A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITKIN COUNTY, COLORADO, APPROVING A BALLOT QUESTION
AUTHORIZING OPEN SPACE CONVEYANCE OF 35-ACRE RYAN PARCEL
TO THE UNITED STATES FOREST SERVICE IN EXCHANGE FOR
REPLACEMENT OPEN SPACE, INCLUDING A 8.6-ACRE PARCEL THAT
WILL BE RECONVEYED AND REPLACED WITH ADDITIONAL OPEN
SPACE.

RECTTALS
1. The Voters of Pitkin County and the Pitkin County Commissioners established an
Open Space and Trails Fund for the purposes of preserving and providing open
space and trails resources in Pitkin County, and established an Open Space and
Trails Board of Trustees to guide the expenditure of those funds.
2. The Open Space and Trails Program is charged with protecting public access to
waterways, scenic view planes, and habitat.
3. In February of 2000, at the request of the Forest Service, Pitkin Counry acquired a
35-acre inholding in a scenic meadow neaz Ashcroft known as the Ryan Pazcel.
4. In 2006, the United State Congress directed that the Forest Service to exchange
certain other lands to Pitkin County in trade for the Ryan Pazcel.
5. Article 13.53 provides that lands acquired by Pitkin County using Open Space
Funds cannot be conveyed unless the Board of County Commissioners and Open
Space and Trails Board identify replacement lands of equivalent value and the
exchange is approved by a majority of the electorate.
6. The Open Space Boazd has studied this exchange in detail and has determined that
that replacement lands aze at least of equivalent value under the terms of Article
13.5.3 of the Pitkin County Home Rule Charter. In making this determination, the
Boazd was cognizant of the permanent protection of the Ryan Parcel itself within the
National Forest, and the market and conservation values of the replacement lands.
NOW THEREFORE BE IT RESOLVED by the Board of County
Commissioners of Pitkin County, Colorado, that:
A. The Board of County Commissioners determines that the replacement open space
lands, as enumerated in the proposed ballot question below, are of equivalent value to
the 35-acre Ryan parcel.

B. The Boazd of County Commissioners approves for inclusion in the general election
of 2008 the following ballot language;
"Shall Pitkin County be authorized, as otherwise contemplated in an Act of Congress
known as the Pitkin Coun[y Land Exchange Act of 2006, to convey to the United States
Forest Service the 35 acre "Ryan" pazcel situated neaz Ashcroft in upper Castle Creek
Valley to be protected forever, and to acquire from the United States Forest Service an
approximately 8.6 acre property located between Difficult Campground and the
Wildwood School, and then re-convey the same 8.6 acres into private ownership,
provided that said lands are replaced by the following Open Space properties, which the
Open Space and Trails Board and Board of County Commissioners have determined to
be of equivalent value, and which shall be held in perpetuity as open space by Pitkin
County;
a. Twelve small parcels (totaling approximately six acres) situated adjacent to and
within the Smuggler Mountain Open Space.
b. A forty acre parcel situated on the Crystal River approximately five miles south of
Cazbondale,
c. An approximately 1300 lineaz foot trail easement for the extension of the east of
Aspen Trail, and an adjacent fishing access easement.
d. Approximately 266 acres above Redstone known as Sawmill Hill, of which
approximately 210 acres will be acquired outright, with a conservation easement
extinguishing all development acquired on the balance of approximately 66
acres."
