In order to adequately access this residence with vehicles, the cut required by a turn around needs to be retained. A tall wall is much more environmentally sound than a series of 30 inch retaining walls would be in this case because of the steep slopes envolved. Thirty inch high retaining walls would require approximately an additional seventy feet of destruction of the natural grade and its vegetation which would then be related with man made terraces. Finally this retaining wall system will not 'interfere with anyones ability to see approaching traffic along the main access street or driveway. Aspen Ranger District will soon initiate formal National Ehvironmental Policy Act (NEPA) analysis on a request that Mr. Goodwyne has presented to the Forest Service. Mr. Gobdwyne desires a road authorization for the driveway which serves the residence on Lot 1. Construction of a replacement driveway, that would be totally on private land, would require very high cut banks and would result in major degradation of visual resources. Therefore, I believe that Mr: Goodwyhe probably will be granted a road easement that will authorize construction and use of a driveway, more or less along the existing route across National Forest land. This case was tabled to June 6, 1995 at the site visit on April 1, 1995. Case 95-05, Werner & Judy Neuman 0171 Hunter Creek Road This case was tabled at the April 4, 1995 meeting. Tim Hagman was present, representing the owners, to request a 10' rear yard setback variance, where 30' is required for a 31, 122 square foot lot, for construction of an addition to a single family residence. Hagman stated that the owner has decided to pursue the proposed variance, rather than designing a second story addition which would not require a variance, but which would be more visually impactive. He added that he spoke with Frank Goldsmith, an adjacent property owner, who supports the variance with the restrictions agreed to by Neuman and Wish, Inc., another adjacent property owner. Lenny Oates, representing Wish, Inc., stated that Neuman has agreed P to lace conditions on thge variance to restrict the height of the addition to the same hei ht as th'e existing structure and not to construct a boundary fence. These restrictions would not apply if the property was redeveloped because a variance is granted for a specific structure. Wheeler noted that the height restriction would prevent the owner from constructin u er levels g pp on the residence, which is consistent with other approvals by the Board where a variance was granted for part of a site while development on another part of the site was restricted. Lukes agreed that the owner would give up the right to come back to the Board for future variances for this sytiw ~,., _. _ _. ~' Pitkin County Board of Adjustment 2 Minutes of April 4, 1995 pp p rt stated that the overall footprint of building will not be expanded because all but 50 square feet of the addition will be located in the empty space that is currently under the deck area. The new vestibule is the only portion that will not be under the decks. He added that the addition will not change the visual impact of cYiapel, and that the addition would have been visible from Highway 82 in any other location. There was no public comment. Brickham moved to grant a 10' west side yard setback variance, a 47' major road setback variance, and a floor area variance to allow a 903 square foot addition to the chapel, due to downzoning and the Chapel being a unique public structure needing to expand to accomodate public uses, subject to approval by the Board of County Commissioners of the Chapel's application for a GMQS Exemption and Scenic Overlay Review. Dyer seconded the motion, and all were in favor. Dyer and Lukes did not vote on this case. Gordon Denton was present, representing the owner, to request a 5' front yard setback variance for the bedroom/garage addition and a 23' front yard setback variance for the entry, where 30' is required for a 92,779 square foot lot in the AFR-10 zone district; a 27.5' height variance, where 30" is allowed, for a retaining structure within the setbacks; and a 5' height variance, where 20' is required for an accessory structure. Denton distributed a landscape plan for the area in front of the retaining wall. The landscaping'is designed to cover the wall. He stated that the retaining wall is below existing grade, and will prevent erosion. He noted that the entire wall will not be visible from Castle Creek Road. A garage with a master bedroom above is proposed on the uphill side of the house. Schaffner stated that the retaining structure can be considered an accessory structure that is located within the setback and exceeds the accessory height limit. Since the Code prohibits excavating more than 30" above or below natural grade within the setback, a 27.5' height variance is requested to allow the wall to be 30' in height within the setback. Outside the setback, the wall still exceeds the accessory height limit and requires a height variance of 5' to allow the wall to be 25' in height. The lot is within an approved subdivision, and does not have a building envelope. Goodwyne has requested authorization for a driveway easement to cross National Forest land, and"Iwamoto noted that the easement would probably be granted. There was no public comment. Denton noted that the cut by the house was enlarged to allow for drilling of a well. Neiley stated that the retaining wall is massive and unnecessary, and the current access to the house seems adequate. The request does not enhance the access, and just creates a greater building area. He noted that he would like to view the site. Wheeler noted that the applicant has moved the topographical hardship in order to expand the site. Denton stated that the owners want to be able to turn around vehicles at the house. The owners requested to upgrade the existing road, but the USFS requested that it be moved up the hill because the existing road does not meet their road requirements, including exceeding a 12% grade at some points, and an easement for the existing road was not approved by the USFS. Wheeler questioned if there was any other developable area on the site. Denton replied that this is the flattest portion of the lot with the best access to the property. Wheeler moved to table to a site visit at 4:00 PM on Tuesday, April li. Brickham seconded the motion, and all were in favor. Case 95-05. Werner & Judv Neuman, 0171 Hunter Creek Road Cooper and Geller did not vote on this case. Werner Neuman and his architect., Tim Hagman, were present to request a 10' rear yard setback variance, where 30' is required for a 31,122 square foot lot, for construction of an addition to a single family residence. Neuman stated that the rear yard setback requirement increased from 20' to 30' when the new Code was adopted. The lot is triangular, therefore, the side and rear lot lines can be determined by the owner. If the north lot line was declared the side yard, the existing house is conforming; a second floor addition could be built that would not require a variance, but the addition would obstruct the, neighbors' views. If the north lot line was declared the rear yard, then the existing home is non-conforming; any addition would require a variance.
