VARIANCE DESCRIBED BELOW:
Pursuant to Pitkin County Resolution of June 5, 1955, as
amended; a Public Hearing will be held in City Council Chambers,
City Hall, First Floor, Aspen, Colorado (or at such other place as
the meeting may then be adjourned) to consider an application filed
with the said Board of Adjustment requesting authority for variance
from the provisions of the County Zoning Resolution.
All persons affected by the proposed variance are invited to

Deaz Board of Adjustment:
My clients, David Epstein and Susan Gordy are requesting a front yard setback reduction for a covered entry way to
their residence. In addition, the remodeling of the existing house requires the residing, decking and adding a railing to
an existing area that is encroached into the front yazd setback. The addition of an upper floor will be set back to the
30ft. front yard setback but requires a 30" reduction to the front. yard setback for the roof overhang.
The proposed covered entry azea is 10'x 10' and located at the existing front door. The existing entry is not covered
and ice and snow create a dangerous situation at the front door and steps. The covered entry would no[ create new
FAR, based on the exemption for overhangs up to IOft. in the 4/26/94 Landuse Code. The hardship is based upon a
pre-existing house location within 25ft. of the west, (Mt. Laurel) property line. The required sef back on [he front
yazd of this property is 30 ft. The Variance request is for a reduction from 30ft. to 15ft. for a covered entry. It'should
be noted that the entry occurs behind a huge spruce tree and is only partially visible from the street. (see attached
photo)
The proposed house remodeling requires the siding, decking and adding a rail [o the existing overhang area above the
garage doors. This work would not create new FAR; because if is existing:'The hards)ip is based upon apre-existing
house location within 21ft. of the west, (Mt. Laurel) property line. The required set back on the front yazd of'this
property is 30ft. The Variance request is for a reduction from 30ft. to 21ft. to reside, deck anti add a rail to an existing
area.
The addition portion of the project is going to be set back into the hillside to meet the 30ft. required setback for this
property. The addition requires a 30" reduction to the front yard setback for the roof overhang. The hardship is based
upon apre-existing house location.

WHEREAS, David Epstein and.-Susan Gordy, owners of 462 Mountain
Laurel Drive, are requesting approval for a 27' front yard setback
variance for the second floor addition, a 15' front yard setback

variance for the entry, and a 7' front yard setback variance for
a deck; and
WHEREAS, a 3A' front yard setback is required for a 17,413 square
foot lot in the R-15A zone district; and
WHEREAS, the subject property is within the unincorporated area of
Pitkin'COUnty, Colorado, (as described in Exhibit "A", attached);
and,
WHEREAS, the Board of Adjustment is vested with the power to grant
or deny such variances by virtue of Title ZI, Section 16-1.3,
Pitkin County Code (Land Use Code) and Colorado Revised Statutes,
1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Board of Adjustment
makes the following findings:
1. Proper notice procedures, including the
notification of all adjoining property owners,
has been shown by the applicant.
2. The required hardship or practical difficulty
has been established.
3,. Granting such relief will not cause substan-
tial detriment to the public welfare and will
not substantially impair the intent and
purpose of the Zoning Resolutions and the
zoning maps.
NOW, THEREFORE, BE IT RESOZ,VED_by the Board of Adjustment, that a
19' front yard setback variance for the covered entry, a 9' front
yard setback variance to modify the overhang/deck on the second
floor, and a 3' front yard setback variance for the roof overhang,
be granted, as shown on the attached plans dated 2/13/95 (Exhibit
"B"), due to down2oning and the existing location of the house.
WARNING: Any violation of the terms of this resolution may
result in rehearing and possible revocation.

Neiley opened the meeting at 5:20 p.m. and introduced the Board to

Terry Kirk, representing Crystal Equipment, was present to request
a 5' north side yard setback variance and a 5' south side yard
setback ,.variance, where 10' is required on each side for a 10,237
square foot lot in the RS-30 zone district; and a 59' major road
setback variance, where 100' is required as measured from the
Highway 133 'right-of-way, for construction of a single family
residence.
Kirk stated that the Board granted the same variances to the
previous owner for a structure that was never built. The design
of the structure has changed, but the building footprint is the
same. The lot is only 31' wide.
Schaffner noted that the Gesberg lots are long and narrow. The
setback requirements, except the major road setback, were reduced
under the new Code. The building envelope was approved through the
1041 hazard review process; and avoids the floodplain and riparian
areas along the river.
There was no public comment.
Brickham moved to grant a 5' north side yard setback variance, a
5' south side yard setback variance, and a 59' major road setback
variance, for construction of a single family residence. Dyer
seconded the motion and all were in favor.

Warren Palmer, representing the owners, was present to request a
27' front yard setback variance for the second floor addition, a
15' front yard setback variance for the entry, and a 7' froht yard
setback variance for a deck, where a 30r front yard setback is
required for a 17,413 square foot lot in the R-15A zone district.
Schaffner stated that the existing residence encroaches into the
front yard setback. The applicant is proposing a second story
addition, entryway and deck; which will increase the encroachment
into the front yard setback.
Palmer stated that the applicants propose to add a third floor
addition, which will be outside of the front yard setback. `The
applicant also proposes the following improvements, which will
encroach into the front yard setback: a covered entryway at grade
overhana notified deck and overhang over the garage; and a roof
~,g third floor addition. The actual bulk of the residence
will be located outside of the setback after the modifications.
Palmer stated that the location of the existing structure'is the
hardship because the owners are trying to remodel a structure that
already encroaches into the setback. HOA has not reviewed 'the
proposal.
Neiley noted that the covered entryway is the only proposed
improvement that will increase the encroachment into the setback.

Brickham seconded the motion, and all were in favor.
Chuck Brandt and Chris Smith were present to request an 18' front
yard setback variance, where 30' is required in the B-2 zone
district, for construction of an additional fuel pump island.
