their building site.

REFERRALS: The application was referred to the Zoning Officer (Attachment B); there are no zoning
concerns at this time. The application was also referred to the Aspen Village HOA; there was no response.
The AVHA Architectural Committee did however provide an approval form to the applicant which was
submitted in the application (Attachment C).
NEIGHBOR CONCERNS; Both adjoining neighbors have provided written consent for the minor
amendment to allow the additional one (I) foot at the midpoint. Notice was posted on the lot; there were no
other responses.
STAFF COMMENTS:
MINOR AMENDMENT (SECTION 2-20 150B1•
A) Minor Amendments Defined
A minor amendment to any development application or permit is one that meets the following criteria, as
determined by the Community Development Director:
1. Is consistent x~ith action(s) taken during previous development approvals for the property; and
Response: The request for a variance to increase the roof mid-height is due to a large amount of water that
seeps onto the parcel. The Geotechnical report included with the application provides several
recommendations to mitigate the impact of this water. The Applicant is proposing a higher level of gravel
drainage under the slab to help with the mitigation. The extra gavel will in turn, move the location of the
home upward, approximately one (1) foot, thereby necessitating the height variance. The request for a
variance to increase the roof mid-height on this lot from 16 feet to 17 feet has been approved by the Aspen

Village Homeowners Association Architectural Committee. The ridge height limit will remain the same and
is within Zoning regulations. The adjoining property owners who will be the most impacted have also given
their consent. The request is consistent with the original action taken.
2. Does not change the use of the proposed development between residential, commercial and tourist
accommodation uses; and
Response: The use will remain the same
3. Does not change the basic character of tl7e approved use of land on which the activity occurs,
including basic visual appearance and method of operation; and
Response: The proposed vaziance will not change the basic chazacter of the approved use as a 16 foot height
limit will still remain for all other lots within the subdivision. The variance from 16 feet to 17 feet will allow
the completion of the development to proceed. Currently, the building permit is "on hold" until the minor
amendment is complete.
4. Does not constitute a new land development activity; and
Response: The proposal does not constitute a new development activity.
5. Does not increase off-site impacts in the surrounding neighborhood; and
Response: The additional 1 foot will not increase off-site impacts.
6. Does not endanger the public health, safety or x~elfare; and
Response: The proposal will not endanger the public. .
7. Does not violate any Land Use Code standard, and
Response: The proposal does not violate any known Code Standazd.
8. Does tot substantially increase the need for on-site parking or utilities, or affect affordable housing
generation; and
Response: The request does not affect parking, utilities or affordable housing generation
9. Does not increase the floor area of the use by more than five (S) percent or decrease the open space
on the site by more than five (S) percent.
Response: The request is in compliance with the criteria.
RECOMMENDATION: Staff recommends that the Director approve the DeWire Minor Amendment to a
Development Permit to amend the PUD guidelines to increase the height of the roof at the mid-point from 16
feet to 17 feet for Lot ] 27, based on compliance with the standards noted above and subject to the conditions
of the attached Administrative Decision.

To whom it may concern:
We aze requesting a minor amendment to our development permit at 127 Aspen Village. Due to the
large amount of groundwater seeping into the excavated azea, we aze requesting that we be allowed to
move the building further out of the ground to allow for additional gravel drainage azea under the slab.
The building will still meet all regulations with the exception of the midpoint: regulations state that the
midpoint is not to exceed 16' and, with our proposed changes, the midpoint will be at 1 T . Therefore,
with this amendment, the variance from the regulation will be a total of 1' in excess.
In accord with Land Use Code Section 2-20-150, this amendment:
Is consistent with previous development approvals for the Aspen Village azea
Does not change the use or basic chazacter of the proposed development
Does not constitute a new land development activity
Does not increase off-site impacts

Pitched or Curved Roofs: There shall be no mid-point of any
primary roof, excluding dormers, which exceeds 16'-0" of for a carport or storage shed
mid-point which exceed 1."-00" about the existing or finished grade, whichever is lower.
Dormers entitled to such exclusion may not exceed 20% of the surface are of the roof
excluding overhangs and must be setback from the elevation defining the eave line at
least 2 feet.
The mid-point of a pitched roof shall be defined as the point,
which is halfway between the top of the ridge, or highest point and the eave point on the
roof, which is the point directly about the outside face of the wall structure below that
roof The mid-point of a curved roof shall be defined as the point, which is halfway
between the uppermost point of the curve and the eave point on the roof. The maximum
height of the eave point is 14 feet.
No point on any mof, primary or dormer, shall exceed 24; 0" or on
a carport or storage shed not exceed 12; 0" about existing or finished grade, whichever is
lower. Chimneys and flues may exceed by 5'-0". For roofs which do not occur directly
above a grade (such as a dormer), then existing grade directly below that roof shall be
used in the height limit calculation.
All measurements shall be computed vertically and plumb
excluding from such calculation, the bottom surface of egress and window wells, and
excluding the bottom surface of below grade exterior stairwells.
Existing Grade or Natural Grade means the natural elevation of the
ground surface prior to development.
Finished Grade shall be defined as the ground surface topography
after development.
Flat Roofs: There shall be no point of a dwelling roof or its
parapet wall, which exceeds 14'-0", or for a carport or shed, which exceeds 10'-0" above
existing or finished grade, which ever is lower. A flat roof shall be defined as a roof
having a pitch of 1:12 or less.
Finished Grade: At no point shall finished grade vary from
existing grade by more than 2~-0". At no point shall finished grade vary from existing
grade by more than 1'-0" in the setbacks.
b. Allowable Floor Area and Calculation.
Allowable Floor Area: The allowable floor area of improvements
On a lot is the horizontal square footage of the lot, as calculated by the survey, multiplied
by a Floor Areas Ratio of .35. Except as modified for small lots.

Subject: Observation of Excavation, Proposed Residence, Lot 127, Aspen Village,
127 Ridge Trail, Pitkin County, Colorado.
Dear Mr. DeWire:
As requested, arepresentative ofHepworth-Pawlak Geotechnical, Inc. observed the
excavation at the subject site on May 23 and 28, 2008 to evaluate the materials exposed
for foundation support. The findings of our observations and rewmmendations for the
foundation design aze presented in this report. The services were performed in
accordance with our agreement for geotechnical engineering services to you dated May
22, 2008.
The proposed residence will consist of a single story wood frame structure over a walkout
basement level. The attached garage and basement floors will be slab-on-grade.
At the time of our initial visit to the site, the foundation excavation had been cut in two
levels from 4 to 8 feet below the adjacent ground surface. The materials exposed in the
bottom of the excavation consisted of claystone bedrock in the eastern portion and sandy
silty clay in the remainder. Results ofswell-consolidation testing performed on samples
ofthe clay soils taken from the site, shown on Figure 1; indicate the soils have low to
moderate compressibility under conditions of loading and wetting. Water seepage was
observed in the upper, eastern part of the excavation. When observed on May 28, the
excavation had been cut in two levels from about 4 to 10 feet below the adjacent ground
surface. The water seepage was being diverted in a trench from the southwest corner to
the southeast. The soils were slightly moist to very moist from the water seepage.
Considering the conditions exposed in the excavation and the nature of the proposed
construction, spread footings placed on the undisturbed natural soil and bedrock materials
designed for an allowable beazing pressure of 1,500 psf should be adequate for support of
the proposed residence. There could be some differential settlement between footings
bearing on the clay soils and footings beazing on the bedrock materials. Footings should
be a minimum width of 16 inches for continuous walls and 2 feet for columns. Loose
disturbed soils and rock should be removed in the footing areas to expose the undisturbed
natural soils or bedrock materials. The water seepage into the excavation should be

collected and diverted away from the footing areas and any softened soils and mud
removed before concrete placement. Exterior footings should be provided with adequate
soil cover above their bearing elevations for frost protection. Continuous foundation
walls should be reinforced top and bottom to span local anomalies such as by assuming
an unsupported length of at least 12 feet. Foundation walls acting as retaining structures
should be designed to resist a lateral earth pressure based on an equivalent fluid unit
weight of at least 50 pcf for on-site soil as backfill. A perimeter foundation drain should
be provided to prevent temporary buildup of hydrostatic pressure behind the walls and
prevent wetting ofthe lower level. Interior lateral drains could be needed to shorten the
flow distances of the perimeter drains. Structural fill placed within floor slab areas can
consist of the on-site soils and well broken bedrock compacted to at least 95% of standard
Proctor density at a moisture content near optimum. Backfill placed around the structure
should be compacted and the surface graded to prevent ponding within at least ]0 feet of
the building.
The recommendations submitted in this letter are based on our observation of the soils
exposed within the foundation excavation and do not include subsurface exploration to
evaluate the subsurface conditions within the loaded depth of foundation influence. This
study is based on the assumption that soils beneath the footings have equal or better
support than those exposed. The risk of foundation movement may be greater than
indicated in this report because of possible variations in the subsurface conditions. In
order to reveal the nature and extent of variations in the subsurface conditions below the
excavation, drilling would be required. It is possible the data obtained by subsurface
exploration could change the recommendations contained in this letter. Our services do
not include determining the presence, prevention or possibility of mold or other biological
contaminants (MOBC) developing in the future. If the client is concerned about MOBC,
then a professional in this special field of practice should be consulted.
