Two single family homes currently exist on one lot, both seemingly containing 2 dwelling units each, the impact has been excessive to the immediate neighbors for many years. (parking on residents' lawns, late night parties resulting in complaints to law enforcement, etc.) b. To support these rental units, an unsightly 4 yard dumpster and laundry building have been added and placed very close to the property line. c. With all units full, traffic on a shared road easement has been excessive. d. The owner has operated some of his excavation construction business from the site, which has had noise and pollution impacts. Gravel is stored on the property, construction vehicles, such as dump trucks, front end loaders regularly use the access road; back up beepers from vehicles are heard in the early morning hours, and extra vehicles are parked on the lawn, close to the property line. There are 8 structures currently on the property for residences and/or storage. e. The original access road to this property from Picket Pin Lane, was blocked off by the owner, and access changed to Snowmass Creek Road, passing within 40 feet of an adjacent home. Was this legal/permitted? 2. Inability of Pitkin County to enforce current R-30 zone codes as they relate to this property, and past actions of owner who has ignored previous agreements. a. In 1989, the owner builds a barn, without permits, exceeding height and width requirements of the County. b. Feb. 1989, in a suit brought by the County, he agrees to make the barn a primary dwelling and remove all kitchen and plumbing facilities so accessory structure cannot be used as an additional residence. County requires he submits a performance bond....was this done? c. The accessory building has been rented, in violation of the above agreement, for 20+ years, despite numerous complaints from neighbors. d. A CDU, from the Land Use Code, is attached to a single family home. This is not approval of a CDU, it is approval of two homes on one lot. e. How will County enforce stipulations of CDU? (no more than 2 adults and related children, etc.). Has the square footage of the accessory dwelling actually been measured? (Assessor's website shows it as over 2,000 sq. ft.) Have the other structures on the property, including the barn, been inspected?
