SATURDAY,FEBRUARY 10,2001

RECITALS
1. Gwyn Knowlton("Applicant")has applied to the Director for approval for night-time use of Gwyn's
Restaurant on Aspen Mountain for a benefit dinner for the Aspen Buddy Program on Saturday, February 10,
2001,from 5:00— 10:30 PM.
2. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code,the Community Development
Director("Director")may approve a temporary use permit for commercial activities or special events, if an
applicant demonstrates that adequate provisions have been made for police supervision,public parking,

M Z insurance, site set-up,maintenance and clean-up,emergency services and safety of operations.

�g z 3. Night-time events at Gwyn's Restaurant are prohibited by the Aspen Mountain Master Plan,
cILpursuant to Resolution No.98-80. Therefore,the Director has opted to forward this request to the BOCC

2 a for review, since these events are prohibited by the Master Plan.

e= 4. Benefit events for the Aspen Art Museum and Jazz Aspen have been held at Gwyn's Restaurant

m in the past(1996-1999).

v a 5. The BOCC finds that the proposed event complies with the applicable standards of the Code with

M m m regard to temporary commercial uses.

`0 6. The BOCC further finds that although the Master Plan prohibits night-time events at Gwyn's

Restaurant, similar events that benefits the community have been permitted in the past and that the impacts of
the event will be insubstantial.
NOW,THEREFORE,BE IT RESOLVED by the BOCC that it hereby approves the Temporary
Use Permit,subject to the following conditions.
1. Access to Gwyn's for the event by guests, staff and event personnel shall be provided by snowcat
only.

2. The Applicant shall comply with the following to the satisfaction of the Environmental Health
Department,prior to February 10,2001:
A. Obtain a current Colorado Retail Food Establishment License.
B. Correct all critical violations noted from 12/06/00 inspection.
I. High temperature dish machine only reaching 150 degrees on the rinse cycle at the

2. Grilled vegetables at service line 85 degrees—must either be held hot, above140, or
—.+M cold, below 41. Time can also be used as a control.
�o 3. Glass of water with no lid on top of ice machine. Cups used by employees and stored

4. No sanitizer in final cycle of dish machine in the dining kitchen.
on. 5. No soap and paper towels available at bar hand sink. in dining area.

6. Sanitizer for wiping clothes greater than 200 ppm chlorine. Should be between 50
CC m and 200 ppm.

a a m D. Preparation of foods to be served at the event must take place in a licensed kitchen. The
m Applicant shall notify the Environmental Health Department if any foods will be transported

We\, 3. The Applicant shall comply with the following recommendations of the Chemical Dependency

A. A variety of foods and non-alcoholic beverages shall be available throughout the event.
�In ° B. All servers shall attend a training to learn how to identify when a participant has had too
—a a much to drink.
C. Develop a plan to handle situations wherein a participant has had too much to drink.
D. Provide alternative modes of transportation home from the event.
E. If children will attend the event, provide a safe place for them to play, which is away
from the serving of alcohol and is supervised by responsible, non-drinking adults.
