant shall surrender the TDR's for additional floor
area up to 8,250 square feet from a base 5,750 square feet Floor area is limited to 8,250 square feet
without further special review for additional TDR's or a Growth Management allocation.
3. No calculations for height, bulk, setback, size, floor area, or arty other building and zoning requirements
have been conducted. These requiremems will be considered at the time of building permit Airy

4. All conditions of Hearing Officer Detennmation No. 53-2006 (Rec. No. 533539} shall remain in full
force and effect unless otherwise amended by this Determination.
5. Prior to submission of any future building permit applications, the Applicant shall be required to
submit for approval by the County Attorney and Community Development a Site Plan that illustrates
the previously approved building envelope in accordance with Land Use Code Section 2-30-20(g) and
Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to
finalization and recordation. The Site Plan shall also incorporate the following changes:
a) The Site Plan shall include all changes conditioned in Hearing Officer Determination
No. 53-2006 and make reference to that approval on the Plan.
b) The Site Plan shall illustrate all footprints of structures on the parcel.
c) The Site Plan shall include an envelope labeled as follows "TEMPORARY
CONSTRUCTION ACCESS AND POST CONSTRUCTION REVEGETATION
ENVELOPE"
6. Prior to Certificate of Occupancy the Applicant shall site the fence 20' from the high water mark of the
Roaring Fork River.
7. The County Attorney shall review and approve the certificate ofnon-merger provided in the application.
Approval from the Attorney shall be in place prior to recordation of the Site Plan.
8. The Applicant shall submit for review and approval by the Community Developmrnt Department a post
construction revegetation plan that is consistent with the natural vegetation in the area. This plan shall
address revegetation of disturbed areas due to construction. This plan shall also include mitigation
measures for any trees removed that are 6" d.b.h. or greater pursuant to Section 7-20-10(c) of the Code.
9. The Applicant shall comply with all representations made in the Site Plan Review including but not
limited to the following;
a) Utilization of earth tone colors and materials on the building fapade;
b) Installation ofnon-reflective roofmg;
c) All lighting shall comply with the Code.
10. The detached CDU shall not exceed 1000 net livable square feet of floor area, which shall count
toward the total allowable floor area for the lot. The kitchen contains the folowing, as defined in the
Aspen/Pitlcin County Employee Housing Guidelines: a minimum of a two-burner stove with avrn,
standard suck, and a mfr'gerator Plus freezer. The oven must be able to bake and broil and be at least 5
cubic feet; the sink must measure at least 14"WX16"DX5.25"H; refrigerator must be at least 5.3 cubic
feet and include at least a .73 cubic foot fieeze~. The floor Plan for the CDU shall be submitted to the
County Housing Office for review.
11. The Applicant shall, by recording a covenant prior to issuance of building permit, guarantee that the
caretaker unit:
a. Shall not be required to be rented;
b. Shall rmt be sold or otherwise conveyed or separated from the original parcel regardless of the
ultimate form of ownership of the caretaker unit;
c. Shall be Limited to occupancy by not more than two adults and related children, who qualify as
(and have been found by the Housing Office to be) employees of the community under such

12. Upon completion of the CDU; but prior to issuance of the Certificate of Occupancy, County Housing
Office staff shall be entitled to conduct an inspection of the CDU for compliance with the above-
referenced requirements.
13. The caretaker dwelling unit restriction may be removed by the Property owner upon approval of the
Community Development Director, subject to the requirement that the dwelling is removed or modified,
If modified, the remaining improvements must no longer be capable of occupancy az a dwelling unit
and must meet otherwise applicable Code requirements.
14. The provisions of this regulation are for the purpose of providmg a voluntary CDU on a legally created
lot or parcel in the County. Any unit approved under this provision of the Pitkin County Land Use shall
not be used for mitigation of employee housing requirements az established elsewhere in said Code.
15. Failure to comp]y with these conditions of approval may result in revocation of this permit or any
subsequent permits related to [his property or vested rights associated with this property,
lti. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County band Use
Code, § 2-20-170 and C_R.S_, § 24-68_IpS. The statutory vested. rights granted herein shall expire on
April 17"', 2010.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 32-2002 establishes a fee
structure for land use applications and the payment of al] processing fees is a condition precedent to a determination of
application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the
cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the
expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full extent of the costs involved in processing the
application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall
accmnulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to
enable the Planning Commission and/or Board of County Commissioners to make legally required f findings for project
approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $
which is based on hours of staff time, and if actual time spent by staff to process the application exceeds the average
number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay
such accrued costs shall be grounds for suspension of processing.
