WHEREAS, Clark Heckert, hereinafter "Applicant", has applied
to the Board of County Commissioners of Pitkin County, Colorado;
hereinafter "Board", for ' Generale Submission approval'" "for" the'"
construction of a single-family residence on a metes and bounds
parcel, pursuant to Section 6-3 of the Pitkin County Land .Use

WHEREAS, the_Applicant's parcel is zoned RS-3b and contains
approximately 7 acres; and
WHEREFi.S, said. parcel is located west of State Highway 133,
approximately four miles south of Redstone, at Placita; Section

WHEREAS, the Applicant is proposing to construct a single-
family residence on site; and
WHEREAS, the Planning and Zoning Commission heard the
application at their regularly scheduled meeting on July 17,
1990, at which time they approved a 1041 Hazard Review and
recommended approval of the General Submission; and
WHEREAS, the Board heard this application at their
regularly scheduled"meeting on September 25, 1990, at which time
evidence and testimony was presented with respect to this
application; and

WHEREAS, the Board finds that the Applicants have complied
„,
with General Submission criteria, pursuant to Section 6-3 of the
Land Use Code.
NOW, THEREFORE, BE IT RESOLVED by the Board that it does
hereby grant General Submission approval to the Heckert
application subject to the following conditions:
1. Wildlife habitat impact shall be mitigated as follows:
1
a. Dogs and livestock shall be prohibited.
b. Native vegetation shall be preserved outside .of the
building envelope and within the envelope wherever
possible.
c. Fencing shall be limited to 42" iri height and 4 strand
or less.
d. Pasturing of horses shall be allowed but shall be
limited to the months of July, August & September.
2. The access drive shall be designed to conform to County
standards and shall be approved by the County Engineer prior,„;,
to issuance of a building permit.
3. The applicant shall apply for and obtain an access permit
from the State Department of Highways prior to excavation
for construction of the driveway.
4. The applicant shall place gravel on the .driveway during
construction to minimize mud carryout onto the highway.
5. Utility lines shall be buried in the driveway.
6. The applicant shall install a second storage tank, to be
approved by the Environmental Health Department, prior to
issuance of a building permit.
7. Prior to issuance of a building permit the Environmental
Health Department shall inspect and approve the existing
water system and proposed septic system design and location.
8. The applicant shall adhere to guidelines contained in the
Colorado State Forest Service booklet entitled "Wildfire
Safety Guidelines for Rural Homeowners". Said guidelines
are as follows:

r-a) An external water supply .for fire fighting shall be
provided (small pond, cistern, well, hydrant or fire
sprinkler system):
b) The Applicant shall thin or clear any trees or shrubs
as necessary within 30"feet of the proposed residence.
c) All roofs shall be kept cleared of debris.
d) Firewood shall be stacked on a contour away from
building.
e) 2'he base of buildings shall be kept cleared of weeds
and debris.
f) At least one (1) ten-pound ABC-class"fire extinguisher
•.~, shall be placed in each structure.
g) All power and telephone lines shall be underground.
9. A drainage plan shall be submitted with the building permit
application to assure negligible effect from runoff. Said
plan shall be"reviewed and approved by`the County 'Engineer
prior to issuance of a building permit.

APPROVAL TO THE HECRERT APPLICATION
Resolution No. PZ-90-~
WHEREAS, Clark Heckert, hereinafter ^Applicant", has applied
to the Planning and Zoning Commission of Pitkin County, Colorado,
hereinafter "Commission", for 1041 Wildlife and Wildfire Hazard
approval for a single-family residence pursuant to Section 5-
400.2(a)(4~ of the Land Use Code; and
WHEREAS, the Applicant's parcel is zoned RS-30 and contains
approximately 7 acres; and
WHEREAS,. said parcel is located west of State Highway 133,
approximately four miles south of Redstone, at Placita; Section
6, Township 11 South, Range 88 West; more specifically described
in Exhibit "A"; and
WFIEREI~S, the Applicant is proposing to construct a single-

WHEREAS, the Commission considered the Application at a duly
noticed public hearing at their regularly scheduled meeting on
July 17, 1990; and
WHEREAS, the Commission determined that the applicant can
adequately mitigate identified 1041 hazards; and
WHEREAS,. the Commission has determined that said application
meets General Submission requirements of the Code.

BE IT FURTHER RESOLVED by the Commission that it does hereby
grant 1041 Wildlife and Wildfire Hazard Review approval to the
Applicant subject to the following conditions:

I have. tried twice to contact you in your office. Each time
you were unavailable so I left a message. The following is°a full
explanation of the messages which will probably present no
surprise to you. As I have stated previously, I understand that
you are very busy with your current case load so I am writing
requesting a copy of the final, report and to have Pitkin County
accounting send a full financial statement on my 1041. I'm sorry
that I have to bug you, but I need the Final report in order to
complete the building application that I plan to submit soon.
If you are finding it difficult to complete the report for
whatever reason please write and give me some indication of when

SUMMARY: The Planning Office and the Planning and Zoning
Commission recommend approval. The applicant agrees to comply
with the recommended conditions of approval.
REQUEST: Clark Heckert is requesting approval of a 1041
Environmental Hazard Review and General Submission. The applicant
is proposing to construct a 625 square foot garage and 2500
square foot residence on a site which is approximately seven

The applicant agrees to abide by recommendations made by the
Division of Wildlife.

below the'Placta Spring. Kevin Wright has reviewed the request
and indicated that he~has rio objection to pasturing the horses
for short durations during the summer.
In summary, while there are. wildlife concerns on 'site, the
applicant ,has worked with DOW to limit building envelope size and
locate. the house and garage such that impacts will be minimized.
The applicant has also agreed to recommended mitigation measures.
GENERAL SOBMISSION
General Submission issues which are pertinent to the development
of this particular site are discussed below.
ACCESS - access to the site is to be off of Highway 133. The
road, is to be a maximum of 7.4$ in grade. The County engineer
has reviewed the proposed driveway and indicates that it appears
to be in conformance with County standards which stipulate that
grades must not exceed 120. Mr. Newland recommends that the
driveway in general be designed to conform with County standards.

He also notes that the applicant will be required to apply for
and obtain an access permit from the State" Department of
Highways. The Environmental Health Department has requested that
gravel be placed on the driveway during construction to minimize
mud carryout onto the highway. The applicant agrees to do so.
Finally, it is recommended that utility lines to the building
envelope be buried in the driveway.

is to be supplied from the Placita .Spring. The applicant owns
1/3 of the water that is contained in the spring and its related
storage facilities. While a consulting hydrologist has indicated

storage tank to ensure that peak demands for water can be met.
The Division of water resources indicates that the water supply
could be curtailed during dry years.- A second water storage tank

the clearing north of the cottonwood and no farther uphill than
the large .boulder and aspen edge. I have no problems'with
pasturing some horses on fhe property for short dizrafions. This
would be'best located in the grassy area near Hwy 133 below the
spring and not up in the aspen. Limited harvest of the dead aspen
trees may help to stimulate aspen sprouting and regenerate the
aspen stand on the upper bench of the property.

The Aspen/Pitkin Environmental Health Department has reviewed the
above-mentioned land use submittal under authority of the Pitkin
County Code, Title II, and has the following comments.
/ SEWAGE TREATMENT AND COLLECTION: Sections 2-7 and 5-200:
The applicant plans to serve the proposed residence with an on-
site sewage disposal system. It is our opinion that the soils
and the topography of the site will prove to be suitable for the
installation of an individual sewage disposal system that will
comply with County standards. We also expect that these soils
will be found to be reasonably permeable. However, a site
specific soils evaluation including percolation tests must be
done in order to determine the final design of the septic system.
If the site conditions or percolation rates preclude the
possibility of a standard design, this department would be able
to permit an engineered design system that still meets the
regulations.
Another consideration is the placement of the on-site system.
The system should be constructed downgradient and as far away as
possible from the spring (at least 100 feet) that is located on
the property. This should be possible because of the size and
the topography of the applicant's property.
ADEQUATE PROVISIONS FOR WATER NEEDS• Sections 2 6 and 5 205
The potable water supply for the proposed residence is to be
supplied from the Placita Spring. This spring is located on the
applicant's property, and it currently serves several nearby
residences. The applicant owns the rights to 1/3 of the water
that is contained in the spring and its related storage
facilities. The applicant has submitted a letter from a
hydrologist, Kerry Sundeen, which states that the spring is
capable of meeting the quantity requirements for the proposed
residence. However, at the time of the hydrologist's assessment,
the discharge from the spring was 2.5 gallons per minute (gpm)
and the discharge from the seepage area was 10 gpm. The
applicant may wish to consider installing a second storage tank
to ensure that peak demands for water can be met. This
department would like to inspect this water system at the time of

The applicant has recently had the water sampled and bacterial
contamination was present. We would suggest some type of
sanitary protection for the Placita Spring. This should include
a provision for the removal of surface drainage from the site of
the spring. In addition, the applicant may wish to consider some
type of point of use disinfection system, such as a chlorine or
ultra-violet light treatment system. These modifications should
ehsuYe that quality of the water from the Placita Spring meets
the Colorado Primary Drinking Water Requirements.
AIR QUALITY: Sections 2-17 and 5-106:
The house is allowed one woodburning fireplace and one certified
~Qf~ woodstove. The owner will need to obtain permits for these
vv~~ devices from this office. The owner should agree not to install
any stove or fireplace. in the garage if it is detached from the
house.
During construction, the applicant should ensure that no mud
carryout onto Highway 133 occurs. This could be minimized by
placing gravel on the access driveway where it enters Highway
133, or by cleaning the entrance to the highway as necessary.
NOISE-e Section 2-23
No long term adverse noise impacts are expected in the
neighborhood as the result project approval. Should this office
receive noise related complaints, Title '24 Article 12 C.R.S.-
Noise Abatement will be the. document used in the investigation.

Pursuant to your request we have completed an assessment of the adequacy of water
supplies to provide for domestic use at a single family residence proposed for
construction on your property near Redstone, Colorado,_Specifically, physical water
supplies, legal water availability, and water quality have been assessed.
Physical Water Supplies
Water will be used at the site for in-house domestic use within_ a single family
residence. In-house water use typically averages about 300 gallons per day in most
residences. A peak in-house use of up to 1000 gallons per day can be expected.
Domestic water at the site will be supplied by the Placita Spring. This spring is
located on the property and consists of a collection system, a 1200 gallon concrete

We conducted a field review of the Placita Spring in December of 1986. The
discharge of the spring was likely at it's lowest level during this time of year. At the
time of our field review, the discharge of the spring was measured to be 2.5 gallons
per minute (gpm). An additional 10 gpm of water was discharged from a seepage
area neat the collection system for the spring.

A one-third interest in the Placita Spring will provide adequate physical water
supplies for on-site domestic use. It is our understanding that the collection system
for the spring has been improved to capture the flow from the nearby seeps, and
that the discharge of the Placita Spring has been significantly increased. However,
even if the spring were not improved and discharge remained at a flow of 2.5 gpm,
sufficient water supplies would occur. For example, one-third of 2.5 gpm would
result in a daily flow of 1,200 gallons. This discharge, coupled with the 400 gallons
of available storage, will easily meet the maximum daily demands for.. domestic use
at the site.

The Placita Springs were decreed 0.23 cfs for domestic and lawn irrigation purposes
in Case W-2187. The rights were adjudicated in T974"and have a 1974 priority date.
While this right is somewhat juriior, it is protected from call by senior water rights
on the Colorado River by releases from Green Mountain Reservoir. The federally
adopted Green Mountain Reservoir operating principles provide for reservoir
releases to offset all out-of-priority depletions for absolute rights decreed prior to
1977. Further, the quantity of use of the. spring is so small that any call by
downstream rights may be futile. Historically, this spring has never been placed on
call, even during the critically dry year of 1977. Accordingly, water rights for the
spring will provide a reliable legal water supply for the development. This is more
fully discussed in the November 26, 1986 correspondence to you from Peter Milwid.
Water Quality
The Placita Spring currently provides domestic water supplies to several nearby

suitable for domestic use. However, recent water quality felts o~ the spring have
identified the presence of coliformbacteria. This indicates that a source of surface
runoff may be' entering the collection system. The presence of bacteria should be
eliminated prior to the continued use of the spring for drinking water purposes. It
may be possible to eliminate the bacteria by sealing the collection system and
storage tack from surface runoff. If this does not eliminate the bacteria a relatively
inexpensive filtration and or chlorination system will easily provide acceptable
domestic water supplies.

area which will minimize impacts to wintering Elk. The house
site, as recommended 'by' Kevin Wright, will allow the Elk to
continue to utilize the aspen 'bench and still allow the Elk to
cross.. the Highway above (or north) of the' house. Division of
Wildlife has recommended the following mitigation measures to
insure that impacts`to wintering Elk are minimized:

As per my phone conversation with Sara yesterday, I will
address the seven remaining points on my application in order.
1) Application fee of $1670.
I have ,enclosed a check for $1557. I previously
submitted a check for $113 for a minor review and a
check for the $10 recording fee.
2) Fire Protection.
I called the Aspen Fire Marshall. He was fully familiar
with the Aspen regulations, but recommended I call the
Carbondale Fire Department to ascertain the regulations
which apply to Placita. I spoke to Bill Gavette of the
Carbondale Fire Department. He said no sprinkling
system is required since I am on Highway 133 nor is any
water additional water supply required since the
Crystal River in next to the property. He wasn't sure
whether the driveway had to be plowed if the utilities
- were turned off. I will, of course, comply with

whatever regulations apply. In addition, I am
considering installing a gravity fed sprinkling system.
3) Dogs.
The Heckert family has no plan to own a dog.
4) Access.
,; .The driveway proposed has a maximum grade of 7.4%.

The property is in the Crystal valley four miles south
of Redstone. The site is situated on approximately
seven acres. Beyond the north, south and west borders'
of the property is National Forest land. state highway
133 forms the eastern border. To the east of 133 is the"
Crystal River. The upper hillside is covered with a
combination of Aspen and scrub oak while the lower
hillside is grass and sage. In the approximate center
is the Placita Spring. Surrounding the spring is a
willow grove.
6) Highway Right-of-way.
The plat plan from Lines in Space shows the highway
right-of-way along the eastern border.
7) Preapplicaton form.
Enclosed is the preapplication form.
In your review of this application I would appreciate
comments on the following subjects..
1) We would like to schedule the hearing in July or
early August to_correspohd with our planned family

As per our previous conversation I am submitting my
application for 1041 review: In my first pre-application
conference Buddy Lucerno raised several issues. I will address
those and others we have discussed in the information that
follows:
DEVELOPMENT PLAN
On approximately seven acres in Placita, CO, four .miles
south of Redstone and west of State Highway 133 we intend to
erect a 625 square foot garage and a 2500 squarh foot house of
the log cabin style. We intend to use the. Placita Spring - a
tributary of the Crystal River - for the domestic water source
and to locate a septic and drain field system sufficiently
separate from the spring to preclude contamination. We intend to
use the existing approach to the garage that we have used for the
„v ...
past three years while camping on our property. Both buildings
and the approach will. benefit from, southern exposure for solar
heating and snow removal.
UTILITIES
Electric power distribution .comes up the valley from the far
side of the Crystal River and crosses to the west side below my
property. We can obtain power from the existing transformer now
serving the Marshall's houses on the other side of State Highway
133. We prefer to bury the wires as they approach our hillside to
minimize their visual impact. During the construction phase power
will be supplied from a portable generator.
WATER RIGHTS
I have attached our water rights as spelled out in the March
26, 1990 ruling of bi&trict Court, water division no. 5,
Heckert Homesite P4 ~ 2 `` ~'
Colorado. My rights cover a''third of the,. water contained in the
Placita spring and are fully adjudicated. A letter from Enartech
hydrologist Mr. Kerry D. Sundeen indicates my of~e third water
right of the Placita spring would provide ample water for our
needs even in a dry period. I intend to divert some of the excess
to a small pond in the low area near highway 133. This diversion
will provide ready access to water for wild game in the
surrounding area. When considering the impact of water use on
wild game, keep in mind that the Crystal river is only a few feet
away from my property. I recently had the water tested 'by the
Colorado Department of health in Grand Junction. The results
indicate some bacteriological contamination, but both the
Colorado Department of Health and Enartech agree the problem is
easily correctable.
IMPACT ON AILDLIFE
I have attached a letter from Mr. Kevin Wright from the
Colorado Division of wildlife indicating that our property
provides a crossing and grazing site for elk in early *ainter. In
this letter Kevin makes several suggestions to minimize the
impact on wintering elk. Accordingly, I met with Kevin on April
2nd on the property and agreed to move the proposed house site
near to the garage and reduced the building envelope to avoid the
aspen bench area which provides food for the wintering elk.
Before submitthg the new plat plan Kevin had an opportunity to'
review and approve the alterations. I have also attached a letter
to Kevin reviewing the high points of our discussion.
LOCATION OF HOMESITE,
The location of our garage and home was chosen for the
following reasons,
1. Minimal threat to wildlife along the western
and northern borders of our property while providing
sufficient setback from State"'fIghway 133.
2. Sufficient setback from. State Highway to
provide a safe playing zone for our four children ages
2,. 5, 7,' and 11.
3. A safe separation horizontally to prevent`
contamination of our water source.

septic system (i.e. not requiring a pump).
DISCIISSION OF HIGHWAY SETBACK
Our parcel was originally described in 195,8 in a deed
belonging to Mid-Continent Coal_ and Coke Company as containing 10
acres. In 1965 State Highway 133 was rerouted across the ten acre.
parcel leaving 7+ acres which we now own. We hope, as do many of
the residents in the Crystal Valley, that Highway 133 will never
be expanded as has become necessary for State Highway 82. We feel
certain, however, that should the highway expand, the engineers
will have to take more of our hillside on our northeastern border
for the new right lanes. The alternative would be to cross the
Crystal River, Since. the land on the opposite side of the river
is considered critical elk range there is little likelihood the
highway will 'be placed there. We have planed to build a modest
retirement vacation and retirement cabin on our property. In our
plans we have tried to consider the long term effects of changes
in the county. Despite our feeling reasonably confident the road
will never expand, we feel it prudent to add an additional
setback beyond the 100 feet required. I discussed this belief
with Kevin Wright on our site visit and he 'found no fault with
the present location for our home site.

In reference to our site visit on my property in Placita on
2 April, 1990, I would like to summarize the. important points of
our discussions as I understand them. Should you disagree or have
any information,. to add to what follows feel free to contact me on

information at a 1041 Hazard Review in Aspen sometime in August.
In early winter (Late November through January) elk cross
McClure„Pass `and follow a path along the'westerri border of my
property to the aspen bench located on the upper regions of the
hillside. The elk feed on the aspen and scrub oak there until the
winter snow gets so deep they are forced to cross State Highway
133 and the Crystal River where they spend the rest of the
winter.
In accordance with your wishes, T agreed t'o reduce the
building envelope so as to not include the aspen bench area, to
move the proposed homesite lower down the hillside and to place
it near the garage site.
Z also commented that the Heckert family has observed deer
inhabiting the willow and aspen grove in the vicinity of the
hillside behind the Placita spring and that the proposed homesite
was placed away from the spring area to purposefully provide a
quiet zone.
After your visit, I staked out the reduced building envelope
and the'new location for our house. This information was relayed
to Lines in Space who will complete~a survey and provide us with
a revised plat plan. The plan wilh be completed later this month

One item we did not discuss during your visit, but it is of
interest to my children. They have a desire to occasionally ride
horses.,My sister in Cheyenne, WY and a friend in Carbondale have

(limited to three weeks of our summer vacation). I have no
intention of permanently pasturing the animals on our property,
but would appreciate the right to occasionally stage them in the
grassy low area near State Highway 133 below the Placita Spring.
The area there is well watered from underground sources and the,
grass would easily replenish itself after our summer vdcaton
well before early winter. If you are in agreement, I would
greatly appreciate some wording to allow horses for short periods
of time'on our property for the 1041 review process.

Divsiion FJo. 5 awarded to Placita Spring, as absolute water right for 0.03
cubic foot of water per second of tide with appropriation date of December 3i,
1918, and a conditional water right for 0.20 cubic foot of water per second of
time With appropriation date `of November l7, 1973, to be used`for domestic and
lawn and garden irrigation purposes. As to the 0:20 c.f,s. coriditohally
awarded, the -Claimant was directed to file an Application for Quadrennail
Finding of Reasonable Diligence in the development .of this conditional water
right in Mauch of 1985 to maintain said conditional water right in fill force
and effect. This Ruling of Referee was confirmed and` made a Dec re? of the
Court on April 27, 1931.

which it is requested that the remaining 0.11 c.f.s. previously avrarded
conditionally to Placita Spring in Case No. W-2137 be made absolute and
unconditional by reason of coapletion of the appropriation.

A. The Applicant Heckerts are the owners of one-third (O.C77

pplicants have camped on tt•e pro ert for several weeks each ear. In so
doing, they have estabttshed a sink/refrigerator, a seater trough, and shotrer.
Additionally, water has beer,' used for irrigation purposes over an area of
approximately two acres. The' above, work has been corpleted at an
out-of-pocket expen3il=ure of approximately $5Q0, together with labor and
installation. Rs a result:, 0.077 c.f.s have, 'bee'n used for the decreed
purposes, and sucn amount is entitled to be made absolute.
B. The Applicant MarS'hails arm two-thirds (0.153 c.f.s.) of the
subject water right. Together with the Heckerts, the Marshalls have repaired
the existing collection point, interconnecting pipe, acid cistern. As a result
of said iiaprovemersts, the farshalls have utll~zed their fg71 entitlement to
this water rioht, and such amount is entitTe~"`to 6e"`c~a~e°ab~aoTixte.
The Referee does therefore conclude that the above entitled Application
should be granted and that the remaning"0;11 cubic foot of water per second
of time previously awarded conditionally tp Placita Spring in Case 'Ho. W-2787,
with Appropriation date of De`cem~er 31, 1918, s'fiould be and fiereby is Wade
absolute and unconditional.
It is accordingly ORDERED that this Ruling shall be' filed with" the Water

Commission.. .noting that' the applicant is requesting
approval of a 1041 Environmental Hazard review, and
General Subm"fission", They propose to construct a 625
s.f. garage and 2,500 s.f. residence on a site which-is
approximately 7 a'or'e"s' in size. ,_ This site is mapped as
Elk winter range and includes a major wildlife highway

crossing from McClure Pass to Placita. Ellen described
the site, location, vegetation, slopes, and noted that
the applicant has worked with the TCevn Wright of DOW to
locate the building envelope to least mpac£ wildlife in

proposal, and has no problem with limited pasturing
