11) The project shall meet•all the codes and requirements of the Aspen Fire
Protection District.
15. All new utility service lines extensions shall be buried within existing roads and
driveway.
16. No reflective glass or roof materials will be allowed.. Exterior Building materials and
colors should blend with the natural environment.
17. In the case of development on any slopes greater than 15%, design and development
shall be based, on a detailed site analysis, including geologic and engineering studies
to identify the best development area based on the following considerations:
a. Adequate mechanical sspport shall be provided for cut slopes.
b. Adding water which may decrease slope stability shall be avoided.
c. Adding weight to the top of the slope shall'be avoided. `
d. disturbed slopes must be contoured so they can be revegetated.
e. Steepening of existing slopes shall be avoided.
f. Confine cuts, fills, grading, and excavation to the minimum area needed for
construction.

Commissioners' Comments
The commissioners' discussion addressed two things - the impact of the proposed
driveway, and the legislative history of the enabling code amendment. All found the
1en~rth of the driveway to be excessive. Furthermore, some considered the pitch of the
driveway as too steep, even where it complied with the code. They disagreed with the
applicants' argument that the location of the proposed driveway would be a public benefit.
Most of the discussion, however, focused on the legislative intent of the enabling
code amendment. There was confusion over some of the language of the ordinance. They
agreed that the meaning of "minor" was of importance, and questioned whether it ought to
be considered vis a vis the total length of rion-complying sections or the ratio of these
sections to the overall length of the dtive. Lance responded that clarification of this
question would require some case law resulting from applications such as this. However,
all commissioners agreed that when they recommended approval of the enabling code
amendment, they meant to allow staff discretion to choose the site with the lea§t`impact,
and the impact of the driveway would not be in the spirit of this intent. Staff's intention
had been to avoid unnecessary takings proceedings in instances where no alternative
exists; the applicants already have an approved site. Given this body of legislative intent,
the commissioners did not look favorably on the application.
Motion
Chazlie Tarver moved to recommend denial of the Pfister West Buttermilk Tract 3
Major Amendment to a Development Permit, I'04I Hazard Review & Conceptual
Submission. Doug Unfug seconded the motion, and the commissioners voted 4-O in favor
of it; Marcella Larsen abstained.
Cooper 1041 Hazard Review and Conceptual Submission
The applicants seek approval for a building envelope for a single family residence
and accessory uses in the Midnight Mine azea.
Staff Comments
Lance Clarke began with a description of how the pazcel is situated; he noted that
it is surrounded by USFS lands and that access would require easements from both the
USFS and private property owners. The parcel is zoned AFR-10, but is adjacent to an
R/R zone and meets many of the R/R criteria.
The application meets 1041 criteria. The proposed envelope lies on slopes from
20 - 25 % as well as on a level, graded area. The wildfire hazard is low, but the site is
adjacent to some elk winter range, so staff has recommended that no dogs be allowed on
the property. The only issue concerns the driveway; staff is required by the code to
require a driveway which meets certain standards. However, given the rural nature of the
surrounding properties, staff would prefer a two track jeep road with a couple of turnouts
along the way, as the drive is fairly long: Lance requested some direction about how to
elicit a substandard driveway without disregarding the code.
Staff recommends approval of the 1041 Hazard Review and the Conceptual
Submission; subject to their conditions.

Commissioners' Discussion
The commissioners discussed three issues wood shingles vs. a metal roof, the
driveway, and FAR restrictions. The commissioners wanfed to anZend staff's condition #7
in order to allow Class A wood shake shingles; this was consistent with actions taken in
previous meetings. Lance noted that the USFS had specified a metal roof due to the
surrounding wildfire hazard; however,. due to the fact that the site is surrounded by forest,
the commissioners did not feel that the roofing materials would make much difference in
the event of a forest fire. As for the access drive, the commissioners agreed with staff that
the site warranted a substandard road, and the applicants indicated a preference for a
smaller road. The commissioners decided to direct the BOCC to consider different
standards, perhaps R/R standazds, for the road.
The discussion of FAR restrictions grew out of a concern over the discrepancy
between the small squaze footage allowed on RJR parcels and the 15,Ob0 squaze feet on
other pazcels; in azeas where there are different zoning districts neighboring one another,
this discrepancy creates the potential for structures which aze':incompatible with the azea.
The commissioners inquired whether the applicants would accept a voluntary FAR
restriction; however, the applicants indicated that they had a modest 3,000 squaze foot
house in mind, and staff noted that the envelope is not large enough to accommodate a
large house, a well, and a septic system. Still, the commissioners felt that this application
offered. a good example of the need to develog criteria under which fhe courity may
impose'F.AR restrictions on parcels bordering R/R zone districts; the county could also use
such criteria for pazcels which were rezoned fromRiR.
Motion
Marcella Larsen moved to recommend approval of the Cooper 1041 Hazard
Review and Conceptual Submission subject to sfafF's recommended conditions with the
amendment of staff Condition #7, in order to allow the use of Class A wood shingle and
with the addition of the following recommended conditions:
Condition #18 - P&Z recommends that the BOCC vary the county road standards to allow
a road for the site that is appropriate for the area.
Charlie Tarver seconded the motion, and the commissioners. voted 5-0 in favor of it.-
Aspen Mass Major Plat Amendment
The applicant requests two major plat amendments: a change to the approved
subdivision agreement to allow construction of employee housing on a dedicated open
space parcel rather than submitting acash-in-lieu payment, and slot-line adjustment to
correct the actions of an owner who constructed a garage off of his lot.

For your records, I am enclosing a copy of the minutes of the Board of County
Commissioners meetii>g of May 8,' 1996 regazding the request for ati extension of vested
rights that Alan Schwartz made on behalf of Castle Creek investors, Inc. (aka CCI). At
that meeting, review of the vested rights extension application for CCI's 67 acre property
in Castle Creek (see attached legal description) was tabled indefinitely at your client's
request.
It is the policy of the Community Development Department to close land use files which
have been inactive for more than one year. It has been more than one yeaz since the
Board reviewed the request for tabling, and your client has pursued no further action.
Unless your client wishes to re-activate planning review ofthe case, the file will be
closed on January 1, 1998. Prior to January 1st, please provide.a letter confirming that no
further planning review is requested at this time or, that your client wishes to schedule the
request for the next available agenda before the Boazd of County Commissioners.

Clarke, Deputy Community Development Director, proceeded with his presentation associated
with this item as outlined in his memorandum to the Board. A copy of this memorandum is
attached hereto and made a part of this record as EXHIBIT "H".
Commissioner Lamont questioned if the Board needs to make a finding as to why we are willing
to waive the driveway standards as recommended in staffls memorandum. One finding that she
can see is that the driveway to the New York Lode starts within our Rural and Remote Zone
District. So to require upgrade of the road, based upon our driveway standards, would seem to
her to be inconsistent with our goals of Rural and Remote.
Commissioner Farris questioned what the 5,000 square floor area consists of?
Mr. Clarke responded that it is defined as per the code, which allows a basement of 4,000 square
feet and a 750 square foot garage.
Sterling Cooper said they concur with the staff recommendation and agree with the conditions of
approval.
Commissioner Lamont questioned if the home were sold, what leverage the Board would have if
someone came in wanting to upgrade the access driveway?
Mr. Clarke responded that very soon staff is bringing to the Board legislation adopting specific
rural and remote road standards, which the Forest Service already has. And their
recommendation is that this be built to Forest Service Rural and Remote Road Standards. He
suggested that the condition be amended to read "Any improvement has to be approved by the
County Engineer" so someone cannot come in at a later date and buff it out more.
Commissioner Lamont moved approval of the Resolution with an amendment to Condition
No. 3 of the Resolution to add language state "safe" access; in addition to add language to
state that once the County Engineer has approved a road improvement design that that not
be further changed in any way through this review. Commissioner Farris seconded the
motion.
Chairman Tuite opened the hearing to public comment. There being no comment, he
closed the public hearing section and brought the matter back to the Board to call the
question. Motion passed unanimously.

DATE: February 28, 1996
REQUEST: Pursuant to Section 4-140.30 of the Land. Use Code, the applicant requests
an extension of vesting for a period of three years.
APPLICANT: Castle Creek Investors, Inc. (herein referred to as "CCI")
LOCATION: The pazcel is located on Little Annie Road, adjacent to the Lime Village
Subdivision, approximately one mile northwest of the intersection of Little Annie and
Castle Creek Roads.
ZONING: The site contains 67 acres and is zoned AFR-10/ ~--i ~ E--

BACKGROUND:
• The BOCC granted 1041 and General Submission approval of a 20,000 sq. ft.
building envelope for one single family residence, accessory structures and a
driveway via Little Annie Road pursuant to Resolution No. 92-316, (attached as
Exhibit A);
• The parcel was reviewed for geologic hazards (steep slopes) and moderate wildfire
hazazds. No other mapped hazard areas exist on the property.
ISSUES:
1. The status of several issues discussed as part of the initial 1041 Review is
summazized in the following paragraphs:
Winter plowing or maintenance of Little Annie Road by the landowner
beyond the driveway was prohibited as a condition of approval. Based on the
acknowledgment of previous land use approvals, the County has since
recognized that winter plowing goes beyond this parcel to the Yellin property
approximately 1/4 mile up Little Annie Road. Consequently, Staff
recommends that the prohibition against winter plowing or maintenance by
the owner be deleted from Condition No. 10, Resolution 92-316.

The applicant agreed to allow public use of a pazking area on their property
(used for backcountry access) for 3 years, until such time as an agreement
could be made by the Forest Service, Pitkin County and the Lime Village
Homeowner's Association for a permanent site relocation. No altemative
location has been agreed to to-date, though discussions have been on-going.
The applicants indicate that they are "prepared to continue to accommodate
the County's needs insofar as possible" for a period of one year from the date
of the vested rights extension. Staff recommends that Condition No. 10,
Resolution 92-316 be revised to reflect the applicants'agreement to allow for
continued use of the parking area for a period of a year, during which time an
agreed-upon alternative parking azea shall be established.
The applicant was required to dedicate a 30' road right-of-way along the
alignment of the Little Annie Road to the County. The right-of-way dedication
has been executed.
2. Since approval in 1992, Staff is aware of the following legislative changes which
affect this parcel:
• A revised edition of the Pitkin County Land Use Code became effective on June 12,
1994. Pursuant to Section 3-80.70, new wildfire mitigation measures were codified.
Staff recommends that wildfire mitigation conditions for the CCI review be revised to
bring the approval into compliance with the current wildfire regulations.
On July 22nd, 1994, pursuant to Ordinance 94-16, the Board created the
Rural/Remote Zone District, and rezoned portions of the Little Annie/Richmond Hill
area to the R/R zone. The CCI property was excluded from the District because of the
existence of the previously approved site specific development plan for the property.
On November 15, 1995, the Board amended the Rural/Remote zone district regulation
and boundaries. However, the status of the CCI property remains the same.
No other mapping or ordinances affecting this parcel have been adopted since the date of
the CCI 1041/General Submission approval in August of 1992.
ALTERNATIVES: The Board may:
1. Extend vested property rights; or
2. Extend vested property rights with new conditions; or
3. Deny the request for extension of property rights:
RECOMMENDATION: Staff recommends that the Board grant approval of an
extension of the vesting period for three years subject to conditions within the attached
Resolution.

RECITALS
1. Castle Creek Investors (hereinafter "Applicant") applied
to Pitkin County for consideration of an extension of vested
real property rights pursuant to Section 4-140.30 of the Land
Use Code for a parcel of land specifically described in
Exhibit "A."
2. The Board considered a memorandum of the Aspen/ Pitkin
County Planning Office dated February 28, 1996.
3. The Board considered the request at its regularly
scheduled meeting of February 28, 1996 and found the extension
to be appropriate, subject to the revision of original
conditions to reflect current County legislation.
NOW, THEREFORE BE IT RESOhVED that the Pitkin County Board of
County Commissioners hereby grants a three year extension to the
vesting period for the Castle Creek Investors, Inc. 1041 approval,
subject to the following conditions:
1. The applicants, their assigns or heirs shall comply with
conditions of Resolution No 92-316 (attached as Exhibit "B"),
except as revised by the following conditions.
a. Condition No. 2 shall be revised with the .following
language:
"The applicant shall meet the requirements of the Aspen

shall be installed within 6 months of issuance of a
certificate of occupancy.
c. Condition No. 10 shall be revised with the following
language:
"The following conditions shall apply to the Little Annie
Road:
1) Only that portion of the Little Annie Road extending
to and immediately past tYie proposed driveway entrance
shall be accepted as part of the County maintained road
system.
2) The applicant shall allow the existing parking area
(used for backcountry access south of the building
envelope) to be available and used by the general public
for one year without prejudice to rights of owners,
applicants or the public; and to cooperate with the
Forest Service, Little Annie Homeowner's Association and
Pitkin County to locate a permanent parking lot to
provide recreational use of Little Annie Road. Nothing
herein shall obligate the applicant to make any of its
land available for the permanent parking area. After one
year, the existing parking area shall be closed and the
County will continue its policy to prohibit parking along
the shoulders of the Little Annie Road right-of-way."
d. Condition No. 11 shall be revised with the following

REQUEST: Pursuant to Section 4-140.30 of the Land Use Code, the applicant requests
an extension of vesting for a period of three years.
BACKGROUND:
The BOCC granted 1041 and General Submission approval of a 20,000 sq. ft.
building envelope for one single family residence, accessory structures and a
driveway via Little Annie Road pursuant to Resolution No. 92-316, (attached as
Exhibit A);
The pazcel was reviewed for geologic hazards (steep slopes) and moderate wildfire
hazazds. No other mapped hazard areas exist on the property.
The following primary issues were discussed as part of the review:
1. Winter plowing or maintenance of Little Annie Road by the landowner
beyond the driveway was prohibited. However, based on the
acknowledgement of previous approvals, the County has since recognized that
winter plowing goes beyond this parcel to the Yellin property approximately
1/4 mile up Little Annie Road.
2. The applicant agreed to allow public use of a parking area on their property
(used for backcountry access) for 3 yeazs, until such time as an agreement
could be made by the Forest Service, Pitkin County and the Lime Village
Homeowner's Association for a permanent site relocation. No alternative
location has been agreed to to-date, though discussions have been on-going.
The applicants indicate that they are "prepared to continue to accommodate
the County's needs insofar as possible" for a period of one year from the date
of the vested rights extension. An update from Public Works as to the status
of discussions will be provided at the meeting.
3. The applicant was required to dedicate a 30' road right-of-way along the
alignment of the Little Annie Road to the County. The right-of--way dedication
has been executed.
APPLICANT: Castle Creek Investors, Inc. (herein referred to as "CCI")

LOCATION: The parcel is Jocated on Little Annie Road, adjacent to the Lime Village
Subdivision, approximately one mile northwest of the intersection of Little Annie and
Castle Creek Roads.
ZONING: The site contains 67 acres and is zoned AFR-10
STAFF COMMENTS:
Since approval in 1992, Staff is aware of the following legislative changes which affect
this parcel:
1. A revised edition of the Pitkin County Land Use Code became effective on June 12,
1994. Pursuant to Section 3-80.70, new wildfire mitigation measures were codified.
Staff recommends that wildfire mitigation conditions for the CCI review be revised to
bring the approval into compliance with the current wildfire regulations.
2. On July 22nd, 1994, pursuant to Ordinance 94-16, the Board created the
Rural/Remote Zone District, and rezoned portions of the Little Annie/Richmond Hill
area to the R/R zone. The CCI property was excluded from the District because of the
existence of the previously approved site specific development plan for the property.
On November 15, 1995, the Board amended the Rural/Tlemote zone district regulation
and boundaries. However, the status of the CCI property remains the same.
No other mapping or ordinances affecting this parcel have been adopted since the date of
the CCI 1041/General Submission approval in August of 1992.
ALTERNATIVES: The Board may:
1. Extend vested property rights; or
2. Extend vested property rights with new conditions; or
3. Deny the request for extension of property rights.
RECOMMENDATION: Staff recommends that the Board grant approval of an
extension of the vesting period for three years subject to conditions within the attached
Resolution.

By this letter and accompaniments, the owner/applicant; Castle
Creek Investors, Inc., is requesting a three (3) year extension of
the vested property rights conveyed in Resolution No. 92'=316; a
copy of which is attached hereto as R'xhbit "Fi." That resolution
granted general submission and 1041 hazard review approval for the
construction of a single-family residence on the real property
described therein, being approximately 67 acres located on Little
Annie Road adjacent to the Lime Village Subdivision. TT'ie "1041
Review Map and Site Plan for the subject property is attached
hereto as Exhibit "B."
The applicant has complied with each condition of approval
requiring performance prior to the date of this extension request,
to-wit: the applicant has dedicated a 30' public right-of-way
along the existing alignment of Little Annie Road through the
subject site, and has Toned the Little 'Annie Homeowners'
Association. The balance of the conditions imposed are
construction related; as of this time, no building permit has been
sought.
Pitkin County did receive the benefit of certain temporary
parking concessions from the applicant in connection with the
original approval. While those concessions have either expired or
will soon expire unles's alterna£ve arrangements are made, the
applicant is prepared to continue to accommodate the County's needs
insofar as possible.

I have reviewed the building application submitted by Castle Creek
Investors, Inc. represented by Davis Horn, Inc., and visited the site
on June 4th. 1 have the following comments with regard to wildfire
hazards.
The overall wildfire hazard on the building .site is moderate.
Vegetation consists of a dense aspen stand with an understory of thick
brush (snowberry), grasses, and fortis. Mr. Horn is correct in his
statement that "aspen stands do not usually contain ladder fuel's that
can carry fire into the crowns of trees". This lack of ladder fuels
would i'n all probability limit any ocdurance of wildfire to the
understory brush and grass. The amount of surface vegetation ccuid
fuel a hot, fast-moving fire if sufficiently dried by drought or if
the fire occurred in the fall when fuel moistures, are low. Steep
slopes on the site (25-30~) would accelerate the rate of spread.
Talt grasses, brush, and dead trees should be cleared within 10 feet
of structures, and low growing species should be encouraged. This will
create a "defendible space" around the structure. Thinning live aspen
trees is not necessary or recommehded, as it could. lead to health
problems within the stand.
It is recommended that the old road running through the building site
not be used for the driveway. This road intersects Little Annie Road
at an acute angle and would make access difficult for large fire
vehicles. The driveway shoulc be constructed as close as possibi.e to a
90 degree angle to Little Annie Road, which would make access easier
and safer for both the homeowner and emergency vehicles.

The Planning Office has completed its preliminary review of the captioned application. We
have determined that this application is complete. Please complete and return the enclosed
Agreement for Payment form.
We have scheduled this application for review at a public hearing by the Board of County
Commissioners on Wednesday, November 29, 1995 at a meeting to begin at 5:00 P. M. Should
this date be inconvenient for you, please contact me within 3 working days of the date of this
letter. After that the agenda date will be considered final and changes to the schedule or tabling
of the application will only be allowed `for unavoidable technical problems. The Friday before
the meeting date, we will call to inform you that a copy of the memo pertaining to the
application is available at the Planning Office.
Please note that it is your responsibility to post the subject property with a sign within 15 days
of the public hearing and to remove it from the property within one week following the hearing.
Please submit the enclosed Affidavit of Notice by Posting as proof of compliance with the Code
prior to or• at the hearing.
