I have written to my client, Richard M. Shohet, to advise him of the magnitude of the undertaking set forth by you in order to receive the necessary Forest Service special use permits. He will be considering the matter and getting back to me on how he wishes to proceed. As one parenthetical matter prior to proceeding, it does need to be brought to your attention that a lower sprinc (unrelated tc the spring on Forest Service land for which Mr. Shohet has been requesting a special use permit for a pipeline rightofway) has existed on the Shohet property from time immemorial and was discharging onto the slope and adversely affecting the county road right-of-way long before Mr. Shohet acquired the property or began any development activity on it. If a drainage system is to be created, I suggest that discussion between yourself and myself as to the relative contribution of these two springs would be in order and the consequent contribution that the count- might make tc the construction of airy drainage system which we might agree upon. As I say, this is a parenthetical matter but I did want to bring it tc your attention at the outset so that there was no misunderstandings between us. I appreciate your competent explanation of the procedures to be followed and look forward t,o working with you on securing the necessary permits once ~e heard from Mr. Shohet. Shohet - Special Review Right-Of-Way and Road Easement Permit Application for Pipeline, Dear Mr. Dominick: Since we last talked, I have conducted.a sight inspection of the subject property and have reviewed the applicable regulations. I have determined that the County definiteTy~does'have an interest in reviewing 'the two special use permit applications under the County°s special review procedure pursuant to ,H.6. 1041. The subject road is currently physically closed; that is, it is blocked by boulders which have been released from the unstable slope i'nto' which""the road has been cut. The County Code would require the submission of a pro- posal to mitigate the impact of this road cut upon the unstable slope. This design plan would have to be prepared by a qualified professional engineer. The pipeline creates an obvious problem below the existing cabin in that the pipeline, in fact, ends at the cabin and the water is allowed to cascade down an unstable slope.` The County"s road is also cut into this same`unsta6le slope. The County has spent considerable amounts of money in attempting to stabilize this condition and, by applying water to this unstable slope, your client has worsened the situation. In this regard,~we need a complete drain- age plan to 6e prepared by a qualified professional engineer describing the drainage system from its source to final destination. These regulations are the authority under which the County will be reviewing Mr. Shohet's application. Finally, the Land Use Code requires that you submit a list of the names and mailing addresses of ali'physcally adjacent property owners, so that we can notify them of the public hearing that will be held before the Board of County Commissioners, a submission fee of X100 payable to the "City of Aspen", and we will need five copies of your complete application (review agencies to include the Colorado Geologic Survey, the County Engineer, the County Sanitarian, the U.S. forest Service and the Planning Office). My review of the file shows that both applications were forwarded by the Forest Service to the county on or about January 19, 1978, and according to the Forest Service, we (the applicant and myself) "should be hearing from the County Planning Office in the near future. ." My file also reveals that I wrote to William Kane of your office on March 23, 1978, inquiring into what information the county felt it needed on these permits. The file indicates that no response was forthcoming from b1r. Kane. As you and I have agreed, I am forwarding 'to you copies of the Special Use Permit Application in both instances. I additionally enclose a Ruling of the Referee and Decree of the Water Court dated October 28, 1977, and February 23, 1978, respectively with regard to the Shohet Spring. STATEMENT 'OF NEED ~... , .: The following Statement of Need is submitted in support of Richard M. Shohet's Special. Use Application and Report: 1., Description of Project and its Iocatian. (a) Purpose. The Special Use Permit is required for the purpose of utilizing and maintaining an access .road from the Castle Creek Couhty Road to the Applicant°s patented mining claim {°'Fenshall C.1am," Survey No. 6955). (b.) Size of Project. The existing access road traverses approximately 160 feet o£ Forest Service land, and the requested use would be for 15 feet on either side of the center line depicted on Attachment A to' Applicant's Special Use Application and Report. (c) Anticipated improvements. As°ths is an existing Project, there would be no improvements to any present project or facilities currently located on Forest Service lands, and the applicant does not presently anticipate that any improvements to or enlargements`of the access road will be necessary. (d) Costs. As the access ,road has Tieen,_in use for a number of years, there would be no additional costs associated with the Project. (e) Method of`operation_upon completion of the Project. The access: road currehtly extehds from the Castle Creek County Road. to the Henshall Claim and is utilized soleIy~for ingress to ancT'egress from`"the Henshall Claim. 2. Description of the relationship of the Project to existing operations or systems. As previously stated, the subject access road. has been in use for a number of years, and no use other than fliat'df the Applicant is made thereof, 3. Necessity for the Project. If a Special Use Permit is not granted, access to the Henshall Claim would not be feasible. 4. Anticipated future expansion. The Applicant does not anticipate that any expansion. of the Project will be required during the next ten (10? years. 5. Alternatives to the Project. The Applicant does not believe there are any viable al- ternatives to the Project. While t. _conceivable that an access Yoad could be built directly from the Castle Creek County Road to the Henshall Claim, the. topography to the Henshall Claim adjacent to the County Road does not lend itself to such construction and the cost to extensively recontour would be prohibitive. The only other alternative would be to abandon the valuable property right that the A licant has in .the Henshall Cl_ pp aim and the structures thereon. Such considerations as "possible use. of facilities owned by other persons or companies, new technology, etc." are not applcable,to this Project. 6. Need for Forest Service lands. Forest Service lands are required for this Project as there is no other viable means of ingress to and egress from the Henshall Claim. 7. Other ownerships and agencies involved. Besides. the Applicant and the Forest Service, the Applicant does not believe that any other ownership would be involved in this Project. •The only regulatory agency which may prospectively be involved would be Pitkn County, Colorado. 8. Technical requirements. The. Applicant does not believe that any technical requirements would be involved in this Project. -2- r 9. Schedule of development. As the Project has been in ,use for a number of years, a schedule of development is not applicable. 10. Supplemental Information. Description of Project and its location. (a) Purpose. The Special Use Permit is required for the purpose of maintaining a water. pipeline from a spring on one patented mining claim ("Dick Claim," Survey No. 6189) across an intervening strip of Forest. Service,_ land to a second patented mining claim ("Henshall. Claim," Survey No. 6955). The Applicant has been ,_ ,, ;_, adjudicated a water right (W-1850, Water Division No. 5, State of Colorado) to the spring on the Dick Claim for domestic and fire protection purposes. (b) Size of Project. The water pipeline traverses approximately 87.855 feet of Forest Service__land, and the requested use would be for 15 feet on either side of the center .,line depicted on Attachment A to Applicant`s Special Use Application and Report. {c) Anticipated improvements. As this. is an existing Project, there would be no improvements to any present project or facilities currently located on Forest Service'lands, and the Applicant does not presently anticipate that any future improvements to or enlarge- ments of the pipeline will be necessary. (d) Costs. As the water pipeline has been in use for a number of years, there would be no additional costs associated with the Project. (e) Method of operation. upon completion of the Project. The water pipeline. is a gravity feed system from the Dick Claim to the Hen5ha11 Claim. If any booster pumps should be_ required, any such equipment would not be located on Forest Service lands. 2. It is the Applicant's belief that no other party will be adversely affected by the granting of the requested Special Use Permit or_the operation of the pipeline thereunder. If the Special Use Permit is not granted, the Applicant 'will be uhabl~.ta convey the decreed water is the-, point of beneficial use on the-Henshall Claim 4. Anticipated future expansion. The Applicant does not anticipate that, any further expansion of the Project will be required during the next ten (10) years. 5. 'Alternatives to the. Project. The Applicant does not be7_,ievE that there are any viable alternatives to the Project. It is conceivable that a pipeline could be installed so as to extend .from, the Dick.. .laim directl to the Fiehshall Claim, but such would he, , (' y economically prohibitive and would destroy the current gravity feed carriage system. The only other alternative would_be, the non-use of the decreed water, with the attendant abandon- ment thereof.. Such considerations as„"possible. use of facilities owned by other persohs'or companies, new technology, etc." are not .,applicable to this Project. 6. Need for National 'FOi`est Service lands. Forest Service lands. are required for this Project as there are'no other viable. means forconveyhg the decreed water from the Dck_Cliam to the Henshall.
