The second lot was sold separately, and an easement was gYanted for the portion of the structure that encroaches onto the existbnr's lot. The owners propose to renovate the portion of g structure that is within the setback; the roof will be raided, but the existing roof line will be maintained. Schaffner suggested that the Board grant, the variances necessary for the development as proposed, since measuring the exact variance re uired is com licated q ~ p 'because the structure is within the setbacks of'both lots. She added that the setback is not measured from the easement, but from the lot line. Brian Davies and Doug Rager were present, representing the owners of the lot onto which the residence encroaches, to support the variance because the existing footprint of the residence will not be extended: Wheeler moved to grant a west side yard setback variance, where 20' is required, for an addition to the existing single family residence which lies on the lot line, with the conditions that the exceedon not exceed the existing footprint of the building, nor the existing overhang of the building, with the exception of the modifications to the building footprint on the south side of the existing structure, due to existing conditions, based on the plans submitted. Gassman stated that when the house was built in 1971, it encroached 5-6' into the setback. The owners propose to enclose the existing deck on the second floor, which is the only logical place to expand the residence. The non-conformity of the structure will not be increased. The proposal has been approved by the Mountain Valley Architectural Committee. He added that the hardship is that the existing deck was originally constructed within the setback. wheeler noted that other areas on the lot outside of the setback could be developed. Bill Welcher and John Wheeler were present to request a 5' west side yard setback variance, where 10' is required, and an 88' arterial highway setback variance, where 200' is required as measured from the Highway 82 right-of-way, for an addition to the general store; also requesting approval for a 98' setback variance, where 100' is required for the placement of an identification sign along Highway 82. Welcher stated that they have already received approval to move the gas pumps and to replace the existing canopy. They are proposing an'8 by 40 addition on the front of the General Store, to accommodate the cashier for the store and for gas. The space is currently used for outdoor seating. The proposed changes will improve' parking and. traffic circulation at the Conoco. The also propose to relocate the existing sign or to replace it with a sign of the same size, but with a lower height. Wheeler added that they also propose`to relocate the sign from the existing canopy to the new canopy; the canopy sign is required by Conoco. Cooper noted that the Conoco is located on a blind curve on the highway, and the signs should be sufficient to identify the area from a distance. He added that the changes will provide a net improvement to the property and the highway corridor. Lukes noted that there are three different signs on the property for the Conoco and the General Store, none of which conform to the sign code. He prefers that there not be a sign on the canopy and added that he would support both Conoco signs if the main sign on the highway is reduced in size. He stressed that the Board must look at what other improvements the owners will want on the property. Wheeler noted that they have applied for a GMQS exemption to allow the expansion. He .added that it is difficult to have the sign visible from both directions.
