RESOLDTION OF THE PITSIN COONTY PLANNING AND ZONING COMMISSION
GRANTING THE R1IWLEY H. S. 1041 HAZARD ~R~'VZEF1
Resolution No. 85- r8
WHEREAS, Carol Hawley (hereinafter "Applicant") is the owner of
real property more specifically described in Exhibit "A" attached
hereto and incorporated by this reference; and
WHEREAS, the Applicant has requested approval of a H.B. 1041
Hazard Review for certain geologic hazards under Section 5-401 of the
Pitkin County Land Use Coded and ~
WHEREAS, a public hearing was held on September 4, 1985 before
the Pitkin County Planning and Zoning Commission (hereinafter Commis-
sion) at which time evidence and testimony was presented with respect
to said application.
NOW, THEF,EF'ORE, BE IT RESOLVED by the Commission that it does
hereby grant approval for the Hawley H.B. 1041 Aazard Review subject
to the following conditions:
1. The homesite shall be limited to the aspen forest and shall not
be allowed in the open meadow area of the site and the building
envelope shall aot be located near the intermittent drainage on
the northern edge of the property. A map shall be submitted
prior to the issuance .of a building permit which outlines the
exact building c..~•„elope ciins~ stent with this condition.
2. All utiliti=s ~~1'1-,be undc ground.

3. Prior to issuance "~ of a „l~ui~ding Permit by the Pitkin County
Building Department the foh owing conditions shall be met:
a. A site specific soils analysis shall be completed.
b. The east wall of the residence shall be no less than three
(3) feet above grade, built to withstand snow slides of up
to ~d0 pounds of pressure per square foot.
c. French drains shall be built around the residence in order
to assure adequate drainage.
d. Landscaping to prevent potential drainage problems shall be
implemented on site in accordance with the recommendations
made in Dr. Nicholas Lampiris' letter dated July 10, 1985.
4. The i3riveway shall conform to the ,1985. .Pitkin County Road

Dear Mark,
At your request, I have reviewed the County approval for
construction of a residence on the Hawley parcel (BOCC peso. No.
85-18): I have also reviewed your letter to Mariano J. 11Buddy"
Lucero, dated. April 25, 1989.
At the present time, the Zoning Department would approve a building
permit for a residence on this property so long as it complied with
the conditions of Resolution No. 85 18 a As such, no further
General Submission review would be required. While this is
presently the case, my opinion is that"this property has no vested
right; therefore, it could be subject to future restrictions as

I can certify that the property in question is owned by Carol D.
Hawley, who was the owner of the property when Resolution 85-18,

foregoing, it is my understanding that an application for a
building permit for single- family dwelling by the present owner
or. her successors will be exempt from the general submission

Dear Buddy:
This letter will confirm our conversation of April 21, 1989
i11 regard to the above matter. I had expressed to you some
concern that Carol Hawley, or her successors in interest to the
property which was the subject of the above-referenced 1041
approval, may be required to complete the General Submission
review process in order to obtain a building permit for such
property. My concern stems from a March 18, 1988 memo from Tom
Smith which seemed to suggest that despite having received 1041
approval in 1985, an application for a building permit to con-
struct a single-family home would no longer be exempt under
Section 18-2.5(a) of the Pitkin County Code from the General
Submission requirements (Category 2 Exemption).
As I understand your advice to me, the County Attorney and
tYle Planning Office have taken the position that a so-called
Category 2 exemption for a building permit to construct a sin-
gle-family dwelling on land that had received 1041 approval prior
to the March 18, 1988 memo would still be available. If my
understanding is correct, please indicate so by executing the
acknowledgment set forth below.

cally, slope, faults, potential avalanche and alluvial, fans concerns._
The applicant's consulting geologist., Nicholas Lampiris, submitted a
letter (attached) with the application which identifies the site and
makes the following representations;
1) The building sites are in the... aspen forest outside of the.,.

2) There' is no evidence of rockfall,_or slope movement and avalanche
evidence is la,ckin,g, although small snow slides are possible from

Dr. Lampiris recommends.:
1. That site specific soils engineering studies be done to detect
the presence or absence. of. high groundwater and proper foundation
design.
2. The east wall of the foundation should protrude at least 3 feet
above grade and be structurally sound enough to withstand any
small snow slides which might reach 400 ppunds per square inch.
3. French drains should be located around the house.
In summary, from a._ geologic point of view,, this is an. excellent site
for a single-family residence;

the Castle Creek Valley. This parcel lies in the northern-
most portion of the Hayden Feat: 7 i/~ minite quadrangle, `

The topography of the Site consists of gently sloping
terrain with an open"meadow forming the`norf(~ern edge and
aspen groves with native grasses covering the rest of the

As aGeneral Submission requirement, the Pitkin County Land Use, Code requires the
applicant to provide to the Planning Office a list of "names and (mailing) addresses
of all holders of mineral estates (including mineral lessees) in the property, and
of adjacent (contiguous) land owners (including those separated from the property
by a public road or right-of-way)"(Article .6-3,1). These property owners ~rvi11

3. Permitted Use. This easement is for the
limited purpose of ingress and egress to the Property and
for the extension of electrical and telephone lines thereto.

manner to cause the least inconvenience to Little Annie

Should the Weights actually desire. utility service to the

3.1 Little Annie will grant to the Weights

an additional easement for,the limited .purpose of electrical
and telephone lines (and the maintenance thereof) over and
across Little. Annie property following a.convenie~nt route
which does not interfere with any actual or future ski area
operations.
3.2 Little Annie shall have the. right to
approve the location of this additional, easement, Which
approval shall not be unreasonably withheld; however, as
a condition to approval, Little Annie. may require the
undergrounding of any portion of the easement which interferes
with actual or future ski area operations.
3.3 Upon agreement as to the location of
this additional easement the Weights shall, at theie,expense,
have the route surveyed and legally described by a registered
~ land surveyor, which description shall. be filed in_the real
estate records of Ptkin County, Colorado as a supplement to
this. Agreement.
3.4 Prior to the installation of a,ny electric
or telephone wires., Little Annie ,shall receive written
notice thereof, and such installation (and maintenance)

shall be done at the sole cost and expense of the Weights in
compliance with applicable codes,uregulations or requirements
~'. of any governmental authoray or utility, having jurisdiction

4~ Maintenance of Access.w Little Annie shall

have no obligation or responsibility for the maintenance of
the ingress and egress easement. The Wrights agree that
nothing shall be done with respect to such easement to ~j/
interfere with„any snocat or ski area operations conducted`- f
by Little Annie.
5. Extinguishment of Certain Obligations. So
long as Little Annie commences day ski area operations
within a time period measured by the lives of all the partners
of of Little Annie, plus twenty-one (21) years or December 31,
2025, whichever is sooner, the obligations of the Wrights
set forth in Paragraph 4 above shall be permanent and perpetual.
If day area ski operations do not commence within t:he__time
provided, the obligations of the Wrights set forth in Para-
graph 4 above shall be forever extinguished in which event
Little Annie will, at the request of the then owner of the
Property, execute and deliver a written instrument in form
suitable for recording, acknowledging the extinguishment of
.such ok~ligations. Ih the event the obligations become
permanent. and perpetual, the. then owner of the Property
shall, at the request of Little Annie, execute and deliver a
written instrument in form suitable for recording, acknow-
legging that the said obligations are permanent and perpetual.
In the event it is determined, that_the time herein provided
for the commencement of_,_day ski area operations violates the
Rule against Perpetuities or any other rule or law against
vesting, restraints,. on the alienation of ,property, or the
like, the time so provided shall nevertheless continue for
the longest permissible period allowed under any such rule
for law.
6. Right of First Refusal.
6.1 Expressly excluded from these first
refusal provisions is a conveyance of the Property by the
Wrights to JOHN C. HEISLER, TRUSTEE and his successors_,n
trust of the JOHN C. IiEISLER;REVOCABLE TRUST dated July 10,
'1978 and as,further amended, or any subsequent transfer to
John C. Heisler_in the event,,, of,revocation of said trust.
6.2 Except as provided in 6.1 above, in the
event the Wrights_or any subsequent owner desires to sell
all or any part of the Property, the Wrights or such subsequent
owner shall give to Little Annie. written notice of the. terms
and conditions under which, they intend to offer the property
for sale. Little Annie shall then_have the first right to
purchase. the, ..Property, under the same terms and conditions
set forth in said notice of intent to sell, said right to
purchase to be exercisable for a period of thirty (30) days
following receipt of notice of intent to sell. Said_r,ight
to purchase exercisable„by Little Annie giving to the Wrights

Dear Dave:
I am in receipt of your letter of February 1, 1985, in which you
request my opinion regarding permit requirements for the extension
of electric' and £elephone lines to the single-family residence
described above located"near the ,Lime Village Subdivision.
Based on the following assumptions and conclusions, it is my
opinion that if a building permit is issued for the parcel the
extension of electric and telephone service lines to it will not
require Special Review Use Approval, 1041 Special Review .Approval,
or a_ss`parate building permit.
The assumptions on which this opinion is based areas follows:.
1. The proposed extension of utilities is for the purpose of
serving a single-family residence, and is not intended as a
main line extension.
2. Installation of the utility lines will be underground in an
existing 'roadway. `The natural condition of the land on which
the road is located is obviously no longer in existence, and
the roadway will be restored to its existing condii:ion upon
installation of the utility lines.
3. Installation of the utilities will not occur on 30~ or greater
slope.
4. Extension of the utilities will be requested as part of an
application for a building permit for the single-family
residence they are to serve, and extension of the utilities
is'condtioned upon issuance of such building permit.
The extension of the electric and telephone lines that is proposed
does not constitute "development" within the meaning of: Section
20-1 of the Pitkin County Land Use Code, since the construction
will not change the basic character or use of the land on which
it occurs. It is my view that this constitutes an "accessory
use," within the meaning of Section 20-1, since the extension of
utilities is a use customarily incidental to `the principal`.build-

ing or use, namely the principal residence. Sf is also, a use
customarily incidental to the roadway under which the utilities
are to be locate d,_ Therefore, it is my view that in accordance
with Section 3=3.27 of the Land Use Co,.de, the, proposed extension
of electriq and telephone lines is an accessory use allowed by
right.
It is also my view, based on the above analysis, that the proposed
activity is exempt from 1041 Special Review in accordance with
Section 5-400.3(b)(2), and exempt from Building Permit Review in
accordance with Sect:on 18,-2.5(a)(4), as an "accessory structure."
You correctly note in your letter that the issuance of a building
permit for 'the residence itself may require-1041 Special Review
if the parcel is located irr_a 1041 haz,ar,d.area.

This letter and attachments are intended as an application
far special review on behalf of Carol F. Hawley, the owner of a
2-acre parcel of land in Pitkin County, more particularly
described in Exhibits A-1 through A-3. Special review is
required because the property has been identified as potentially
subject to geologic hazards and steep slopes.
The applicant desires to obtain special review approval
for the construction of a single family dwelling on the presently
vacant parcel. As disclosed in the attached report of Nicholas
Lampiris (Exhibit B), consulting geologist, no geologic hazards
or slope problems exist which would prevent the construction and
occupancy of such a dwelling provided that routine foundation
engineering is undertaken.
A water well has been installed to serve the property, which
has been recently tested and found to be adequate (Exhibit C).
The applicant proposes a septic and leachfield system for sewage
disposal. A current perk test and report of Bob Nelson,
Environmental Coordinator, is attached as Exhibit D.
Access to the property is provided by existing roadways over
which the applicant has an easement. Electric utilities will be
provided by Holy Cross Electric. All utilities to the property
will be underground. Attached as Exhibit E is a letter from the
Pitkin County Attorney regarding the extention of utilities.

2. If the proposed Insured has or acquires actual knowledge of any defect, lien,
encumbrance, adverse claim or other matter affecting the estate or interest or
mortgage thereon covered_ by this Commitment other than those shown `in
Schedule B hereof, and shall fail to disclose such knowledge toahe Company in
writing, the Company shall be relieved from liability fog any loss or damage
