YELLIN/LOWEY CARETAKER DWELLd/NG UNIT

RECITALS
1. Jackie Yellin, hereinafter "Applicant!'., has applied to the
Board of County Commissioners of Pitkin County, Colorado,
.hereinafter"Board", for"approval of an attached caretaker dwelling
unit„pursuant to Section 3-8.13 (c) of the Land Use Code.
2. The applicant proposes to incorporate a 575 square foot unit
into a 7,900 square foot residence for which a building permit was
issued in early June of 1993.
2. The Applicant's lot is zoned AF-1 and is approximately 2 acres
in size.
3. Said parcel is located on 1041 Lower Hurricane Road, more
specifically described on Exhibit "A," attached.
4. Said parcel is accessed via Castle Creek and Little Annie
Roads and lies within the Little Annie/Richmond Hill Planning area
identified in Exhibit "A" of--Emergency Ordinance No. 93-~ which
restricts development within the Little Annie/Richmond Hill area.
5. The square footage to accommodate the caretaker unit was
included in the building permit which was issued pursuant to a site
specific development plan prior to the Board's adoption of
Emergency Ordinance No. 93-~.
6. The Board heard this application at a regular meeting on June
29, 1993, at which time evidence and testimony was presented with
respect to this application.

7. The Board determined that the proposed caretaker unit
complies with the criteria established in Section 3-8.13 (c) of the
Land Use Code.
NOW, THEREFORE, BE IT RESOLVED by the Board that 'it does
hereby grant approval to the Yellin/Lowey caretaker dwelling unit
application subject to the following conditions:
1. Prior to issuance of a building permit change-order to
accommodate installation of the caretaker unit, the applicant
shall submit an avalanche hazard analysis prepared by a
qualified avalanche expert. Said analysis shall address the
issue of avalanche hazard and associated risk on the portion
of Little Annie and .Hurricane Roads accessing the residence
and proposed caretaker unit. The segment of road to be
analyzed should begin from the Castle Creek Investors property
referenced in Arthur Mears' report dated July 11, 1993
(attached} and continue up -the Little Annie and Hurricane
Roads to the point of entry to the Yellin building site. If
the report concludes that there is no additional risk beyond
that already established for the Little Annie Road segment
,below the CCI property, the"'Planning Director shall sign-off
on the building permit change-order to allow construction of
the caretaker unit. If the report concludes that there is

ah additional avalanche risk associated with the_ Yellin
access, the change order shall' not be issued and the
.caretaker unit re est shall return to the Board for further
review.
2.' Prior to issuance of a building permit change-order to
accommodate installation of the caretaker unit, the
applicant shall submit a 24 x 36 inch mylar site plan which
meets the approval of the Planning Office and County Attorney
prior to recording. The following 1041 Hazard Review Warning
and Disclaimer shall be noted on the Plan:
"The provisions of these regulations do not in any way
assure or imply that areas outside of designated hazard
areas will be free from hazards, or that approved
mitigation measures wi1Z guarantee. the safety of any
property."
3. Recording of this plan does not effect the conditions of the
prior 1041 approval for the site pursuant to Resolution No.
85-18. Said conditions shall also apply to the caretaker
unit.

4. The occupant of the caretaker unit shall be employed full-
time on-site. Prior to occupancy the applicant shall provide
evidence of on-site employment of the occupant to the Housing
Office.
5. The following conditions shall be adhered to by the applicant:
a. The applicant shall provide a deed restriction, as
stipulated in Section 3-8.13 (a) of the Land Use Code, to
the Aspen Pitkin County Housing Authority for approval.
Upon approval by £he APCHA, the apphicant shall record
the deed with the Pitkin County Clerk and Rec'order's
Office prior to issuance of a building permit change-
order to accommodate installation of the caretaker unit.
b. Prior to leasing the Caretaker Dwelling Unit, the
applicant shall notify the Housing Authority, and have
the prospective tenant complete the required
qualification forms and submit those to the Housing
Authority for approval. Such farms shall include proof
of'full-time on-site employment.
c. If the unit is rented, the applicant shall provide to the
Housing Authority a copy of the executed lease at the
time the unit is rented and upon every 'renewal of the
lease term.
6. All material representations made by the applicant in the
application and during public meetings shall be adhered to and
considered conditions of approval, unless otherwise amended
by other conditions.

BUILDING SITE. Ttic building site will be located on a west-facing slope at approximately
9,450 feet elevati~n,(see map). The slope supports a mature aspen forest with many members
of the forest exceeding b inches diameter; This suggests a forest age of 4U-FiU years. Forests

'' steep locally {>30°} to puce small wet snow slides, although no evidence could be found
:v ~ that even small avalanches have occutred. Small wet snow slides would be confrncd to
gullies asomc of which are too small to be displayed on the attached topographic map.
Residential structures, therefore, should not be placed directly below gullies if removal of
trees is planned on slopes exceeding 30° inctinativn above gullies.
In summary, avalanche hazard at the building site. and on the access road to the site is so
small that this hazard, in my opinion, should not preclude construction of a residential
building.

At your request, I completed a site inspection of the Yellin/I.owey residence which is under
construction neaz the Little Annie Road in the Castle Creek drainage, approximately 5 miles
south of Aspen. The building site and access road are shown on the,_attached topographic
map (Figure 1). The purpose of my site inspection was to evaluate the snow avalanche
hazard at' the building site and access road. My observations and. conclusions are summarized
below.
1. BUILDING SITE, The building site (including main house, caretaker's unit,
garage, and equipment storage) are not exposed to snow avalanches therefore do not
require mitigation.
2. ACCESS ROAD. The access road between the switchback at approximately 9,250
feet elevation (near Glenn Hom and Alice Davis's house) and the beginning of the
Yellin/L.owey driveway at approximately 9,600 feet elevation is not exposed to
avalanches. Small "bank slides" can release from the steep, north-facing cut bank of
the existing road (a short distance before the driveway) for a distance of roughly 200-
300 feet. These small slides may deposit small amounts of snow at the edge of the
road but they will not block the road or endanger travelers. The driveway itself is not
exposed to avalanche hazazd.
In my opinion, and as exemplified by the avalanches during the 1992193 season, a faz more

significant avalanche risk is on the Castle Creek Road between the Little Annie Road and
Aspen. During any period of "high" or "extreme" avalanche hazard, persons would be safer
at the proposed Yellin/Loweq residence or on that portion of the Little Annie road described.

Combliance with Section 3-8.13 of the Land Use Code

Pursuant to Section 3-8.13(c) of the Code, the Board may permit an
attached caretaker. dwelling unit of T00 square feet or less, on
non-conforming lots within the AF-1 zone distract under the
following conditions and limitations
1. The total floor area of the principal and. caretaker unit shall
not exceed the. allowable FAR, of the, applicable zone district;
Responses A maximum floor area of 15,000 square feet is currently
allowed in the AF-1 zone district. Additional floor area is
,,.,
subject to special review. The applicant is"constructing a "home
with a total floor area of approximately 7,884 square feet.
2. The applicant shall deed restrict the uait_to comply with the
Caretaker unit deed restriction pursuant to Section 3-8.13 (a)(4)
of the`Land Use-Code.
Response: The. applicant agrees to deed restrict the caretaker unit
in accordance with County-regulations.
3. The dwelling unit deed restriction may only be removed upon
approval by the Board of county Commissioners.
Response: The applicant agrees to comply with this restriction.
Issues
1. Pursuant to Resolution 93-44, the Board denied 3 similar
caretaker unit request, based on the finding that a full-time
resident accessing the property via Castle Creek Road would be
exposed to an unacceptable avalanche risk. This determination .was
made during review of the Blattberg (aka Navratilova Subdivision,
Lot 2)'Plat Amendment, 104.1 and Caretaker Unit application.
The Yellin site is approximately 1/2 mile down-valley, north of
the Blattberg site, This caretaker unit will be accessed via
Castle' Creek Road and Little Annie Road, both of which are prone
to avalanche. Several avalanches stranded residents of the Lime
Village Subdivision over a severa'1 day period `this winter, during'
which time emergency services were unavailable to these residents.
Avalanche risk on Lower Little Annie Road has been assessed,,,by
<, ..
Arthur Mears in a report prepared for the Castle Creek Investor's
1041 Review. This report is dated July 11, 1992 (attached).
Specifically, his report states that approximately 200-300 feet of
the lower portion of Little Annie Road can be reached by avalanche;
however, based on resident reports only approximately 50' feet of
the road is covered during the 5-1'0 year frequency interval. Mears
felt that the avalanche risk was nonetheless acceptable. He did

not specifically address the road above the CCI envelope.
Mears also analyzed the previously mentioned Blattberg Hazard
Review. During that hearing at the BOCC, Mr. Mears testified that
avalanche risks existed along Castle C"reek Road (BOCC Meeting,
3/23%93).
The Board concluded at the,_Blattberg hearing that the risk posed
to employees and second units by `avalanche hazards across access
roads was not acceptable. "This finding was based on both physical
risk caused by the avalanche paths, as well as the additional risks
caused by residents being stranded from emergency services by
impassable roads.
2. The Yellin site lies within the mapped Rural-Remote boundary
identified in the ~OCC Emergency`Ordinance Restricting Development
on Certain Parcels Within the `Richmond Hill/Little Annie Area. This
ordinance stipulates that all parcels within this area shall be
restricted to a maximum development of 300 square feet of above
grade floor area, inclusive of all structures'. The Ordinance was
adopted on June 15, 1993. Thee Ordinance specifically exempts
parcels with vested site specific development approvals.
This parcel has no vested approvals, but does have a valid 1985
1041 Hazard Review approval for construction of a single family
dwelling. That dwelling is currently under construction. The
valid building permit, under which construction is proceeding, has
authorized a 7,884 sq. ft. house. Construction of this dwelling
is not impacted by the Emergency Ordinance as it is proceeding
under "a valid building permit. However, the caretaker unit was
never .approved, and obviously not vested. Additional square
footage for this second dwelling unit would be inconsistent with
the newly adopted Ordinance. Further ,expansions of the house,
beyond: that approved by the current building permit, can not be
allowed under the provisions of the Emergency`Ordinance.

for recording: Staff recommends that a Plan be recorded prior to
any further approvals for development on the. property. This
recordation will not vest this 1041 approval, but only seeks to
legalize the ongoing construction.
SUMMARY: While the applicant's proposal complies with the
requirements of Section 3-8.13(c) of the Code with respect to
caretaker units, the Board has previously determined that Special
Review approval is not appropriate for accessory housing in upper
portions of the Ca°stle Creek valley due to avalanche hazard
associated with access. As the existing residence on the Yellin
site contains substantially more than 300 square feet of floor
area, compliance with the Emergency Ordinance is not possible.

As you requested; this letter discusses the avalanche hazard to the above-referenced building
site, and on the Little Annie Road, which would be used to access this site, The conclusions
are based on my field inspection and study of tl.S: Forest Service aeriah photography, both
conducted on July 8 and 9; 1992.
The building site and access route aze both tdenhfied on the attached map, which is a portion
of the revised (198' Hayden Peak, C7.S:`Ge`ol'ogical 5'iarvey topograpliic quadrangle map. "
ACCESS ROUTE. Tle access route consists of approximately 4,500 feet of dirt road (thee"
Little Armic Road), and climbs from"thc~'Castle C~'eek Ffeiad°`ai 9;~~U"'fcct'clcvation'~o"'the
proposed building site at 9;450 feet. Approximately 20D-300 feet of this portion of the road
can be ~ched by avalanches (6% of the road), but observations. of avalanche frequency by
local resi ents indicate that only approximately SO feet of road is covered by avalanches once
every 5-10 years. My observations of terrain, exposure, and vegetation damage also _suggest
low avalanche frequency at this location. The avalanche-hazard rating (based on the
Canadian system, but using local observations of frequency), places the road in the "very
low" hazard category. In my opinion, no avalanche-hazard mitigation is required on this
portion of the access road:
BUILDING SITE. The building site will be located on a west-facing alopc at approximately
9,450 feet elevation (see map). The slope supports a mature aspen forest with many metnbczs
of the forest;exeeeding Cinches diameter; This suggests a forest age of 40-60 years. Fore's`ts
with closely-spaced trees such as this one tend to anchor the snow and prevent avalanche
release. Avalanches at the site have not been reported through local observations.
Furthermore, there exists no evidence, in the form of tree damage, that avalanches have
rcachcci the site, and no indication Eliot avalanches 'have occurred this century, as interpreted
tluough study of U,S. Forest Service aerial photograph}' dated 1939, 1956, and 1981.

The terrain immediately to the east of the site and 300 to 500 feet above it is sufficiently
steep locally (>30°} to produce small wet'snow slides, aiihough nti` evidence could be found
that even small avalanches have occurred, Small wet snow slides, would be confined to
gullies some of which are too small to be displayed on the attached topographic map.
Residential structures, tlcrcfore~should not be placed directly'lelow gullies if removal of
trees is planned on slopes exceeding 30° inclination above gullies.
In summary, avalanche hazard at the building site and on the access road to the site is so
small that this hazard, in my opinion, should not preclude construction of a residential
building.

The executive committee of the Maroon/Castle Caucus met
Friday, June`4, 1993. 'Two items were discussed at the meeting.
The first item was the Aspen Highlands application for lift
replacement. The consensus of the committee was that, although
everyone is in favor of improvement to the Aspen Highlands ski
area, the impacts of the lift replacement must be thorougfily
considered before approval is given to this request. We felt that
the Highlands is fortunate in possessing a superior ski mountain,
but that skier days at the area have been suppressed in recent
years due. to the antiquated lift system and .base area. Modernizing
the lifts would undoubtedly attracted a lot of locals who have
stopped regularly skiing the Highlands because'of those factors.
For the same reason, an increased number of tourists would probably
return to the mountain. Accordingly, we feel that some specific
measures need to be adopted concerning transportation, air quality,
and the like.
We also considered the ,; request for a caretaker
unit. Ordinarily, the Board takes the position on caretaker units
that they are acceptable provided that the unit is properly deed
restricted, utilized as a legitimate caretaker unit, and
assimilated into the main residential structure.' In this case, we
noted that the unit is detached, which we felt to be undesirable.
Further, it was brought up at the meeting that we believe 'that fiSr`s.
Yellin in the past added a caretaker unit to her residence (in a
different neighborhood) without approval or permission. Further,
it was understood that that `unit was treated as rental housing.
Accordingly, in this case, particular care must be given to
enforcement of the .appropriate deed restrictions.

The Planning Office has completed its preliminary review of the captioned application. We
have determined that this application is complete.
We have scheduled this application for review at a public hearing by the Board of County
Commissioners on Tuesday, June 29, 1993 at a meeting to begin at 5:00 P.M. Should this date
be inconvenient for you, please contact me within 3 working days of the date of this letter.
After that the agenda date will be considered final and changes to the schedule or tabling of the
application will only be allowed for unavoidable technical problems. The Friday before the
meeting date, we will call to inform you that a copy of the memo pertaining to the application
is available at the Planning Office.
