HomeMy WebLinkAboutbocc.res.033.2001 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO,APPROVING A TEMPORARY USE PERMIT FOR THE NIGHT-TIME USE OF THE CLOUD NINE RESTAURANT FOR FIVE EVENTS IN FEBRUARY AND MARCH,2001 Resolution No da-2001 RECITALS 1. Aspen Skiing Company("Applicant")has applied to the Director for approval for night-time use of the Cloud Nine Restaurant on Aspen Highlands for five night-time dinner events in February and March of 2001. The night-time operation is proposed on a trial basis,so the Applicant can determine whether to pursue an amendment to the Highlands AF-SKI Master Plan. 2. Pursuant to Section 3-200-030 of the Pitkin County Land Use Code,the Community Development Director("Director")may approve a temporary use permit for commercial activities or special events, if an applicant demonstrates that adequate provisions have been made for police supervision,public parking, insurance,site set-up,maintenance and clean-up,emergency services and safety of operations. 3. Night-time events at the Cloud Nine Restaurant are not specifically mentioned in the Highlands Ski Area Master Plan, pursuant to Resolution No. 97-199. Therefore,the Director has opted to forward this request to the BOCC for review, since these events are not part of the Master Plan. 4. The BOCC considered the request at a regularly scheduled meeting on February 14, 2001. 5. The BOCC finds that it is appropriate to approve the request and to permit a limited number of events on a trial basis, in order to allow the Applicant to gather data on the positive and negative impacts of the events to determine whether to proceed with an amendment to the Highlands AF-SKI Master Plan. NOW,THEREFORE,BE IT RESOLVED by the BOCC that it does hereby approve the Temporary Use Permit for night-time uses of the Cloud Nine Restaurant on Aspen Highlands, subject to the following conditions: 1. The Applicant may operate the restaurant for dinner on five evenings in February and March of 2001. Further night use shall require an amendment to the Highlands AF-SKI Master Plan. 2. Access to and from Cloud Nine for night-time use by guests shall be provided by snowcat only. Staff may access by snowmobile. 3. Prior to the first event,the Applicant shall: Resolution No.033-2001 Page 2 A. Submit an insurance certificate for all five events for review and approval by the County's Risk Manager. The certificate shall list Pitkin County as an additional insured. B. Provide notification of the events to the public in the newspaper and mail notice to the properties at the base of the mountain. C. Provide verification that Cloud Nine's retail food license has been properly renewed. 4. The Applicant shall obtain detailed information on the following issues during the trial period in order to measure the impacts of the approved night use: safety,parking,employees generated, lighting,noise, air quality, evacuation and public notice. 5. There shall be at least two Emergency Medical Technicians present at each event. APPROVED this 14th day of February,2001.
