RECTTALS
John Matthews ("Applicant") has applied to the Pitkin County Board of County Commissioners
("BGCC") for Special Review approval to extend electric service approximately 700 feet to an existing
cabin within the RuraURemote zone district
2. The property is located on Lower Hurricane Road off of Little Annie Road, and is described as the
Globe Lode, USMS 6987.
3. The parcel is zoned Rural/Remote and contains approximately 8.6 acres.

REQUEST:. The Applicant proposes to extend electric service approximately 700 feet to an existing cabin

The Planning Commission recommended denial on February 6, 2001, by a vote of 41. The staff memo to
the Planning Commission, which fully addresses the review criteria, is attached for reference. The minutes
from the Plarming Commission meeting were not available. Only specific issues raised by staff, the Planning
Commission or the Applicant are addressed below.

Sorry this has taken me so long. I hope as I gef up to speed with my new "job" as
president I will be able to respond on a more timely basis.
Discussion amongst the members of the Castle/Maroon Creek Caucus'Hoard indicated

that we have no objections or concerns about the extension of electricity to the Mathews
property. Questions were raised concerning the ramifications of electricity to other areas
such as septic (electric clothes washer, dishwasher etc.). Dces anyone know what soil of
` septic system is on the property?
I also contacted Glen Horn, Randy Gold (President of the Little Annie Homeowner's
Association) and Judy Hass. As bone of them had any serious objections, the Board
recommends that this special review request be granted to the Mathews.

REQUEST: The Applicant proposes to extend electric service approximately 700 feet to an existing cabin
within the RuralA2emote zone district.
APPLICANT: John Matthews

LOCATION: Lower Hurricane Road; Globe Lode USMS 6987
ZONING: The property is zoned Rural/Remote and contains approximately 8.6 acres.
ACCESS: The property is accessed from Castle Creek Road via Little Annie and Lower Hurricane Roads.
Lower Hurricane Road traverses several privately owned mining claims-the Applicant has access easements
across these properties.
BACKGROUND:. The Planning Commission granted 1041 approval for the Globe Lode on October 22,
1985. At that time the property was zoned "AF 1." A building permif fora 900 square foot residence was
issued on June 3, 1987. A well and septic system were installed for the residence. Joanna Schaffner notes
that it does not appeaz that a Certificate of Occupancy was ever issued for the residence.
The property was rezoned Rural/Remote in 1994. Little Annie andLower Hurricane Roads are plowed to the
Yellin residence, but not to the Globe Lode. Electric service currently terminates at the Erie Lode (Haas
residence), which is located above the Yellin residence and below the Globe Lode. The access easements
across the adjacent mining claims permit the extension of electrical and telephone lines.
REFERRAL COMMENTS: Referral comments from Zoning, County Engineer,. Wildlife Biologist,and
Envirotunental Health are incorporated throughout this memorandum and are attached for r£erence. The
application was referred to the Castle/Maroon Creek Caucus and the Little Anriie Homeowners' Association,
but comments were not received.
STAFF COMMENTS:
UTILITY EXTENSIONS IN THE RURALZREMOTE ZONE DISTRICT: The Applicant proposes to extend:
electric service from its present terminal on Lower Hurricane Road to the existing cabin, which is a
distance of approximately 700 feet. The electric line would be installed in a trench along the existing
road and driveway access to the residence. Tfie extension is subject to the foll'owin'g criteria, pursuant to
Section 3-200-095 of the Code:
1. Is the extension of the utility service Zess disruptive to the environment than an alternative
source?
Response: Since an alternative power source is already in existence, staff finds that extending the
electric line to the residence will be more disruptive to the environment than continuing to use the
alternative source.
2. Does the proposed utility extension encroach upon or impact environmental hazards or
resources such as floodplain, geologic hazards, slopes exceeding 15% in grade, wildlife habitat, wildfire,
groundwater, ridgelines, vegetation, agricultural lands (irrigated meadows, dryland pastures or other
environmentally significant features)?
Response: The electric line will be extended within a trench along the existing road and driveway, so
will not create any additional 1041 impacts. The existing road is located on slopes that exceed 15% in
grade; any disturbance would have to occur with the existing disturbed area, so as not to disturb slopes
in excess of 15% adjacent to the road.
3. Is there a significant visual change or impact to the land area affected by the zrtiliry
extension?
Response: Extending the electric line within the existing roadway will have an insignificant visual
impact.
4. Can the visual impact be mitigated?
Response: Not applicable.
5. Does the extension visztalZy impact surrounding properties?
Response: The extension will not visually impact surrounding properties, as it will occur within the
existing roadway.
6. Do reclamation and landscaping measures appear natural as related to the former
condition and surrounding environment?
Response: Since the extension will occur within the existing roadway, reclamation and landscaping
measures will not be necessary.
Does the utility extension comply with the intent of the Rural/Remote zone district?
Response: The intent of the Rural/Remote zone district is "to conserve and protect the natural
environment and its resources; to preserve the unique low scale, low density backcountry character and
lifestyle; to minimize environmental degradation; to retain undeveloped areas; and to allow for limited
recreational uses and limitedresidential development while still preserving the character of rural/remote
lands...: '
The Applicant asserts that the extension is justified by his proximity to existing development -
specifically the Haas and Yellin residences - tliat fias electricity. Tiowever electric lines were extended
to those properties prior to the rezoning to Rural/Remote. Staff does not believe that the existence of
electricity on adjacent properties justifies the extension. In addition, staff would note that the dabiri has
been in existence since 1987-88 without electric power.
Staff finds that although the extension will have limited visual or environmental impacts, it will impact
the character of the rural/remote azea. Part of the unique "backcountry chazacter and lifestyle" of the
eon alternative energy sources. Almost all
Little Annia area is the lack oftr_aditional ytilities and_reliane,
of the property owners in the Little Annie area make the same argument as the Applicant that utilities
could be extended to their properties within existing roads and driveways without creating environmental
or visual impacts. However, the extension and existence of traditional utilities wonTd diminish the
character of the area. Staff is concerned that approval of this extension could open up the "floodgates" for
other adjacent property owners, who will argue that utilities exist "in close proximity" and that the existence
of traditional utilities is part of the "new" chazacter of the azea.
SPECIAL REVIEW: Special Review approval is required for the extension of utilities within the
Rural/Remote zone district. Special Review uses mustcomply with the following review standards of
Section 3-210-010 of the Code.
A. The special review use shall consider
1. The applicable County Master Plan;
2. County Land Use Policies in Article 2;
3. The intent of the Zone District in which it is proposed to be located, and
4. The character of the immediate vicinity of the parcel proposed for development and
surrounding Zand uses, or enhance the mixture of complimentary uses and activities in the immediate
vicinity of the parcel proposed for development.
Response: Staff asserts above that the proposed extension is not consistent with the intent of the
Rural/Remote zone district and will impact the character of the azea. No County master plans address this
.azea.
B. The location, size, design and operating characteristics of the;nroposed special review
use must be in harmony with the surrounding area and minimizes adverse effects, including visual
impacts, impacts on pedestrian and vehicular circulation, parking, trash, service delivery, noise,
vibrations and odor on surrounding properties.
Response: As noted above, the extension will occur within the existing road and driveway, so will have
limited environmental or visual impacts.
C There must be adequate public facilities and services to serve the special review use
including but not limited to roads, potable water, sewer, solid waste, parks, police, fire protection,
emergency medical services, hospital and medical services, drainage systems, and schools.
Response: Staff assumes that capacity to serve is not an issue for Holy Cross: The extension will not
impact other public facilities and services.
D. Arr application for a speciatreview use must demonstrate to the Board of County
Commissioners that the proposed development will not:
1. Materially endanger the public health, safety or welfare; and
2. Substantially injure the value of adjoining or abutting properl)~.
Response: The proposed extension will not endangerthe public or injure surrounding property values.
RECOIVIMENDATION: Staff recommends that the Planning Commission recommend denialto the Boazd
of County Commissioners of the Matthews Special Review for extensirn of utilities in the Rural/Remote

7. This fee structure shall be reviewed .annually as part of the County budget hearing process and should

8. The Community Development Department shall identify, prior to or at the time of submission of a land
use application, whether an application is to be referred to the Engineering, Environmental Health,
Wildlife Officer, or Housing Departments or whether a County Clerk Administrative Fees is required.
The Community Development Department shall also identify whether an application constitutes a
minor or a major referral, based on the number of hours which will l;e required to review the
application, and charge the applicant for each referral accordingly. Additional Billings and Refunds

In the event that staff determines. that special expertise is required to assist the Community Development
Department in the review of a permit application such costs will be borne by the applicant.

The following conditions should be required to minimize the ecological impacts of the utility
installation:
1. The disturbance or removal of native vegetation should be avoided tq the maximum
extent possible.
2. Revegetation of all disturbed areas should be required and installed within the first
growing season after completion of the project.
3. A revegetation plan should be required and approved. by the Land Manager. The
seed mix used for revegetation must consist of native grasses and (orbs and must be
included in the revegetation plan by common and Latin name.
4. A $500.00 revegetation deposit should be required and held for at least three growing
seasons. After the third growing season the project must be evaluated by the County
for compliance and success before the bond is returned.

Suzanne, I have reviewed the application and have the following comments:
1) The proposed location of the utility trench, appears to be on a fairly
steep slope. The applicant should provide an erosion control plan to
control for runoff during construction and for the first growing after t:he
completion of the undergrounding.
2) It should be pointed out that if the alignment of the utilities moves
from in orimmediately adjacent to the road/driveway; the iristallatior
would be subject to further review fior 1041 coricerhs for steep slopes.

Hi Suzanne,
I have looked at the Mathews Special Review and the Environmental Health Department
does not have any issues with the extension of electric service to the cabin.
As a side note, I looked up the parcel ID in our files and found that the septic was permitted
in 1985 for one bedroom and one loft in the cabin. As long as there are no changes in the
bedroom count within the cabin, this system should be adequate.

The applicant proposes to extend electric service to his existing cabin from its
present terminal on Lower Hurricane Road, a distance of approximately 700 ft. (.13 mi.)
The existing cabin was permitted and constructed in 1988, prior to enactment of
the "Rural and Remote" ordinance.
The applicant believes that because of his proximity to existing development he is
not subject to restrictions upon the extension of power under the definitions of the (Rural
and Remote) code.
The extension of power would be installed in a trench along the existing road and
driveway access to the residence.
