Pursuant to Pitkin County Resolution of June 5, 1955, as amended, a Public Hearing will
be held in City Council Chambers, City Hall, First Floor, Aspen, Colorado (or at such other
place as the meeting may then be adjourned) to consider an application filed with the said Board
of Adjustment requesting authority for variance from the provisions of the County Zoning
Resolufion.
All persons affected by the proposed variance are invited to appear and state their views,
protests or objections. If you cannot appear personally at such meeting, then you are urged to

Dear Sirs;
Enclosed is an application for a variance regarding our Meadowood home and garage.
Our original home is a 100 year old "cabin" which we added on to in 1990. Tle cabin was built
long before the Medowood Subdivision was conceived. The home was included in lot # 3, filling
2 with the setback lines for the north, west and south side yards right next to the existing house.
This has precluded us from building on three sides of the house.
In 1991 we received a variance to construct a garage, attached as Exhibit C. We realized
in 1992 that the gazdge would not allow us any storage and started to redesign the structure to
allow for the storage we needed and the. space for a caretaker. unit, We now come to you asking
for a variance for this new structure,
We have obtained approval from our neighbors and Homeowners Association for this
garage and caretakers unit. We have also received approval from the utility companies to
encroach into the setback and have letters approving this. This new garage encroaches less than
the previously approved garage. This new floor plan also saves trees on the west side of our lot
and breaks up the west facade more than the previously approved garage.
We believe our hardship is:
- The house was built before the subdivision was conceived and plated.
- We would have destroyed the cabin if we tried to move the structure to accommodate
the gazage in the only location allowed because of the setback lines.

approximately four feet into the utility easement at 100 Meadowood Drive,
Aspen, Colorado., We concur to the variance under the following conditions:
1. That 2-4 inch block iron. pipes with caps at both ends be placed
under or around the building and extending four feet on either side of the
building.
2. If any Portion of a paved driveway encroaches into the easement then

the Pico house on Meadowood Drive. She wondered why it was, needed and suggested it be taken
out. There'was discussion bothpr'o and con, with Borne against, suggesting it hadbeen the cause
of accidents: After discussion, it was finally decided that the bump stiouid be reduced ih height
and that the,area be more heavily graveled in winie~. There being no further business, tfie

GRANTING SETBACK RELIEF FOR CHUCK & MARILYN FRIAS
Resolution No. 95-23
WHEREAS, Chuck and Marilyn Frias, owners of 100 Meadowood Drive, aze requesting approval
of a 28 foot front yard setback variance, for construction of an attachedgazage; and
WHEREAS, 30 feet is required fora 32,996.5 square foot lot in the R-30 zone district; and
WHEREAS, the subject property is within the unincorporated azea of Pitkirt County, Colorado, and
is described as Lot 3, Filing 2, Meadowood Subdivision; and,
WHEREAS, the Board of Adjustment is vested with the power to grant or deny such variances by
virtue of Title Il, Section 7-10.30, Pitkin County Code (Land Use. Code) and Colorado Revised
Statutes, 1973, 30-28-118(2) (C); and,
WHEREAS, based on the evidence presented, the Boazd of Adjustment makes the following
findings:
1. Froper notice procedures, including the notification of all adjoining property owners, has been
shown by the applicant.
2. The required hazdship or practical difficulty has been established.
3. Granting such relief will not. cause substantial detriment to the public welfare and will not
substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps.
NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment, that a 28 foot front yazd

Neiley opened the meeting at 5:15 PM and introduced the Board to
those present.
Case 95-18 Linda Anderson 0801 Seven Oaks Road
Cooper did not vote on this case.
This case was tabled at the July 11 meeting to allow the applicant
to provide specific elevations and plans for the garage and photos
of the area.
Anderson presented a revised site plan, elevations and photographs,
as requested by the Board. The garage was reduced to 24 feet by
24 feet, and the front yard setback variance request was reduced
from 15 feet to 7 feet, which includes a 2 foot eave.
There was no public comment.
Lukes moved to grant a 7 foot front yard setback variance for
construction~of a garage, based on practical difficulties. Cooper
seconded the motion, and all were in favor.
Case 95-23, Chuck & Marilyn Frias, 100 Meadowood Drive
Lukes did not vote on this case.
Chuck and Marilyn Frias were preseht to request a 28 foot front
yard setback variance, where 30 feet is required for a 32,996.5
square foot lot in the R-30 zone district, for construction of an
addition to a single family residence.
Frias stated that a variance was granted in 1991 for a garage that

they subsequently decided was inadequate. The original house is
over 100 years old. The lot lines were drawn after the residence
was built, when Meadowood was subdivided. Frias noted that their
only options were to encroach into the setback or to move the house
farther into the lot.. The current design for the garage requires
less of a variance than the previous design. They have received
approval from the utility companies to encroach into the easement,
and all of Meadowood's utilities are currently located on the other
side of the road. The pavement of the road is 30 feet from the lot
line and a berm is located in that area. The back of the garage
will be below grade.
Schaffner noted that the Board previously approved a side yard
setback variance; however, a front yard setback variance is now
being requested because the front yard is defined differently in
the new Code.
There was no public comment.
Neiley entered into the record letters of support from John
Keleher, Michael Kerr, Freddie Bissig and William Ball, adjacent
property owners.
Wheeler questioned if the addition could be moved to minimize the
encroachment. Frias replied that if the garage was moved to the
east, then the living room windows would be blocked. They are
limited as to where they can expand because of the angle of the lot
lines and where the residence sits on the lot. Frias stated that
they prefer to cluster the development, rather than build a
detached structure, and that the neighbors also prefer that the
addition be attached to the existing structure.
Cooper moved to grant a 28 foot front yard setback variance for a
garage addition. Rudnick seconded the motion, and all were in

David Baker was present, representing the applicants, to request
a 10 foot south side yard setback variance, where 20 feet is
required for a 2 acre lot in the AFR-2 zone district, for
construction of a detached garage.
Baker stated that the existing two car garage is not big enough for
their vehicles and equipment storage. The property is divided into
two areas: a flat area next to Liberty Lane and a lower level next
to the river. They propose to build the garage on the lower level
where the existing house is located. Baker noted that locating the
garage on the upper level would have more impact on the neighbors
and would be more inconvenient. The garage cannot be moved next
