Richard Jelinek ("Applicant") has applied to the Pitkin County Boazd of County Commissioners ("BOCC") to consider an extension of vested real property rights pursuant to Section 4-140-30 of the Land Use Code ("Code") to construct a single family residence of up to 15,000 square feet of floor area on a metes and bounds parcel. The vested rights will expire on November 17, 2002. 2. The parcel is located 5 miles south of Carbondale off of Prince Creek Road, and is mare specifically described in Exhibit A. The parcel is coned RS-30 and contains approximately 320 acrea 4. The BOCC approved the 1041 hazard review, conceptual submission and caretaker dwelling unit application, pursuant to Resolution No. 99-196. The 1041 site plan was recorded in Plat Book 52 at Page 99. 5. The BOCC reviewed the request for an extension at a duly noticed public hearing on August 14, 2002, at which time evidence and testimony were presented with respect to this application. 6. The BOCC finds that the extension of vested rights is consistent with the applicable provisions of the Land Use Code. NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant an extension of vested rights for Richard Jelinek for the Jelinek East Parcel, subject to the following conditions, which shall run with the land and be binding on all successors in interest: This approval is subject to the terms and conditions of BCCC Resolution Nos.99-196, except as specified herein. 2. Condition #3A of Resolution No. 99-196 under "Structural Design and Construction Requirements" shall be replaced as follows: Roofs shall have anon-combustible roof covering on a Class A assembly. Wood shake/shingle roof coverings are prohibited in all wildfve hazard areas. Roofs with less than a 3:12 pitch arc not permitted in 1041 Wildfire Areas unless they comply with the following: A. All roof coverings shall be noncombustible materials as defined in the Uniform Building Code (UBC) 1997 Section 1504 and installed on a Class A roof assembly. B. A11 roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. C. All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above the roofline, such as parapets, shall be prohibited. Roofs shall be installed as requited by UBC 1997 Chapter 15 and shall have a minimum slope of 1:48. E. All roof designs, coverings, or equivalent assemblies sha0 be specifically approved by the Fire Marshal prior to submittal of a building petmit application. 3. Floor azea for the parcel shall be limited to 5,750 square feet exempt from growth management. Additional floor area up to a maximum of 10,750 square feet may be acquired through the use of TDRs. At building permit application, the Applicant shall surrender up to two original Certificates of TDRs and a copy of the deed evidencing the Applicant's acquisition of the Certificates (if applicable), in order to develop more than 5,750 and up to 10,750 square feet of floor area. 4. Prior to issuance of any building permit applications for the residence, the Applicant shall pay the applicable road impact fee. 5. The Applicant shall adhere to all material representations made in public hearings and in the application. 6. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-ti8-105. The vested rights will expire on November 17, 2002. APPLICANT: Richard Jelinek REPRESENTATIVE: Doug Pratte LOCATION: 5 miles south of Carbondale off of Prince Creek Road ZONING/LOT SIZE: RS-30; approximately 320 acres ACCESS: The parcel is accessed via Highway 133, Prince Creek Road, and an existing ranch road. BACKGROUND: The BOCC approved the 1041 hazard review, conceptual submission and caretaker dwelling unit application, pursuant to Resolution No. 94196. The 1041 site plan was recorded in Plat Book 52 at Page 99. STAFF COMMENTS: vESrED RtGxrs EXTENSION: The BOCC shall consider, but not be limited to, the following criteria in reviewing a request for an extension of vested property rights: 1. Complirntce with conditions of approval requiring performance prior to the extension of vested rights: The Applicant has recorded the 1041 site plan. No other conditions required performance prior to building or other permit application. 2. Progress in pursuing the project: The Applicant obtained an access permit for the driveway in June of 2002. The Applicant has not applied for any building permits in order to pursue development of a single family residence on the parcel. The Applicant notes that negotiations for utility easements across adjacent properties have failed after 2 years of discussion, and is currently working with Holy Cross Energy to condemn a piece of land in order to extend utilities. 3. Nature and extent of benefits received by the County: No benefits were required to be granted to the County as a result of the previous approval. 000005 n U 4. Needs of the County and the applicant that would be served by approval of the request.• The Applicant's needs would be met by vesting the property against further land use regulations. The needs of the County would not be served by this extension, as the County would give up the right to apply new land use regulations to the property during the vesting period. Staff would note that absent an extension of vested rights, the underlying 1041 approval for the pazcel remains intacx but is subject to changes in the Code, most notably the restriction to 5,750 squaze feet of floor area exempt from growth management. If the BOCC is inclined to grant an extension, staff would recommend that the Applicant be limited to 5,750 squaze feet, rather than 15,000 square feet, in order to comply with current regulations. The Crystal River Caucus recommended approval of the extension with a limitation to 5,750 squaze feet. RECOMMENDATION: Pursuant to Section 4-140-030, staff recommends that the BOCC adopt a "motion to deny the Jelinek East Extension of Vested Rights, subject to the attached Resolution." Mr Jelinek received 1041 Hazazd Review and Conceptual Submission approval to establish one building envelope for construcion of a 15,000 s.f. single family residence on November 17, 1999. At this time, no plans have been submitted for building permit due lazgely to the time required to establish utility easement agreements and create driveway improvements. Negotiations for a utility easement between Mike Huck, Jeff Bayer and Richard Jelinek have failed after two yeazs of discussion. Mr. Jelinek is currently working with Holy Cross to condemn a piece of land required to extend utilities to the Samuelson property. A utility easement agreement is currently being negotiated through the Samuelson prop- erty to the Jelinek property and finalization of that agreement should occur shortly. An access permit application has been submitted to the Pitkin County Engineer to upgrade the existing driveway and will likely be approved by June 1, 2002. Mr. Jelinek plans to begin construction of the driveway upgrades in the summer of 2002 with reveg- etation to be completed in the Spring of 2003. Due to the amount of time required for these above items which are required to be in place prior to the submittal for any building permit, Mr. Jelinek would request a three year extension of his vested rights. As you know, Richazd Jelinek also has submitted an application for a cluster subdivi- sion to Pitkin County which includes this previously approved envelope. The motion was admittedly unweildy since it approves only what he could get now without an extension, but the motion language is always what it is from the person making the motion. Re: Hot Springs Ranch: the motion was to approve the subdivision request, 23-3 as I remember. I specifically mentioned the desire to assure a building right of 5,750 and not be "grandfather limited" to the existing size of the current house. Also, that any use other than that allowed under the current zoning would come back in front of the caucus. If you have any other questions, please let me know. (Dale: I got your message and I think everything went well for you at the meeting. Dot specifically said that the proceeds from the sale would stay in the valley. The only question I couldn't specifically answer was "what limits (conservation easements, use limitations, etc., whatever) will OSTB put on the 8.5-acre site before they sell it?" The title of the site plan shell read"Jelinek East 1041 Environmental Hazard Site Plan." 3, Wildfire mitigation shall be as follows: Defensible Space; A, Tha area around the structure shall incorporate landscaping with wildfire defensible space considerations as follows: NOTE: Actual vegetatidn manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions. 1. Brush, debris, and non-ornamental vegetation shall be removed within a minimum 10 foot perimeter around all swctures. Vegetation in this area shall be at 6" or less (i.e. mowed grass, low-growing perennials). No vegetation taller than 6" shall be planted in this area. 2. Spacing between clumps of brush and vegetation for a distance of 35 feet uphill -and to the ' r/'~ sides and 37 feet downhill around structures shall be a minimum of two times the height of v e~ the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. Afl `V+ measurements shall be from the edges of the crowns of the fuel. 3. Tree crown separation within the 30 foot perimeter shall have a minimum of 10 feet " between the edges of the crowns. All deadfall within the 100 foot perimeter shall be removed. -_ 6. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 7. The heavy woody fuels adjacent to the access driveway shall becut/mowed as low as possible and maintained at that low height for natural fuel break characteristics of the driveway. Roofs and gutters shall be kept clear of debris. B. Yards shall be kept clear of all litter, slash, and flammab]e debris. C. All flammable materials (including firewood/wood piles} shall be stored on a parallel contour a minimum of 15 feet away from any structure. Miscellaneous: A. Fences shall be kept clear of brush and debris. B, Wood fences shall not be connected to the structure. C, Fuel tanks shall be installed underground with an approved container. D. Each structure shall have a minimum of one 10 Ib. ABC fire extinguisher. E. Addresses shall be cleazly marked and visible with minimum 2" non-combustible letters and shall be cleazly visible at the primary point of access from the public or common access road and installed on anon-combustible post. G. Any outbuildings or additional buildings shall adhere to the same standards as structures. H. Swimming pools shall be accessible to Fire Department vehicles. ~"~ Utilities: J V -" ~' A. The Applicant shall comply with the all codes and requirements of the Carbondale & Rural Fire Protection District. 10. For any free market residential structure of 5,000 gross square feet or greater, the Applicant shall comply with Section 4.01.01(B) of the Pitkin County Road Management and Maintenance Plan, which requires the Applicant to provide construction trip and residential trip generation studies. The Applicant shall comply with this provision as it is in effect at the time of building permit issuance to the satisfaction of the County Engineer. 11, The Applicant shall obtain an access permit from the County Engineer, prior to the submittal of any building permit applications. Access road(s) shall be built to County Standards. The Applicant shall work with the County Engineer and a qualified geotechnical engineer to develop a stable design configuration for the access drive.
