Complete afireplace/woodstove registration form with the Community Development Department, if necessary. B_ Obtain a County access/driveway permit to improve or relocate the driveway, if applicable. Submit a construction management plan for review and approval by the County Engineer showing the locations of staging, material storage and employee and construction traffic parking. E. Pay the applicable road and employee housing impact fees. F. Obtain approval of a septic permit from the Environmental Health Department. The septic system shall be located entirely within the approved building envelope, and must comply with the setback requirements from surface and groundwater sources. G. Submit a plan for review and applroval by the Aspeu Fire Marshal to demonstrate that the project .meets all of the codes and requirements of the Fire District, including provision of adequate access and a turnaround area and installation of an approved fire sprinkler system and 20,000 gallon water supply for fire fighting. Prior to commencement of auy earthmoviug or construction activity, the Applicant shall stake the corners of the building envelope and install construction fencing around the perimeter of the building envelope. Silt fencing shall be installed along the eastern boundaries of the building and accessory envelopes adjacent to the riparian areas and the creek. The fencing shall remain in place until a Certificate of Occupancy is issued for the residence. 5. The Applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: A. Vegetation shall be reduced to Ureal. up the vertieat and Horizontal colitinuity of the fuels a minimum of a 30 foot perimeter around all stmctures. B. Spacing between clumps of brush and vegetation within the 30 foot perimeter shall be a minimum of two times the height of the fiiel. Maximum diamexer of the clumps shall be two times the height of the fuel. Al I measurements shall be from the edges of the crowns of the fuel. C. .All branches from trees and brusli within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees aztd brush shall be removed. D. Tree crown separation within the 30 foot perimeter shall have a_minftlnum of 10 feet between the edges of the crowns. E. All branches that extend over the roof eaves shall be trinnned and all branches within 15 feet of the chinmeys shall be removed. F. Low vegetation (less than 6 inches m lieigitt) shall be maintained within a 10 foot perimeter around all structures. G. The Applicant shall be responsible for the continued. maintenance of the defensible space vegetation requirements 6. The Applicant shall comply with the following additional wildfire mitigation standards: A. Roofs shall be constructed with a Class A roof covering or a Class A assembly as defined in the hrtemational Building Code (IBC) Section 1505.2, Wood shake/sliiiigl0 roof coverings are prohibited. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be noncombustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof. 3) All roof designs shall facilitate the natural process of clearing roof`de6ris. Propane tanks shall be installed according to NFPA 48 standards and o^ a contour away from the structure with standard defensible space vegetation mitigation around anyabove-ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire- resistive construction on the exterior side of the walls. K. Each structure shall Have a minimum of one 10 pound approved ABC fire extinguisher placed iu a visible and accessible location. L. The Applicant shall comply with the following to mitigate ecological impacts: A. Install and use approved bear-proof trash containers. B. Maintain native vegetation outside of the building envelope. If any native riparian vegetation is impacted by construction (in particular the utility corridor and the acerrss envelope), the Applicant shall mitigate at a l: ] ratio immediately adjacent to or as close as possible to the impacted area according to a revegetation and mitigation plan prepared by the Applicant and approved by the County. C. Surface and ground water flows shall not be diverted away from existing wetlands. 8. No development, including, grading, excavation, fill placement, berming, landscaping, vegetation removal or disturbance, entry or ranch gates, well or septic system shall occur outside of the approved building and accessory envelopes. 9. All areas disturbed by construction shall be revegetated to limit water consumption and additional nmoff within one growing season after completion of catstruction. 10. Failure to comply with these conditions of approval may result in revocation of this permit or any subsequent permits related to this property or vested rights associated-with this property. 1 1. The proposed building envelope encompasses the existing residence, driveway, septic system, well, and other improvements and the accessory envelope will accommodate awater tank for fire fighting. APPLICANT: Heirloom Properties Colorado LLC REPRESENTATIVE: Glenn Horn LOCATION: 0249 Conundmm Road, adjacent to Castle Creek ZONING/LOT SIZE: The parcel contains approximately 1.3 acres and is anon-conforming size parcel in the AFR-10 zone district. BACKGROUND: The existing residence was constnicted in 1962 The BOCC approved a subdivision exemption in 1978 that reconfigured three esistiitg parcels into two and changed the boundaries of the parcels to the centerline of the road; the plat was recorded in Plat Book 7 at Page 19. REFERRAL AGENCIES: Comments fran Aspen Fire for the adjacent parcel are attached for reference. STAFF COMMENTS GNI~S EYEA-tPTION: The existing residence was legally constructed in 1967, and is eligible to be replaced with a residence of up to 5,750 square feet of floor area. 1091 Hg%4 RD REV/EW'cf; CONC'EPTU.~9L SLBNI(SS/ON IVetlands/Riz~arian Habitat/Wildlife: The property is not within any mapped wildlife habitat areas. Jonathan Lowsky with Wildlife and Wetland Solutions LLC delineated the riparian habitat; his report is included in the application. He states Yhat the property occurs within the riparian zone of Castle Creek, but,that the proposed building and accessory envelopes encompass areas designated upland or which are devoid of riparian vegetation (due to the prior development of the parcel). Tlie proposed building and accessory envelopes avoid any designated riparian areas. The Applicant has also designated a "utility corridor" across the riparian area to connect the water tank in the accessory envelope to the driveway and vi "access envelope" along the road where the Fire Marshal has requested a pullout. These envelopes encroach into the designated riparian area, bu't the area has been disrupted as a result of the original development of the property. Therefore, the utility,corridor and access envelope are acceptable, subject to mitigation of any native riparian vegetation that is removed'as a result ofdevolopment in these areas. ~~~~~f Mr. Lowsky's recommendations to minimize ecological impacts are included iii the conditions of approval. Floodnlain: The proposed building envelope avoids the 106year floodp~ain of Castle Creels YVild ire: The wildfire hazard on the parcel is mapped as IaW, and can be minimized with standard mitigation measures. Ed Vaal Walraven, Aspen Fire Marshal, notes that the project must meet all of the codes and requirements of the Fire District, including adequate access and hirnaround area, an approved fire sprililder system, a ?0,000 gallon water supply for fire fighting atSd detailed wildfire mitigation plans for both landscaping and struchieal standpoints. Mr. Van Walraven states, "Since this area can be extremely challenging, detailed plans mitigating these issues shall be submitted prior to the issuance of permits." His recommendations are included in the conditions of approval The Applicant has been working with Mr. Van Walraven to address his concerns. Geoloeic: The parcel is comprised entirely of slopes of less than 15%. Water & Se,n~er: The property is served by an existing residential well, which will be replaced in order to provide a ] 00 foot setbagk from the waste water disposal system. The existing septic system will be replaced. A test pit and percolation holes were dug and Tim and Richard Petz of All Service Septic LLC, have stated that the parcel can accommodate a system fora 5 bedroom residence of less than 6,000 square feet of living area. Accea•,r/Roads: The property is accessed directly off of Conundrum Road on an esisting driveway that serves 5 existing residences and provides access to one undeveloped parcel: RECOMMENDATION:. The applicant owns a 1.3 acre parcel located at 0249 Conundrum Road, the subject of this land use application. The applicant is seeking approval to establish a building envelope within which to replace the existing home and accessory residential uses. Attachment 1 is a vicinity map depicting the location of the property. The exiting improvements on the property were built in 1967. These improvements predate many growth control and development regulations. Therefore, the applicant wishes to develop a building envelope for the redevelopment of the residential uses. The applicant is seeking the following land use approvals: 1041 Environmental Hazard Review for one single family dwelling unit and accessory buildings; 2. GMQS Exemption for a Replacement Unit; and 3. Vesting of Property Rights. This letter describes the subject site and demonstrates compliance with the relevant Pitkin County Land Use Code standards and policies. SITE DESCRIPTION The subject property was originally comprised of two lots owned by the Carter and Gossard families. On October 2, 1978 the Pitkin County Board of Courty Commissioners approved a Subdivision Exemption Plat for the Carter/Gossard Tracts which eliminatedone lot and created Tracts A and B. The subject property is Tract B. Please refer to this'Plat in Attachment 2. Attachment 1 shows the subject site is bordered by Castle Creek in the Conundrum Valley at 0249 Conundrum Creek Road. Neigtiborrg properties include single family homes on metes and bounds parcels and a few undeveloped or underdeveloped parcels which are now being developed or redeveloped. There is an existing gravel driveway, parking area and septic system, all of which will be rebuilt along with the house. Since the property is adjacent to Castle Creek on its eastern boundary, the presence of riparian vegetation, floodplain and suitability for waste water disposal systems are the primary development considerations. The limits of the riparian vegetation are clearly mapped on Attachment 3, page 2 of the Heirloom Properties Colorado LLC 1041 Site Plan. Please also refer to Attachment 5, a Riparian Delineation Report prepared by Jonathan Lowsky, M.S. of Wildlife and Wetland Solutions, LLC. According to Lowsky, the entire property used to be riparian, but an area where the riparian vegetation was disturbed long ago, is the most appropriate area for redevelopment. These areas which no longer have riparian vegetation are the areas included in the proposed building envelopes. There are two proposed building envelopes on the proposed 1041 Site Plan in Attachment 2. The larger one is for the primary residence and the second will be for an accessory structure and possibly a caretaker dwelling unit. An access, landscape and utility envelope has also been designated. The Site Plan also shows the 100 year floodplain. LAND USE REVIEWS This section of the application demonstrates consistency and compliance with the sections of the Land Use Code identified as applicable in the applicant's pre-application conference. The pre- application conference summary is found in Attachment 4 and the necessary reviews identified are listed below. * Section 3-60 -Environmental & Aesthetic Standards; * Section 3-70 -Water Resources; * Section 3-80- 1041 Hazard Review including: 3-80-040 Fooodplain; 3-80-050 Geologic; 3-80-070 Wildfire; and 3-80 080 Wildlife. * Section 3-110 -Improvements and Services; * Section 9-110-052 (D) - GMQS Exemption for a Replacement Unit; and * Article 2, Land Use Policies. Environmental & Aesthetic Standards (Section 3-60) ~~~~~'~ This section of the application demonstrates compliance with the Environmental & Aesthetic standards. Section 3-60-020 Air Quality There will be insignificant impacts on air quality from the proposed redevelopment. The subject site is already improved with asingle-family dwelling unit and. a accessory building. Section 3-60-030 Preservation of Natural Landscape The applicant will comply with the standards of this section. Site disturbance will be limited to the driveway and development envelopes. The site will be revegetated during the first planting season after construction. Topsoil will be stockpiled and utilized for site revegetation. Section 3-60-040 Scenic Overlay The subject is not within the Scenic Overlay zone. Section 3-60-050 Scenic Quality The proposed redevelopment will have minimal negative impacts on scenic quality. It is not visible from Castle Creek Road. Section 3-60-060 Solar Access The house will be designed to take advantage of passive solar energy and shall comply with the Pitkin County Energy Codes. Section 3-60-070 Reduction in Density for Steep Slopes This section of the Code is not applicable to the subject site. Water Resource Standards (Section 3-70) Water Resource Standards are addressed in this section. Section 3-70-020 Encroachment or Channeling No encroachment or channeling activities on the adjacent Castle Creek will occur. Section 3-70-030 Drainage The applicant will submit a drainage plan with the building permit application as required by Pitkin County. Historic on-site flow patterns and runoff will be maintained to preserve the natural character of the area and to prevent property damage attributed to runoff rate and velocity increases, diversions and/or unplanned ponding or storm runoff. Landscaping around any structures will utilize positive drainage to direct water away from any structures. Section 3-70-040 Erosion 3 ;. The subject site is well vegetated. Existing vegetation will be maintained to the greatest extent possible, to preserve the character of the site and to minimize erosion. Vegetation shall be removed as necessary to create defensible space for wildfire protection. Standard erosion control measures shall be utilized during construction. Section 3-70-050 Groundwater The proposed development shall not interfere with groundwater recharge azeas. Section 3-070-060 Irrigated Areas The subject site is not irrigated for agricultural purposes. Areas irrigated for agricultural purposes will not be affected by the proposed development. Section 3-070-070 Irrigation Ditches This is not applicable to the subject property. Section 3-070-080 Sedimentation Standard construction practices will be utilized to reduce sedimentation. The site will be revegetated in the first growing season after the completion of construction. Section 3-070-090 Water Quality Water quality will not be impacted by the proposed development. Section 3-070-090 Water Supply The existing private residential well on the site will be replaced. Anew well will be drilled and located in the smaller proposed building envelope so that the 100 foot setback requirement between a waste water disposal system and a water well is met. The existing well did not meet this setback requirement. Water quality and quantity will not be problem. Water quantity and quality have been good in the vicinity as the water table is high in the area. Many successful wells have been drilled, including the existing well on the subject site. Areas of Local and State Interest- 1041 Environmental Hazard Areas Section 3-80 This section demonstrates compliance with the applicable 1041 Environmental Hazard standards, specifically Fooodplain, Geologic, Wildfire and Wildlife hazards, the hazards identified in the pre-application conference found in Attachment 4: Section 3-80-040 Floodplain: 100 year floodplain of Castle Creek Please refer to Attachment 3, the proposed 1041 Hazazd Review Site Plan which locates the 100 year floodplain as it relates to the subject property. The proposed building envelope is outside the floodplain. All development or use of the area within the building envelope will comply with this section of the Code so that no unwanted impacts will result outside the building envelope withsegazd to the floodplain. ~~~ui.~ ,~ _ Section 3-80-050 Geologic Hazard Areas Slopes in Excess of 15 Percent The subject property is mostly level with no significant slopes. Geologic hazards with respect to slopes are not an issue. Section 3-80-070 Wildfire Areas Wildfire hazard on the subject site is mapped as low. The location next to Castle Creek gives a natural fire block. The applicant agrees to any necessary conditions for wildfire mitigation. Section 3-80-080 Wildlife Habitat Areas The subject site is not within a mapped wildlife area. There are ripazian areas on the site related to the adjacent Castle Creek. The limits of the riparian vegetation are shown on the Site Plan in Attachment 3. No development will occur where there is riparian vegetation or wetlands. These wildlife habitat areas will be preserved. Please refer to Attachment 5, a report from Jonathan Lothsky of Wetlands and Wildlife Solutions, who indicates that development in the proposed building envelope will not impact the riparian vegetation on the site. IMPROVEMENTS AND SERVICES Section 3-110 This section of the land use application demonstrates compliance with the Improvements and Services standards of the Pitkin County Land Use Code. Logical Extension of Utilities Section 3-110-020 There will be a new private well and a new onsite wastewater system on the site, replacing the old well and septic system. All other essential public utilities already serve the site. The individual private well will be replaced in order to provide a 100 foot required setback from the new waste water disposal system proposed. Please refer to Tom Petz' report in Attachment 6 which analyzes the waste water disposal needs of the site designed for the redevelopment of the property. Water Distribution Systems Section 3-110-030 The existing individual water well will be replaced by a new private well to be drilled in a location further from the proposed new onsite wastewater system so that the required 100 foot setback between the two can be met. Water quality and quantity in the area is good. The existing well has adequate quality and quantity and no such water issues exist in the area. Water Supply Systems Section 3-110-040 As noted above, the subject parcel will be served by a new individual water well and a new onsite wastewater system. The existing well is to be replaced so that a 100 foot setback can be maintained between the well and the new onsite wastewater system. Sewage Treatment and Collection Section 3-110-050 On-site improvements will be served by a new individual sewage disposal system. The existing -aooo~~~ ~-. ~ system is to be replaced by a new OSW (onsite wastewater system) which will be designed by a Registered Professional Engineer. A test pit and percolation holes were dug to determine the viability of the lot for an OWS to serve a five bedroom residence with a living area of less than 6,000 square feet. As stated in the letter from Tim and Richard Petz`of ALL SERVICE septic LLC, the lot is capable of accommodating a system to serve such a residence. Please refer to this letter in Attachment 6. Public Utilities Section 3-110-060 The applicant will obtain commitment to serve letters for any necessary public utilities prior to the issuance of a building permit. Roads Section 3-110-070 The subject site is accessed by a private drive which branches off Conundrum Road. The parcel is approximately one third of a mile from Castle Creek Road. The existing and any new driveway will be within the proposed building envelopes. Parking Section 3-110-090 The applicant will meet all applicable parking requirements. Trails Section 3-110-100 Public trails are not proposed, nor necessary. Lighting Section 3-110-120 Ali lighting will comply with the Pitkin County lighting standards. Signs Section 3-110-130 Al] signs will comply with the Pitkin County sign standazds Growth Management Exemption for a Replacement Unit Section 9-110-042.D Section 9-110-042 D of the Code permits an exemption from GMQS for the replacement of an existing single family residential structure unit. The replacement structure may be up to 5,750 square feet in size. Please refer to Attachment 7, a copy of the original building permit issued for the improvements m 1961. Attachment 8 shows Pitkin county Tax Assessor records indicating that the house was completed in 1967. As a home legally created prior to 1978, the replacement unit is allowed to be 5,750 square feet. ARTICLE 2 POLICIES 6 t3Q~3~? y. ~: .. ,.~~ The following sections demonstrate consistency of the proposed development with County Code policies. Policy 2-10 Community Balance The proposed development does not affect the Commuriity Balance policy. Policy 2-20 Comprehensive Plan This policy is not applicable. Policy 2-30 Conformance with Comprehensive Plan The proposed development is in conformance with the applicable comprehensive plan The subject site is within the boundaries of the Maroon Castle Creek Master Plan which was adopted in November of 2003. The proposal is in conformance with this Plan as the Plan envisions the redevelopment of older homes such as the subject in the Castle Creek Valley. The existing house will be demolished for the redevelopment of the new home and accessory uses. Policy 2-40 Growth Rate: Phasing of Public Services and Facilities; Section 3-140 Non-Metro Area Residential and Tourist Accommodations and Metro and Non-Metro Commercial Growth Management Quota System Allotments; and Section 3-150 Metro and Non-Metro Area Growth Management Quota System Exemptions. The proposed request will have no impact on this policy. The site is already developed. A growth management exemption for the replacement of the existing home is being requested and has been contemplated in the phasing of growth for the area. Policy 2-50 Development or Expansion of Slti Areas This policy is not applicable to the application. Policy 2-60 Compatibility with Existing Adjacent Neighborhoods The proposed use will be compatible with land uses in the site vicinity which aze similaz residential uses. Policy 2-70 Conformance with other Laws The proposed development will be in conformance with all applicable laws of the United States of America and the State of Colorado. Policy 2-80 Natural and Man-made Hazard and Resource Areas This policy is addressed in the 1041 Environmental Hazazd Review section of this application. The proposed building envelopes do not include land within the 100 year floodpIain or within wetland or riparian areas. The building envelope is IeveI, with very little slope. Wildfire hazard is low and the applicant will agree to standazd wildfire conditions related to a mapped low hazazd neaz a large water body such as Castle Creek. There is no mapped wildlife hazard area, but the riparian areas desirable for wildlife will not be disturbed. See the 1041 section of the report for more detail. 7 Policy 2-90 Soil, Geologic Characteristics and Radiation The applicant is not awaze of any soil, geologic characteristics or radiation concerns on the subject property. Any radon issues will be addressed if required through the building permit process. There are no significant geologic concerns. The site is essentially flat, so slopes are not of concern. Please refer to the 1041 section of this_application for more information on geologic hazards. Policy 2-100 Drainage The applicant will submit drainage plans as required by Pitkin County in association with a building permit application. Drainage is also addressed. in the standards section of the application. Policy 2-110 Erosion An erosion control plan will be submitted as part of the. building permit application. Policy 2-120 Scenic Quality The subject site is not located within a Scenic Overlay area. Visual impacts are minimal. Policy 2-130 Air Quality The proposed improvements will have minimal impacts on air quality because the site is already developed. Policy 2-140 Water Resource Impacts It is not anticipated that there will be any impacts on water resources. Policy 2-150 Noise The activities proposed for the site will comply with Pitkin County noise standards. Policy 2-160 Wildlife Management Wildlife is addressed in the 1041 Environmental Hazazd Review section of the application. There are no wildlife habitat concerns and riparian azeas, important to wildlife, aze not within the proposed building envelope. Policy 2-170 Adequate Provision For Water Needs There is an existing well on the subject property which will be replaced with a new well to be drilled within the smaller proposed building envelope. The new well will meet the 100 foot setback regquired between a well and a septic system. Water quality and quantity aze good in the area and will not be a problem for the new well. The old well functions well with good quality and a good quantity of water. Policy 2-180 Sewage Treatment ~~~~ ~' A new Onsite Wastewater System (OWS) is proposed for the new improvements. Please refer to Tim and Richard Petz' letter in Attachment 7. The proposed system will be designed as necessary to accommodate a home up to 6,000 square feet in size. The proposed home will be 5,750 square feet as allowed through the GMQS exemption. The system complies with applicable local and state standards. Policy 2-190 Impacts on Road System Policy 2-200 Road Design and Construction Policy 2-230 Transportation The proposed improvements will have little, if any, impact on the road system. A construction management plan will be submitted, if required. All County road standards will be met. Access is via Castle Creek Road to Conundrum Road, then a private road on a 12 foot easement. An access, utility and landscape envelope has been designated on the property to accommodate the driveway from this access easement and existing private road to the new improvements which will be within the proposed building envelopes. Policy 2-210 Logical Extension of Utilities The site is currently served by a private well and septic system. Both will be redeveloped with the new improvements. Other utilities are already available to the subject site. This policy was addressed in the standards section. See Attachment. 6 for a report on the Onsite Wastewater System proposed. Policy 2-220 Impacts on Taxes and Management of Necessary Services and Facilities There will be minimal impact on taxes and services. Policy 2-240 Compatibility with Agricultural Lands and Operations The subject site is not used for agricultural uses. Policy 2-250 Compatibility with Historical and Archaeological Resources This policy is not applicable. Policy 2-260 Housing Affordable housing is not proposed nor required. Policy 2-270 Energy Conservation The proposal will incorporate energy conserving devices in compliance with or in excess of the requirements of the Building Code. Policy 2-280 Compatibility with Public Lauds The proposed use will be compatible with nearby public lands. Policy 2-290 Access to Public Lands Access to public lands through the subject site is not proposed, nor is it necessary. Policy 2-300 Private Land Surrounded by Public Lands (Inholdings) This policy is not applicable to the site. VESTING OF PROPERTY RIGHTS Section 4-140 The applicant requests approval of Vested Property Rights pursuant to Section 4-140 of the Code. The proposed 1041 Site Plan in Attachment 3 will function as,the Site Specific Development Plan for the property and includes all of the required standazds. SUMMARY This application. requests approval for the two proposed building envelopes and the access, utility and landscape envelope as designated on the 1041 Site Plan'in Attachment 3. Mitchell Lot B Property (the Property) at 249 Conundrum Creek Road, ]?itkin County, Colorado. The delineation is reported as it relates to §3-80.080(G) of the Pitkin County Land Use Code (LUC). 2.0 METHODS On May 25, 2005 a site visit was conducted to evaluate the vegetational and hydrological characteristics of the site. Following an examination of the plant communities and hydrological gradient, boundaries between upland and riparian areas were demarcated with pink pin flags and photographed. This delineation is based on: (1) Riparian area definitions described in A S sy tem for Mapping Riparian Areas in the Western United States (U.S. Fish and Wildlife Service 1997); (2) Riparian plant communities described in the Colorado Natural Heritage Program's A Classification of Ripazian Wetland Plant Associations of Colorado (Kittel et al. 1999); and (3) the author's experience in recognizing and delineating riparian areas in Colorado and the Roaring Fork Valley. 3.0 SITE DESCRIPTION The Property is located along Castle Creek just north (downstream) of its confluence with Conundrum Creek in unincorporated Pitkin County, Colorado.. The Property is approximately 6.28 miles south of downtown Aspen, Colorado in Township 11 South, Range 85 West, Section 2 of the 6th Principal Meridian at approximate 8,520 feet in elevation (Figure 1). The subject site is located immediately adjacent to Castle Creek and its flood plain. The site is highly disturbed with an existing residence. Most areas immediately surrounding the structure have been cleared of native vegetation and replaced with non-native lawn gasses. In'areas where maintenance of the landscaping has lapsed native vegetation is beginning to recover. 4.0 RIPARIAN DELINEATION For the purpose of this delineation, riparian areas are defined as plant communities contiguous to and affected by surface and subsurface hydrologic features of perennial or intermittent lotic (e.g., rivers, streams) and lentic (e.g., lakes, ponds) water bodies. Riparian areas have distinctly different plant species than adjacent areas; and/or species similar to adjacent areas but exhibiting more vigorous or robust growth forms (LI.S. Fish and Wildlife Service 1997). Non-riparian areas of the delineation are where the composition of the plant community consists predominantly of upland plants with few, if any riparian or hydrophilic plants, or where the ground is devoid of plants due to development (e.g., roads, structures) and has been in such a state for more than one yeaz prior to the delineation. The potential natural community on the site is a Narrowleaf Cottonwood -Colorado Blue Spruce. / Thinleaf Alder .Riparian Woodland with Engelmann spruce present but not as common as blue s race. Consequently, the ripazian plant community has been significantly disrupted. All of the riparian boundaries were classified as components of the greater Narrowleaf Cottonwood -Colorado Blue Spruce / Thinleaf Alder Riparian Woodland. Non-riparian areas (Appendix A) include: 1. The existing residence; 2. Roads; 3. Driveways; 4. Areas of naturally occurring upland vegetation with no riparian chazacteristics; and 5. Areas cleazed of naturally occurring vegetation. 6.0 CONCLUSION The subject site includes areas that have been classified as riparian and non-ripazian. The landscaped area, driveway, and access road are either upland or devoid of riparian vegetation. The azeas around the perimeter of lawn were classified as Narrowleaf Cottonwood -Colorado Blue Spruce / Thinleaf Alder Riparian Woodland and included within the riparian area. The ripazian area of the subject site was accurately recorded in the survey provided by Sopris Engineering, LLC (Appendix A). 7.0 RECOMMENDATIONS TO MINIl1-IIZE ECOLOGICAL IMPACTS 1. Removal of riparian vegetation and disturbance of ground cover adjacent to streams will be avoided to the maximum extent possible. as per Section 3-80.80(G)(3) of the Pitkin County Land Use Code. 2. A silt fence will be installed between any' areas of disturbed soil and the Roaring Fo River and the spring during all phases of construction in compliance with the Pitkin County Assets Management Plan. 3. Surface and ground water flows will not be diverted away from existing wetlands. 4. Only plant species that are identified by the Pitkin County Revegetation Guide as being appropriate for wetland or riparian areas, or native species found to occur on site but not listed in the Pitkin County Revegetation Guide, will be used for mitigation of any impacts to native vegetation. 5. Any native riparian vegetation permanently impacted by construction or construction related activities will be mitigated at a 1 a ratio immediately adjacent to' or as close as possible to the impacted area according to a revegetation and mitigation plan submitted by the applicant and approved by Pitkin County as per §3-80.80(A)(4) of the Pitkin County Land Use Code. 6. ff necessary, revegetation and/or mitigation plans submitted will contain the following elements: A. The purpose of our investigation was to determine the viability of the lot for an onsite wastewater system (OWS) to serve afve-bedroom residence with a living azea less than 6000 ft STI'E CONDTTIONS There is an existing residence with an OWS on the subject property. The existing residence is to be replaced by alive-bedroom residence with a living area less than 6000 ft and a new OWS is to be constructed. The property is located southwest of Aspen, Colorado, in an area where OWS aze necessary. Water is provided to the site by an on-site well. SUBSURFACE The subsurface was investigated by excavating an 8-foot test pit and three percolation holes neaz the proposed drain field location The test pit indicated the site has a Y-foot sandy, silty, root zone, underlain by silty, gravelly, sand, with cobbles and small boulders up to 16-inches in diameter to the maximum depth explored of 8 feet. Groundwater or bedrock was not encountered. A log of the test pit is included as Figure 1. Percolation test results indicate percolation rates ranging from 4 minutes per inch (MPI) to 13 MPI and an average percolation rate of 8 MPI. Percolation data is included as Table 1. Also, it may be possible to reduce the setback distances to the drain field through geologic justification and/or OWS design upgrades. The lot will accommodate an OWS for a 5-bedroom residence.
