SMITH LNING TRUST 1041 HAZARD REVIEW AND SPECIAL REVIEW FOR A CARETAKER DWELLING UNIT Administrative Decision No.(~-2005 RECITALS ] . Jane W. Smith Living Trust ("Applicant") has applied to the Pitkin County Community Development Director ("Director") for 1041 Hazard Review and Special Review approval to establish a building envelope and legalize a Caretaker Dwelling Unit (CDU). 2. The parcel is located at 0321 E. Sopris Creek Rd., and is more specifically described in Exhibit A. 3. The parcel is zoned AFR-10 and contains approximately 3.72 acres. 4. The Director finds that the wildfire hazard within the envelope can be mitigated, and that the envelopes are located on slopes of less than 30%. THE DIRECTOR DOES HEREBY APPROVE the Jane W. Smith Living Trust 104 ] Hazard Review and Special Review for a CDU, subject to the following conditions, which shall run with the land and be binding on al] successors in interest: l . Prior to submission of any building permit applications for new development, the Applicant shall submit a 104] Hazard Review Site Plau to the Community Development Department for approval and recording. The mylar copy of the site plan must be signed by the owner prior to submittal for recording. 2. Prior to commencement of any earthmoving or construction activity, the Applicant shall stake the corners of the building and other envelopes and install construction fencing around the perimeter of the envelopes. The fencing shall remain in place for the duration of the construction. 3. Prior to issuance of any building permits for a new residence, the Applicant shall: A. Complete afireplace/woodstove registration form with the Community Development _ Department, if necessary. B. Pay the applicable road impact and affordable housing fees. 4. The Applicant shall comply with the following to mitigate impacts on wildlife: A. Dogs shall be leashed or kenneled. B. Fencing outside of the building envelope shall comply with the wildlife fencing standards in the Land Use Code. C. Install and use an approved bear-proof trash container as required by the County. D. Maintain native vegetation outside of the building envelope. E. Avoid fruit-bearing trees and shrubs in any landscaping. 5. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around al] structures. B. Spacing between clumps of brush and vegetation within the 30 foot perimeter shall be a minimwn of two times the height of the fuel. Maximum diameter of the clumps shall be two times the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. C. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of ] 0 feet above the ground and ladder fiiels from around trees and brush shall be removed. D. Tree crown separation within the 30 foot perimeter shall have a minimum of ] 0 feet between the edges of the crowns. E. All branches that extend over the roof eaves shall be trirruned and all branches within 15 feet of the chinmevs shall be removed. F. Low vegetation (less than 6 inches in height) shall be maintained within a ] 0 foot perimeter around all structures. G. The Applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 6. The Applicant shall comply with the following additional wildfire mitigation standards: A. Roofs shall he constructed with a Class A roof covering or a Class A assembly as defined in the International Building Code (IBC) Section 1505.2. Wood shake/shingle roof coverings aze prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be noncombustible materials and installed on a Class A roof assembly. 2) All roof coverings steal I have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing roof debris. Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted building code and shall have a minimum slope of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marsha] prior to submittal of a building permit application. B. Vents shall be screened with corrosive resistant wire mesh with mesh '/a inch maximum. C. Roofs and gutters shall be kept cleaz of debris. D. Yards shall be kept clear of all litter, slash, and flatnmab]e debris. E. All flammable materials and firewood/wood piles shall be stored on a parallel contour a minimum of 15 feet away from any structure. F. Swimming pools or ponds shall be accessible to Fire Department vehicles. G. Fences shall be kept clear of brush and debris. H. Wood fences shall not connect to the structure. 1. Fuel tanks shall be installed underground with an approved container. .I. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above-ground tank. Atry wood enclosure around the tank shall be constructed with materials approved for 2 hour fire- resistive construction on the exterior side of the walls. K. All areas disturbed by construction shall be revegetated within one growing season of the projects completion. 9. The caretaker dwelling unit shall be limited to 1,000 net livable square feet and the kitchen shall contain a minimum of a two burner stove with oven, standard sink, and at least a 6 cubic foot refrigerator plus freezer. A minimum of one off-street parking space shall be provided for the unit. ] 0. Prior to submission of any building permits for the caretaker unit, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor plans oftlte unit shall be submitted to the Housing Office with the deed restriction. 1 1. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, the Housing Office shall inspect the unit. 12. The Applicant shall obtain the required variance and building permit necessary to legalize the existing barn and Caretaker Dwelling Unit within 6 months of this approval. 13. The Caretaker Dwelling Unit (CDU) shall remain vacant until the proper permits have been obtained to legalize the existing CDU. 14. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. ]5. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 4-140 and C.R.S., § 24-68-105. SMITH SPECIAL REVIEW FOR A DETACHED CDU Parcel ID No. 2465-132-00-016: P 106-OS ISSUE: The applicant is requesting approval to legalize a detached caretaker dwelling unit located within an illegal barn. BACKGROUND: According to Section 9-110.041(0) of the Pitkin County Land Use Code, a Caretaker Dwelling Unit in the R-30, AFR-2, AFR-10, RS-2Q, RS-30 and RS-160 zone districts are allowed up to 1,000 square feet as long as the following conditions are met: a The floor area of the caretaker unit shall be included in the total allowed floor area for the lot or parcel of land. b. There shall be provided wie off-street parking space for each bedroom within the principal dwelling and one off-street parking space for each bedroom in the caretaker unit. c. The applicant shall, by deed restriction or other permanent commitment running with the land, guarantee that the caretaker unit shall not be required to be rented; not be sold or otherwise conveyed or separated from the original paccel regardless of the ultimate form of ownership of the caretaker unit; be limited to occupancy by not more than two adults and related. children, who qualify as (and have been found by the Housing Authority to be) employees of the commmnity under such guidelines as may be from time to time established by said authority: be rented for terms not less than six months if rented. The caretaker dwelling unit may be occupied by members of the immediate family (as defined in Section 8-1 ), even though they may not qualify as employees of the community. d. The caretaker dwelling unit restriction may be removed by the property owner upon approval of the Community Development Director, subject to the requirement that the dwelling is removed or modified. If modified, the remaining improvements must no longer be capable of occupancy as a dwelling unit and must meet otherwise applicable Code requirements. The provisions of this regulation are Rn- the purpose of providing a voluntary unit (or units) on a legally created property in the Cow~ty. Any unit granted under this provision of the Code shall not he used for mitigation of employee housing requirements as established elsewhere in this Code. 000(105 RECOMMENDATION: Staff recommends approval of this request under the following conditions: 1. Smith Living Trust 1041 Hazard and CDU Review DATE: July 13, 2005 REQUEST: The Applicant proposes to legalize a detached CDU within an illegal barn (built without a building permit and in the setback). The Applicant will be working to secure a building permit for the "barn," together with a variance, and will be using the existing "barn" as office space and not as a barn as defined under the Land Use Code. The Applicant further desires to establish a building envelope and access envelope on the property (to encompass the existing residence, some small additions, an area for future development, the "barn" and the CDU). APPLICANT: Jane W. Smith Living Trust REPRESENTATIVE: Steve Atchison LOCATION: 0321 E. Sopris Creek Rd. ZONING/LOT SIZE: AER-10/3.72 acres. REFERRAL COMMENTS: Comments were received from the Housing Office, and the recommendations will be reflected in the proposed conditions of approval. 'r The County Historic Officer stated that the residence contains massive alterations and would not be considered historic under the County's guidelines. r The Emma Caucus offered some concern as to the proposed "office" use to be contained within the barn and requested that any office use must comply with the County's standards for home occupation. 1041 HAZARD REVIEW (SECTION 3-801: Geologic (Section 3-80-050): The parcel is flat and contains slopes of less than 15%. Wildfire (Section 3-80-070): The building envelope is located within a "Moderate Hazard: Brush" rated wildfire area. The Applicant will comply with the conditions set forth by the Code. Wildlife (3-80-080): There is limited wildlife concern for the parcel as it is located in an existing subdivision and is not adjacent to riparian habitat. SPECIAL REVIEW FOR A CARETAKER DWELLING UNIT (Section 3 210 0201 A. The special review use shall not cor~ict with any applicable sections of the Pitkin County land Use Code, including the County Land Llce Policies irz Article 2. Response: The use is consistent with the Pitkin County Land Use Code and the Land Use Policies. C. The special review use shall be consistent with the intent of the Zone District in which it is proposed to be located. Response: The intent of the AFR-10 zone district is in part "to maintain the rural character of lands proximate to development centers and State Highways by preserving agricultural operations, wildlife habitat and scenic quality while permitting low density, single family dwelling units and customary accessory uses." The County considers a CDU to be accessory to a principal residence. While the parcel is non- conforming in size, it is within an established subdivision that was created before the current zoning was enacted. D. The special review use shall fie compatible with the character of the immediate vicinity of the parcel proposed. for development and .run•oztnding land uses, or shall enhance the mixture of complirnentrny ztses and activities in the immediate vicinity of the parcel proposed, for development. Response: Caretaker Dwelling Units have been approved, and built in the Emma Area. The Emma Caucus recommended approval of the request, and no neighbors objected. L. The locenion, size, design and operating characteristics ofthe proposed special review use must he in harmony with the surrounding area and minimizes adrerse effects, includhtg visual impacts, impacts otz pedestrian and vehicular circtdution, tragic generation, parking, trash, service delivery, air/water pollution or other impacts on natural resources, noise, vihrations and odor nn surroundo:g properties. Response: The CUU is existing and the Applicant is attempting legalize it. Some of the neighbors reviewed the proposal and felt that there would be no impacts. Response: The Applicant has received approval for a septic system that will accommodate the principal residence and the proposed CDU. The CDU will not create additional impacts on public facilities and services, such as fire, EMS, schools, etc., beyond the impacts generated by the existing principal residence. G. An application for u special review use must demonstrate to the Board ofCounty Convnissioners that the proposed development will not: u. Materially endanger the public health, safety rn• welfare, and b. Substantially injure the value of adjoining or abutting property. Fees have been set to be consistent and fair to the public and to reflect the expense incurred in providing such services to the public. 3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed project, it may not be possible at the time of application to ascertain the full extent of the costs involved in processing the application. 4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall accumulate if an application includes more than one type of land use review. 5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staffto complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision. 6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shad pay a base fee in the amount of $ which is based on _ hours of staff time, and if actual time spent by staff to process the application exceeds the average number of hours by more than 20%, then the COUNTY will bill the APPLICANT quarterly for the additional time spent. Materials were forwarded to those Executive Committee members in town. The Caucus discussed the application at the regulaz meeting on .Tune 6, 2005. Comments: Caucus members were concerned with the extent of office use to be conducted in the "barn". Although the property has had a history of "non-barn" use, it appeazs this prior use did not have a significant negative impact on neighbors. However, it is unclear from the application materials what type of "office use" is planned for the barn, and the barn appears large enough to support a considerable business, generating employees and traftlc. There were concerns about making anon-conforming use more non-conforming. Other comments included concerns over the Caretaker Dwelling Unit and how this might add to the density of the neighborhood. There were additional concerns that this CDU may in fact be too small fox a full time caretaker for the property. The manner in which the CDU would be deed-restricted was also unclear. However, it was pointed out that the caretaker use is consistent with other caretaker uses in the neighborhood. Consensus: After discussion among the 12 members present, there was a consensus among Caucus members not to oppose the application as long as the final result does not create a conflict with existing zoning codes. We assume the office use will comply with the County's definition of a "home office" and restrictions on the CDU will not pose a hardship for the owner/applicant or the neighbors. 000;.?
