The purpose of the exchange is to adjust the properties back to historical possession and use, and utilize Castle Creek as a natural lot boundary. APPLICANTS: Luetta Whitson, James A. Hamilin and Linda K. Hamlin (Whitson Interests), and Frank Bergen. REPRENSENTATIVE: Maria Ticsay (Oates, Knezevich and Gardenswartz, P.C.) LOCATION: Conundrum Road, Castle Creek Valley ZONING/ORIGINAL LOT SIZE: AFR-10/ 2.12 Acres (Whitson), 3.547 (Bergen) REFERRAL COMMENTS: The application was referred to, but no comments were received from, the County Attorney, County Zoning, and Castle/Maroon Caucus. PROCEDURE/PROCESS: The Community Development Director may approve a Subdivision Exemption for a Lot Line Adjustment subject to the standards in Section 3-190-030 of the Pitkin County Land Use Code. Adjustment creates not more than the original number of lots or parcels. Staff Comment: There are currently two parcels, and if this request is approved, there will still be two parcels. 2. The purpose or effect of the lot line adjustment is not the creation of a new lot or parcel, nor any increase in floor area ratio for a parcel which gains size, nor creation of a Zot or parcel substantially different in size for development or resale purposes. Staff Comment: This lot line adjustment, if approved, does not create a new parcel, nor increase floor area ratio, nor create a parcel of substantially different size. 3. Irz the case of conforming lots and parcels, any resulting lot or parcel shall conform to the minimum requirements for area or width established by the provisions of the code. Staff Comment: The lots are legal, non-conforming. 4. The applicant shall prepare a subdivision exemption lot line adjustment map in compliance with the standards in Land Use Code Section 5-60-040. Staff Comment: Applicant is in compliance. 5. A lot line adjustment shall not be used to increase, the floor area ratio for a parcel that increases in size due to the adjustment. The floor area ratio will be reduced on a parcel that decreases in size due to the adjustment. Applications to add floor area ratio to a lot or parcel are to be major amendments and shall be reviewed pursuant to sectiozz 3-190-090. Staff Comment: There will be no increase in Floor Area Ratio. WHIT5ON -BERGEN LOT LINE ADJUSTMENT APPLICATION Responses to Lot Line Adjustment Criteria The Lot Line Adjustment criteria outlined in Section 3-190-030, and the Applicant's response to those criteria are as follows: CODE A. The adjustment creates not more than the original number of lots or parcels. Response: This adjustment will not create any new lots or parcels. CODE B: The purpose or effect of the lot line adjustment is not the creation of a new lot or parcel, nor anyincrease in floor area ratio for a parcel which gains size, nor creation of a lot or parcel substantially different in size for development or resale purposes. Response: The purpose of this application is to adjust the 1'ot line so that it comports with historical usage and with the natural boundaries of the property. The purpose of this application is not to create a new lot. The parcel being transferred is landlocked between the. Whitson property and Castle Creek and is largely inaccessible to anyone other than the Whitson interests. The Whitson and Bergen properties are zoned AFR-10. Both are legal, non- conforming lots in that they do not have the minimum acreage of ten (10) acres required in the AFR-10 zone. The transfer of the pazcel being transferred is small - less than one-tenth of an acre. As such, the Lot Line Adjustment will not create a parcel substantially different in size. Both lots will continue to be legal, non- conforming lots. Both properties have single family residences on them. Under the Pitkin County Land Use Code, the maximum permissible residential floor area for the properties is fifteen thousand (15,000) square feet. As the lots are already zoned for the maximum floor area ratio permitted without a TDR, the transfer will riofincrease the floor area ratio. CODE C. In the case of conforming lots and parcels any resulting lot or parcel shall conform to the minimum requirements for area or width established by the provisions of the Code. Response: Both lots are legal, nonconforming lots. As such, this criteria does not apply. CODE D: In the case of substandard size lots or parcels, the resulting lots or parcels may increase in non-conformity as to lot size so long as the other standards of ths`Code continue to be met. Response: Both lots will continue to be legal non-conforming lots. All other standards of the Land Use Code will continue to be met. CODE E: The applicant shall prepare a subdivision exemption lot line adjustment map in compliance with the standards in Section 5-60. Response: This application includes a draft Lot Line Adjustment Survey. If approved, the Applicant will prepare a lot line adjustment plat for recording pursuant to the standards contained in Section 5-60 of the Land Use Code. CODE F: A lot line adjustment shalTnot be used to increase the floor area ratio for a parcel that increases in size due to the adjustment. The floor area ratio will be reduced on a parcel that decreases in size due to the adjustment. Applications to add floor area ratio to a lot or a parcel are considered to be major amendments and shall be reviewed pursuant to Section 3- 190-90. Response: Both properties are zoned AFR-10, and the parcel transfer will have no effect on the floor area allowed for each property. MS.
