APPLICANT: Harry and Lynne McNamara. ~I LOCATION and ZONING: The 2.0 acre parcel is zoned AF-1 and is located approximately 7 miles southwest of Aspen. The building envelope sits on a bench above Conundrum Creek,'just upstream from i the confluence of Conundrum Creek 'and Cast"].e Ckee)C. The property ' is located within Section 2, Township 11 South,"Mange 85"West of ~I the 6th PM. (see vicinity map) REFERRAL COMMENTS; Environmental Health The Environmental health Department reviewed the application and determined that the site ties an adequate water supply, the soils l I todviadthe ceomm~.tme t to inst llgonlytonetwood burning fireplace nd one certified wood burning stove. (Exhibit A) ~ a Zoning Zoning had no comment other than, noting that a building permit I would be required if the proposed berm along the west side of the l circular driveway is to exceed 6'. The applicant has proposed the berm as a mitigation strategy to reduce avalanche hazards. ~!~ (Exhibit B) Colorado State Forest Service. The applicant will provide the re uested circular driveway with a'hamnerhead turn q ....~ around and will sprinkler the house, but is not willing to widen the access road. The applicant feels that the ,road width issue was resolved following the Planning and Zoning Commission's 10`4i`haz3rd review and approval for the accessroad which occurred in 1988, and which specified a width of. 12' in accordance with a conceptual plan supplied by the applicant. STAFF DISCUSSION: Two major and several minor issues were identified by staff ', following a review of the pertinent sections of foie Land i7se Code. The major issues involve .mitigating potential avalanche hazards'~~ir and resolving competing interests regarding the adequacy of the access road width. Avalanche Hazard The 1041 hazard maps and a site visit both. indicate that thel hillside above the property showa 'evidence of historical avalanches. Other Geologic Hazards ~ Mr. Lampiris noted that several small faults occur in the vicinity, and recommended that the house be designed to the specifications of the Uniform Building Code for""""Seismic Zone II. He also noted that the home should be designed to prevent the accumulation'of .m radon gas. These recommendations have been translated into staff's ..~, ..,,~ _..~, .. K~ ., ~ . ~.._,-_ ~ -. ,..., .o ..,. .,. - recommended conditions of approva`I. Staff also identified two .areas of slopes >30% on the lot. one ~._ . ~, a .~ area of steep slopes occurs'along'the western side_of the lot, and the other lies along the eastern side of the proposed home site.. The applicant's 1041 map has been revised so as; to eliminate these steep slopes from the building envelope. Also, the circular driveway proposed by the applicant will require minor clearing and grading on 10-15~ slopes at the toe of the historical slide. area. _~.,., ~ w.~,.,.., ,.. ,. Staff requested that the driveway be designed to minimize disturbance on„the toe of these slopes. The applicant has complied by adjusting the driveway alignment, and has 'revised the 1041, map accordingly. Leaving the existing young aspen grove on these slopes could help to deflect or slow small snow slides and„further reduce potential avalanche hazards. Access Road The access road that serves the property was discussions by staff and the Planning and 3 the subject of lengthy 1, Zoning Commission at _. ~, meetings on March 8 and April 5, 1988. The 1988 1041 hazard review identified several constraints reiaceu to the proposed road construction including steep s"~.opes'"(60~)~ , ~~ potential damage to a spring at tkie base of the hill, and land • g and grading (cuts and fills) scarrin related to the clearing needed to install the road and necessary slope stabilization requirements. Thus, it appears that the P&Z concurred with staff's .recommendation and determined that the visual and geoiogical considerations `should ~i override the Fire District's recommendations for a wider road m owy;k~a~.nt ,ia 3aJx~a~+m.a,ul>~ i3 +w .. ~: .* ... ,3n;"^~1 •. This issue is being raised in the context of this 1041 _hazard .. , _.,, F application for further consideration. Again, the Fire District is recommending that the applicant widen the existing access road to 16' in conjunction with the Uniform Fire. Thus, it appears that the P&Z sued with staff and made a decision that the visual and geological considerations should override the Fire District's recommendations for a wider road. This issue is being raised in the context of this 1041 hazard application for further consideration. Again, the Fire District is recommending that the applicant widen the existing access road ate, to 16' in conjunction with the Uniform Fire Code provisions (see i~ Exhibit G). The. County Attorney is researching the authority of the Board to accept a standard less than that proposed by the Fire ~I District in accordance with their authority under the Uniform Fire I Code. While the access road does not meet CSFS suggested standards this site is in a low hazard riparian 'area. Additionally, the building envelope: is not thickly vegetated, does have adequate ', "defensible space" and the slope leading up to the building envelope is aspen forest type without any ladder fuels.
